In the name of the Commonwealth you are hereby directed to notify and warn the inhabitants of the Town of Braintree, qualified to vote in elections, to meet at the polling places in their respective Pre- cincts, to wit:

On Tuesday, the sixth day of November, 1934, at five forty-five o'clock in the forenoon, then and there to bring in to the Wardens of their respective Pre- cincts, their votes on the official ballot for Governor; Lieutenant Governor; Secretary; Treasurer; Auditor ; Attorney General; Senator in Congress; Representa- tive in Congress; Councillor; Senator; Representative in General Court; District Attorney; Clerk of Courts; Register of Deeds; One County Commissioner; Two Associate County Commissioners; Register of Probate and Insolvency.

QUESTION NO. 1.


LAW SUBMITTED UPON REFERENDUM PETITION


Shall a law described as follows :-


This law amends General Laws, Chapter 131, as previously amended, by repealing section 105A thereof and adding thereto three new sections, 105B, 105C, and 114A.


Section 105B provides that whoever uses any trap or other device for capture of fur bearing animals, which is not designed to kill such animal at once or to take it unhurt and which is likely to cause con- tinued suffering to an animal caught therein, shall be

fined fifty dollars, but traps or other devices for pro- tection of property, set not more than fifty yards from any building, cultivated plot or enclosures used for rearing poultry or game birds, to the use of which the presence of vermin may be detrimental, are ex- cluded from the application of this section.


Section 105C provides for the submission to the voters at a municipal election in any city or town upon petition, of the question of whether the opera- tion of Section 105B shall be suspended or if it has been already suspended, of the question whether it shall again be operative in such city or town.


Section 114A provides that the Commissioner of Conservation may suspend the operation of Section 105B for a period not exceeding Yes No thirty days within any specified ter- ritory under the control of his de- partment.


The law also provides for the submission by the selectmen to the voters at a special town meeting in the current year, upon petition, of the question as to whether the provisions of section 105B shall be sus- pended in any Town, and which was approved by both branches of the General Court by vote not re- corded, be approved ?


QUESTION NO. 2.


To obtain a full expression of opinion, voters should vote on both of the following questions :


(a) If a voter desires to permit the sale of any and all alcoholic beverages in this town he will vote "YES" on both questions.


(b) If he desires to permit the sale of wines and malt beverages only herein, he will vote "No" on question 1 and "Yes" on question 2.

WARRANT FOR SPECIAL TOWN MEETING COMMONWEALTH OF MASSACHUSETTS


Norfolk, ss. To either of the Constables of the Town of Braintree.


Greeting :


In the name of the Commonwealth of Massachu- setts, you are hereby directed to notify and warn the inhabitantss of the Town of Braintree, qualified to vote in Town affairs, to meet at the Town Hall, in said Braintree.


On Friday, the ninth day of November, 1934, at seven forty-five o'clock in the evening, to act on the following articles, namely :-


ARTICLE 1. To see if the Town will accept the bequest from the Estate of AVIS A. THAYER, late of Braintree, in accordance with the terms as stated in her will.


ARTICLE 2. To see if the Town will vote to ratify the issue of $150,000 Sewer Bonds and the execution of a grant agreement with the United States of America under the vote of the Town passed under Article of the Warrant for a Special Town Meeting held November 27, 1933.


ARTICLE 3. To see if the Town will vote to ac- cept the lay-out of OLD NORTH STREET, as laid out by the Selectmen, according to plans prepared by the Department of Public Works and on file with the Town Clerk of Braintree.

ARTICLE 4. AMENDMENT TO BY-LAWS. To see if the Town will vote to alter and revise Section 2 of Article 10 of the By-Laws of the Town of Brain- tree, to read as follows:


1. Before any opening or obstruction is made in, or any materials are placed on, a public way or a way under control of the Town of Braintree, either by a department of the Town or a private individual or corporation, application for a permit shall be made to the Board of Selectmen, upon forms provided by the Board of Selectmen for that purpose.


2. Before such permit is granted, an applicant other than town department shall file a bond in a sum satisfactory to the Board of Selectmen, conditioned upon the faithful discharge and performance of every duty and requirement imposed by statute, by law of the Town or regulation of the Board of Select- men applicable thereto, and upon conformance to all directions of the Superintendent of Streets relating to the work to be done under such permit, and upon the payment of all expense and damage incurred by the Town or recovered from it by reason of or in connec- tion with such occupation, opening or work.


3. Permits will designate the points where open- ings may be made in or the materials may be placed on the streets and where entry may be made into the public works of the Town, in accordance with what the Selectmen shall consider for the best interest of the Town and the preservation of its streets. No de- partment, person or corporation shall open a street at any point not designated in such permit.


