ANNUAL TOWN REPORT


UNDER ARTICLE 46:


Mr. Warren Lahue moved that the Town vote to amend Section IB (7) of the Zoning By-Law and the map accompanying said section and on file with the Clerk of the Town of Chelmsford, "Chelmsford, Mass .- Zoning District Map, 1956", by removing from Limited Industrial District the following described premises and amend Section IB (2) of said sec- tion by including the following described premises as Single Residence A-2 District (RA-2), Beginning at a point on the easterly side of Garrison Road at land of one Helen E. Parkhurst; thence northwesterly along the easterly line of Garrison Road 846.63 feet to land of Chelmsford Drive-In, Inc., thence northeasterly along land of Chelmsford Drive-In, Inc. 507.92 feet to other land of Chelmsford Drive-In, Inc .; thence still by land of Chelmsford Drive-In, Inc. 778.15 feet to land of Helen E. Parkhurst; thence southwesterly by land of one Parkhurst 474.53 feet to the easterly line of Garrison Road and point of beginning. Beginning at a point on the westerly side of Garrison Road at land of Sy D. UNDER ARTICLE 47:


Mr. Edgar P. George moved that the Town vote to convey, by a good and sufficient quitclaim deed, to George M. Zaher, for the sum of One Dollar ($1.00) a certain parcel of land with the buildings thereon situated in said Chelmsford on the northerly side of Davis Road, bounded and described as follows: Beginning at the northwesterly corner of the granted premises on Davis Road, thence running northeasterly 316.34 feet to a drill hole in the wall, thence turning and running southeasterly by a stone wall 98.13 feet to a drill hole in said wall, thence still south- easterly 62.57 feet to a drill hole in a wall, thence turning and running easterly by said stone wall 125 feet to the westerly side of a ten (10) foot right of way, thence turning and running southwesterly along said westerly side of said ten foot right of way 284.25 feet to Davis Road, thence turning and running along said Davis Road northwesterly 460 feet to the point of beginning. This was so voted.


ARTICLE 48. To see if the Town will vote to amend the Building Code of the Town of Chelmsford by striking therefrom Article III, Sec- tion 1, Paragraph 2 and substituting therefor the following language: The Building Inspector shall make at least three inspections of each in- dustrial, commercial and residential building, including attached and ac- cessory buildings. One of these inspections shall be made after the found- ation, the first or grade floor framing and its rough floor have been completed. Until after this inspection has been made and the approval of the Building Inspector given of the work done to this point, the ex- cavation shall not be backfilled. Another inspection shall be made after the building is structurally completed or enclosed, but before any wall or ceiling interior covering has been applied over the studs or joists. Another inspection shall be made when the building is ready for sale or occupancy. Such inspections shall be made within 48 hours after notice is received Sundays and holidays excepted.


UNDER ARTICLE 48:


Mr. Raymond J. Greenwood moved that the Town vote to amend the Building Code of the Town of Chelmsford by striking therefrom the lan- guage in Article III, Section 1, Paragraph 2 and substituting therefor the following language: The Building Inspector shall make at least three inspections of each industrial, commercial and residential building, in- cluding attached and accessory buildings. One of these inspections shall be made after the foundation, the first or grade floor framing and its rough floor have been completed. Until after this inspection has been made and the approval of the Building Inspector given of the work done to this point, the excavation shall not be backfilled. Another inspection shall be made after the building is structurally completed or enclosed, but before any wall or ceiling interior covering has been applied over the studs or joists. ARTICLE 49. To see if the Town will vote to adopt the following By-Law: All contractors, builders, companies, corporations, or individuals who promote the construction of multiple houses, housing units, develop- ments, or the erection of three or more houses in a given area shall be required to plant one tree for each lot and two trees for every corner lot; such plantings shall be done before the street is paved and must be in accordance with the specifications as prescribed by the Chelmsford Tree Warden.


UNDER ARTICLE 49:


Mr. Myles Hogan moved that the Town vote to adopt the following By-Law: All contractors, builders, companies, corporations or individuals who promote the construction of multiple houses, housing units, develop- ments or the erection of three or more houses in a given area shall be required to plant one tree for each lot and two trees for every corner lot; such plantings shall be done before the street is paved and must be in accordance with the specifications as prescribed by the Chelmsford Tree Warden. This was so voted.


ARTICLE 50. To see if the Town will vote to raise and appropriate the sum of Five Thousand Dollars ($5,000.00) for the purpose of estab- lishing a Stabilization Fund under the provisions of Chapter 40, Section 5B of the General Laws, for use in the purchasing of Fire Department automotive equipment; or act in relation thereto.


