Voted unanimously that the Town accept as a public way,

under the Betterment Act, Riverview Avenue from Overlook Road southeasterly about 500 feet, as laid out by the Board of Selectmen and as shown on plan entitled "Plan and Profile of Riverview Avenue, Wayland, Mass." dated October 21, 1947, Everett M. Brooks Co. C. E. on file with the Town Clerk ; that the Board of Selectmen be and it hereby is authorized to acquire any necessary land by right of eminent domain, purchase or otherwise, and that the Town appropriate and assess the sum of $2700 to cover the acquisition of such land and the construction of said way, and that no work be done until there is definite assurance by subsequent action of the Town that water will be available.


Article 16. To see if the Town will vote to install water pipes and hydrants in the roads named in the foregoing article, or any portion thereof, to appropriate and assess a sum of money to pay the expense thereof and to authorize such sums, or any part thereof, to be included in the betterments to be assessed under the previous article, or take any action thereon.

Voted that the Town appropriate and assess the sum of $3,500 for the installation of water pipes and hydrants in Over- look Road for a distance of about 1,000 feet, the work to be done under the supervision of the Water Department, and that the Board of Selectmen be authorized to assess betterments therefor under the Betterment Act, and that no work be done until there is definite assurance by subsequent action of the Town that water will be available.

Voted that the Town appropriate and assess the sum of $1700 for the installation of water pipes and hydrants in River- view Avenue from its junction with Overlook Road easterly to the end for a distance of about 500 feet, the work to be done under the supervision of the Water Department, and that the Board of Selectmen be authorized to assess betterments therefor under the Betterment Act, and that no work be done until there is definite assurance by subsequent action of the Town that water will be available.


Article 17. To see if the Town will vote to accept as a public town way, under the provisions of the Betterment Act, the way known as Adelaide Avenue, leading off West Plain Street in that part of the town known as Cochituate, as laid out by the Board of Selectmen, and as shown on a plan or plans on file with the Town Clerk; to authorize the Board of Selectmen

to acquire any necessary land by eminent domain, purchase or otherwise; and to appropriate and assess a sum of money to cover the acquisition of such land and the construction of said public town way, or any part thereof, or take any action in regard thereto.

Article 18. To see if the Town will vote to authorize the installation of a water main and hydrant in Adelaide Avenue for a distance of 600 feet, running northerly from West Plain Street ; to appropriate and assess a sum of money therefor and to authorize such sums, or any part thereof, to be included in the betterment to be assessed under the previous article, or take any action thereon.


Voted that the Town appropriate and assess the sum of $1,800 for the installation of water pipes and hydrant in Ade- laide Avenue for a distance of about 600 feet, the work to be done under the supervision of the Water Department, and that the Board of Selectmen be authorized to assess betterments therefor under the Betterment Act.


Article 19. To see what action the Town will take with respect to the improvement and better maintenance of the Town dumps and what sum of money it will appropriate and assess therefor, or do or act.


Voted that there be appropriated and assessed the sum of $1,300 for the erection of fencing and gates, and for the super- vison of the dump located adjacent to the Highway Garage, both the work and maintenance to be under the supervision of the Highway Department, the Department to set and post a schedule of the days the dump is to be open; employ an attend- ant, with the waste collected allowed as a portion of the pay and exclude non-residents from using the dump.


Article 20. To see if the Town will amend its by-laws by

adding thereto, a new by-law entitled, "Control of Dumps" and reading substantially as follows :


1. No person, other than an inhabitant of the Town shall use any public dump established by the Town.


2. All public dumps shall be used only at such times as may be permitted by regulations adopted by the Select- men.


3. Whoever violates the provision of this by-law shall be subject to a penalty of $20 for each offense.


or will take any other action deemed necessary or desirable to effect the control of public dumps in the Town, to confine the use thereof to inhabitants of the Town and to make possible the enforcement of any such control, or do or act.


Voted unanimously that the Town amend its By-Laws by adding a new by-law entitled, "Control of Dumps" to read as follows :

Article 21. To see if the Town will vote to amend the present Zoning By-laws by providing for the establishment of a new type of district permitting a limited type of business use, to be designated as a roadside business district and to provide the use or uses permissible in such district and to provide a method for the location of such district or districts upon the zoning plan, or take any action in regard thereto.

SECTION V A


1. Buildings and structures in a roadside business district may be constructed, reconstructed, altered, enlarged, or used,

and premises may be used for the following purposes and no others :


(a) Any use permitted in a residence district.


(b) Restaurants or other eating places.


(c) Farm stands for sale of produce the major portion of which is raised in the Town.


