To see if the Town will vote to appropriate the sum of $1,150.00 to be used toward the purchase of a 11/2- ton dump truck for the Highway Department, said sum of money to be taken from "Road Machinery Fund," and in con- nection with the purchase thereof, will authorize the Highway Surveyor, with the approval of the Board of Selectmen, to sell, trade or otherwise dispose of the 1934 11/2-ton truck.

Article 14. To see if the Town will appropriate and assess a sum of $10,000.00 to be used under the direction of the Board of Selectmen in connection with W. P. A. or other similar Federal or State projects, or do or act.

Article 15. To see if the Town will appropriate and assess an additional sum of money for "Chapter 90 Maintenance" on Old Connecticut Path under a W. P. A. farm-to-market pro- ject, such amount to be over and above that provided in the bud- get for "Chapter 90 Maintenance," and with a further under- standing that such sum is to be spent under the supervision of the Board of Selectmen under plans and specifications prepared by the State and County Highway Engineers, but only on the condition that the State or County and the Federal Government join in the undertaking as a farm-to-market project.

Article 16. To see if the Town will vote to appropriate and assess the sum of $600.00 for the rent of quarters for the Charles H. Alward Post No. 133, American Legion, Inc., under the provisions of Chapter 40, Section 9, as amended, of the General Laws, or do or act.

Article 17. To see if the Town will vote to request the Harvard Trust Company, as Trustee under the will of Jonathan Maynard Parmenter, to use the funds in its hands under the hospital trust, so called, to build a hospital, or otherwise to use said funds in some manner for the benefit of the people and in conformity with the intent of said Jonathan Maynard Parmen- ter.


Voted that there be appointed a committee of five to con- sist of the Town Counsel, the School Physician, one member of the Board of Selectmen designated by the Board, and two others to be selected by the three so designated, and that this commit- tee be directed to make a thorough investigation and recom- mendation to the Town with respect to the Parmenter Fund.

Article 18. To see if the Town will vote to raise and ap- propriate a sum of money for the repair and renovation of the Grammar School Building in Wayland Centre, or do or act.


Voted that the Town appropriate and assess the sum of $9,500.00 for the repair and renovation of the Grammar School Building in Wayland Centre, the work to be let out at private contract and done under the supervision of the School Commit- tee.


Article 19. To see if the Town will vote to appropriate and assess a sum of money for the installation of a six-inch water main with hydrants on Lakeview Road, or do or act.


Voted to pass over the Article.


Article 20. To see if the Town will vote to amend the existing by-laws of the Town by adopting a new article to be known as the Building Code and being regulations of the in- spector of materials, construction, alteration, repair and use of buildings and other structures within the Town, and to provide penalties for violation thereof, substantially as contained in the report of the committee appointed at the Special Town Meeting December 14, 1938, as added to by vote of the Town at the An- nual Town Meeting in March, 1939, a copy of which report is printed in the Town Report for the calendar year ending De- cember 31, 1939, and a copy of which is on file in the Town Clerk's Office, or do or act.


Voted to recommit the Building Code to the Committee, to be reported on at the next Annual Meeting.


Article 21. To see if the Town will vote to appropriate and assess a sum of money in the amount of $3,000.00 to reim- burse Frank A. Burke of Wayland for hospital and medical ex- penses incurred as a result of injuries sustained by him while in the performance of his duties as a fireman for the Town of Wayland, or do or otherwise act thereon.


Voted not to reimburse Frank A. Burke $2,000.00 under a motion for that amount.

Article 22. To see if the Town will appoint a committee to investigate and report at the next Town Meeting on the need of new quarters for the Fire Department, Branch of the Public

Library and other Town Departments in Cochituate, or do or act.

Article 23. To see if the Town will amend the vote passed under Article 26 of the Annual Town Meeting held March 9, 1938, or take any other action in relation to said vote, so that the sum of $3,500.00, appropriated and assessed to settle claims of the City of Boston for the year 1937 and all prior years, shall be made available also for the settlement of all claims by and between the Town of Wayland and other cities and towns for the year 1939 and all prior years, payment of such settle- ment to be made upon the approval of the Town Counsel and the Board of Public Welfare, or take any other action to make available such portion of said sum of $3,500.00 as has not here- tofore been used, or do or act.


Voted unanimously that the sum of $3,500.00 previously appropriated and assessed to settle claims of the City of Boston for the year 1937 and all prior years, and now remaining un- used, be expended for the settlement of all claims by and be- tween the Town of Wayland and other cities and towns for the year 1939 and all prior years, payment of such settlements to be made upon the approval of the Town Counsel and the Board of Public Welfare.


