Article 40. On Petition. To see if the Town will vote to accept as and for a Town Way, PORTER AVENUE, so-called, running in a west- erly and northerly direction from Glendale Road; as laid out by the Select- men; and raise and appropriate a sum of money for the improvement of said way under a W. P. A. Project, or take any action relative thereto.

PARK DEPARTMENT


Article 43. To see what sums of money the Town will vote to raise and appropriate for the general uses of the Board of Park Commissioners, or take any action relative thereto.


CEMETERIES


Article 44. To see what sums of money the Town will vote to raise and appropriate for the improvement of the Cemetery, or take any action relative thereto.


SCHOOLS AND LIBRARIES


Article 45. To see what sums of money the Town will vote to raise and appropriate for the support of the Public Schools, or take any other action relative thereto.


Article 46. To see if the Town will vote to raise, or borrow, and ap- propriate sums of money for the purpose of constructing, furnishing, and equipping an addition to the High School, and for the making of additions, alterations and repairs to the present building, and to obtain authority to use land necessary for said purposes, and to authorize the Treasurer, with the approval of the Selectmen, to borrow all, or any part of, said sums, in accordance with the provisions of any general or special acts authorizing the Town to borrow for said purpose, or take any other action relative thereto.


Article 47. To see if the Town will vote to set aside for school pur- Doses as part of the Highlands School grounds, under the control of the School Committee, such portions of lots A and B, on a plan prepared by the Town Engineer, dated January 15, 1941, and on file in his office, as may be now. or hereafter, acquired by the Town through tax title foreclosure proceedings, or take any other action relative thereto.


Article 48. To see if the Town will raise and appropriate a sum of money for the purpose of erecting a suitable fence on the Westerly, North- erly and Easterly boundaries of the Jonas Perkins School grounds, or to take any other action relative thereto.


Article 49. To see what sums of money the Town will vote to raise and appropriate for the Public Library, or take any action relative thereto.


SOLDIERS BENEFITS


Article 50. To see what sums of money the Town will vote to raise and appropriate for Soldiers' Relief, State Aid and Military Aid, or take any action relative thereto.

Article 51. To see if the Town will vote to raise and appropriate a sum of money for the Observance of Memorial Day, or take any action relative thereto.


PUBLIC WELFARE


Article 52. To see what sums of money the Town will vote to raise and appropriate for the Public Welfare Department, including Aid for De- pendent Children, and Adequate Assistance to Certain Aged Persons under the provisions of Chapter 118A, Acts of 1931; or take any action relative thereto.


MISCELLANEOUS


Article 53 To see if the Town will vote to raise and appropriate a sum of money in addition to sums of money already appropriated, to cover the Town's share for materials, trucking and other necessary expenditures in connection with W. P. A. activities or other Special Aid projects in con- junction with State or Federal Government; or take any action relative thereto.


Article 54. To see what sums of money, in addition to that appro- priated under any other article, the Town will vote to raise or borrow and appropriate for Land Damages.


Article 55. To see if the Town will vote to raise and apropriate a sum of money for the payment of printing and distribution of the Annual Report of the Town of Braintree for 1940.


Article 56. To see what distribution the Town will vote to make of the income of the Thayer Fund.


Article 57. To see what sums of money the Town will vote to raise and appropriate for the expenses of the Planning Board, or take any ac- tion relative thereto.


Article 58. TO SEE IF THE TOWN WILL VOTE TO ACCEPT THE GIFT OF THE BRAINTREE HIGHLANDS NEIGHBOR- HOOD CLUB IN THE AMOUNT OF $2000.00 AND LAND OF ES- TIMATED VALUE-$1500.00, subject to the provisions of said gift and to see if the Town will vote to raise and appropriate the sum of $3500.00 to fulfill the provisions of said gift; or take any action relative thereto.


Article 59. To see what action the Town will take relative to the ac- ceptance and disposition of a bequest of $50,000 00 received under the pro- visions of Paragraph 3 of Article 8 of the Will of the Late Ellis Hollings- worth.


Article 60. To hear the report of the Committee appointed under Article 75 of the Annual Town Meeting of 1940; and to see if the Town will vote to raise and appropriate a sum of money for the purchase or taking by Eminent Domain of certain lands for Parking Places in the busi- ness centers of the Town, or take any action relative thereto.


