Section 23. Exceptions under Specific Rules. When in its judgment the public convenience and welfare will be sub- stantially served, and where such exception will tend to improve the status of the neighborhood, the Board of Appeals may in specific cases, after public notice, a hearing, and subject to appropriate conditions and safeguards, determine and vary the application of the district regulations herein established in har- mony with their general purpose and intent as follows :


(a) Permit the alteration of a one-family house or building, existing at the time this By-law is adopted and wherever located, to accommodate two families.


(b) Grant temporary and conditional permits for structures and uses that do not conform to the regulations herein pre- scribed, provided that no permit shall be for more than a one- year period.


(c) The Board of Appeals may grant no variation which would amount to an amendment of this By-law or a change in zone lines, all such amendments to be made as provided in General Laws, Chapter 40, Section 30 and in Section 24 of this By-law.


Section 24. Amendments. The Planning Board, either up- on its own initiative or upon petition of ten persons, shall hold public hearings, 14 days' public notice of which shall be given, for the consideration of any repeal or amendments to this By- law, and report to a town meeting its recommendations as to what action should be taken, before any repeal or amendment may be considered by a town meeting.


Section 25. This By-law shall take effect as provided by law.

Voted, That the Selectmen be and they are hereby authorized and instructed to petition the next General Court for enabling legislation to permit an increase in the number of members of the School Committee from five to nine; and that a committee of five be appointed by the Selectmen to investigate the acts of the School Committee and report at the next Annual Town Meet- ing. Yeas 326, Nays 4.

Unanimous consent was given to Mortimer H. Mellen to sub- mit the following resolution, which was unanimously adopted :


"Believing that the services of Jesse W. Lambert, Superin- tendent of Schools, cannot be easily replaced and that his resigna- tion should not be offered to the School Committee, be it :


RESOLVED, That it is the will of this meeting that the School Committee refrain from accepting the resignation of Jesse W. Lambert, Superintendent of Schools of the town of Saugus, should it be tendered before July 1, 1929." Yeas 150, Nays o.

Voted, That the balance of the appropriation for unpaid bills for 1927 and prior years, made at the Annual Town Meeting of 1928 be transferred back to surplus.


Unanimous consent was given to the presentation of a resolu- tion on the subject of mosquitoes, and the resolution was adopted.


"RESOLVED, That the Board of Health be authorized to spend from their appropriation funds for suppression of mos- quitoes."

In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the town of Saugus, qualified to vote in town affairs, to appear at the Town Hall on Wednesday evening, August twenty-second, A.D. 1928, at eight o'clock, to hear and act on the following articles, viz. :


ARTICLE I. To choose a Moderator to preside at said meeting.


ART. 2. To hear and act on reports of committees.


ART. 3. To see if the town will vote to appropriate the sum of $200 for unpaid bills for 1927 and prior years, said sum to be transferred from the surplus, or to see what action the town will take in the matter, agreeable to the petition of the Board of Selectmen.

To see if the town will vote to transfer $6,500 from the appropriation for permanent construction made at the Annual Town Meeting of 1928 to be expended for permanent construction on Walnut street provided that the county contri- butes $6,500 and the state contributes $2,500 for the same pur- pose, or to see what action the town will take in the matter, agreeable to the petition of the Board of Selectmen.


ART. 7. To see if the town will vote that the balance remaining in the appropriation for a new school on Lincoln avenue appropriated at the Special Town Meeting held April 6, 1925, and the Annual Town Meeting of 1926, shall be spent under the direction of the School Committee for the completion of said school building, or to see what action the town will take in the matter, agreeable to the petition of the Board of Selectmen.


ART. 8. To see if the town will vote to discharge the committee appointed under vote of the Special Town Meeting held April 6, 1925, to build a new school on Lincoln avenue, or to see what action the town will take in the matter, agreeable to the petition of the Board of Selectmen.


ART. 9. To see if the town will instruct the Board of Select- men to investigate the matter of securing Walden Pond avenue from the city of Lynn for the town of Saugus, and to report with recommendations to the next town meeting, agreeable to the petition of the Board of Selectmen.


You are hereby directed to serve this Warrant by posting attested copies thereof at the usual places seven days, at least, before the time of holding said meeting, and to distribute copies as provided by the By-laws at least four days before.


