Article 4. To see if the Town will vote to fix the salary and compensation of all elective officers of the Town, as pro- vided by Section 108, Chapter 41, General Laws, as amended, and set the effective date of such salary and compensation.
Voted unanimously that the Town fix the salary and com- pensation of all elective officers of the Town as provided in the budget as voted under Article 3, the effective date of such sal- ary and compensation to be from January 1, 1949.
Article 5. To see if the Town will vote to authorize the Board of Selectmen to sell or otherwise dispose of the present police car in connection with the purchase of a new car and to sell the present moth spraying equipment and authorize the Road Commissioners to sell or otherwise dispose of the 1936 International truck and two old snow blades in connection with the purchase of a new truck and two new high-speed snow blades, respectively, provided for in the budgets of these two departments, or do or act.
Voted unanimously that the Town authorize the Board of Selectmen to sell the present moth spraying equipment and the present police car, in connection with the purchase of a new car and that the Town authorize the Road Commissioners to sell or otherwise dispose of the following: (1) the 1936 International truck, in connection with the purchase of a new truck, and (2) two old snow plough blades, in connection with the purchase of two new high-speed snow blades.
Article 6. To see if the Town will authorize the Treasurer, with the approval of the Board of Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1949, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than a year, in accord- ance with Section 17, Chapter 44, General Laws.

Voted unanimously that the Town appropriate the sum of : (1) $9,226.47 for the payment of Water Coupon Notes, Water Bonds and Water Registered Notes-principal-maturing in 1949; (2) $2,656.40 for the payment of Water Coupon Notes, Water Bonds and Water Registered Notes-interest-due in 1949; (3) $14,500 for Water Department Maintenance; (4) $1,500 for joint Town office and clerical expense, the entire sum, $27,882.87, to be taken from Water Available Surplus.
Article 8. To see if the Town will vote to appropriate and assess a sum of money for the reconstruction and improvement of Chapter 90 roads, said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose, the work to be done by the Road Com- missioners, or take any action in relation thereto.
Voted unanimously that the Town appropriate and assess the sum of $3,750 for the reconstruction and improvement of Chapter 90 roads, said money to be used in conjunction with such money as may be allotted for the purpose by the State or County, or both, the work to be done under the supervision of the Road Commissioners.
Article 9. To see if the Town will vote to appropriate and assess, or transfer from other available funds, a sum of money for "Road Machinery Account," or do or act.
Voted unanimously that the Town appropriate and assess the sum of $1,000 for the "Road Machinery Account."
Article 10. To see if the Town will vote to purchase a parcel of land located on the southerly side of Mathews Drive and the westerly side of Main Street, Cochituate owned, or said to be owned, by Rosalthe C. Robertson, and having an area of about ten acres, more or less, and for such purpose appropriate and assess a sum of money therefor, or take any action relative thereto.
Voted unanimously that the Planning Board be and hereby is instructed to make a study, hold hearings and prepare recom- mendations to be ready for presentation to the Town at the next special or annual meeting for either: (1) the purchase or lease of additional dumping facilities adjacent to those now

