REPORT OF THE TOWN CLERK


ANNUAL TOWN MEETING-MARCH 12th, 1951


The Annual Business Meeting in the Town of Chelmsford was held in the High School Auditorium on March 12, 1951, at 7:30 P. M. with Judge John H. Valentine presiding as Moderator and Harold C. Petter- son, Town Clerk.


The first business to be transacted was the election of a Member of the Varney Playground Commission. Clifford Hartley was elected to serve for a term of three years.


UNDER ARTICLE ONE:


To hear reports of Town Officers and Committees:


Edward Krasnecki reported for the Committee appointed to study the Town Manager form of government, and reported that the Com- mittee was appointed last December 1st and had not had time to make a complete report at this time and asked for further time, and it was so voted.


Robert Picken reported for the Committee on a new school at North Chelmsford and stated that his Committee would report at a Special town meeting to be held in the future.


Clifford Hartley reported for the Committee on a new school addi- tion to the High School and stated that his Committee would report at a special town meeting.


Allan Kidder reported for the Committee on a new Fire House at Chelmsford Centre and that the Committee was making progress.


Robert Spaulding reported for the Honor Roll Committee and re- ported that the Committee was taking care of the Honor Roll and that they had expended $25.00 for their work.


On a motion made by Carl A. E. Peterson it was voted to accept the Town Report as printed.

Under Article Three:


On a motion made by Carl A. E. Peterson, it was voted to au- thorize the Selectmen to act as its agent in any suit or suits which may arise during the current year, with authority to settle and adjust claims or demands for or against the Town; and to employ counsel whenever in their judgment it is necessary.


Under Article Four:


On a motion made by Harold C. Petterson, it was voted, that the Treasurer be authorized with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the current financial year beginning January 1st 1951 and to issue a note or notes payable within one year and to renew any note or notes given for a period of less than one year in accordance with Section 17, Chapter 44 of the General Laws.


Under Article Five:


On a motion made by Arnaud R. Blackadar, it was voted to raise and appropriate the sum of $1,023.27 with which to meet unpaid bills of previous years.

Under Article Six:


On a motion made by Theodore W. Emerson, it was voted to raise and appropriate the sum of $3,894.00 to pay to the Treasurer of Mid- dlesex County Retirement System, the said amount being the Town's share of the Pension and Expense Fund.


Under Article Seven:


On a motion made by Warren C. Lahue, it was voted to transfer from the Overlay Reserve Fund the sum of $5,000.00 to be used as a Reserve Fund at the discretion of the Finance Committee as provided in General Laws, Chapter 40, Section 6.


Under Article Eight:


On a motion made by Harold C. Petterson, it was voted, That the Board of Assessors be instructed to deduct the sum of $50,000.00 being less than 50% of the available funds in the Excess and Deficiency Account as of December 31, 1950, from the aggregate of all amounts appropriated, granted or lawfully required by law to be raised by taxation for the fiscal year 1951, pursuant to the provisions of Section 23 of Chapter 59 of the General Laws, as amended by Chapter 104, Section 1 of the Acts of 1949, to reduce the amount of taxes to be assessed and the tax rate for the year 1951.


Under Article Nine:


In regard to the Cemetery Commissioners working in Cemeteries at the rate of $1.10 per hour, it was voted to dismiss this article.


Under Article Ten:


In regard to the Park Commissioners working in the Parks at the rate of $1.10 per hour, it was voted to dismiss this article.


Under Article Eleven:


On a motion made by Carl A. E. Peterson, it was voted to raise and appropriate the sum of $900.00 for the purpose of purchasing two automobiles for the Police Dept .; said purchases to be made under the supervision of the Board of Selectmen.


Under Article Twelve:


On a motion made by Carl A. E. Peterson, it was voted, to trans- fer by good and sufficient bill of sale two automobiles now used by the Police Dept. as part payment for the purchase of two new auto- mobiles for the Police Dept.


Under Article Thirteen:


On a motion made by Arnaud R. Blackadar, it was voted to raise and appropriate the sum of $3,000.00 to meet the Town's share of the cost of Chapter 90, Highway Maintenance.


Under Article Fourteen:


It was voted to dismiss this article, the motion was made by Arnaud R. Blackadar.

On a motion made by T. W. Emerson, it was voted, to raise and appropriate the sum of $4,500.00 to be used for Chapter 90 Con- struction of the Groton Road.


Under Article Sixteen:

Under Article Seventeen:

On a motion made by Warren Wright it was voted to raise and appropriate the sum of $4,000.00 for the purpose of continuing the survey and maps of the Town under the supervision of the Board of Assessors.


Under Article Twenty-Two:


On a motion made by Carl A. E. Peterson, it was voted to transfer the sum of $1,500.00 from the Highway Road Machinery Fund to the account to be called "Purchase of a sand spreader" for the Highway Dept. The purchase to be made under the supervision of the Board of Selectmen.


Under Article Twenty-Three:


On a motion made by Harold C. Petterson, it was voted to raise and appropriate the sum of $2,200.00 for the purpose of installing adequate lighting in the class rooms at the McFarlin School.


Under Article Twenty-Four:


In regard to acquiring a Parking Lot in Chelmsford Center, on a motion made by Arnold C. Perham it was voted to lay this article on the table until the next annual Town Meeting.

Under Article Thirty-One:


On a motion by T. W. Emerson, it was voted to raise and appro- priate the sum of $2,610.05 for the purpose of paying a premium for insurance providing for Workmen's Compensation benefits.


