This paragraph or any amendment thereof shall not apply to a building in existence when this By-Law becomes effective provided the lot upon which it stands is not subsequently diminished in area or width or front- age; nor shall it apply to a lot described in a deed, or shown on a plan, duly recorded in the Plymouth County Registry of Deeds when this By-Law or any amend- ment to this paragraph becomes effective, provided that if at such time there was other contiguous land of the same owner which might be used in connection with such lot, such land shall be so used to the amount required to constitute a lot of the area and frontage prescribed in this paragraph, and such lot shall not subsequently be diminished in area or frontage below the requirements herein stated. In the case of any lot so described or shown in said Registry of Deeds, to which there is not sufficient other land of the same owner contiguous and capable of use to constitute a lot of the area and frontage prescribed in this para- graph, the owner may erect and maintain one, but not more than one building, other than accessory buildings, on such lot. Under Article 39, Voted, that the Town install water mains not less than 6 inches in diameter on Acorn, Franklin, Lincoln, and Temple Streets in North Dux- bury in accordance with an agreement between the Town Water Committee of 1951 and the Water Com- missioners of Marshfield at a distance of 8,000 ft. more or less. And raise and appropriate $8,000.00 and in addition appropriate from available funds in the Treasury the sum of $15,000.00 for this purpose and that the Board of Selectmen be and is hereby author- ized to expend such appropriation or as much as is needed and to enter into an agreement with the Water Commissioners of Marshfield to complete this work.

REPORT OF SPECIAL TOWN MEETING At High School Auditorium
Friday, January 4, 1952, at 8:00 P. M.
At 8:05 o'clock the meeting was called to order by the Moderator, Mr. William W. McCarthy. The invo- cation was given by Rev. Herman F. Lion. A quorum was declared present and the warrant was read by the Town Clerk.
There being no objection, the Moderator declared that proponents on any article in the warrant should be given opportunity to speak on the question being voted upon before the article was tabled, as in previous meetings.
John E. Lucey, Helen F. Dawes, Gilbert F. Redlon and Barclay J. Woodward III were appointed Tellers and were sworn in by the Moderator. The voting list showed that 241 names of registered voters had been checked, 100 being a quorum.
Under Article 1, it was voted that the Town of Dux- bury purchase a certain parcel of land situated on the Southerly side of St. George St. East of the Library, and shown on the Town of Duxbury Assessor's Map as Lots R 12 B and R 12 C, and raise and appropriate the sum of $12,000.00 for the purpose of purchasing this land.
Vote (Yes 144 No 65).
Under Article 2, there was no action taken as there are no unpaid bills.
At 8 :45 P. M. it was voted to adjourn.

REPORT OF SPECIAL TOWN MEETING At Elementary School Cafeteria
Friday, June 27, 1952, at 8 P. M.
At 8:15 P. M. the meeting was called to order by the Moderator, Mr. William W. McCarthy. The Lord's Prayer was repeated by the assembly. A quorum was declared present and the warrant was read by the Town Clerk.
There being no objection, the Moderator declared that proponents on any article in the warrant should be given opportunity to speak on the question being voted upon before the article was tabled, as in previous meetings.
J. Alvin Borgeson, Helen F. Dawes, Rodney W. Leach, Harry A. McNaught, Gilbert F. Redlon, Con- stance L. Webb and Frank H. Williams were appointed Tellers and were sworn in by the Town Clerk. The voting list showed that 290 names of registered voters had been checked, 100 being a quorum.
Under Article 1, it was voted that the Town clarify the action taken under Article 39 at the annual Meet- ing in the following manner:
That the Selectmen be and are hereby authorized to do all things necessary and proper to furnish water on the following streets in the North Dux- bury area-namely, Franklin Street, Temple Street, Lincoln Street, Acorn Street, and to make the necessary connection with the existing water main on Walnut Street in the Town of Marshfield.
Under Article 2, it was voted that the Town appro- priate the sum of $36,250.00 for the construction of two