being used on the easterly side of Cochituate Road to the north and rear of the Highway Garage, or, (2) the purchase or lease of such other site as it deems suitable for the purpose.
Article 11. To see if the Town will vote to appropriate a sum of money for the collection of garbage for the Town of Wayland, or do or act.
Voted that the Town authorize the Board of Selectmen, acting with the Board of Health, to arrange for a system of garbage collection through a one-year contract, with an option for a further period of two years, the contractor to have the right to collect garbage throughout the Town under rules and regulations promulgated by the Board of Health, the Selectmen to require that an Adequate Performance Bond be deposited and that the Town appropriate and assess the sum of $3,500 the whole or any portion of this amount to be expended toward the payment of a year's service under the contract.
Article 12. To see if the Town will vote to accept as public town ways, under the provisions of the Betterment Act, in that part of the Town known as Riverview Terrace, the roads known as "Riverview Circle" and "Shore Drive," or either of them, or any portion of them, as laid out by the Board of Selectmen and as shown on a plan or plans on file with the Town Clerk ; and to authorize the Board of Selectmen to acquire any necessary land by eminent domain, by purchase, gift or otherwise ; and to appropriate a sum of money for acquisition of any such land and the construction of such way or ways, or any portion thereof, and determine how the money shall be raised, or take any action relative thereto.
Voted unanimously to dispense with the reading of the report and order of laying out adopted by the Selectmen with respect to Riverview Circle and Shore Drive, on file with the Town Clerk.
Voted unanimously that the Town accept the laying out as a public way of Riverview Circle from Overlook Road to Shore Drive and of Shore Drive from Riverview Circle to Overlook Road, as shown on plan entitled "Plan and Profile of Riverview Circle, Wayland, Mass." dated October 21, 1947, revised February 28, 1949, Everett M. Brooks Co. C. E., and as laid out by the Selectmen and filed in the office of the Town Clerk, with assessment of betterments under the Betterment Act as provided in the order of laying out; that the Board of Selectmen be authorized to acquire any necessary land by

eminent domain, by purchase, gift or otherwise; and that $5,600 be appropriated and assessed for the acquisition of any such land and the construction of such ways and other costs in con- nection with the project.
Article 13. To see if the Town will vote to install water pipes and hydrants in the ways named in the foregoing article, or in any portion thereof, and to appropriate a sum of money for the expense thereof and determine how the money shall be raised ; and will authorize such sum, or any portion thereof, to be included in any betterments that may be assessed under the preceding article, or take any action relative thereto.
Voted unanimously that the Town appropriate and assess the sum of $2,800 for the installation of water pipes and hydrants in Riverview Circle from Overlook Road to Shore Drive, and in Shore Drive from Riverview Circle to Overlook Road for a distance of about 930 feet, the work to be done under the supervision of the Water Department, and that the Board of Selectmen be authorized to assess betterments there- for under the Betterment Act.
Article 14. To see if the Town will vote to accept as public town ways, under the provisions of the Betterment Act, the roads known as "Rich Valley Road" and "Hayward Road," or either of them, or a portion of them, as laid out by the Board of Selectmen, and as shown on a plan, or plans, on file with the Town Clerk, and authorize the Board of Selectmen to acquire necessary land by purchase, gift or otherwise, and appropriate a sum of money for the acquisition of any such land and the construction of such way, or ways, or any portion thereof, and determine how the money should be raised, or take any action relative thereto.
Voted that the proposed acceptance and construction of Rich Valley and Hayward Roads be referred to the Board of Selectmen and the Planning Board for appropriate action and report at a later meeting.
Article 15. To see whether the Town will vote to author- ize the use for burial purposes of the land adjoining Lakeview Cemetery acquired by the Town from Bessie G. Holcomb and Blanche Schleicher.
Voted that the Town authorize the use for burial purposes of land acquired from Bessie G. Holcomb and Blanche

Schleicher, pursuant to vote of the Annual Town Meeting in March, 1948.
Article 16. To see if the Town will vote to approve regu- lations of the Cemetery Commissioners relating to the sale of lots and prices, to interment charges and charges for annual care of cemetery lots and the collection of such charges and to restricting the right of burial when payment of such charges is in default, or other regulations of the Cemetery Commissioners, or take any action relative thereto.
Voted unanimously that the Town approve the following regulations of the Cemetery Commissioners :
TOWN OF WAYLAND
REGULATIONS OF CEMETERY COMMISSIONERS
1. Sale of Lots
No lots shall be sold to any persons except persons who are, or have been, residents of the Town. All deeds of lots shall be subject to the condition that the lots and the use thereof shall at all times be subject to the regulations of the Cemetery Commissioners from time to time in effect. Prices of lots shall be as fixed by schedules from time to time adopted by the Cemetery Commissioners, which schedules may fix different prices for persons who are and are not residents of the Town. No lot shall be sold to a person who is not a resident of the Town at the time of such sale unless in the opinion of the Cemetery Commissioners such sale can be made without undue prejudice to the present and future availability of lots for persons who are residents of the Town. In such sections of the cemeteries as the Cemetery Commissioners may designate, lots shall be sold on a perpetual care basis only.
2. Interments
No lot shall be used for the interment of any persons other than the owners of the lot and persons related to such owners as spouse, child or more remote issue, brothers, sisters, parents, uncles, aunts or first cousins of such owners, except as approved in each instance by the Cemetery Commissioners.
3. Annual Care
The charge for annual care of lots for which funds for perpetual care are not provided shall be at such rates as shall be fixed by the Cemetery Commissioners from time

