To either of the Constables of the Town of Swampscott, in said County, GREETING :


In the name of the Commonwealth of Massachusetts, you are directed to notify the inhabitants of the Town of Swampscott, qualified to vote in elections and in Town affairs, to assemble in the Town Hall, in said Swampscott, on Friday, the twenty-fifth day of October, current, at eight o'clock P. M., then and there to act on the following articles, viz. :


ARTICLE I. To see if the Town will vote to appropriate an additional sum of money to complete the sewers under con- struction on Beach avenue, Mapledale place and Greenwood avenue, as recommended by the Water and Sewerage Board.

ART. 2. To see if the Town will vote that the Town Treas- urer, with the approval of the Selectmen, be and hereby is authorized to borrow money from to time to time in anticipation of the taxes of the municipal year beginning the first day of January, A. D., 1913, to an amount not exceeding in the aggre- gate one hundred twenty-five thousand ($125,000) dollars, and to issue a note or notes therefor, payable within one year. Any debt or debts incurred under this vote to be paid from the taxes of said municipal year, as recommended by the Selectmen.


ART. 3. To see if the Town will vote to construct a sewer connection between the High School and the sewer on Green- wood avenue and make an appropriation therefor, as recom- mended by the School Committee.


ART. 4. To see if the Town will vote to accept and allow the taking of the Phillips property, so called, as described in vote of taking of the Park Commissioners, dated the fourteenth day of October, A. D., 1912, and filed with the Town Clerk the fourteenth day of October, A. D., 1912, as recommended by the Park Commissioners.


ART. 5. To see if the Town will vote to lay a six-inch water main in Bay View avenue a distance of about 500 feet. The owner of the land guarantees to pay interest upon the amount expended until such time as the revenue from the water meets the interest, and make the necessary appropriation therefor, as petitioned for by George T. Till and others.


ART. 6. To appropriate and raise by borrowing or otherwise such sum or sums of money as may be necessary for all or any of the purposes mentioned in the foregoing articles.

And you are directed to serve this Warrant by posting attested copies thereof at the Town Hall, Depots, Post Offices and three other public and conspicuous places in the Town, seven days at least before the time of holding said meeting.

Pursuant to the within Warrant to me directed I have notified the legal voters of Swampscott by posting attested copies of said Warrant at the Town Hall, Post Officers, Depots and three other public and conspicuous places in Swampscott, on Thursday. October 17, 1912, the posting of said notices being at least seven days before the time of said meeting.

In accordance with the foregoing warrant the legal voters of the Town assembled at the Town Hall on Friday evening, October 25, 1912.


The meeting was called to order at eight o'clock by Daniel F. Knowlton, Moderator.


The Town Clerk read the Warrant and return thereon. There were upwards of one hundred voters present.


Report of the Ways and Means Committee, October 25, 1912.


ARTICLE I. The amounts asked for by the Water and Sewerage Board to construct these sewers were based upon the probable conditions to be encountered in the course of construc- tion. As frequently happens in Swampscott the amount of ledge beneath the surface was found to be greater than estimated, and accordingly the work could not be completed for the sums previously appropriated. In addition to this the land damages made necessary by the Mapledale place sewer in crossing private property were greater than at first estimated, so that in all three of these sewers it has been necessary for the Board to come before the Town and ask for an increased appropriation. to complete these three sewers are as follows : Beach avenue, $1,500; Mapledale avenue, $900 ; Greenwood avenue, $1,500 ; making a total of $3,900 altogether. The town has voted to construct these sewers, and we recommend that the sum of $3,900 be appropriated for the purpose of completing the sewers in Beach avenue, Mapledale place and Greenwood avenue.


ART. 2. This is a usual proceeding and made necessary by the fact that the taxes do not become available until the latter part of the year, while expenses are incurred from the first of the year. It is brought in now in order to save time and enable the Town Treasurer to hire such money as may be necessary after the first of the year without waiting for the Annual Town meet- ing to authorize it. Accordingly we recommend that the Town Treasurer with the approval of the Selectmen be and hereby is authorized to borrow money from time to time in anticipation of the taxes of the municipal year, beginning the first day of January, 1913, to an amount not exceeding the aggregate of $125,000, and to issue a note or notes to be payable within one year.


ART. 3. The sewer system has now been extended from Greenwood avenue to a point opposite the High School. The top of this hill is almost entirely ledge and the drainage is at present inadequate as well as unsanitary. A connection to the sewer for the High School seems to be necessary and should be made, if possible, this year. Based upon the fact that the hill is nearly all ledge the Water and Sewerage Board have estimated that it will cost $1,000 to make this connection. We recom- mend that the Town appropriate the sum of $1,000 to make the particular connection from the High School into the main sewer in Greenwood avenue.


