VOTED: That the Selectmen be, and hereby are, auth- orized and empowered in the name and on behalf of the Town to ac- quire in fee, by eminent domain, or by purchase, from the Lincolns- field Realty Trust, for conservation purposes, a certain parcel of land in Lincoln lying northeasterly of the Concord Turnpike and southwesterly of North Great Road and adjoining land of the Town, containing approximately 45 acres, as shown on plan entitled "Pro- posed Recreation and Conservation Area in Lincoln, Mass. ", dated June 2, 1965, Cleverdon, Varney & Pike, Civil Engineers, to be recorded with the Middlesex South District Registry of Deeds and for said purposes to expend from monies in the Conservation Fund established pursuant to the vote of the Town under Article 13 of the 1961 Annual Town Meeting the sum of $24, 500. 00; and that the Se- lectmen be and hereby are authorized to make application to the U. S. Housing and Home Finance Agency, under Title VII of the Housing Act of 1961, for a grant to acquire open space land, and to execute such other documents as may be necessary to obtain such a grant.


Article 11. To determine whether the Town will vote to acquire for conservation and recreational purposes by eminent do- main, purchase, or in any other way, from Sandy Pond Trust, a certain parcel of land on the northeast side of the Concord Turn- pike, containing 16 acres, more or less, and for such purposes to expend a sum of money from the Conservation Fund established pursuant to the vote of the Town under Article 13 of the 1961 Annual Town Meeting.

Article 12. To determine whether the Town will vote to transfer the balance of $3, 975.50 in the Weston Road account, vo- ted under Article 16, at the Annual Town Meeting, held on March 16, 1964, to an account for repairs to Tower Road, or take any oth- er action relative thereto.

Article 13.


To determine whether the Town will author- ize the Selectmen to accept $115, 000 from the Trustee under the

Will of John H. Pierce, as modified by court decrees relating there- to, and to give a release, on behalf of the Town, to said Trustee of all claims arising under said Will, said sum to be used by the Se- lectmen as provided in said Will as modified, or take any other ac- tion relative thereto.


VOTED: That the Town authorize the Selectmen to ac- cept $115, 000 from the Trustee under the Will of John H. Pierce, as modified by court decrees relating thereto, and to give a release, on behalf of the Town, to said Trustee of all claims arising under said Will, said sum to be used by the Selectmen as provided in said Will as modified.


Article 14. To determine whether the Town will vote to amend the Town By-Law pertaining to a Celebration Committee, by striking out the amendment voted under Article 21 at the Annual Town Meeting on March 22nd, 1965, and substituting the following: "That the Town amend its By-Laws by adding a new section estab- lishing a Celebration Committee, to consist of five members to be appointed by the Board of Selectmen: two for one year, two for two years, and one for three years; thereafter, as each term expires, a successor shall be appointed for a three-year term. "


VOTED: That the General By-Laws of the Town be amended by striking out the amendment voted under Article 21 of the Annual Town Meeting held on March 22, 1965, and substituting the following: That the Town amend its General By-Laws by adding a new section establishing a Celebration Committee, to consist of five members to be appointed by the Board of Selectmen: two for one year, two for two years, and one for three years; thereafter, as each term expires, a successor shall be appointed for a three - year term.

M. for the tran- saction of all business, except that the election of such officers and the determination of such matters as by law are required to be elected or determined by ballot shall take place on the following Saturday, when the polls shall be open from 8 o'clock A. M. until 7 o'clock P. M. or to such later time up to 8 o'clock P. M. as the

Pursuant to a Warrant duly served, the meeting was called to order by the Moderator, Mr. Charles Y. Wadsworth, at 7:45 o'clock P. M. The return of the Warrant was read, and, a quo- rum being present, the following business was transacted.


Article 1. To determine whether the Town will vote to ap- prove or disapprove the amount of indebtedness, namely, $315, 000, authorized by vote of the Lincoln-Sudbury Regional District School Committee on June 4th, 1965, for the purpose of constructing and equipping additions to the existing Regional School buildings, or pass any vote, or take any action relative thereto. VOTED: That the Town approve the amount of indebt- edness, namely $315, 000, authorized by vote of the Lincoln-Sudbury Regional District School Committee on June 4th, 1965, for the pur- pose of constructing and equipping additions to the existing Regional School buildings.


The Meeting was adjourned at 8:20 P. M.


SPECIAL TOWN MEETING November 1, 1965


Pursuant to a Warrant duly served, the meeting was called to order at 7:38 P. M. by the Moderator, Mr. Charles Y. Wads - worth. The return of the Warrant was read and the invocation giv- en by the Rev. Charles M. Styron. A quorum being present, the following business was transacted:


Article 1. To determine whether the Town will vote to instruct the Water Board to provide for the development of a well field by the installation of a well or wells, pipes, pumping station,

pumping equipment, including appropriate control facilities and in- terconnections with and at the pressure reservoir and existing pump- ing station at Sandy Pond, and water mains of less than 16 inches on certain land, as specified in Article 35 of the 1965 Annual Town Meet- ing, and to raise and appropriate a sum of money therefor, a por- tion to be taken from balances in the account voted under Article 36 of the 1965 Annual Town Meeting, and determine whether the re- mainder shall be provided for by borrowing under Authority of Gen- eral Laws, Chapter 44, Section 8, Clause (5), or take any other ac- tion relative thereto.