Under Article Thirty-Two:


On a motion by Francis R. Foster, it was voted to raise and appropriate the sum of $1,900.00 for the purpose of installing a plumbing and heating system, water service and cesspool in the American Legion Quarters Post 313 on Gay Street, the installation to be under the supervision of the Board of Selectmen.


Under Article Thirty-Three:


On a motion made by Warren C. Lahue, it was voted to raise and appropriate the sum of $1,500.00 for the purpose of having certain Town records microfilmed.


Under Article Thirty-Four:


On a motion made by Charles D. Harrington, it was voted to raise and appropriate the sum of $1,800.00 for the purpose of pur- chasing a three-quarter ton pickup truck for the Fire Department, said purchase to be made under the supervision of the Board of Fire Engineers.

Under Article Thirty-Five:


On a motion made by Charles D. Harrington it was voted to raise and appropriate the sum of $1,250.00 for the purpose of making re- pairs and repainting former Engine 2 prior to its usage as Engine 4 at East Chelmsford.


Under Article Thirty-Six:


On a motion made by Carl A. E. Peterson, it was voted to au- thorize the Selectmen to grant an easement to the Lowell Electric Light Corp. to locate a pole with wires and cables thereon on the Town owned land in the Crystal Lake area.


Under Article Thirty-Seven:


On a motion made by T. W. Emerson to amend the law regarding sick leave, this motion was lost and the article dismissed.


Under Article Thirty-Eight:


On a motion made by Arnold C. Perham, it was voted to amend the Zoning By-Laws by extending the business area on the westerly side of the Tyngsboro Road from the present boundary northerly to and including the premises now of Mrs. Mabel Syvret at 112 Tyngs- boro Road, the Westerly line to be 200 feet from and parallel to the Tyngsboro Road. 102 voted in the affirmative and 1 voted in the negative.


Under Article Thirty-Nine:


On a motion made by Arnold C. Perham, it was voted to amend the Zoning By-Laws by designating as business area the land on the Easterly side of Tyngsboro Road from the present business area boundary northerly to Sleeper Street, the easterly line to be 400 feet from and parallel to Tyngsboro Road. This vote was unanimous.


Under Article Forty :


On a motion made by Arnold C. Perham it was voted to amend the Zoning By-Laws by designating as industrial area all the land between the B. and M. R. R. tracks and the Merrimack River, bounded on the South by the Lowell City Line and the North by the Tyngsboro Town Line. This vote was unanimous.


Under Article Forty-One:


On a motion made by Arnold C. Perham it was voted to amend the Zoning By-Laws by designating as industrial area all the land bounded by Sleeper Street, the B. and M. R. R. tracks and Wotton Lane and a line 400 feet from and parallel to the Tyngsboro Road.


Under Article Forty-Two:


In regard to work being done on Fletcher Street widening, etc., it was voted to dismiss this article.

REPORT OF THE TOWN CLERK


Under Article Forty-Three:


In regard to acquiring more land for a Parking area in North Chelmsford, it was voted to dismiss this article.


Under Article Forty-Four: It was voted to dismiss this article.


Under Article Forty-Five:


On a motion made by Arnaud R. Blackadar it was voted to amend the present by-laws by changing the time for submitting articles for the warrant at the annual town meeting from January 21 to January 15th. This vote was unanimous.


Under Article Forty-Six:


In regard to making a re-valuation of the real estate in Chelms- ford by an outside firm, it was voted to dismiss this article.


Under Article Forty-Seven: It was voted to dismiss this article.


Under Article Forty-Eight:


On a motion made by Frank H. Hardy, it was voted to accept Section 19 and 24 of Chapter 114 of the General Laws with respect to certain records to be kept by the Town Clerk. It was also voted to raise and appropriate for this purpose $90.00 for the Town Clerk's salary; $300.00 for Clerk Hire and $250.00 for other expenses making a total of $640.00.


Under Article Forty-Nine:


On a motion made by Frank H. Hardy, it was voted to instruct the Town Treasurer to place one-half of the present "Sale of Lots and Graves" account and one-half of the future receipts from Sale of same in a "Cemetery Expansion Fund" account to be invested at interest.


Under Article Fifty:


On a motion made by Arthur W. House it was voted to transfer $200.00 from the Sale of Lots and Graves account in the Cemetery Department, said sum to be used for repairs to Cemetery grounds and historic headstones.


Under Article Fifty-One:


In regard to the acceptance of a portion of Swain Road, it was voted to dismiss this article.


Under Article Fifty-Two:


In regard for funds for Swain Road, it was voted to dismiss this article.

Under Article Fifty-Three:


On a motion made by Arnaud R. Blackadar it was voted to accept a portion of Pine Hill Road as laid out by the Board of Selectmen as shown by their report and plan duly filed in the office of the Town Clerk.


Under Article Fifty-Four:


In regard for funds for Pine Hill Road, it was voted to dismiss this article.


Under Article Fifty-Five:


In regard to the acceptance of Leedberg Street, it was voted to dismiss this article.


Under Article Fifty-Six:


On a' motion made by Leon J. Bisson, it was voted to accept Merilda Avenue as laid out by the Selectmen as shown by their report and plan duly filed in the office of the Town Clerk.


Under Article Fifty-Seven:


On a motion made by Leon J. Bisson, it was voted to accept Bisson Street as laid out by the Selectmen as shown by their report and plan duly filed in the office of the Town Clerk.