to time. No interment shall be made in any such lot at a time when any such charges for annual care remain unpaid.
4. Service Charges
Service charges in connection with interments shall be as fixed by schedules from time to time adopted by the Cemetery Commissioners, which schedule may fix different charges for interment of persons who are and are not residents of the Town.
Article 17. To see if the Town will vote to amend the zoning ordinance as follows: To change from a residential to a Roadside Service District that portion of the land on the northerly side of State Road East owned by Thomas F. Mc- Manus, bounded and described as follows: easterly by Rich Valley Road, westerly by property now or formerly of Charles B. and Ellen A. Enstrom, and to have a depth of one hundred and fifty feet (150 feet) from said State Road, or do or act.
Voted to pass over the Article.
Article 18. To see whether the Town will vote to amend Section 3 of Article 1 of the Town By-Laws by striking out the date "January 10th" and substituting therefor the date "December 15th" so that said Section 3 shall read as follows :
"Section 3. All articles for insertion in the Warrant for the Annual Town Meeting must be presented in writing to the Board of Selectmen in accordance with law on or before December 15th or such earlier time as may be fixed by the Board of Selectmen, and all such articles for Special Town Meetings must be so presented at least twenty-one days before the date set for such meeting."
Voted unanimously that Section 3 of Article 1 of the Town By-Laws be amended by striking out the date "January 10th" and substituting therefor the date "December 15th" so that said section shall read as follows :
"Section 3. All articles for insertion in the Warrant for the Annual Town Meeting must be presented in writing to the Board of Selectmen in accordance with law on or before December 15th or such earlier time as may be fixed by the Board of Selectmen, and all such articles for Special Town Meetings must be so presented at least twenty-one days before the date set for such meeting."
Article 19. To see if the Town, in order to rectify certain irregularities relating to the numbering of certain sections of

the Zoning By-Laws, will vote to amend Article IX of said Zoning By-Laws so that paragraph (g) thereof shall read as set forth in full in the vote adopted under Article 23 at the Annual Town Meeting held on March 5, 1947 and so that para- graph (h) thereof shall be as set out as paragraph (g) in the original Zoning By-Laws adopted September 5, 1934 and so that the paragraphs thereof heretofore lettered (h), (i) and (j) are relettered paragraphs (i), (j) and (k), respectively.
Voted unanimously that Article IX of the Zoning By-Laws be amended so that paragraphs (g) and (h) thereof shall read as follows :
(g) No dwelling shall hereafter be erected on a parcel or lot of land not fronting on a street which parcel or lot of land shall contain less than ten thousand square feet ; or which shall have less than the minimum area and front- age on a right of way required for the zone in which it is located, unless such dwelling is accessory only to some existing building or dwelling; and no dwelling shall hereafter be erected on a parcel or lot of land fronting on a street which parcel or lot of land shall contain less area and less frontage on a street than the minimum of area and frontage required for the zone in which said parcel or lot of land is located, as set forth in paragraph (e) hereof, except that where a parcel or lot was record- ed at the Registry of Deeds at the time this by-law was adopted, the provisions of Section X, applying to nar- row and irregular lots, shall apply.
(h) Behind every dwelling house there shall be provided a back yard between the rear line of the house and the rear lot line, not less than thirty feet in depth. A back yard may contain accessory buildings, each of which shall not be more than one and one-half stories high and which together shall cover not more than thirty per cent of its area
and that paragraphs lettered (h), (i) and (j) are relettered paragraphs (i), (j) and (k), respectively.
Article 20. To see whether the Town will vote to amend the Town By-Laws by designating the By-Law entitled "Con- trol of Dumps" as Article 9 and by adding an additional article as follows :
"Article 14. - Snow Removal"
"Section 1. The Superintendent of Streets or other officers

