ADJOURNED TOWN MEETING, APRIL 2, 1959


Article 90. To see if the Town will authorize the Se- lectmen to purchase or take by eminent domain the land and buildings thereon between Brewster and North Streets as shown on plan entitled "Proposed Off Street Parking, Site 1, Plymouth, Mass., Scale 1" = 60' for purpose of constructing a public off-street parking facility and to determine whether the Town will appropriate money therefor by taxation, by appropriation from available funds in the Treasury, includ- ing parking meter receipts or by borrowing under Chapter 44 of the General Laws, as amended, or take any action rela- tive thereto.

The Planning Board has disapproved.


By motion of the Traffic Committee that the Selectmen purchase or take by eminent domain for a public off-street parking area, the land with the buildings thereon between Brewster and North Streets, being lots or portion of lots shown on. Plat 20 of the Plymouth Assessors' Plans, as out- lined heavily on plan entitled "Proposed Off-Street Parking Site 1, Plymouth, Mass., Scale 1" = 60', prepared by Bruce Campbell & Associates, Consultant, Boston, Mass." filed with the report of the Parking and Traffic Committee authorized by the annual Town Meeting of March 1958, bounded and de- scribed substantially as follows:


Beginning on the northwesterly side of North Street at land of Besse at the southwesterly line of lot 26A, thence running the following courses and distances, to wit: By said Lot 26A northwesterly 144' to lot 24A southwesterly by lot 24A 42' and northwesterly by lot 24A and lot 25, 108' to land of Kusmin thence by Kusmin land northeasterly 18' and northwesterly 83'; thence by land of Kusmin, Dawson, Chris- tie, Bradley and Russell, northeasterly 180' to Gordon Place thence by Gordon Place and land of Jackson northwesterly 138' to Brewster Street; thence by Brewster Street north- easterly 78'; thence by Jackson land southeasterly 114' to Gor- don Place; thence by Gordon Place northeasterly 186' to Win- slow Street and by Winslow Street southeasterly 18' and again by Gordon Place southwesterly 96' to land of Kellen; thence by Kellen land southeasterly 84' and southwesterly 24' to land of the Mayflower Society, so-called; thence by said Society land 186'; thence by land of Russell and land of Ortolani, southwesterly 110' to Gordon Place; thence south- easterly by Gordon Place 114' to North Street and southwest- erly by North Street 12' and northwesterly by Gordon Place 113'; thence by land of The Plymouth National Bank and of Benea southwesterly 96'; thence still by Benea land south- easterly 102' to North Street and southwesterly by North Street 36' to the point of beginning: all of said measurements being more or less; so much thereof as is shown as lot 9 be- ing property of Hannah Jackson to be subject to a life estate therein in said Hannah Jackson for and during the term of her natural life; and that the Town raise and appropriate for the acquisition of said land $140,000 and to meet said ap- propriation $10,000 be from the current tax levy and the

Town Treasurer with the approval of the Selectmen, be and hereby is authorized to borrow the sum of $130,000, in ac- cordance with the provisions of Section 7 (3) of Chapter 44 of the General Laws, so that the whole loan shall be paid in not more than 20 years after the date of the issuance of the first bond or note or at such earlier date as the Treasurer or Selectmen may determine.


That the Town raise and appropriate $50,000 for the orig- inal construction and hard-surfacing of the public off-street parking area between North and Brewster Streets, under specifications approved by the Department of Public Works, and to meet said appropriation $10,000 be from the current tax levy and the Town Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow the sum of $40,000 in accordance with the provisions of Section 7 (5) of Chapter 44 of the General Laws, so that the whole loan shall be paid in not more than ten years after the date of the issuance of the first bond or note or at such earlier date as the Treasurer or Selectmen may determine.


That the Town raise and appropriate or transfer from parking meter receipts the sum of $10,000 for the purchase and installation of parking meters in the Brewster - North Street public off-street parking area.


Taken by a ballot vote, 83 in the affirmative, 60 in the negative, not having a two-thirds vote the motion was lost.


Article 91. To see if the Town will authorize the Se- lectmen to appoint a Board of 3 members to supervise, main- tain and control on and off-street parking meters and to en- force the parking regulations insofar as said on and off-street meters are concerned, or take any action relative thereto, said Board to have a full-time police officer assigned to en- force said regulations and to maintain said meters; said offi- cer's salary and any additional enforcement personnel and clerical, legal and other expenses of said Board to be paid by appropriation from parking meter receipts.


Recommendation under this article left to the Traffic Committee.


Voted: That the Town authorize the Parking and Traffic Committee, appointed under Article 3 of the 1958 annual town meeting, to prepare plans and cost estimates on pro- posed sites for a parking area; and to raise and appropriate the sum of $1,500 for the expenses of said committee.

Article 92. To see if the Town will vote to change the term of office of Selectman from one to three years and elect, at the next annual meeting, one Selectman for one year, two for two years and two for three years and thereafter shall elect them for terms of three years, or take any action rela- tive thereto.


