the first ten signers of a referendum petition asking for the repeal of an emergency law or of a law which takes effect because the referendum petition does not contain a request for suspension, and shall print at the top of each blank a fair, concise summary of the proposed law as such summary will appear on the ballot together with the names and residences of the first ten signers.

This article of amendment to the Constitution of Massachusetts annuls Article VIII of section 1 of chapter II of Part the Second of the Constitu- tion, which vested the Gvoernor, by and with the advice of the Council with the full and unrestricted power of pardoning offeners of which a person is convicted, except such as persons may be convicted of before the Senate by an impeachment of the House, and adopts a new Article VIII in place thereof.


This new Article VIII vests the pardoning power in the Governor, by and with the advice of the Council, but provides further that if the offence to be pardoned is a felony the Legislature shall have power to prescribe the terms and conditions upon which a pardon may be granted.

Shall a law described as follows: This law amends chapter 271 of the General Laws by striking out section 22A, as previously amended, and insert- ing in place thereof a new section 22A, which provides that conducting or promoting a game of whist or bridge in connection with which prizes are offered to be won by chance, or allowing such a game to be conducted or promoted, shall not authorize the prosecution, arrest or conviction of any person for such acts under chapter 271 of the General Laws, which deals with crimes against public policy, if the entire proceeds of the charges for admis- sion to such game are donated solely to charitable, civic, educational, fraternal or religious purposes. Greetings:


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Braintree, qualified to vote in Town Affairs, to meet at the Town Hall, in said Braintree on Monday, the twenty-seventh day of November, 1944, at seven forty-five o'clock in the evening, to act on the following articles, namely :


Article 1. To see if the Town will raise and appropriate or transfer from available funds a sum of money for the purpose of providing Adequate Assistance to Certain Aged Persons under the provisions of Chapter 118A, General Laws; or take any action relative thereto.

WHEREAS; petitions have been filed with the State Secretary, in the interest of Francis E. Kelley, of Boston, Democratic candidate for the office of Attorney General, and Clarence A. Barnes, of Mansfield, Republican candi- date for the office of Attorney General for state-wide recounts of ballots cast at the election held November 7, 1944, for the office of Attorney General, under the provisions of General Laws, chapter 54, section 135, as amended ; and


WHEREAS, after official tabulation of votes by the Governor and Council it appears that the difference in the number of votes cast for the two leading candidates for said office of Attorney General is less than one per cent of the total number of votes cast for such office ;


THEREFORE, under the provisions of said section 135, as amended, it becomes my duty to, and I do hereby order the clerk of cach city and town of the Commonwealth to transmit forthwith, and said clerk shall so transmit, the envelopes containing the ballots, sealed, to the registrars of the city or town who shall, without unnecessary delay, open the envelopes, recount the ballots cast for said office and determine the questions raised.