Article 61. To see if the Town will vote to amend the By-Laws by substituting for Article 11A of the 1925 revision, a new article to be known as 13A BUILDING CODE, the substance of said article to be the Build- ing Code as revised by the committee for that purpose and contained in its report now on file with the Town Clerk, or take any action relative thereto.


Article 62. To see what sums of money the Town will vote to raise and appropriate to meet the payment of certain bills contracted prior to January 1st, 1941, or take any other action relative thereto.

Article 63. To see if the Town will vote to raise and appropriate a sum of money for the care and maintenance of property acquired by the Town under Tax Title Foreclosure Procedure, or take any other action relative thereto.


Article 64 To see if the Town will vote to authorize and direct the Assessors to use any sum or sums of money from Free Cash toward the reduction of the 1941 tax rate.


Article 65. To see if the Town will vote to sell and convey to James A. Jensen a certain parcel of land, including approximately 56,000 square feet, as shown on a plan drawn by the Town Engineer and dated January 8th, 1941, in lieu of any sums which may be due from the Town to said Jensen, on account of a Taking by the County Commissioners, for the widening of Liberty Street; or take any action relative thereto.


Article 66. To see if the Town will vote to accept a bequest under Article Fourteen of the will of James W. Colbert providing a sum of $25,- 000 for the purpose of building a unit to the Josephine B. Colbert School, or take any other action relative thereto.


Article 67. To see if the Town will vote to accept the bequest under Article Sixteen of the will of James W. Colbert providing the residue of said estate to be used for a building, books, and other equipment of a public library, to be known as the Colbert Public Library, upon the terms and conditions set forth in said will, or take any other action relative thereto.


Article 68. To see if the Town will vote to authorize the appointment of a committee to study the necessity for, and report possible locations, for the establishment of a new Highway Department Garage; or take any ac- tion relative thereto.


Article 69. To see if the Town will vote to lease to the Government of the United States of America for the term of one year from October 18, 1940, and from year to year thereafter, two small rooms on the second floor of the Police Station, for Selective Service Headquarters-Local Board No. 39, for the sum of $6.00 per month; and authorize the Selectmen to execute on behalf of the Town, a lease for that purpose; or take any other action relative thereto.


Article 70 To see if the Town will vote to amend Article XIII of the By-Laws by adding thereto the following section:


Section 18: No person or corporation shall erect or maintain a bill- board, sign or other outdoor advertising device, except as provided in Sec- tion 32 of Chapter 93 of General Laws, on any location within three hun- dred feet of any public park or playground or Metropolitan Park or Park- way, if within public view from any portion of such parks, playgrounds or parkways; or within three hundred feet of any other public way and within public view from any portion of the same, if such billboard, sign or device exceeds five feet in height or eight feet in length, and no billboard, sign or device placed within three hundred feet of any such public way and within public view shall be nearer than fifty feet to any other such billboard, sign or device; or at the corner of any public ways and within the radius of one hundred and fifty feet from the point where the center lines of such ways intersect; or in any place unless the lowest portion of such billboard, sign or device is at least three feet from the ground, and the entire structure, including its braces and supports, is maintained in good repair, painted, and free from accumulation of rubbish and filth and from the pupae, eggs and caterpillars of gypsy and brown-tail moths and other tree and shrub de- stroying pests; provided that this section shall not apply to signs or other devices which advertise or indicate either the person occupying the prem- ises in question or the business transacted thereon, or advertise the prop- erty itself or any part thereof as for sale or to let.

Article 71. To see if the Town will vote to amend the Zoning By- Law and the Zoning Map dated May 2, 1940, by providing that the follow- ing described areas shall be included in either the Industrial or Business Zones :-


1. An area bounded easterly by Quincy Avenue; northerly by the Quincy City Line; westerly by Howard and Shaw Streets; and southerly by a line parallel to and 100 feet distant from the northerly side line of Dewey Road.


2. An area bounded northerly by the Quincy City Line; easterly by Howard Street; southerly by a line running in a westerly direction from the junction of Howard and Shaw Streets; and westerly by a line parallel to and 200 feet distant from the westerly side line of Howard Street; or take any action relative thereto.


Article 72. To see if the Town will vote to amend the Zoning By- Law and the Zoning Map dated May 2, 1940, by providing that Lots No. 1, 2, and 3 located between Independence Avenue, and Center Street and adjoining the Traffic circle at the intersection of said streets, shall be a business district instead of a Residence B. district as originally designated on said map; or take any other action relative thereto.