(d) Gasoline and motor oil filling stations, salesrooms for motor vehicles, garages and repair shops, not including auto wrecking yards. All vehicles, except those being ser- viced with gasoline, oil, or minor repairs shall be stored within an enclosed building unless permission is granted by the Board of Appeals, in accordance with and as set forth in Section V (r), for the use of an adequately screened storage yard.


2. In a roadside business district, buildings, structures and premises used for purposes permitted in a residence district shall conform to the height, area, yard, and other regulations of Sections VIII and IX applicable to the single residence district nearest to the premises, except that no building or structure shall extend within 60 feet of any street line.


3. In a roadside business district, buildings, structures and premises used for purposes other than those permitted in a residence district shall observe the following special provisions :


(a) No building or structure, except gasoline pumps and accessory signs as hereafter provided, shall extend within 60 feet of any street line.


(b) No building or structure shall be located or shall extend nearer than 30 feet to the property line or nearer than 30 feet to any other detached building or structure on the premises.


(c) All buildings and structures shall conform to the height and lot coverage regulations for residence districts as contained in Section VIII (a) and Section IX (j) respec- tively.


(d) Premises shall have a lot frontage on any street of not less than 200 feet. Existing premises having less frontage may be used, provided that such frontage shall not be further reduced.


(e) Except where adjacent premises are served by the same driveway openings, each premises shall be provided with two driveway openings onto the street, one of which shall be

used for entrance to and the other for exit from the premises. Not more than two such openings shall be permitted for each 200 feet of street frontage. Such openings shall be not more than 20 feet in width at the street line and located not less than 40 feet apart measured along said line and not less than 20 feet from side lot lines. Where approval by the Massa- chusetts Department of Public Works is required in connec- tion with driveway openings onto state highways, the prior provisions of this paragraph, (e), shall be waived and the regulations of said department shall be applicable.


(f) Each premises shall provide and maintain adequate areas off the street for parking of cars of employees and cus- tomers in order to avoid undue interference with traffic. The issuance of a building permit shall not be construed as an approval of the adequacy of such parking areas.


(g) Not more than one sign, other than those which are attached to and are part of the architectural design of a building or structure including a gas pump, shall be permitted on each premises.


(h) Accessory signs and gasoline pumps shall not be located nearer than 30 feet to any property or street line.


Article 22. To see if the Town will vote to amend the Zoning By-laws as follows :


To change from a residential to a business zone that por- tion of the land on East Commonwealth Road, owned by Frank J. Maley, bounded and described as follows : westerly by J. M. Bent ; easterly by Winter Street; from Commonwealth Road to Dean property, bordering Bents', depth 327 feet; from Commonwealth Road to Dean property, bordering Winter Street, depth 219 feet.


Voted to pass over the Article.


Article 23. To see if the Town will vote to amend the Zoning By-laws as follows :


To change from a residential to a business zone that por- tion of land on the southerly side of State Road East, owned by Lillian E. Benson and by John J. Cassidy, bounded and described as follows: easterly by Pine Brook Road; westerly by land formerly of Eugene and Annie L. White and of Mary Frances White, and to have a depth of 300 feet from said State Road.

Voted that the Zoning Plan, Town of Wayland, Mass., be amended as follows :


That a certain portion of land on the southerly side of State Road East be changed from a residential to a Roadside busi- ness zone, said land being bounded and described as follows : easterly by Pine Brook Road; westerly by land of Mary Frances White; and southerly by a line 300 feet southerly of State Road East and parallel with the southerly side line of said State Road East, including lots or portions thereof now or formerly owned by Lillian E. Benson, John J. Cassidy and Kenneth V. Sartwell, if and when the Roadside District Zone is approved by the Attorney General.

Article 24. To see if the Town will vote to amend the Zoning By-laws as follows :


To change from a residential to a business zone that por- tion of land on the northerly side of State Road East, owned by James H. Lee, bounded and described as fol- lows : easterly by roadway of Peter Bianchi; westerly along State Road to land of Charles Wheelock and northerly to a depth of 300 feet.


Voted that the Zoning Plan, Town of Wayland, Mass., be amended as follows :


That a certain portion of land on the northerly side of State Road East be changed from a residential to a Roadside busi- ness zone, being bounded and described as follows; easterly by right of way of Peter Bianchi; westerly by a line parallel to said right of way and running from a point on the norther- ly side of State Road East 200 feet east of land of Charles Wheelock; and northerly by a line 300 feet northerly from State Road East and parallel with the northerly side of said road, if and when the Attorney General approves the Amend- ment providing for a Roadside Business District.