Article 24. To see if the Town will vote to authorize the Town Treasurer as Custodian of property acquired by the Town through foreclosure of tax titles to demolish, with the approval of the Board of Selectmen, any buildings or other structures thereon.

Article 25. Article 26. To see if the Town will vote to authorize the Town Treasurer to sell any land owned by the Town as a result of tax takings or tax titles foreclosed to the Commonwealth, acting through the Metropolitan District Commission, and give a deed or deeds therefor in connection with the property adja- cent to the new aqueduct being constructed by said Commission or take any other action in connection with such lands, or do or act.


Voted that the Town Treasurer be and he hereby is author- ized to execute a deed or deeds conveying to the Common- wealth of Massachusetts in confirmation of certain takings of land by the Commonwealth acting through the Metropolitan District Water Commission any land owned by the Town as a result of tax takings or tax titles foreclosed, and to deliver such deeds to the representatives of the said Metropolitan District Water Commission.


Article 27. To see if the Town will accept any or all of the following conveyances to the Town :


(1) Conveyance of easement and right of way by Thomas E. Wentworth, dated November 15, 1939.


(2) Conveyance of easement by Daniel Brackett, dated February, 1940.


(3) Conveyance of easement by Doris I. Hobbs in cer- tain land on or near the aqueduct taking in that part of the Town known as Cochituate, as more fully described at the Meeting, or do or act.


Voted that the Town accept the following conveyances to the Town :


(1) Conveyance of easement and right of way by Thomas E. Wentworth, dated November 15, 1939.


(2) Conveyance of easement by Daniel Brackett, dated February 7, 1940.


(3) Conveyance of easement by Doris I. Hobbs in cer- tain land on or near the aqueduct taking in that part of the Town known as Cochituate, dated February 26, 1940.

Article 28. To see if the Town will appropriate and as- sess a sum of money to put a six-inch water main in Lake Path for a distance of about 320 feet and lower the water main in a portion of Pine Ridge Road and Woodland Road, or do or act.


Voted that there be appropriated and assessed the sum of $1,200.00 for the installation of a six-inch water main in Lake Path for about 320 feet and for the lowering of the present water line in that portion of Pine Ridge Road and Woodland Road mentioned under Article 29, the work to be done under the supervision of the Water Board.


Article 29. To see if the Town will vote to accept as pub- lic town ways under the Betterment Act, Pine Ridge Road, Pine Ridge Road Extension and Lake Path from the latter way to its intersection of Hemlock Road, or portion thereof, all said ways being situated within or adjacent to Woodland Park De- velopment, so called, in that part of the Town known as Co- chituate, as laid out by the Board of Selectmen, and shown on a plan of plans on file with the Town Clerk; to authorize the Board of Selectmen to acquire any necessary land by eminent domain, purchase or otherwise; and to appropriate a sum of money to cover the acquisition of such land and the construction of said public town ways or any part thereof, or do or act.

Article 31. To see if the Town will vote to abolish the office of Highway Surveyor, and authorize the Board of Select- men to appoint a Superintendent of Streets, or create a Board of Public Works, or do or act.

Article 32. To see what sum, if any, the Town will vote to transfer from available funds to meet any of the appropria- tions made under the foregoing articles.

Pursuant to the following warrant the inhabitants of the Town of Wayland met this day and did the following business.


Article 1. To see if the Town will vote to raise and appro- priate or transfer from available funds a sum of money for Welfare: Expense, or do or act.


Voted unanimously that there be appropriated for Wel- fare : Expense the sum of $2,800.00, and that that amount be transferred from Available Surplus Revenue


Article 2. To see if the Town will vote to raise and appro- priate or transfer from available funds a sum of money for Welfare: Expense to pay a Framingham Union Hospital bill for the years 1937, 1938, 1939 and 1940 totalling $721.60, or do or act.


Voted that the Town appropriate for Welfare: Expense to pay the Framingham Union Hospital bill for 1937, 1938, 1939 and 1940 the sum of $721.60, and that that amount be transferred from Available Surplus Revenue, and that the Welfare Board be directed to turn over to the Town Counsel the claims against the individuals for suit for reimbursement in each case in which in the opinion of the Welfare Board the in- dividual is able to pay.


Article 3. To see if the Town will vote to raise and appro- priate or transfer from available funds the sum of $2,145 for the purchase of sidewalk tractor plow equipment for the High- way Department, or do or act.


Voted unanimously that the Town appropriate for the pur- chase of sidewalk tractor plow equipment the sum of $2,145.00, that that sum be transferred from Available Surplus Revenue and that the purchase be negotiated by the Highway Surveyor and made with the approval of the Board of Selectmen.
