Notice has been served on the Town to widen and straighten the highavay on petition of David Torrey, Jr., and others, at various points, from the residence of Benjamin Litchfield, to that of Benjamin Merrett. Omitting any alteration in the highway, from a point near the house of Joseph Merrett, to that of Joseph T. Litchfield. The completion of the road is ordered as soon as the first day of September next. We know of no other repairs involving much expense likely to come during the present year. We believe a petition by Horace P. Stevens and others, has been presented to the County Commissioners, but the Town has not been notified of any action thereon, and such widenings, &c., can hardly come into the next year's expenses. As instructed by the Town, the Selectmen have petitioned for an alteration of the highway near the house of Martin C. Glover, which will probably be effected during the present year. Aside from these, we can anticipate nothing more than ordinary expenses for such purposes.

Your Selectmen would take this opportunity to congratulate the Town on their Financial Standing. As will be seen by the Report, the Debt of the Town is materially reduced, and we believe the same rate of Tax- ation as last year, will pay the present Debt in Six Years, unless the State Tax is largely increased, or the Town makes Appropriations larger than those of the last year.


The Selectmen respectfully call the attention of their fellow-citizens to the following communication from Harris & Tucker, their attornies in the case of Salmond vs. Hanover.


BOSTON, Feb. 7th, 1867.


SAMUEL TOLMAN, Jr., EsQ. : - Dear Sir, - The case of Salmond vs. Han- over, as you have already been informed, was decided for the defendant by the Supreme Judicial Court. We ought, however, to inform you and others interested that the main question raised or attempted to be raised, was not determined; the case having been decided upon the mere question of the forin of the proceeding. The Court decided that the plaintiff should have asked for an abatement of the tax, and, if the Assessors of Hanover declined or neg- lected to grant it, appealed to the County Commissioners, and that this is the only remedy in a case of over-valuation, which they held this to be.


We have no doubt the Court will hold the town line to be established by the Legislature, by the Act of 1857, and that when the case can be presented in the right way, the Court will fully sustain our rights, as we understand them. We are, of course, very sorry that any mistake should have been made in bringing the action in this case, but we have only to say, that we took the course which seemed to us most wise and prudent in the absence of any ex- press decision of the Court upon the point, and have succeeded in ascertaining - what was not known before - the only correct way. We have not the remotest doubt that the property lies in South Scituate and is taxable there, and we have reason for saying that on this point the Court is with us and will so decide when the case can reach them, so as to give them jurisdiction. We hardly believe the counsel on the other side have really any strong faith in their case or hope of sustaining it.


We hope we shall yet be able to establish the plaintiff's position, if the plaintiff sees fit to continue to entrust us with his interests.

SOLDIERS' RECORD.


The selectmen would respectfully present to the Town a list of the soldiers and sailors who have filled the various Quotas of the town during the great rebellion. We have endeavored to give the date of enlistment, and term of service of each, but in many instances have been unable to do so. With regard to most of those enlisting from other towns, aliens, &c., the certificates of muster on our files state only the Regiment, omitting the letter of the Company to which they were as- signed, for the reason that such recruits were always assigned to Com- panies according to the orders of the Colonel of the Regiment after their arrival. By the kindness of Adjutant General Cunningham, and the aid of his polite and obliging assistants, we have succeeded better than we anticipated. As his Records are perfected, it will be easy to fill up and complete the Town Record. There are two reasons for preparing these statements ; one, that we presumed our fellow Citizens would be highly pleased to possess such a Record of our soldiers for preservation - although incomplete - and another that the Legislature of 1865 en- acted a law so effecting the settlement of soldiers and sailors, that it seemed imperative that the Town should possess a full and complete account of every essential fact relating thereto. This Record will be copied in a book prepared therefor, and placed on the files of the Town for future completion, as facts may be obtained.


For the information of the Town, we present the Law of Settlement to which we have referred. It will be perceived that we have furnished during the war two hundred and thirty-nine men, more than one half our rateable polls, and probably more than all the ablebodied men be- tween the ages of eighteen and forty-five. The cash expenses for boun- ties, recruiting services, uniforms, &c., drawn from the Town Treasury, were fourteen thousand five hundred and ninety-seven dollars. To these expenses might be added many hundreds more of private contributions.


CHAP. 230.


AN ACT relating to the Settlement aud Relief of Persons who have served in the Army and Navy of the United States.


Be it enacted, &c., as follows :


SECT. 1. Any person who shall have been duly enlisted and mus- tered into the military or naval service of the United States, as a part of

the quota of any city or town in this Commonwealth, under any call of the president of the United States, during the recent civil war, or who shall have continued in such service for a term not less than one year, or who shall have died or become disabled from wounds or disease re- ceived or contracted while engaged in such service, or while a prisoner in the hands of the enemy, and the wife or widow and minor children of snch person, shall be deemed thereby to have acquired a settlement in such city or town ; and all the rights, duties and liabilities pertaining to such settlement, as set forth in chapters sixty-nine and seventy, and in section forty-nine of chapter seventy-one of the General Statutes, shall attach thereto : provided, such person was, at the time of his enlistment, of the age of twenty-one years, an inhabitant of said city or town, and had resided therein for six months next previous to the time of his being mustered into said service.
