Whereas William Ballord & Nathan Breed petitioned the Town at their Annuall meeting in March 1737 to sell to them ye corner of comon Land that Lyeth Betwixt Nathanll Ballards House Who is deseased & Nathan Breeds hous & to Exchang sum of sd Land with Wm Ballord in order to accomadate the way Better: Wherefore Voted that the selectmen mak sale of so much of sd Land as they shall thinck Conveniant and Exchang so much as will accomadate the Rhoad Better : Whereupon we ye subscribers according to ye trust Reposed in us : have Laid out to William Ballard 20 poole and Ex- changed with sd Ballard 4 poole to accomadate ye way as afore sd & sold to sd Ballard 16 poole at 4s pr. poole and to Nathan Breed 21 poole Including his shop at 4s per pole as Witnis our hands June ye 20th 1737 then Recd Richard Johnson of Nathan Breed for himself & Daniel Mansfeild

and at ye same Meeting Ebenez Ramsdill pd 10s for sedg Island & he to have it again for 10s ye next year Godfrey Tarbox paid ten pounds for the hire of the Nahant Beachis for the year past and the Town Let them to him again for five pounds for the year Ensewing

Whereas William Ballord and Nathan Breed Desired ye Town to make an Exchange with the sd William Ballard of sum Land to straighten his fence against ye hous formerly Nathaniel Ballards : and to sell to sd Ballard & Breed about twenty or thirty pooles of Land in that Corner of Land Betwixt ye hous formerly Nathaniel

Ballords & Nathan Breeds hous: In answer to sd Request Voted that the selectmen make an Exchange with the sd William Ballard and make sail of so much of that Land Requested as they in their prudence thinck Conveniant to Willem Ballard and Nathan Breed and ye selectmen to set ye price of sd Land and Receive ye money for it for ye Town


at the same Meeting whereas Edward Irson had complained to ye Town that he had not his full Wright in the common Lands and a Committe was Chosen to consider of his Complaint and make Report to ye Town Which is as followeth: We the subscribers being ap- pointed by the Town of Lynn at their Meeting held in Lynn Sep- tember ye 29th 1736 To take Under Consideration the Complaint of Edward Ireson to the sd Town of his not haveing had his pro- portionable part of the Common & Undevideds when they was Layd out to & among the Propriators & Inhabitants of the afore said Town -


Pursuant there to we have Carefully Examined into that affair & by sarching into the Records & other Information find that the said Edward Ierson hath: 1: acre &: 60: pooles more of the Com- mon Lands (in quontity) then the other Commoners who drawed the same Right with his prodesessors but for as much as the sd Iresons predesessors was the onely Commoner who had no Lot Laid out in Nahant & that haveing Risen in Vallue for more then the other common Lands - We are of Opinion that in Consideration there of and in full sattisfaction there for there be granted to the said Edward Ierson about : 80: pooles of common Land bounded Easterly on his homested & westerly on the Highway that Leads from Samuel Ingoles to Marblhead Road and Northerly so far as to take the front of his said homesteed & so far southerly as the said Ingoles well and the sd 80 pooles of Land to be the same Length on that side next to the aforesaid highway as on the other side thereoff the fore menshoned Report was Voted Ebenezer Burrill an acception by ye Town and the sd Richard Mower Edward Ierson Being present accepted Elisha Newhall of it in full Sattisfaction


At the same Meeting March ye 7th 1736/7


Whereas the Reverant Mr Nathaniel Henchman prefered a petition to the Town at their Townmeeting ye 17th of May: 1736: and in answer to the same ye selectmen was appointed to vew the same & make Report to the Town the next Townmeeting the Which they

did : at a Townmeeting July ye 8th 1736: But nothing was acted up- on it at that meeting : and the sd Mr Hinchman Desired the Town to pass upon it at the Generall Town Meeting this day: the Petition is as followeth: To the Town of Lynn Assembled this 17th of May 1736: Gentlmen there being a few Pols of comon Land adjoyning to the Northern Bounds of my Homested the purchas where of would accomadate me with a certain watering place: the want of which By Reason of ye uncertainty of the upper stream is a Considerable Disapintment to me, I therefore Request your sail of it to me whereby youl ablidg yours to serve N Hinchman then the question was put wheither they would grant the prayer of the petition and it was Voted in the affirmitive then the qestion was put wheither they would give the peac of Land to Mr Hinchman and it was Voted in the affirmitive At A Meeting of ye selectmen March ye 11th 1736/7 the severall officers was sworn to their severall offices as followeth viz Richard Johnson as Town Clerk and Capt Mower Capt Newhall Jacob Newhall Daniel Mansfeild Capt Fuller & Richard Johnson as assessors