Sea Walls at Duxbury Beach as described in the Acts of 1952 and that to meet said appropriation the sum of $18,125.00 be transferred from available funds in the treasury ; and that the Treasurer with the approval of the Selectmen, be and hereby is authorized to bor- row the sum of $18,125.00 and to issue bonds or notes of the Town therefor payable in accordance with the provisions of Chapter 44 of the General Laws so that the whole loan shall be paid in not more than ten years from the date of issue of the first bond or note; said sums to be used in conjunction with the sum of $72,- 500.00 appropriated by the State and $36,250.00 ap- propriated by the County, for the construction of the aforesaid Sea Walls; and voted that the sum of $18,- 125.00 be assessed against the properties protected by the Sea Walls over a ten year period as provided in the Acts of 1952.

Under Article 3, it was voted that the Town appro- priate from available surplus funds now in the Treas- ury the sum of $5,000.00 to be used with $12,000.00 hereby transferred, as recommended by the Finance Committee, from the Duxbury Harbor Dredging Ap- propriation Project appropriation, together with $8,- 000.00 to be contributed by the Duxbury Yacht Public Works, for the purpose of enlarging the basin at Mat- takeeset Court.
Under Article 4, it was voted to assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as amended by Chapters 516 and 524, Acts of 1950, for all damages that may be incurred by work to be performed by the Department of Public Works of Massachusetts for the improvement, develop- ment, maintenance and protection of tidal and non- tidal rivers and streams, harbors, tidewater, fore- shores and shores along a public beach outside of Bos-

ton Harbor, including the Merrimack and Connecticut Rivers, in accordance with Section 11 of Chapter 91 of the General Laws and authorize the Selectmen to exe- cute and deliver a bond of Indemnity therefor to the Commonwealth.
Under Article 5, it was voted that the Town grant to the Plymouth County Electric Company an easement to erect and maintain from the line which now feeds the Town Hall and the Town Barn a two pole extension to be located off the northerly side of the driveway leading behind the Town Hall and the Unitarian Church.
Under Article 6, it was voted that the Selectmen appoint a committee to study the matter of construc- tion of a pier or float at Howlands Landing, or other more suitable sites, and to report their findings at the next Annual Town Meeting.
Under Article 7, it was voted to appropriate from available funds in the treasury the sum of $30.00 to pay an unpaid bill of 1950.
Vote: (Yes 157 No 6).
Under Article 8, it was voted that the sum of $2,- 000.00 be transfered from available surplus funds in the treasury to the Highway Department to be used to repair damage done to the Town roads and highways by the Water District in the repairing and maintaining of old water installations and the laying of new in- stallations; that the cost of this work, including labor and all materials, be billed to the Water district as per agreement between the Water Commissioners and the Board of Selectmen; and that this $2,000.00 be ear- marked for the work described above.

Under Article 1, it was voted that the Town transfer $3,000.00 from funds now available in the Welfare Fund to the Old Age Assistance Fund.
Under Article 2, it was voted that the Town transfer $1,200.00 from funds now available in the Aid to De- pendent Children Fund to the Disability Assistance Fund.
Under Article 3, it was voted that the Town instruct the Moderator to appoint a Committee of seven, in- cluding one member of the School Committee, to fur- ther study, in cooperation with the State School Build- ing Assistance Commission, the future school building

needs and to present preliminary plans and estimates to provide for such needs at or before the next regular Town Meeting; and voted that they appropriate from available funds now in the treasury $5,000.00 for this purpose.
Under Article 4, it was voted that the Town author- ize the School Committee to establish and maintain State-aided vocational education in accordance with the provisions of Chapter 74, General Laws, and Acts amendatory thereto, or dependent thereon, and appro- priated $100.00 from available funds in the treasury for this purpose.
Under Article 5, voted as amended, that the Town appropriate $4,000.00 from available funds in the treasury, to be used by the School Committee for the purpose of making the stage in the High School Audi- torium meet the State Safety regulations, and instruct the Moderator to appoint a committee of five, to work in co-operation with the School Committee, to study further the stage needs for additional equipment, and report it's findings and recommendations not later than the Annual Town Meeting in March, 1953.
Vote: (Yes 202 No 96).
