Article 4. Voted: That the Town vote to authorize the Selectmen to take charge of all legal proceedings for or against the Town.

Ed.)


Article 9. Voted: That the Town appropriate from the Excess & Deficiency Account, the sum of Twenty-five thousand ($25,000.00) dollars for use by the Board of As- sessors in fixing the tax rate for 1954.

Article 16. Voted: That the Town vote to transfer the sum of Two thousand ($2,000.00) dollars from the Parking Meter Fund to the Maintenance of Roads and Sidewalks in the Metered Area Account of the Highway Department.


Article 17. Voted: That the Town vote to transfer the sum of Six thousand ($6,000.00) dollars from the Park- ing Meter Fund to the Snow Removal in the Metered Area Account of the Highway Department.


Article 18. Voted: That the Town vote to raise and appropriate the sum of One thousand five hundred ($1,500.00) dollars for the construction of a new Bridge on Mellen Street, said money to be used together with money previously appropriated for this bridge. Said money to be expended by the Board of Selectmen.

A motion was made and seconded that the Town raise and appropriate the sum of Thirty-five thousand five-hundred and seventy-nine ($35,579.00) dol- lars for the operation and maintenance of a public licensed nursing home under the supervision of the Board of Public Welfare at the present Town Infirmary located on Asylum Street, Milford.


Motion lost on a voice vote.

ADJOURNED TOWN MEETING, MARCH 24, 1954


The meeting was called to order by Moderator Curran at 8 P. M. The Monitors checked the lists and 136 persons being present, a sufficient number to constitute a quorum, the business of the meeting was opened.

Article 20. Voted: That the Town will vote to ac- cept the provisions of Section 1 of Chapter 60 of the Acts of 1953, which is an act providing that the chairman of the Board of Appeal under zoning by-laws and the chairman of the Planning Board of the Town of Milford shall be Town Meeting Members at Large in said Town.


Article 21. A motion was made and seconded that the Town pursuant to the authority contained in Section 21-A of Chapter 40 of the General Laws, will vote to amend the by-laws of the Town by adding thereto the following: "That any employee of the Town, other than those ap- pointed by the School Committee, including members of the Police and Fire Departments who has worked continu- ously for five years but less than ten years shall be granted an annual vacation of not less than three weeks without loss of pay, and any employee thereof who has worked continuously for ten years or more shall be granted an annual vacation of not less than four weeks without loss of pay".


7 persons stood and were recognized for a Secret Ballot. The counters James Birmingham, Anthony Compagnone and Ernest Lombardi gave the result of the ballot to the Moderator. 61 persons having voted in the affirmative and 77 in the negative, the motion was lost.


Article 22. A motion was made and seconded to see if the Town, pursuant to the authority contained in Section 21-A of Chapter 40, of the General Laws, will vote to amend the by-laws of the Town by adding thereto the following: "That any member of the Police or Fire Departments who is required to work on January first, February 22, April 19, May 30, July 4, the first Monday of September, Octo- ber twelfth, November eleventh, Thanksgiving day or Christmas day or the day following when any of the five days first mentioned or October twelfth, November eleventh or Christmas day, occurs on Sunday, he shall be given an additional day off, or, if such additional day off cannot be given because of personnel shortage or other cause, he shall be entitled to an additional day's pay; provided that, in

the case of any member of the Police or Fire Department who works five or more days a week, and whose regular day off falls on any of the afore-mentioned holidays except when such holiday occurs on Saturday, an additional day off shall be allowed, or payment in lieu of one day shall be allowed".


An amendment was made that the Town, pursuant to the authority contained in Section 21-A of Chapter 40 of the General Laws, will vote to amend the By-laws of the Town by adding the following :- That any member of the Police or Fire Departments who is required to work on May 30th, July 4th, the first Monday of September, Thanks- giving Day or Christmas Day or the day following, when any of the above-mentioned five days that occur on Sun- day. He shall be given an additional day off, or if such ad- ditional day off cannot be given because of personnel shortage or other cause he shall be entitled to an additional day's pay; provided that, in the case of any member of the Police or Fire Departments who work five or more days a week, and whose regular day off falls on any of the afore- mentioned holidays, except when such holiday occurs on Saturday. an additional day off shall be allowed, or pay- ment in lieu of one day shall be allowed.


A motion was made and seconded that the result be ascertained by a standing vote. Voice vote carried.


The vote was doubted by 7 persons who stood and were recognized and a standing vote was taken.


85 persons having voted in the affirmative and 33 in the negative the motion was carried and the question now came on the amendment. A standing vote was taken and 42 persons having voted in the affirmative and 81 in the negative the amendment was lost.

