Mr. Paul J. Whipple moved that the Town take no action under Article 88.


Mr. Benjamin B. Brewster moved to amend the motion of Mr. Whipple by substituting the following: That the Town raise and appropriate the sum of $1,900 for the purchase of a 1/2-ton pickup truck by the Water Commissioners.

Article 89. To see if the Town will authorize the Water Commissioners to enter into all necessary contracts to lay water mains of not less than 6" in diameter and to do such other acts or things as may be necessary to supply Town water along the so-called Darby Road westerly from the end of the present main for a distance of approximately three miles and to purchase necessary material therefor and enter into all necessary contracts and to do such other acts and things in respect thereto as may be necessary to supply Town water to the Inhabitants in the above-mentioned territory and to make an appropriation therefor. To meet the appropriation, the Town Treasurer with the approval of the Selectmen, be authorized to borrow a sum sufficient to meet the cost thereof and to issue therefor bonds or notes of the Town pay- able in accordance with Section 19, Chapter 44 of the General Laws, as amended, so that the whole loan shall be paid in not more than fifteen (15) years after the date of the issuance of the first bond or note, or at such earlier date as the Treas- urer or Selectmen may determine. Article 90. Article 91. To see if the Town will vote to raise and appropriate the sum of $1,500 to take exploratory borings at and adjacent to the bulkhead near the Town Wharf.

Article 92. To see if the Town will vote to raise and appropriate the sum of $25,000 to construct a plank bulkhead about 250 feet in length adjacent to the Town Wharf; said funds to be spent in conjunction with funds to be provided by the Commonwealth of Massachusetts, the Town to assume liability as provided by Section 29, Chapter 91, as amended, for damages incurred hereunder.


The Committee recommends an appropriation of $25,000. The total estimated cost of this project is $50,000, of which $25,000 is to be allotted by the Commonwealth.

Article 93. To see if the Town will vote to raise and appropriate the sum of $4,500 to be spent in conjunction with sums to be provided by the State or County, or both, for the ยท construction of waterfront protection at Massasoit Shores in Ellisville and that to meet said appropriation the sum of $2,250 be appropriated from the tax levy of the current year and $2,250 from money in the Town Treasury received from the abutters; the Town to assume liability as provided by Section 29, Chapter 91 of the General Laws, as amended, for all damages incurred hereunder.


The Committee recommends an appropriation of $4,500, provided $2,250 of this appropriation is deposited with the Town Treasurer by the abutters before town meeting. The total estimated cost of this project is $18,000, $9,000 to be allotted by the Commonwealth and $4,500 by the County.

Article 95. To see if the Town will vote to raise and appropriate the sum of $1,500 to be spent in conjunction with

sums to be provided by the State or County, or both, for the construction of stone mounds or riprap on both sides of Bartlett Brook easterly from the bridge at Taylor Avenue; the Town to assume liability as provided by Section 29, Chapter 91, as amended, for damages incurred hereunder.


The Committee recommends an appropriation of $750. The total estimated cost of this project is $3,000, $1,500 to be allotted by the Commonwealth and $750 by the County.


Voted: That the Town raise and appropriate the sum of $750, to be spent in conjunction with sums to be provided by the State or County, or both, for the construction of stone mounds or riprap on both sides of Bartlett Brook easterly from the bridge at Taylor Avenue, the Town to assume li- ability as provided by Section 29, Chapter 91, as amended, for damages incurred hereunder.


Article 96. To see if the Town will assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as amended, by Chapters 516 and 524, Acts of 1950, for all damages that may be incurred by work to be performed by the Department of Public Works of Massachu- setts, for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores and shores along a public beach out- side of Boston Harbor, including the Merrimack and Con- necticut Rivers, in accordance with Section 11 of Chapter 91 of the General Laws, and to authorize the Selectmen to ex- ecute and deliver a bond of indemnity therefor to the Com- monwealth.


The Committee recommends favorable action.


Voted: That the Town assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as amended by Chapters 516 and 524 of the Acts of 1950, for all damages that may be incurred by work to be performed by the Department of Public Works of Massachusetts, for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores and shores along a public beach outside of Boston Harbor, including the Merrimack and Connecticut Rivers, in accordance with Section 11 of Chapter 91 of the General Laws, and to authorize the Selectmen to execute and deliver a bond of indemnity therefor to the Commonwealth.