4. Inasmuch as the proper resurfacing of the streets cannot be done immediately after an opening has been made and closed, all applicants will be re-

quired to make a payment at the time of application, of a sum equal to $3.00 per square yard of surface of street to be opened under the permit applied for, to cover the expense to the Town of subsequent re- surfacing of the street, provided, however, that de- partments of the Town and public service corpora- tions may be excused from making prior payment upon satisfactory assurance being given that the above amount will be paid, or an amount equal to the cost of said resurfacing ..


ARTICLE 5. To see what sums of money, in ad- dition to amounts already appropriated, the Town will vote to raise and appropriate for the Fire De- partment.


ARTICLE 6. To see what sums of money, in ad- dition to amounts already appropriated, the Town will vote to raise and appropriate for the Police De- ARTICLE 7. To see what sums of money in ad- dition to amounts already appropriated, the Town will vote to raise and appropriate for the Welfare Department.


ARTICLE 8. To see what sums of money, in ad- dition to amounts already appropriated, the Town will vote to raise and appropriate for the Soldiers' Relief.

ARTICLE 13. To see what sums of money, in ad- dition to amounts already appropriated, the Town will vote to raise and appropriate for unpaid bills of 1932-1933.


ARTICLE 14. To see what sums of money, in ad- dition to amounts already appropriated, the Town will vote to raise and appropriate for EXPENSES OF ELECTIONS AND REGISTRATIONS.


ARTICLE 15. To see if the Town will vote to raise and appropriate a sum of money for the use of the Sewer Department to be taken from the Sewer Assessment Reserve Fund, or take any action relative thereto.


ARTICLE 16. To see if the Town will vote to raise and appropriate a sum of money for the House Sewer Connection Working Account, or take any ac- tion relative thereto.


ARTICLE 17. ON PETITION. To see if the Town will vote to raise and appropriate a sum of money to pay Clarence R. Bestick for supervision, materials, and trucking furnished by him on behalf of the Town in connection with C. W. A. Project No. 812, or take any action thereon.

ARTICLE 18. To see if the Town wll vote to raise and appropriate a sum of money from the in- come and revenue of the Water Department of the Town of Braintree for the general operating expenses of the Town; and to see if the Town will vote to authorize the Water Commissioners to transfer the said sum of money to the Town Treasurer to be used to defray the general operating expenses of the Town, or take any other action relative thereto.


ARTICLE 19. To see if the Town will vote to , raise and appropriate a sum of money from the in- come and revenue of the Electric Light Department of the Town of Braintree for the general operating expenses of the Town; and to see if the Town will vote to authorize the Electric Light Commissioners to transfer the said sum of money to the Town Treasu- rer to be used to defray the general operating ex- penses of the Town, or take any action relative thereto.


ARTICLE 20. RESOLVE. WHEREAS, The finan- cial and economic disturbance of 1932 having ad- justed itself, and there being no necessity to continue further the drastic reduction in salaries of employees of the Town of Braintree, and WHEREAS, it being the policy of both Federal and State Governments to restore salary reductions :


BE IT RESOLVED, That the Town of Braintree, in its Special Town Meeting essembled, vote to follow the policy of both Federal and State Governments in sal- ary restoration and do hereby proclaim no further necessity exists to warrant the continuance of salary reduction and do hereby vote to restore all salaries in the various divisions, including the full comple- ment of permanent officials and employees of the Town of Braintree, as of January 1st, 1935.

You are directed to serve this warrant by posting true and attested copies thereof in three public places in each voting precinct in said Town of Braintree ten days at least before said ninth day of November, 1934, and by publishing the same one each week for two successive weeks in the Braintree Citizen, first publi- cation to be at least eight days before said meeting.


Hereof fail not, and make due return of this war- rant, with your doings thereon, to the Town Clerk before said meeting.

SPECIAL TOWN MEETING


November 9, 1934.


A Special Town Meeting was called to order at 7:52 P. M. by Moderator William F. Rogers. There was a quorum of voters present.


Mr. Grady stated that: Because of the short space . of time the Finance Committee have had this War- rant for their consideration, I move : An adjournment of this meeting until one week from Monday night, November 19, 1934.


Mr. Mooney offered the following amendment: That the adjournment be for one hour instead of one week from Monday night, that the Finance Commit- tee retire and have the report here in one hour.


The vote on the amendment as made by Mr.


Mooney being doubted, the Moderator appointed the following to act as tellers: Messrs. Baker, Jenkins, Patten, Spring, Cummings, Gillette, Bryant, and Greenough.