A motion was made and seconded that a committee of nine (9) be appointed by the Board of Selectmen to study the advisability of establishing a public licensed

nursing home under the supervision of the Board of Public Welfare, at the Town Infirmary and to report to the Board of Selectmen on or before January 15th 1955 said com- mittee to be made up as follows:


1 Member from each Precinct.


2 Members of the Finance Committee.


2 Members of the Board of Public Welfare.


It was moved and seconded to adjourn the meeting to Thursday at 8 P. M.

ADJOURNED TOWN MEETING, MARCH 31, 1954


The meeting was called to order by Moderator Curran at 8 P. M. The Monitors checked the lists and 134 persons being present, a sufficient number to constitute a quorum, the business of the meeting was opened.


The following Resolutions were presented to the as- sembly at this time.


Resolutions


WHEREAS, this meeting has learned with deep regret of the untimely passing of William Wallace O'Brien, a Town Meeting Member since the inception of this form of municipal government, a former Member and Secretary of the Finance Committee, a former Member of the School Committee and an active participant in all activities that were for the betterment of our town and its inhabitants, and


WHEREAS, Mr. O'Brien spent many years in the service of the State of Massachusetts and gave unselfishly of his time and strength in an effort to make our highways safe for all of us, and


WHEREAS, his passing is mourned by all of the com- munity because of the example set by him as a citizen, family man, employee, friend, and because of his true un- derstanding of his obligations to his God, his country and his fellowman.

THEREFORE, be it resolved, that the business of this meeting be suspended and that the members stand with bowed heads as a tribute to his memory, and


BE It Resolved further that the clerk be directed to send a copy of these Resolutions to the relatives of the deceased and that these Resolutions be printed in the next annual Town Report.

Article 23. Voted: That the Town authorize the Fire Chief to sell any obsolete equipment or apparatus owned by the Town and presently controlled by the Fire Department.


Article 24. Voted: To pass over the article.


Article 25. Voted: That the Town vote to appro- priate the sum of Eighteen thousand eight hundred eighty- three ($18,883.00) dollars for the purpose of constructing a new building for the Highway Department on land now owned by the Town of Milford, adjacent to the present Highway Department yard, and for the fencing in of the lot on which the building is to be erected, and that to meet this appropriation, the sum of Four thousand eight hundred eighty-three ($4,883.00) dollars be raised in the 1954 tax levy and that the Treasurer with the approval of the Se- lectmen be, and hereby is authorized to borrow the sum of Fourteen thousand ($14,000.00) dollars and issue bonds and notes of the Town therefore, payable in accordance with the provisions of the General Laws, so that the whole loan shall be paid in not more than five (5) years from the date of issue of the first bond or note, or at such earlier time as the Treasurer and the Selectmen may determine. Said money to be expended under the supervision of the High- way Surveyor.

Voted: That there be appropriated the sum of Seventeen thousand ($17,000.00) dollars for the purpose of purchasing a new Pumping Engine for the use of the Fire Department, and to meet the said appropria- tion, that the amount of Four thousand Five hundred ($4,500.00) dollars be raised in the Tax Levy of the current year, and that the Treasurer be and is hereby authorized to borrow a sum not to exceed Twelve thousand Five hun- dred ($12,500.00) dollars and to issue bonds or notes of the Town therefore, said bonds or notes to be payable in accordance with the provisions of Chapter 44, of the Gen- eral Laws. The whole loan shall be paid in not more than five (5) years, or at such period as may be determined by the Treasurer with the approval of the Selectmen.

Article 27. Voted: That the Town vote to transfer from the Parking Meter Collection Account to the Police Dept. Parking Meter Maintenance and Operating Account, the sum of $13,475.73 for the purpose of paying salaries.


Article 28. Voted: That the Town vote to transfer from the Parking Meter Collection Account, to the Police Dept. Parking Meter Maintenance Account, the sum of $1500.00.

Article 30. Voted: That the Town vote to raise and appropriate the sum of Two thousand ($2,000.00) dol- lars for the purpose of preparing and publishing a valua- tion book covering valuations of all real and personal es- tates in the Town, the same to be expended under the jurisdiction of the Board of Assessors, copies thereof to be issued to the public at a cost of not less than Fifty (.50) cents for each book.

Rosenfeld Avenue


Beginning at an iron pipe in the southerly line of Fountain St. Said pipe is located N. 71°-50' E., 240.1 ft. from a square stone post at the intersection of the Easterly line of Congress St., and the Southerly line of Fountain St.,


Thence; Running S. 16°-30' E. 471.4 ft. to an iron pipe at an angle point.