Article 73. To see if the Town will vote to amend the Zoning By- Law and the Zoning Map dated May 2, 1940, by providing that the area within 200 feet on either side of the center line of the Fore River Branch line R. R. shall be included in the Industrial Area or take any other action relative thereto.


Article 74. To see if the Town will vote to amend the Zoning By- Law and the Zoning Map dated May 2, 1940, by providing that the follow- ing described areas originally designated on said map as a Business Dis- trict shall be a Residence B. District ;- the areas on both sides of Granite Street between the Town Line of Braintree and Quincy and a line formed by the northerly sideline of Chickatawbut Road and the projection thereof, said areas being 100 feet in depth except for the portion on the westerly side of Granite Street lying between said northerly sideline of Chickatawbut Road and a line 190 feet northerly thereof and parallel thereto, said portion being 180 feet in depth; or take any action relative thereto.


Article 75. To see if the Town will vote to authorize the installation of a Water Main on Olympia Avenue, South Braintree, approximately 530 feet southerly from the end of the present 6" main on Oregon Avenue; or take any action relative thereto.


Article 76 On Petition. To see if the Town will vote to raise and appropriate a sum of money to construct and maintain during the current year, toilet facilities at the bathing beach at Sunset Lake, or take any other action relative thereto.


Article 77. On Petition. To see if the Town will, as a W. P. A. pro- ject or otherwise, erect a safety island in South Braintree Square.


Article 78. On Petition. To see if the Town will raise and appropri- ate the necessary sums to erect traffic signals at these points; Grove and Liberty Streets-Plain and Grove Streets-Granite and Pond Streets.


Article 79. On Petition. To see if the Town will, as a W. P. A. pro- ject, widen Pearl Street at the point where the Monatiquot River crosses, to a width of 50 feet.


Article 80. On Petition. To see if the Town will authorize the Mod- erator to appoint a committee of not less than seven persons to consider the matter of consolidating into one department and to be known as the

Dept. of Public Works, the following departments; Engineering, Highway, Water, Sewer, Tree Warden and Moth, and to report their recommenda- tions at the next annual meeting.


Article 81. On Petition. To see if the Town will vote to provide ad- ditional Police protection in the Braintree Highlands section of Braintree, and raise and appropriate a sum of money for the same; or take any action relative thereto.


Article 82. On Petition. To see what action the Town will take on the report of the Committee appointed pursuant to a vote of the 1937 An- nual Meeting under Article 68 to consider a War Memorial; and to see what sum of money the Town will vote to raise and appropriate for a me- morial to commemorate the services and sacrifices of the men and women of Braintree who served in the Spanish and World Wars, or take any ac- tion relative thereto.


Article 83. On Petition. To see if the Town will vote to raise or borrow and appropriate a sum or sums of money to construct an enclosed Athletic field on the Hollis Field, so-called, to be known as the World War Memorial Stadium or to provide the sponsor's contribution on a W. P. A. or other Federal Aid Project for the same purpose, or take any other ac- tion relative thereto.


Article 84. On Petition. To see if the Town will vote to authorize the Selectmen to permit the use of the Allen Street Fire Station by the Braintree Post, V. F. W., after the abandonment of said premises by the Fire Department, said premises to be used only at the risk and expense of said Post.


Article 85. On Petition. To see if the Town will vote to construct a Skating Rink on Watson Park, and raise and appropriate a sum of money for the construction of the same; or take any action relative thereto.


Article 86. On Petition. To see if the Town will vote to purchase, at a price not to exceed $3000.00, or take by Eminent Domain, a parcel of land with the buildings thereon, being shown as Lot No. A-5 on Land Court Plan No. 2986-k, for the purpose of maintaining a Branch of the Thayer Public Library thereon; or take any action relative thereto. .


You are directed to serve this Warrant by posting true and attested copies thereof in one or more public places in each Voting Precinct in said Town of Braintree, ten days at least before said third day of March, 1941, and by publishing the same once each week for two successive weeks in the "Braintree News-Item," the first publication to be at least eight days before said meeting.


Hereof fail not, and make due return of this Warrant with your doings thereon, to the Town Clerk, before said meeting.
