The adjourned Town Meeting was called to order by Moderator Edward J. Desaulnier, Jr. at 7:30 P.M. Nine voters were present, because of the blizzard, which did not constitute a quorum. Chief of Police Ralph J. Hulslander immediately moved adjournment to Monday, March 26, 1956 at 7:30 P.M.

Joseph Lukas moved that the meeting return to Article 1, regard- ing acceptance of the Town Report and particularly the report of the Fire Chief. No action was taken concerning acceptance of the Town Report.


UNDER ARTICLE 7.


On a motion made by Hans H. Schliebus, it was voted to raise and appropriate the sum of $20,000.00 to be used as a Reserve Fund at the discretion of the Finance Committee as provided in General Laws, Chapter 40, Section 6.


Joseph Lukas moved that the meeting take up Article 70 out of order. A hand vote was taken, 103 voted in the affirmative and 65 in the negative.


UNDER ARTICLE 70.


Joseph Lukas moved that the Town order the Board of Selectmen. and other town officials to revoke the permit or license of the ex- plosive company storing explosives in the Town of Chelmsford, because of persistent and continued violation of a by-law. A hand vote was taken, 43 voted in the affirmative, 83 in the negative. The motion failed.


Joseph Lukas moved that the meeting take up Article 69 out of order. The motion failed.


UNDER ARTICLE 8.


On a motion made by Daniel J. Hart, it was voted to instruct the Board of Assessors to use the sum of $100,000.00 from the Free Cash in the Treasury for the reduction of the 1956 Tax Rate.


UNDER ARTICLE 9.


On a motion made by Edgar P. George, it was voted to accept Roberts Street as shown on a plan of said street duly filed in the Office of Town Clerk.


UNDER ARTICLE 10.


On a motion made by Edgar P. George, it was voted to raise and appropriate the sum of $1,500.00 for the purpose of reconstructing Roberts Street.

UNDER ARTICLE 38.


Regarding Wage-Benefits under the Personnel, Wage and Salary Administration By-Law, this article was dismissed.


UNDER ARTICLE 39.


This article was acted upon on March 12, 1956.


UNDER ARTICLE 40.


On a motion made by Bernard F. McGovern, it was voted to raise and appropriate the sum of Twenty-Five Thousand, ($25,000.00) Dollars to be added to money previously appropriated for the pur- pose of building, equipping and furnishing, including architectural fees, a fire station in North Chelmsford.


UNDER ARTICLE 41.


On a motion made by Ralph R. Cole, it was voted to amend the Building Code of the Town of Chelmsford in the following parti- culars:


Article 10, Section 1, Strike out the paragraph under the heading, "Girders or Carrying Timbers", and insert the following paragraph :- "Girders or carrying timbers shall be not less than (6x8) six by eight inches if of built-up or of solid wood. If of structural steel they must be of sufficient size to carry all live and dead loads. All joints shall be made over piers or column supports. When (2x8) two by eight floor joists are required the maximum clear span for (6x8) six by eight wood girders shall be eight feet for one story dwellings and seven feet for one and one-half story dwellings. When (2x10) two by ten floor joists are required not less than a (6x10) six by ten wood girder shall be used and the maximum clear span for (6x10) six by ten wood girders shall be eight feet for one story dwellings and seven feet for one and one-half story dwellings." This vote was unanimous.


UNDER ARTICLE 42.


On a motion made by Ralph R. Cole, it was voted to amend the Building Code of the Town of Chelmsford in the following parti- culars :


Article 10, Section 1, Strike out the paragraph, under the heading "Studding" and insert the following paragraph: - "All outside wall and carrying partitions must be of (2x4) two by four studding set on (16) sixteen inch centers, or the equivalent of the same.


Plates on all outside and bearing partitions must be doubled.


All door, window and other openings must have studs doubled on the jambs.


Lintel or headers over all openings shall be doubled.


Span for lintel or header shall not exceed the following for size given: -

Two 2x4's on edge - 3' - 6" Maximum span.


Two 2x6's on edge - 4' - 6" Maximum span.


Two 2x8's on edge - 6' - 0" Maximum span.


Two 2x10's on edge - 7' - 6" Maximum span.


Two 2x12's on edge - 9' - 0" Maximum span.


Headers for, spans of over nine (9) feet will be allowed if satis- factory engineering data is submitted by the builder, to the Building Inspector.


Where headers support concentrated loads or are subjected to other unusual conditions, the header shall be specially designed. This vote was unanimous.


UNDER ARTICLE 43.


Regarding the printing of Building Code Books, this article was dismissed.


UNDER ARTICLE 44.


On a motion made by Ralph R. Cole, it was voted to amend the Building Code of the Town of Chelmsford in the following parti- culars :


Article 6, After Section 3, add the Following: "Section 4. Size of Dwellings. No single family dwelling one story in height shall have a finished floor area of less than 1000 square feet. No single family dwelling more than one story in height shall have a finished first floor area of less than 800 square feet, plus a second floor area of not less than 300 square feet. Of the second floor area at least 150 square feet shall have a head room of not less than 7 feet. No duplex house shall have a floor area of less than 1000 square feet including the stairways, per family unit". At the written request of 12 voters, a secret ballot was taken, 131 voted in the affirmative, 101 in the negative.


UNDER ARTICLE 45.