VOTED: That the Town instruct the Water Board to provide for the development of a well field by the installation of a well, or wells, pipes, pumping station, pumping equipment, includ- ing appropriate control facilities and interconnections with and at the pressure reservoir and existing pumping station at Sandy Pond, and water mains of less than 16 inches on certain land as specified in Article 35 of the 1965 Annual Town Meeting, and to raise and ap- propriate the sum of $70, 000. 00 therefor, and to meet said appro- priation, the Treasurer, with the approval of the Selectmen, be and hereby is, authorized to borrow the sum of $70, 000.00, or such les- ser amount as may be necessary, and to issue bonds or notes of the Town therefor, under the provisions of General Laws, Chapter 44, Section 8, Clause (5), so that the whole loan shall be paid in not more than 15 years from the date of issue of the first bond or note.


Article 2. To determine whether the Town will vote to instruct the Water Board to lower the intake pipe in Sandy Pond, and, for this purpose, increase the Water Department Water Supply expense account #953, to raise and appropriate a sum of money therefor, or take any other action relative thereto.


VOTED: That the Town instruct the Water Board to lower the intake pipe in Sandy Pond, and for this purpose, increase the Water Supply expense account, raise and appropriate the sum of $5, 000. 00 therefor, $2, 000. 00 to be taken from Water Department Surplus, and $3, 000. 00 from Water Department Revenue.


Article 3. To determine whether the Town will vote to increase the Water Department water transmission expense account #954, to raise and appropriate a sum of money therefor, a portion to be taken from the balance in the truck purchase account under Article 34 of the 1965 Annual Town Meeting, or take any other ac-

tion relative thereto.


VOTED: That the Town increase the Water Depart- ment transmission expense account #954, raise and appropriate the sum of $4, 000. 00 therefor, $983.52 to be taken from the balance in the Water Department truck account, $2, 516. 48 from Water De- partment Surplus, and $500. 00 from Water Department Revenue.


Article 4. To determine whether the Town will vote to instruct the Selectmen and Water Commissioners to petition the General Court to rescind Chapter 438 of the Acts of 1911, and pro- vide that all the water in Sandy Pond be reserved for the use of the Town of Lincoln.


VOTED: That the Town authorize the Selectmen and Water Commissioners to petition the General Court to rescind Chapter 438 of the Acts of 1911, and provide that all the water in Sandy Pond shall be reserved for the use of the Town of Lincoln.


Article 5. To determine whether the Town will vote to transfer a sum of money from the Ball Field repair account, voted under Article 19 of the 1965 Annual Town Meeting to an account for development of the DiPerna Recreational Area, or take any other action relative thereto.


VOTED: That the Town transfer $1, 400.00 from the Ball Field repair account, voted under Article 19 of the Annual Town Meeting of 1965, to an account for the development of the Di- Perna Recreational Area.


Article 6.


To determine whether the Town will vote to release to Lincoln Development Corporation all its rights, title and interest in and to a certain fifty (50) foot right of way marked "Right of Way" on a plan entitled "Todd Pond, Lincoln, Mass., Lincoln Associates, Owner", dated May 21, 1963, revised to Aug- ust 21, 1963, by Gordon E. Ainsworth & Associates, Registered Land Surveyors, Engineers and Landscape Architects, duly re- corded with Middlesex South District Registry of Deeds in book 10342, page 290, insofar as said fifty (50) foot right of way abuts parcel 33, as shown on said plan, or take any other action relative thereto.


VOTED: That the Town for the consideration of one dollar release to the Lincoln Development Corporation all its rights, title, and interest in and to a certain fifty (50) foot wide right of way marked "Right of Way" on a plan entitled "Todd Pond,

Lincoln, Mass., Lincoln Associates, Owner", dated May 21, 1963, revised to August 21, 1963, by Gordon E. Ainsworth & Associates, Registered Land Surveyors, Engineers and Landscape Architects, duly recorded with Middlesex South District Registry of Deeds in Book 10342, Page 290, insofar as said fifty (50) foot right of way abuts Parcel 33, as shown on said plan, on condition that the Town receive an easement for passage by bicycle, on horseback and on foot, in form satisfactory to the Planning Board.


Article 7. To determine whether the Town will accept as a Town way a portion of Todd Pond Road from station 00 at Lincoln Road to station 22+69 at the intersection of a private way shown as Short Hill Road on a plan entitled "Todd Pond, Lincoln, Mass., Lincoln Associates, Owners", Gordon E. Ainsworth & Associates, Registered Land Surveyors, recorded in Middlesex South District Registry of Deeds, Book 10342, page 290; and to de- termine whether the Town for this purpose will authorize the Board of Selectmen to acquire by eminent domain, purchase, or other- wise, the land therein contained, or take any other action relative thereto.

To determine whether the Town will accept as a Town way Meadowbrook Road from South Great Road to and including the turnaround as shown on a plan entitled "Plan Showing Subdivision of Land in Lincoln, Mass., Owned by Stella A. Giles", Snelling, Hilton & Associates, Surveyors, dated March 21, 1963, recorded in Middlesex South District Registry of Deeds, Book 10309, page 432; and to determine whether the Town for this purpose will authorize the Board of Selectmen to acquire by eminent domain, pur- chase, or otherwise, the land therein contained, or take any other action relative thereto.

Nylander, Surveyors, dated Nov- ember 19, 1964, being Land Court plan #20706E, recorded in Mid- dlesex South District Registry in Book 683, page 196, with certifi- cate of title #110746; and to determine if the Town for this purpose will authorize the Board of Selectmen to acquire by eminent domain, purchase, or otherwise, the land therein contained, or take any oth- er action relative thereto.