The Committee recommends favorable action.


Voted: That the Town change the term of office of Se- lectmen from one to three years and elect, at the next annual meeting, one Selectman for one year, two for two years and two for three years and thereafter shall elect them for terms of three years.


Article 93. To see if the Town will vote to raise and ap- propriate $5,000 in accordance with the provisions of Section 5, Clause (47) of Chapter 40 of the General Laws, as amend- ed, to be spent under the direction of the Development and Industrial Commission.


The Committee recommends an appropriation of $5,000.


Voted: That the Town raise and appropriate the sum of $5,000, in accordance with the provisions of Section. 5, Clause (47) of Chapter 40 of the General Laws, as amended, to be spent under the direction of the Development and Industrial Commission.


Article 94. To see if the Town will amend the action taken under Article 102 of the 1957 Annual Meeting by in- creasing the membership of the Development and Industrial Commission from seven to nine members.


In accordance with the request of the Development and Industrial Commission, the Committee recommends favor- able action.


Voted: That the Town increase the membership of the Development and Industrial Commission, established under Section 8A of Chapter 40 of the General Laws, from seven to nine members.


Article 95. To see if the Town will authorize the Select- men to convey to Joseph G. Callahan, Lot A on plan entitled "Town of Plymouth Cedarville Dump"; said lot to be recon-

veyed to the Town by the grantee on condition that it will revert to him when no longer needed for dump purposes.


The Committee recommends favorable action.


The Planning Board has approved.


Voted: (Unanimously) That the Town authorize the Se- lectmen to convey to Joseph G. Callahan for no consideration a parcel of land in the Cedarville section of Plymouth and shown as Lot A on a plan entitled "Town of Plymouth, Ce- darville Dump, Scale: 1 in. == 100 ft., Dec. 14, 1957, Edward Chase, Town Engineer," said lot to be reconveyed to the Town by the grantee on condition that it will revert to him when no longer needed for dump purposes.


Article 96. To see if the Town will authorize the Select- men to purchase Lot 14A, Plat 45B of the Assessors' Plans, containing 2.39 acres and being a portion of White Horse Beach and make an appropriation therefor.


The Committee recommends the purchase of this land for $1 and an appropriation of $100 for expenses of acquiring title.


The Planning Board has approved.


Voted: (Unanimously) That the Town authorize the Se- lectmen to purchase for municipal purposes, Lot 14A of Plat 45B of the Assessors' Plans for $1 and to raise and appro- priate the sum of $100 for expenses of acquiring title.


Article 97. To see if the Town will vote to rescind the action taken under Article 96 of the 1958 Town Meeting and authorize the transfer of the appropriation of $300 to E & D.


The Committee recommends favorable action.


Voted: That the Town rescind the action taken under Article 96 of the 1958 Town Meeting and authorize the trans- fer of the appropriation of $300 to Excess and Deficiency.


Article 98. To see if the Town will vote, in accordance with Section 110A of Chapter 41 of the General Laws to close the Town Offices on Saturday provided the weekly hours are adjusted to conform with those set by the Personnel Board. (By Petition)


The Committee recommends no action.


Mr. John Armstrong moved favorable action but the motion was lost.

Article 99. To see what action the Town will take with regard to $175 "Conscience Money" received by the Tax Col- lector in 1957.


The Committee recommends that this money be transferred to Excess and Deficiency.


Voted: That the Town authorize the transfer to Excess and Deficiency of the $175 "Conscience Money" received by the Tax Collector in 1957.


Article 100. To see if the Town will adopt as a by-law for procedure at any town meeting the following "At any town meeting, all votes on any article involving any ex- penditure of $10,000 or more shall be taken by ballot, ex- cept when this rule is waived by unanimous consent."

The Committee recommends no action.


Voted: That the Town adopt as a By-Law for procedure at any town meeting the following: At any representative town meeting where the voice vote taken on any motion in- volving an expenditure of $10,000 or more, is not decisive or is doubted by at least seven voters, a final vote shall be taken by ballot.


Article 101. To see if, for the purpose of organizing and expediting progress thereof, the Town will direct the Mod- erator to serve as an ex-officio member, without vote, on any special study committee where said Moderator is authorized by the Town to appoint such committee. (By Petition)


The Committee recommends no action.


Mr. Paul Withington moved that the town take no action under Article 101.


Mr. Howard Barnes moved to amend Mr. Withington's motion by the following: That for the purpose of organizing and expediting the study, the Moderator is authorized to serve as an ex-officio member, without vote, on any special study committee to which a Moderator is directed to make the appointments.


Article 102. That the Town be authorized and instructed to erect a boardwalk at least three feet wide on that property owned by the Town of Plymouth on Taylor Avenue and

bounded by the beach and by the property of the Mayflower Hotel; said boardwalk to run from Taylor Avenue to the beach and that the town make an appropriation therefor. (By Petition)


The Committee recommends no action.


Voted: That the Town take no action under Article 102. At 10:30 P.M., April 2nd, 1959, it was voted to adjourn.