Article 25. To see if the Town will vote to have the neces- sary number of copies of the Town By-laws printed so that each of its voters may have a copy, if he so desires, plus a reason- able number of additional copies to be kept in the Town Hall at Wayland and at the Cochituate Branch of the Public Library.

Voted that the Planning Board arrange for the printing of the Town By-Laws, Building Code, Zoning By-Laws, regula- tions of the Board of Health, Police Department, Fire Depart- ment, Water Department, Planning Board with respect to sub- divisions and those governing the use of Town Dumps, with the funds from its budget and that one copy be sent to each voter and a charge set by the board for each section for addi- tional copies to be distributed from the Town Hall and the Cochituate Branch of the Library.


Article 26. To see if the Town will vote to amend that part of the by-laws of the Town, known as the Building Code, by adding to Chapter 3, Section 4, MASONRY, Par. 3.4.1. the following new paragraph, or make any amendment of said para- graph of a similar nature, or do or act :


EXTERNAL, PARTITION or BEARING walls may, if approved by the BUILDING INSPECTOR, be built in part, or whole, of iron, steel, concrete or combination of such or like materials and when so built may be of less thickness than is hereinbefore required, provided that all constructional parts are thoroughly protected from fire by brick, terra cotta, cement or plastering upon metal furring, and provided the strength of all bearing sup- ports is equivalent to that of brick, masonry or concrete walls otherwise herein required, including floor and roof construction.


Voted that the subject of this article be referred to a com- mittee consisting of the Fire Chief, one member of the Planning Board and a third member to be appointed by the first two, said committee to prepare a report and recommendation to be pre- sented to the next annual Town Meeting.


Article 27. To see if the Town will adopt a resolution affording the people of Wayland an opportunity to express to their representatives in Congress, in the Executive Department of the United States, and in the United Nations, their deep feel- ing regarding war and peace and requesting such representa- tives to take such steps as may be necessary to help make the United Nations into a World Government capable of enacting, interpreting and enforcing world law to prevent war.

Article 28. To see what sum, if any, the Town will vote to transfer from available funds to meet any of the appropria- tions made under the foregoing articles.

Pursuant to the following warrant the inhabitants of the Town of Wayland met this day and did the following business. The necessary one hundred voters were present which consti- tutes a quorum to transact business at any town meeting.


Article 1. To see if the Town will vote to raise and appro- priate a sum of money for the erection of a new pumping station at the site of the new well off Old Connecticut Path ; for original pumping station equipment ; for the laying of pipe of not less than 6" in diameter to connect the new station with the existing water system; for the construction of a new addi- tion to the pump house at Baldwin's Pond and for the installa- tion of original pumping station equipment ; to determine how the money shall be raised, by borrowing or otherwise, and to authorize the Water Board, with the approval of the Selectmen, to enter into necessary contracts and agreements and to take any action relative thereto.


Voted unanimously that the Town appropriate the sum of $37,000 for the erection of a new pumping station at the site of the new well off Old Connecticut Path, for original pumping station equipment, for the laying of pipe of not less than 6" in diameter to connect the new station with the existing water system, for the construction of a new addition to the pump house at Baldwin's Pond and for the installation of original pumping station equipment ; that to meet this appropriation, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow said sum of $37,000, and to issue bonds or notes of the Town therefor, payable in accordance with the provisions of Chapter 44 of the Massachusetts General Laws, Ter. Ed. as amended, so that the whole loan shall be paid over

a period of fifteen years from the date of issue of the first bond or note; and that the Water Board, with the approval of the Selectmen, be and hereby is authorized to do, or procure the doing of, the work and to enter into any contracts or agree- ments in connection therewith.


Article 2. To see if the Town will vote to raise and appro- priate a sum of money for the laying and re-laying of existing water lines of not less than 6" in diameter as follows :


(1) For new installation of water mains :


(a) in Winter Street from Commonwealth Road East to Willard Street-a distance of 500 feet ;


(b) in Waltham and Lincoln Roads-between ends of existing lines-a distance of 1,300 feet.


(2) For replacement of water mains :


(a) in West Plain Street, from Main Street to Old Connecticut Path-a distance of 5,300 feet ;


(b) in Pemberton Road, from West Plain Street to Commonwealth Road West-a distance of 2,500 feet.


and to determine how the money shall be raised, by borrowing or otherwise, and to authorize the Water Board, with the ap- proval of the Selectmen, to enter into any necessary contracts or agreements and to take any action relative thereto.