At 10:40 p.m. on motion of Mr. James T. Frazier, it was voted to adjourn until Wednesday, March 28th, at 7:30 p.m.

ADJOURNED TOWN MEETING, MARCH 28, 1956


The Meeting was called to order by the Moderator at 7:30 p.m.


Article 97. To see if the Town will vote to amend the Zoning By-Laws to revise the provisions of Article VI to redefine frontage and area.


The Committee recommends that Article VI(a) of the Zonns By-Law be amended by substituting in place thereof the following, as approved by the Planning Board:


"(a) Lot Frontage and Area)


Any dwelling hereafter erected or placed in any district shall be located on a lot having a frontage of not less than 80 feet and an area of not less than 10,000 square feet, provided that one dwelling may be erected on a lot having a lesser frontage of area where said lot existed and' was shown upon a plat or plan duly recorded with the Plymouth County Registry of Deeds at the time the original Zoning By-Law became effective, and provided further that there shall be 10,000 square feet of area for each dwelling erected or placed on any one lot in any district and further that no dwelling shall be placed, nor extend, within 20 feet of another dwelling on the same lot.


Notwithstanding the foregoing provisions of this section, one dwelling may be erected on a lot having a frontage of not less than 60 feet and an area of not less than 6000 square feet, where said lot existed and was shown upon a plat or plan duly recorded with the Plymouth County Registry of Deeds at the time this section becomes effective."


Voted (Unanimously) : That the Town amend Article VI (a) of the Zoning By-Law as shown in the printed report of the Advisory and Finance Committee, except that the word "of" in the fifth line should be changed to "or" (typographical error) .


Article 98. To see if the Town will authorize the Plan- ning Board to prepare a revision of the Zoning By-Law, for submission to the Town, with particular reference to the establishment of additional districts, and make an appropri- ation for the study thereof.


Recommendation under this article left to the Planning Board.


Mr. James A. White moved that no action be taken under Article 98.


Mr. Edward Chased moved to amend the motion of Mr. White by a vote of 69 in the affirmative, 48 in the negative, that the Moderator appoint a committee of seven to study the

advisability of revising the Zoning By-Laws, clarifying the language of the By-Laws and otherwise modifying them to meet with any conditions which have changed since original adoption as to provide for modification or change where ex- perience has shown the By-Laws require change, and it was so voted.


Article 99. To see if the Town will vote to amend the Town of Plymouth, Massachusetts, Zoning Map, dated Feb- ruary 1, 1951, changing from a Residence District to a Com- mercial District, all or any part of the area bounded south- erly by Atlantic Street, northerly by Prince Street, westerly by land already zoned as Commercial and easterly by a line 300 feet from the easterly line of Court Street.


The Committee recommends this amendment of the Zoning Map, as approved by the Planning Board, which increases the depth of the commercial area from Atlantic to Prince Street on the easterly side of Court Street from 150 feet to 300 feet.


Voted: 116 in the affirmative, 3 in the negative, that the Town amend the Town of Plymouth, Massachusetts, Zoning Map, dated February 1, 1951, changing from a Residence Dis- trict to a Commercial District, all of the area bounded south- erly by Atlantic Street, northerly by Prince Street, westerly by land already zoned as Commercial and easterly by a line 300 feet from the easterly line of Court Street.


Article 100. To see if the Town will vote to amend the Zoning By-Laws to extend the Commercial zone on Summer Street to include Lots numbered 92, 91, 90, 87, 86, 84 as shown on Plat #19 of the Assessors' Plans or take any action relative thereto. (By Petition)


The Committee recommends no action.


Planning Board has not approved.


Mr. Paul J. Whipple moved that the Town take no action under Article 100.


Mr. William Armstrong moved to amend the motion of Mr. Whipple by substituting the following: That the Town vote to amend the Zoning By-Laws to extend the Commercial zone on Summer Street to include Lots numbered 92, 91, 90, 87, 86, 84 as shown on Plat No. 19 of the Assessors' Plans or take any action relative thereto.