Thence; Running S. 19°-25' E. 679 ft. to an iron pipe in the Northerly line of Metcalf Ave.


The street, now a private way called Rosenfeld Ave., is to be 40 ft. wide and is to lie to the east of the above described line. It is bounded on the West by lands of Rao, Powers and Rosenfeld, and on the East by lands of Bibbo, Rubenstein, Platukis, Kirsner, Rosenfeld, Knights, Barton and Gentile.

Article 38. The Clerk read the report of the Exten- sion of Congress Terrace.


Extension of Congress Terrace


Beginning at a stake at the northwesterly corner of Congress Terrace as accepted in the adjourned Town Meet- ing of 1951. Thence continuing the northerly line of Con- gress Terrace 61.6 ft. across a private way known as High St. extended, to a concrete bound. Thence running S. 76 degrees -02 minutes W. 201.7 ft. to a concrete bound at a private way known as "B" St. The street, now a private way known as "A" St. is to be 40 ft. wide and is to lie to the south of the above described line.


The street is bounded on the north by "High St. ex- tended" and by lands of Andreotti and Gentilotti, on the west by land of Iadarola, on the south by land of Iadarola and "High St. extended", and on the east by Congress Terrace. The layout is shown on plan titled "Layout Plan of "A" St. (a private way) as an extension of Congress Terrace, Milford, Mass., Jan. 1954, Scale 1"=20" by East- man & Corbett Inc. Civil Engineers.

Article 42. The Clerk read the report of Broad Street.


Broad Street


Beginning at an iron pin in the southerly line of Med- way St., said pin is located S. 69 degrees, 34 minutes, 33 seconds East 687.52 ft. from a Worcester County highway bound situated near 55 Medway St.


Thence running South 15 degrees, 22 minutes, 03 sec- onds, East 660 ft. to a stake. The street is to be 40 ft. wide and is to lie to the east of the above described line.


The street is bounded on the east by lands of Tocchi, Papelian, Besozzi and Mancuso; and on the west by lands of Lombardi, Benotti, Carney, Tusoni, Bianchi, Bibbo, Hynes and an unknown owner. The layout is shown on a plan titled "Layout Plan of Broad Street, Milford, Mass., Jan. 1954, Scale 1" == 40', by Eastman & Corbett, Inc. Civil Engineers, Milford, Mass.


Voted: That the Town vote to accept as a public way a private way known as Broad Street.

Extension of Hale Avenue


Beginning at a stake in the westerly line of La Voie Ave., which stake is located N. 17 degrees, 2 minutes W., 255 ft. from a drill hole in a stone in a wall.


Thence running S. 73°-08' W. 220 ft. to a stake at the south west corner of land of one Gulino.


The street, now a private way known as Hale Avenue, is to be 40 ft. wide and is to lie to the north of the above described line. It is bounded on the south by lands of one Alphonse and one Gulino and on the north by lands of DePaolo and Kellett.


The layout is shown on a plan titled "Layout Plan of an extension of Hale Ave., Milford, Mass., Feb. 1954, Scale 1"=20', by Eastman & Corbett Inc., Civil Engineers, Mil- ford, Mass.


Voted: That the Town vote to accept as a public way a private way known as Extension of Hale Avenue.


Article 46. Voted: That the Town raise and ap- propriate the sum of Twenty-five hundred ($2500.00) dol- the construction of Hale Avenue Extension.

Voted: That there being a substantial shortage of rental housing accommodations in Milford and that controls of rent is in the public interest and that the town vote to continue in effect "An Act relative to Rent Control" for a period of nine months from June 30, 1954, in accordance with the provisions of Chapter 434 of the Acts of 1953, adopted by the Town of Milford, on July 21, 1953, and to raise and appropriate the sum of Four thou- sand seven hundred and eighty-one ($4781.00) dollars to be expended for the maintenance and salaries incidental to the operation of this office.

At this time a motion was made and seconded that the Moderator and a committee of eight (8) to be appointed by him, be authorized and directed to prepare rules of proce- dure by which the Town Meetings shall be governed: Such committee to report to the next Annual Town Meeting.


Article 53. A motion was made and seconded to raise and appropriate the sum of Twenty-five hundred ($2500.00) dollars for the purpose of making passable that portion of Mt. Pleasant Street running from a point opposite 86 Mt. Pleasant Street to the intersection of Mt. Pleasant Street and Central Streets a distance of approximately 650 ft. The motion was lost by a voice vote.