UNDER ARTICLE 50:


Mr. Robert F. McAndrew moved that the Town vote to raise and appropriate the sum of Five Thousand Dollars ($5,000) for the purpose of establishing a Stabilization Fund under the provisions of Chapter 40, Section 5B of the General Laws, for use in the purchasing of Fire De- partment Automotive equipment. It was so voted unanimously.


ARTICLE 51. To see if the Town will vote to authorize the Board of Selectmen to raze the buildings in the rear of the Chelmsford Town Hall formerly used by the Highway Department and to sell, by a good and sufficient bill of sale, such salvage as may be derived therefrom; or act in relation thereto.


UNDER ARTICLE 51:


Mr. Edgar P. George moved that the Town vote to authorize the Board of Selectmen to raze the buildings in the rear of the Chelmsford Town Hall formerly used by the Highway Department and to sell, by a good and sufficient bill of sale, such salvage as may be derived there- from. This was so voted.


ARTICLE 52. To see if the Town will vote to amend the Zoning By-Law by adding thereto after Sub-section (e) of Section 9, Paragraph 3, the following Sub-sections to be known as (f), (g) and (h) :

UNDER ARTICLE 53:


Mr. Edgar P. George moved that the Town vote to accept Lauderdale Road as Lauderdale Road as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the office of the Town Clerk, and appropriate the sum of $130.00 for the construction of said way. This was so voted.


ARTICLE 54. To see if the Town will vote to accept Lancaster Avenue as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk; and to raise and appropriate, or transfer from available funds, a certain sum of money for the purpose of reconstructing Lancaster Avenue; or act in relation thereto.


UNDER ARTICLE 54:


Mr. Edgar P. George moved that the Town vote to accept Lancaster Avenue as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk, and appropriate the sum of $85.00 for the construction of said way. This was so voted.


ARTICLE 55. To see if the Town will vote to accept Murray Hill Road as laid out by the Board of Selectmen, and shown by their report

Mr. Edgar P. George moved that the Town vote to accept Murray Hill Road as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the office of the Town Clerk, and appropriate the sum of $900.00 for the construction of said way. This was so voted.


ARTICLE 56. To see if the Town will vote to accept Pearson Street as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk; and to raise and appropriate, or transfer from available funds, a certain sum of money for the purpose of reconstructing Pearson Street; or act in relation thereto.


UNDER ARTICLE 56:


Mr. Raymond J. Greenwood moved that the Town vote to accept Pearson Street as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk, and appropriate the sum of $108.00 for the construction of said way. This was so voted.


ARTICLE 57. To see if the Town will vote to accept Oriole Street as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk; and to raise and appropri- ate, or transfer from available funds, a certain sum of money for the purpose of reconstructing Oriole Street; or act in relation thereto.


UNDER ARTICLE 57:


Mr. Edgar P. George moved that the Town vote to accept Oriole Street as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk, and appropriate the sum of $600.00 for the construction of said way. This was so voted.


ARTICLE 58. To see if the Town will vote to accept McFarlin Road as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk; and to raise and appropriate, or transfer from available funds, a certain sum of money for the purpose of reconstructing McFarlin Road; or act in relation thereto.


UNDER ARTICLE 58:


Mr. Robert F. McAndrew moved that the Town vote to accept McFarlin Road as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk, and appropri- ate the sum of $500.00 for the construction of said way. This was so voted.

Mrs. Robert F. McAndrew moved that the Town vote to accept Balsam Drive as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk, and appropriate the sum of $85.00 for the reconstruction of said way. This was so voted.


ARTICLE 60. To see if the Town will vote to accept Gail Street as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk; and to raise and appro- priate, or transfer from available funds, a certain sum of money for the purpose of reconstructing Gail Street; or act in relation thereto.


UNDER ARTICLE 60:


Mr. Raymond J. Greenwood moved that the Town vote to accept Gail Street as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk, and appropriate the sum of $135.00 for the construction of said way. This was so voted.


ARTICLE 61. To see if the Town will vote to accept Arbutus Avenue as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk; and to raise and appropriate, or transfer from available funds, a certain sum of money for the purpose of reconstructing Arbutus Avenue; or act in relation thereto.


UNDER ARTICLE 61:


Mr. Raymond J. Greenwood moved that the Town vote to accept Arbutus Avenue as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk, and appropriate the sum of $145.00 for the construction of said way. This was so voted.