Taken by ballot, 61 in the affirmative, 72 in the negative, the motion to amend was lost. Voted no action.

Article 101. To see if the Town will vote to amend the Zoning Map changing from a residence district to a com- mercial district an area extending from the existing business ' area two hundred (200) feet easterly of the State Highway as measured along the northerly sideline of Manomet Point Road for a distance of approximately five hundred and fifty (550) feet easterly to a depth of six hundred (600) feet, more or less. (By Petition) The Committee recommends no action: Planning Board has not approved.


Voted: That the Town take no action under Article 101.


Article 102. To see if the Town will amend the Zoning By-Law and Zoning Map to change from a residential dis- triet to a commercial district, Lot 8-J on North Spooner Street as shown on Sheet 1 of the Assessors' Map and the remaining portion of Lot 22B on Court Street on said Sheet 1 of the Assessors' map not already zoned as commercial.

The Committee makes no recommendation under this article.


Recommendations of the Planning Board not yet available.


Voted: 122 in the affirmative, 9 in the negative, that the Town amend the Town of Plymouth, Massachusetts, Zoning Map, dated February 1, 1951, by increasing the depth from Court Street of the commercial area of Lot 22B of Plat 1 of the Assessors' Plans from 200 feet to 675 feet.


Article 103. To see what action the Town will take in regard to the expected arrival from England of the replica of the ship "Mayflower" and for the entertainment of dis- tinguished guests and make an appropriation therefor.


The Committee recommends an appropriation of $300 for expenses of a committee to be appointed by the Selectmen to make plans for this event.


Voted: That the Town raise and appropriate the sum of $300 for the expenses of a committee, to be appointed by the Selectmen, to make plans for the arrival from England of the replica of the ship "Mayflower" and for the entertainment of distinguished guests in connection therewith.


Article 104. To see what amount the Town will vote to raise and appropriate to remodel and equip the former taxi-stand now located at the rear of the Memorial Building Parking Lot for use as a public sanitary, information booth with office space and an additional amount for the operation

The Committee recommends an appropriation of $10,500 for construction costs and $275 for maintenance.


Voted: That the Town take no action under Article 104.


Article 105. To see if the Inhabitants of the Town of Plymouth will vote to authorize the Selectmen to grant Plymouth County Electric Company and New England Tele- phone and Telegraph Company an easement covering joint pole locations and wire rights for the lines now serving the Town of Plymouth Parking Area at rear of the Memorial Building and Memorial Drive or take any other action thereon.


The Committee recommends favorable action.


Voted: That the Town authorize the Selectmen to grant the Plymouth County Electric Company and New England Telephone and Telegraph Company an easement covering joint pole locations and wire rights for the lines now serving the Town of Plymouth parking area at the rear of the Memo- rial Building.


Article 106. To see if the Town will vote to name the road between Sandwich Road and the junction of Jordan Road and Russell Mills Road as "Jordan Road."


The Committee recommends favorable action.

Article 107. To see if the Town will vote to accept the provisions of Section 8A of Chapter 40 of the General Laws as established by Chapter 297 of the Acts of 1954 and amended by Chapter 102 of the Acts of 1955, and to establish a devel- opment and industrial commission of 7 members with all the powers and duties thereof as provided in said Section 8A of Chapter 40 of the General Laws.


The Committee recommends no action.

Article 108. To see if the Town will vote to raise and appropriate a sum of money for the purpose of establishing and maintaining a development and industrial commission as provided by Section 8A of Chapter 40 of the General Laws and determine whether the money shall be provided for by taxation or by appropriation from available funds in the Treasury.


The Committee recommends no action.


Voted: That the Town raise and appropriate the sum of $2,000 for economic base survey of the Town, to be done under the present committee.


Article 109. To see what action the Town will take with reference to adopting a by-law regulating the operation of motor boats within the limits of the Town.

Article 110. To see what action the Town will take with reference to revision of the Building By-Laws of the Town of Plymouth.


Recommendation under this article left to the special com- mittee appointed for this purpose.


Voted: That the Town revise the Building By-Laws of the Town of Plymouth by striking out the existing Building By-Laws and substituting in place thereof the Building By- Laws as shown at the end of the printed report of the Advisory and Finance Committee and recommended by the Special Committee appointed to revise them.