Voted unanimously that the Town appropriate the sum of $41,500 for the laying of new water mains :


(1) of 8" in diameter in Winter Street, from Commonwealth Road East to Willard Street-a distance of 500 feet


and


(2) of 6" in diameter in Waltham and Lincoln Roads, be- tween ends of existing lines-a distance of 1,300 feet


and for the re-laying of existing water lines :


(1) with mains of 10" in diameter in West Plain Street, from Main Street to Old Connecticut Path-a distance about 5,300 feet


and


(2) with mains of 8" in diameter in Pemberton Road, from West Plain Street to Commonwealth Road West-a dis- tance of about 2,500 feet ;


that, to meet this appropriation, the Treasurer, with the approv- al of the Selectmen, be and hereby is authorized to borrow said sum of $41,500 and to issue bonds or notes of the Town there- for, payable in accordance with provisions of Chapter 44 of the

Massachusetts General Laws, Ter. Ed. as amended, so that the whole loan shall be paid over a period of fifteen years from the date of issue of the first bond or note; and that the Water Board, with the approval of the Selectmen, be and hereby is authorized, empowered and directed to let the work out at pri- vate contract and to enter into contracts and agreements in con- nection therewith.


Article 3. To see if the Town will vote to raise and appro- priate a sum of money for the extension of the water system by installing water mains of not less than 6" in diameter in Rice Road, from Commonwealth Road East to a point opposite Snake Brook Reservoir-a distance of about 4,300 feet; to determine how the money shall be raised, by borrowing or other- wise, and to authorize the Water Board, with the approval of the Selectmen, to enter into the necessary contracts and agree- ments, or take any action relative thereto.


Voted unanimously that the Town appropriate the sum of $23,700 for the extension of the water system by the installa- tion of a water main 8" in diameter in Rice Road from Com- monwealth Road East to a point opposite Snake Brook Reser- voir-a distance of about 4,300 feet; that to meet this appro- priation, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow said sum of $23,700, and to issue bonds or notes of the Town therefor, payable in accord- ance with the provisions of Chapter 44 of the Massachusetts General Laws, Ter. Ed. as amended, so that the whole loan shall be paid over a period of fifteen years from the date of issue of the first bond or note; and that the Water Board, with the ap- proval of the Selectmen, be and hereby is authorized, empowered and directed to let the work out at private contract and to enter into contracts and agreements in connection therewith ; but that no work shall be done until the Water Department has secured written agreements from the owners of at least 50% of the existing dwellings on the road to the effect that they will agree to purchase water from the Town at the applicable rates when the main has been installed.


Article 4. To see if the Town will vote to raise and appro- priate a sum of money for the extension of the water system by installing water mains of not less than 6" in diameter in Stonebridge Road, from Old Connecticut Path to Sudbury River-a distance of 6,000 feet; to determine how the money shall be raised, by borrowing or otherwise, and to authorize the Water Board, with the approval of the Selectmen, to enter into

the necessary contracts and agreements and to take any action relative thereto.


Voted not to pass over the Article.


Voted that the Town appropriate the sum of $26,400 for the extension of the water system by the installation of a water main 8" in diameter in Stonebridge Road, from Old Connecticut Path to the Sudbury River-a distance of about 6,000 feet ; that to meet this appropriation, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow said sum of $26,400, and to issue bonds or notes of the Town there- for, payable in accordance with the provisions of Chapter 44 of the Massachusetts General Laws, Ter. Ed. as amended, so that the whole loan shall be paid over a period of fifteen years from the date of issue of the first bond or note; and that the Water Board, with the approval of the Selectmen, be and hereby is authorized, empowered and directed to let the work out at pri- vate contract and to enter into contracts and agreements in con- nection therewith.

To see if the Town will vote to raise and appro- priate, by borrowing or otherwise, a sum of money for the installation of water mains of not less than 6" in diameter in such accepted streets and town roads as may be recommended by the Water Board and approved by the majority of the Selectmen and by a majority of the Finance Committee; to authorize the Water Board, with the approval of the Selectmen to enter into any necessary contracts and agreements, or take any action relative thereto.

Board and approved by a majority of the Selectmen and a majority of the Finance Committee ; that to meet this appropri- ation, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow said sum of $20,000 and to issue bonds or notes of the Town therefor, payable in accordance with the provisions of Chapter 44 of the Massachusetts General Laws, Ter. Ed. as amended, so that the whole loan shall be paid over a period of fifteen years from the date of issue of the first bond or note; and that the Water Board, with the approval of the Selectmen, be and hereby is authorized to do or procure the doing of, the work and to enter into any contracts or agree- ments in connection therewith.