ARTICLE 62. To see if the Town will vote to accept Hickory Lane as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk; and to raise and appro- priate, or transfer from available funds, a certain sum of money for the purpose of reconstructing Hickory Lane; or act in relation thereto.


UNDER ARTICLE 62:


Mr. Edgar P. George moved that the Town vote to accept Hickory Lane as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk, and appropriate the sum of $100.00 for the construction of said way. This was so voted.

To see if the Town will vote to accept Kensington Drive as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk; and to raise and appropriate, or transfer from available funds, a certain sum of money for the purpose of reconstructing Kensington Drive; or act in relation thereto.


UNDER ARTICLE 64:


Mr. Raymond J. Greenwood moved that the Town vote to accept Kensington Drive as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk, and appropriate the sum of $300.00 for the construction of said way. This was so voted.


ARTICLE 65. To see if the Town will vote to accept Harold Street as laid out by the Board of selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk; and to raise and appropriate, or transfer from available funds, a certain sum of money for the purpose of reconstructing Harold Street; or act in relation thereto.


UNDER ARTICLE 65:


Mr. Edgar P. George moved that the Town vote to accept Harold Street as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk, and appropriate the sum of $200.00 for the construction of said way. This was so voted.


ARTICLE 66. To see if the Town will vote to accept Beech Street as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk; and to raise and appro- priate, or transfer from available funds, a certain sum of money for the purpose of reconstructing Beech Street; or act in relation thereto.


UNDER ARTICLE 66:


Mr. Raymond J. Greenwood moved that the Town vote to accept Beech Street as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk, and appropri- ate the sum of $900.00 for the construction of said way. This was so voted.

To see if the Town will vote to accept Colonial Ter- race as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk; and to raise and appropriate, or transfer from available funds, a certain sum of money for the purpose of reconstructing Colonial Terrace; or act in relation thereto.


UNDER ARTICLE 67:


Mr. Raymond J. Greenwood moved that the Town vote to accept Colonial Terrace as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk, and appropriate the sum of $870.00 for the construction of said way. This was so voted.


ARTICLE 68. To see if the Town will vote to accept Marose Ave- nue as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk; and to raise and appropri- ate, or transfer from available funds, a certain sum of money for the purpose of reconstructing Marose Avenue; or act in relation thereto.


UNDER ARTICLE 68:


Mr. Robert F. McAndrew moved that the Town vote to accept Marose Avenue as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk, and appropriate the sum of $800.00 for the construction of said way. This was so voted.


ARTICLE 69. To see if the Town will vote to accept Edgelawn Avenue as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk; and to raise and appropriate, or transfer from available funds, a certain sum of money for the purpose of reconstructing Edgelawn Avenue; or act in relation thereto.


UNDER ARTICLE 69:


Mr. Robert F. McAndrew moved that the Town vote to accept Edge- lawn Avenue as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk, and appropri- ate the sum of $400.00 for the construction of said way. This was so voted.


ARTICLE 70. To see if the Town will vote to instruct the Board of Assessors to use the sum of Two Hundred Thousand Dollars ($200,000.00), or some other sum, from Free Cash in the Treasury for the reduction of the 1960 Tax Rate; or act in relation thereto.


UNDER ARTICLE 70:


Mr. Schliebus moved that the Town vote to instruct the Board of Assessors to use the sum of $180,000. from Free Cash in the Treasury for the reduction of the 1960 Tax Rate. This was so voted.

To Ralph J. Pederson, Constable, or any other suitable person of the Town of Chelmsford:


GREETING:


In the name of the Commonwealth aforesaid, you are hereby required to notify and warn the legal voters of said Chelmsford to meet in the New High School Gymnasium, Chelmsford Center, on Monday, the twenty-eighth day of March, 1960, at eight-fifteen o'clock in the evening, then and there to act on the following article, viz:


ARTICLE I. To see if the Town will vote to accept the provisions of Chapter 136, Section 4B, of the General Laws of the Commonwealth of Massachusetts, relative to the granting of licenses for the operation of bowling alleys on the Lord's day between the hours of one and eleven post meridian; or act in relation thereto.


AND YOU ARE DIRECTED to serve this Warrant by posting attested copies thereof at the Post Offices in Chelmsford Center, South Chelmsford, North Chelmsford and West Chelmsford, and at the School- house in East Chelmsford and the Westlands Schoolhouse, seven days, at least, before the time appointed for holding the meeting aforesaid.