having charge of ways of the Town shall have the authority for the purposes of removing or plowing snow, or removing ice, from any way in the Town, to remove, or cause to be removed, to some convenient place, includ- ing in such term a public garage, any vehicle interfering with such work."
"Section 2. The owner of any such vehicle so removed shall be liable for the reasonable cost of such removal and storage, and delivery of the vehicle to said onwer may be withheld by the Superintendent of Streets or other officer having charge of ways in the Town, until such reasonable costs shall be paid."

Pursuant to the following warrant the inhabitants of the Town of Wayland met this day and after the Moderator declared a quorum present proceeded to transact the following business.
Article 1. To see if the Town will vote to amend the vote made under Article 6 at the Special Town Meeting of 4/28/48 by revising that portion of the vote dealing with the borrowing of funds which now reads: "that to meet this appropriation, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow said sum of $20,000 and to issue bonds or notes of the Town therefor, payable in accordance with the provisions of Chapter 44 of the Massachusetts Gen- eral Laws, Ter. Ed., as amended, so that the whole loan shall be paid over a period of fifteen years from the date of issue of the first bond or note;" by substituting therefor the following language :
"That to meet this appropriation, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow from time to time in any amounts which, in the aggregate, do not exceed $20,000 and to issue bonds or notes of the Town therefor payable in accordance with the provisions of Chapter 44 of the Massachusetts General Laws, Ter. Ed., as amended so that the whole loan shall be paid over a period not to exceed fifteen years from the date of issue of the first bond or note"

Voted unanimously that that portion of the vote under Article 6 passed at the Special Town Meeting of April 28, 1948, reading as follows :

Ed., as amended, so that the whole loan shall be paid over a period of fifteen years from the date of issue of the first bond or note" be revised to read :
"That to meet this appropriation, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow from time to time not exceeding $20,000 and to issue bonds or notes of the town therefor, payable in accordance with the provisions of G. L. (Ter. Ed.) Chap- ter 44 as amended, provided, however, that such borrow- ing shall be in one or more separate issues in the amount of $5,000 or a multiple thereof, as determined by the Treasurer with the approval of the Board of Selectmen, and that each such issue shall constitute a separate loan and be payable in not more than fifteen years from the date of the bonds or notes of that issue.
Article 2. To see if the Town will vote to appropriate and transfer from Available Funds a sum of money for Welfare Department "Aid to Dependent Children," or do or act.
Voted unanimously that the Town appropriate and transfer from Excess & Deficiency Account for Welfare Department- "Aid to Dependent Children" the sum of $1,000.
Article 3. To see if the Town will authorize the Welfare Board to sell or otherwise dispose of the present 1941 Ford 2-door sedan, or do or act.
Voted unanimously that the Welfare Board be authorized to sell, trade or otherwise dispose of the present 1941 2-door sedan in connection with the purchase of a new car for the use of the Welfare Department.
Article 4. To see if the Town will authorize and instruct the Cemetery Commissioner and/or the Park Commissioner and/or the Selectmen and/or the Tree Warden to operate the Cemetery Department, Park Department, Moth Superintendent, and the Tree Warden's Department or any two or more of them together as a single consolidated department with a single full-time joint superintendent under the supervision of the

Cemetery and Park Commissioners and Tree Warden and will authorize the Selectmen to petition the Legislature for legis- lation to combine any two or more of the above departments into a single department and provide for a three or five-man board, or do or act.
Voted not to refer this Article to a Committee of five for further study.
Voted to lay the Article on the table.