Voted that Mr Jacob Newhall Cap John Fuller & Mr David Johnson be a Committe Carefully to Inspect into any persons haveing made incroachment upon any of the Roads or highways within the Limmits of the Town or upon any of the Towns Land by Raising or Erecting any boulding thereon or on any part there off or that shall fence Inclose or Erect any Building on any of the Roads highways or Lands as afore sd before the annuall Town Meeting in March next & the afore said Committee are here by fully autherised & Impow- ered in behalfe of the Town to prosecute in the Law to Effect all & Every person Erecting any boulding fencing or Incloseing as a fore said (Excepting such only as have allready made satisfaction to the Town therefor) or otherwise to agree with all or any person fencing boulding or Erecting any boulding or Inclosing any of the Towns Land as afore sd and the said Committe to Render an Accompt of their Doings to the aforesaid Annuall Town Meeting

At a Town Meeting Held in Lynn March ye 25th ---- 1737 Nathaniel Collins petitioned the Town to sell him about seven pools of Common Land to the southard of his Dwelling hous In answer to sd Request William Basset Ens Benja Newhall & Edwon Lewis are appointed a Committe to vew sd Land petitisoned for and make Report the next May Town Meeting


at the same Meeting March ye 25th Whereas Samuel Alley petitined the Town to sell to him about six pooles of Common Land at the East End of his hous to Make a Cow yard In answer to sd Request William Basset Ens Benja Newhall & Edmond Lewis are appointed a Commity to vew sd Land petitisoned for and make Report to the Town the next May Town Meeting

Whereas Nathaniel Collins senr petitioned the Town to sell him a small peace of Land upon ye common near his hous to set a Barn on at the Town Meeting March ye 25th 1737 In answer to sd petition William Basset Ens Benja Newhall & Edmond Lewis was appointed a committe to vew sd Land petitioned for and make Report to ye Town wheither it was Conveniant for the Town to sell it to the sd Collins : and at a Town Meeting Held in Lynn May ye 13th 1737 sd committe Mad & Repor to the Town that they had vewed sd Land petitioned for and thought their migh be sold to the petitiner ten pooles of Land without any predidsh to the Highway or neibourhod near his sons work hous as they had staked it out -


Upon which the Town voted that Nathaniel Collins should have ye ten pooles of Land as it was stacked out he paying to ye Town Treas- urer forty shillings for the sd Land for the Towns Use


June ye 6th 1738 Jedediah Collins pd for sd Land forty shilling to me Richard Johnson

Whereas Samuel Alley petitioned the Town at their Town meeting in March ye 25th 1737 1737 to sell him a small peace of Common Land at the East End of his Dwelling hous for a Cow yard and a Committee Chose to vew sd Land petitined for and make Report the next Town meeting : the which they did at the Townmeeting Held in Lynn May ye 13th 1737 that they had vewed sd Land petitioned for and was of opinion that there might be about ten pools of Land sold to sd Alley without any Damage to the Road : Upon which Report the Town Voted that the sd Samuel Alley should have the sd Land as it was stacked out he paying to the Town Treasurer forty shillings for sd Land for ye use of the Town March ye 16th 1737/8 Samuel Alley paid forty shillings for ye said Land £2-0-0

Voted that ther shall be a tax of one hundered & ninty pounds to pay ye nessesary Charge ariseing in said Town for the year Ineswing at the same Meeting


Voted that the selectmen have full power to Receive any Books or Deeds or papers of the Excexretrix of Corll Burrill Deseased that was in his hands when he Deseased that was the Towns

Whereas Samuel Breed William Basset John Basset Zaccheus Collins & Samuell Newhall ye 3d Requested the Town to grant them a Peace of Land to Accomadate the People Called Quakers to bould a new meetinghous on the said Peace of Land to Joyne to the fence at the front of the Quakers old meeting hous the question being asked wheither the Town would grant their Request and it was voted in the affirmitive and Capt John Fuller Jacob Newhall and Edmond Lewis was Chose a Committe to stack out the said Land

Henery Silsbe Requested the Town to sell him about Eighty Poole of Common Land at the front of his hous and Land wherefore

Abraham Allen Petitisoned the Town to sell him about Eight or ten pole of Land upon ye southard of his hous adoyning to his garding In answer to the same Ens Benja Newhall Edmond Lewis and Jona- than Blany are appointed to vew the same and make Report to the Town the next Town Meeting

It was asked wheither the Town would Chuse a Committe to stack out the Land Mr Hinchman had a Vote of the Last March Town meeting and it past in the negative

Whereas there was a grant of ten pools of Land to Edward Howard senr at a Town Meeting Held in Lynn October ye 30th 1710 where he set his hous and now stands and a Restriction was put upon it that if ever he sold said Land the Town to have the offer of buying it : therefore at this meeting Edward Howard Junr gave the Town the offer of buying it : and it was put to vote wheither the Town would by it and it passed in the neggative

the List of Jurymen was Read to the Town and approved of

Captn James Person put in a petition to the Town to se if they would give him fifteen pounds six shillings & six pence which was dew to the Town as by a Note of hand which was given by him to the selectm of sd Town and after sum Debate upon it: the further Consideration of it was continued untill the next Town Meeting