ART. 4. Your Committee is unable to make a report on this article at this time and recommends that the matter be left with the Committee on Ways and Means for further study. We are informed that in a vote of taking, the law required a description sufficiently accurate for identification, and we have been at some pains to identify the land in question from the description con- tained in the vote of taking by the Park Commissioners and are unable to reconcile the description given with the description shown on the Assessors' plans. For this reason it would seem advisable to delay action upon the acceptance of the taking until the Park Commissioners are given an opportunity to correct the description contained in their vote of taking by a further vote.

ART. 5. We recommend that the Town lay a 6-inch water main in Bay View avenue for a distance of 500 feet from Green- wood avenue, provided that before the Town shall incur any expense the owner or owners of land along Bay View avenue shall file with the Water and Sewerage Board, guaranteeing an annual payment to the Town equal to 6 per cent of the expense incurred until such time as the revenue from the users of water from said water main on Bay View avenue shall equal or exceed the sum of 6 per cent on said expenditure. Provided also that no work shall be performed by the Town, or expense incurred under this vote, and no bond shall be issued for any of the pur- poses of this vote until the provisions of Chapter 191 of the Acts of 1907 shall have been complied with.


ART. 6. We recommend that the following be fixed as par- ticulars of the bonds to be issued by the Town under vote taken under Article 1, appropriating thirty-nine hundred dollars for sewer construction.


There shall be seven bonds of one hundred dollars each, dated during the current year, maturing one each year for the period of seven years. Said seven bonds shall be issued for the pur- poses stated in and under the provisions of Chapter 86 of the Acts of 1902, and Chapter 401 of the Acts of 1903, and acts in amendment thereof and in addition thereto.


The bonds shall bear the Town seal, be signed by the treasurer of the Town, and countersigned by a majority of the sewer com- missioners, now Water and Sewerage Board, and shall be authenticated by some bank or trust company ; shall bear interest at a rate not exceeding 4 per cent per annum, and shall be sub- ject to registration at holder's option on presentation to the Town Treasurer for the cancellation of the coupons and appro- priate endorsement. The principal and interest shall be payable at the Town Treasurer's office, or at such Boston Trust Com- pany or Bank as the Town Treasurer or the Water and Sewer- age Board designate. Each of said bonds shall bear on the face thereof the words : "Swampscott Sewerage Loan, 1912." Said bonds shall be sold under the direction of the Town Treasurer and the Water and Sewerage Board. All other particulars as to form, issuance and sale of said bonds shall be determined by the Town Treasurer and the Water and Sewerage Board, but shall not be sold at less than par and interest.


There shall also be thirty-two bonds of one hundred dollars each, dated during the current year, two maturing one year from

the date thereof, two maturing two years from the date thereof, and one maturing each year for the period of twenty-eight years. The bonds shall bear the Town seal, be signed by the Town Treasurer and countersigned by the Water and Sewerage Board ; shall be authenticated by some Bank or Trust Company, and shall bear interest at a rate not exceding 4 per cent per annum : they shall be subject to registration at the holder's option on presentation to the Town Treasurer for cancellation of the coupons and appropriate endorsement. The principal and interest shall be payable at the Town Treasurer's office, or at such Boston Trust Company or bank as the Town Treasurer or the Water and Sewerage Board designate. Article 3, Voted : to accept and adopt the report of the Ways and Means Committee, appropriating the sum of one thousand dollars ($1,000) to make the sewer connection from the High School into the main sewer in Greenwood avenue.


Article 4. The report of the Ways and Means Committee was read.


Voted : that the matter of Article 4, be referred back to the Park Commissioners, they to report at a Special Town Meeting to be called by the Selectmen within four weeks from this date.


Article 5, Voted : to accept and adopt the report of the Ways and Means Committee, recommending that the Town lay a 6-inch water main in Bay View avenue for a distance of 500 feet from Greenwood avenue, provided that before the Town shall incur any expense the owners or owner of land along Bay View avenue shall file with the Water and Sewerage Board, guaranteeing an annual payment to the Town equal to 6 per cent of the expenses incurred until such time as the revenue from the users of water from said water main on Bay View avenue shall equal or exceed the sum of 6 per cent on said expenditure. That the following be fixed as particulars of the bonds to be issued by the Town under vote taken under Article number I, appropriating thirty-nine hundred dollars for sewer construction.


There shall be seven bonds of one hundred dollars each dated during the current year maturing one each year for the period of seven years. Said seven bonds shall be issued for the pur- poses stated in and under the provisions of Chapter 86 of the Acts of 1902 and Chapter 401 of the Acts of 1903 and acts in amendment thereof and in addition thereto.


The bonds shall bear the Town Seal, be signed by the Treas- urer of the Town, and countersigned by a majority of the Sewer Commissioners, now Water and Sewerage Board, and shall be authenticated by some Bank or Trust Company ; shall bear in- terest at a rate not exceeding 4 per cent per annum, and shall be subject to registration at the holder's option on presentation to