On a motion made by Ralph R. Cole, it was voted to amend the Building Code of the Town of Chelmsford in the following parti- culars :


Article 8, Section 2, Strike out paragraph one (1) and insert the following paragraph: - "All dwellings, breezeways, porches and at- tached garages, must have a foundation wall which extends (42) forty-two inches below the finished grade, including the footing. Foundations walls if of poured concrete shall be not less than (16) sixteen inches in thickness for fireproof, semi-fireproof, and heavy timber buildings, and not less than (12) twelve inches for masonry, or masonry veneered buildings, and not less than (10) ten inches in thickness for ordinary, or wood frame Buildings not exceeding two stories, and also for one story masonry buildings. This vote was unanimous.

UNDER ARTICLE 46.


On a motion made by Warren C. Lahue, it was voted to amend the building code of the Town of Chelmsford in the following parti- culars :


Article 8, Section 2, Strike out paragraph four (4) and insert the following paragraph: "All hollow masonry foundation walls shall not be less than twelve (12) inches thick except one story porches and garages which shall be not less than 8" thick. Foundation walls of approved hollow masonry units shall be provided with not less than (4) four inches of solid masonry at girder bearings, or shall be strengthened with buttresses".


This vote was unanimous.


UNDER ARTICLE 47.


On a motion made by Ralph R. Cole regarding foundation walls, this article was dismissed.


UNDER ARTICLE 48.


On a motion made by Ralph R. Cole, it was voted to amend the Building Code of the Town of Chelmsford in the following parti- culars :


Article 10, Section 2, Strike out paragraph 2, and insert the follow- ing paragraph: - "all corner posts shall be not less than (4"x6") four by six inches, solid, starting at the sill and braced by not less than (1) one by four (1x4) inch diagonal braces cut into the studs or by equivalent construction satisfactory to the building inspector." This vote was unanimous.


UNDER ARTICLE 49.


On a motion made by Ralph R. Cole, it was voted to amend the Building Code of the Town of Chelmsford in the following parti- culars :


Article 10, Section 1, under the heading "Roof Rafters", Paragraph 4, Strike out the following sentence - "Collar beams must be used on every second rafter where spans exceed those in above table". This vote was unanimous.


UNDER ARTICLE 50.


This article was acted upon on March 12, 1956.


UNDER ARTICLE 51.


It was voted to dismiss this article regarding sidewalks in the Golden Cove Rd. area.


UNDER ARTICLE 52.


On a motion made by Edgar P. George, it was voted to request the Department of Corporations and Taxation, Division of Accounts

of the Commonwealth of Massachusetts to make an audit of all accounts in all departments in the Town of Chelmsford, Massachu- setts.


ARTICLE 53.


On a motion made by Frank H. Hardy, it was voted to appropriate and transfer from the SALE OF LOTS & GRAVES ACCOUNT, the sum of three hundred ($300.00) dollars for the purpose of beauti- fying the entrance to Heart Pond Cemetery in South Chelmsford and the erection of a new sign at entrance of the West Chelmsford Cemetery.


UNDER ARTICLE 54.


On a motion made by Daniel J. Hart, it was voted to raise and appropriate the sum of $4,000.00 for the purpose of purchasing three 1956 Tudor Police Cruisers, said purchase to be under the supervision of the Board of Selectmen.

On a motion made by Daniel J. Hart, it was voted to authorize the Selectmen to sell by good and sufficient Bill of Sale, the two 1955 automobiles now used by the Police Department.


UNDER ARTICLE 56.


It was voted to dismiss this article regarding overtime pay for cemetery superintendent.


UNDER ARTICLE 57.


It was voted to dismiss this article regarding purchase of several small parcels of land at the corner of Fletcher and Chelmsford Sts.


UNDER ARTICLE 58.


On a motion made by Daniel J. Hart, it was voted to appoint a committee, to be comprised of the following-mentioned persons; Warren C. Lahue, William M. Burns, Edward Hoyt, Frederick R. Greenwood, the Superintendent of Streets, and Henry B. Mauti, to study plans and specifications, and costs for the construction of a new highway garage on land purchased by the Town in 1955 on Richardson Road and to appropriate the sum of Fifteen Hundred ($1,500.00) Dollars for the purpose of securing costs, plans, sur- veys and all other expenses necessary to complete the report of said committee which shall make its report at the next Town Meet- ing following the completion of its work.


UNDER ARTICLE 59.


It was voted to dismiss this article regarding a committee study- ing the advisibility of taking land on North Road between the Fire Station and Town Hall.

UNDER ARTICLE 60.


This article was acted upon on March 12, 1956.


UNDER ARTICLE 61.


On a motion made by Richard P. Delmore, it was voted to trans- fer to the jurisdiction of the Park Department the following des- cribed parcel of land: Starting from a cement post located approxi- mately six (6) feet from the easterly side of Carlisle Street in an easterly direction sixty (60) feet then in a southerly direction sixty- four (64) feet then in a westerly direction sixty-three (63) feet to a concrete post and then in a northerly direction parallel to Car- lisle Street sixty-six (66) feet to the point of beginning.


UNDER ARTICLE 62.


On a motion made by Richard P. Delmore, it was voted to raise and appropriate the sum of Five Hundred ($500.00) Dollars for the purpose of repairing the Monument and Flag Pole located on the land described in Article 61, and relandscaping and beautifying said described land.


UNDER ARTICLE 63.


On a motion made by Thomas Malloy, it was voted that Walter I. Bell, Jr. registered Funeral Director and licensed Embalmer be granted a re-building permit in order to practice the profession of funeral directing and to maintain a funeral home at 5 North Road, Chelmsford, Massachusetts.
