Dear Senator Gunn:
I have discussed further with Commissioner Callahan the procedure to be followed with respect to the Montague to North Amherst road and he advises me that a State highway layout based on an indemnity vote and agree- ment by each of the towns will be satisfactory without any action by the County Commissioners. I am therefore enclos- ing two copies of suggested articles to be inserted in the town warrants and suggested votes to be passed by each of the
towns. In the first article and vote the town authorizes the selectmen to sign an indemnity agreement. This article should be inserted and the vote passed without change in
the wording. The selectmen will be given the opportunity to scrutinize the plans before we request them to sign the agreement and the agreement will be based on definite plans.
The second article and vote provides for an appropriation. These appropriations at this time should be only nominal sums and actual appropriations to cover the actual damages can be made at some later town meetings when the amounts of the damages are known. This article and vote should also be used exactly as worded particularly with re- spect to the word "towards" which enables the town to make a later appropriation for the same purpose, but each town will probably need to add something to cover the method by which the nominal sum appropriated will be raised, There must be some appropriation as without this the indemnity vote is not binding.