HEKEOF, FAIL NOT, and make due return of this Warrant, with your doings thereon, to the Town Clerk, at the time and place of said meeting.

The meeting was called to order by the Town Clerk, Lillian Shores.


The Warrant was read by the Town Clerk, omitting the read- ing of the Articles upon motion, which was carried, that the reading of the Articles be dispensed with.

ARTICLE I. To choose a Moderator to preside at said meeting.


Chose Frank P. Bennett, Jr., for Moderator, who, after being duly qualified by the Town Clerk, took charge of the meeting.


The Moderator appointed the following Tellers : William Jones, Raymond Love, Walter S. Gay, Edwin K. Hayden and Charles E. Welt and duly qualified them.


More than the quorum of 100 being present, the Moderator proceeded with the business before the meeting, after having warned non-voters to proceed to a space reserved in the gallery in accordance with Article 2, Section 10 of the By-laws.


The salute to the Flag was given.


ART. 2. Reports of Committees.


A verbal report from the Board of Survey was given on the proposed Golden Hills Highway, and the highway was not recommended. Report accepted.


ART. 3. Unpaid bills.


Voted, That the sum of $200 be and the same is hereby appro- priated from the Surplus for the payment of unpaid bills of 1927 and prior years.


ART. 4. Assessment on the East Saugus bridge.


Voted, That there be raised and appropriated the sum of $10,000 for the purpose of paying the assessment made on the town by the county of Essex on account of the recon- struction of East Saugus bridge over Saugus river, as authorized by Chapter 293, Acts of 1926, as amended and to meet said appropriation that there be transferred from the free cash in the treasury the sum of 1,000 dollars, and that the treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow the sum of $9,000 and to issue note of the town therefor under authority of Chapter 293, Acts of 1926, as amended, said note to be paid in not more than one year. Yeas 140, Nays I.


ART. 5. Interest on assessment of East Saugus bridge.

ART. 6. Transfer of $6,500 from appropriation for perma- nent construction.


Voted, That the sum of $6,500 be and the same hereby is transferred from the appropriation for permanent construction of highways made at the Annual Town Meeting of 1928 to be expended for permanent construction on Walnut street, provided that the county contributes $6,500 and the State contributes $2,500 for the same purpose.

ART. 9. Securing of Walden Pond avenue.


Voted, That the Board of Selectmen be and hereby is instructed to investigate the matter of securing Walden Pond avenue from the city of Lynn and to report with recommends to the next town meeting.

To W. Charles Sellick, Constable of the Town of Saugus, GREETING :


In the name of the Commonwealth of Massachusetts you are hereby required to notify and warn the inhabitants of said town who are qualified to vote in State Elections to meet in the several voting precincts of the town on Tuesday the sixth day of November, 1928, at 12 o'clock M., for the following purposes :


To bring in their votes to the election officers for the election of candidates of political parties for the following officers :


Presidential Electors.


Governor.


Lieutenant Governor.


Secretary.


Treasurer.


Auditor.


Attorney General. Senator in Congress.


Congressman.


Councillor.


Senator.


Representatives in General Court (3).


County Commissioners (2).


Clerk of Courts.


Register of Deeds.


Also to mark your "Yes" or "No" to the following questions "Law Proposed by Initiative Petition."


Shall the proposed law which provides that it shall be lawful in any city which accepts the act by vote of its city council and in any town which accepts the act by vote of its inhabitants, to take part in or witness any athletic outdoor sport or game, except horse racing, automobile racing, boxing or hunting with fire- arms, on the Lord's Day between 2 and 6 P.M. ; that such sports

or games shall take place on such playgrounds, parks or other places as may be designated in a license issued by certain licens- ing authorities ; that no sport or game shall be permitted in a place other than a public playground or park within one thous- and feet of any regular place of worship; that the charging of admission fees or the taking of collections or the receiving of remuneration by any person in charge of or participating in any such sport or game shall not be prohibited ; that the license may be revoked ; and that in cities and towns in which amateur sports or games are permitted under existing law such amateur sports or games may be held until the proposed law is accepted or the provisions of the existing law fail of acceptance on resubmission to the people, which law was disapproved in the Senate by a vote of 9 in the affirma tive and 22 in the negative and in the House YES of Representatives by a vote of 93 in the affirmative and 110 in the negative be NO approved ?