Article 111. To see what action the Town will take with reference to revision of the Plumbing By-Laws of the Town and make an appropriation therefor.


Recommendation under this article left to the special com- mittee appointed for this purpose.

Voted: That the Town revise the Plumbing By-Laws of the Town of Plymouth by striking out the existing Plumbing By-Laws and substituting in place thereof the Plumbing By- Laws as shown at the end of the printed report of the Advis- ory and Finance Committee and recommended by the Special Committee appointed to revise them, with the following cor- rections to them:


1. Page 53 - omit "also"


2. Page 57 - insert (b)


3. Page 64 - delete "water in the tank without raising"


Article 112. To see what'action the Town will take on the report and recommendations of the Special Committee authorized under Article 12 at the Special Town Meeting of September 26, 1955 to study and compare the present ad- ministrative organization of the Town with other types, in- cluding any recommended legislation and make an appropri- ation therefor.


The Committee recommends the continuance of this special committee and an appropriation of $300 for expenses.


Voted: That the Town continue the committee, appointed under Article 12 of the Special Town Meeting of September 26, 1955, and to raise and appropriate the sum of $300 for the expenses of said committee.


Article 113. To see what action the Town will take with reference to adopting a by-law to provide that all contracts entered into by the Town or any departments thereof in- volving the expenditure of $1,000 or more, shall prior to ex- ecution be presented to the Town Counsel for approval.


The Committee recommends favorable action.


Voted: That the Town adopt the following by-law:


"All contracts entered into by the Town or any depart- ment thereof, involving the expenditure of $1,000 or more, shall, prior to execution, be presented to the Town Counsel for approval as to form and legality."


Article 114. To see what action the Town will take with reference to adopting a by-law to provide that the Advisory and Finance Committee shall be notified of the existence of any cases of extreme emergency involving the health and safety of persons or property and that all contracts entered into as a result of said emergency shall be submitted to said Advisory and Finance Committee before the execution thereof.


The Committee recommends favorable action.

Article 115. To see if the Town will vote to raise and appropriate the sum of $37,500 for the purpose of establishing a marginal pier and floats for the use of the fishing party boat fleet and general public near the Town Wharf on Water Street and to determine whether the money shall be provided by taxation or by appropriation from available funds in the Treasury or by borrowing in accordance with the terms of Chapter 44 of the General Laws, as amended; said sum to be spent under the direction of the Board of Selectmen in conjunction with a similar sum to be appropriated by the Commonwealth of Massachusetts for the said purposes. -

The Committee recommends that this matter be referred to the Harbor Committee.


Voted: That the Town refer the advisability of establish- ment of a marginal pier and floats for the use of the fishing party boat fleet and general public near the Town Wharf to the special Harbor Committee, appointed under Article 100 of the Annual Town Meeting of March, 1952, for their consider- ation and recommendation to the Town.


Article 116. To see if the Town will vote to eliminate from the deed to the Plymouth Memorial Post No. 1822, Veterans of Foreign Wars of a certain building and land on Spring Street, the clause requiring the reversion of said real estate to the Town in the event that the said Post should cease to use it as Post Headquarters; and to substitute therefor a clause binding on the said Post and all its successors in title to the effect that if the said real estate should ever be taken by the Town in eminent domain proceedings that the damages payable in such event would not exceed the sum of $3,500. (By Petition)


The Committee recommends favorable action.


Mr. Paul J. Whipple moved that the Town take no action under Article 116.


Mr. Thomas F. Quinn moved to amend the motion of Mr. Whipple by substituting the following: That the Town vote to eliminate from the deed, dated May 17, 1950, and recorded with the Plymouth County Registry of Deeds, Book 2111, Page 479, of the Plymouth Memorial Post No. 1822, Veterans of Foreign Wars, to a certain building and land on Spring Street, the clause requiring the reversion of said real estate to the

Town in the event that the said Post should cease to use it as Post Headquarters, and to substitute therefor a clause binding on the said Post and all its successors in title to the effect that, if the said real estate should ever be taken by the Town in eminent domain proceedings, the damages payable in such event would not exceed the sum of $3,500.
