Under authority voted at the adjourned annual town meeting, under Article 40 of the warrant, the Moderator appointed the fol- lowing committee to make a study of the fire protection facilities of the town of Swampscott.

SPECIAL TOWN MEETING Wednesday, April 4, 1934


Essex ss.


To either of the Constables of the Town of Swampscott in said County: Greeting:


In the name of the Commonwealth of Massachusetts you are directed to notify the inhabitants of the town of Swampscott, quali- fied to vote in elections and in town affairs, to assemble in the audi- torium of the Hadley school in said Swampscott on Wednesday, the fourth day of April, at 7.45 P.M., then and there to act on the follow- ing articles, viz .:


Article 1. To hear and act on the report of the committee ap- pointed by the Moderator to consider the question of fire protection for the town.


Article 2. To hear and act on the reports of town officials, boards and committees.


Article 3. To see if the town will vote to restore the 10 per cent wage reduction effective in 1933 to the members of the Police department and appropriate $3,171.80 in addition to the amount al- ready appropriated for wages in the Police department for 1934; said restoration to become effective as of March 1, 1934.


Article 4. To see if the town will vote to restore the 10 per cent wage reduction effective in 1933 to the members of the Fire department and appropriate $3,441.62 in addition to the amount al- ready appropriated for wages in the Fire department for 1934; said restoration to become effective as of March 1, 1934.


Article 5. To see if the town will vote to pay to the employees of the Moth and Tree Warden's departments for the year 1934 the wage scale under which they worked prior to March 1, 1933, and ap- propriate $676.00 to the Tree Warden's wage appropriation therefor, the same to be in addition to any amounts already appropriated for this department as petitioned for by Ralph Maxwell.


Article 6. To see if the town will vote to restore the 10 per cent wage reduction effective in 1933, to all employees of the town of Swampscott and appropriate money therefor, said restoration to become effective as of January 1st, 1934, and to cover the year 1934, as petitioned for by Guy T. White.


Article 7. To see if the town will vote to restore the 10 per cent. salary reduction effective in 1933, to all elected officials of the town of Swampscott and appropriate money therefor, said restora- tion to become effective as of February 19, 1934, and to cover the year 1934.


Article 8. To see if the town will vote to change from a residen- tial zone to a business area the property located at 646 Humphrey street bounded on the east by Cardillo terrace, and on the west by Glen road and shown on Assessors' Plan No. 23, as lot No. 10 as petitioned for by Abram French et al.


Article 9. To see if the town will vote to change from a resi- dential zone to a business area the property located on Humphrey street, between land of Harry B. and Bessie F. Lombard, and land of the King's Beach Garage, shown on Assessors' Plan No. 1 as Lots numbered 181 and 122; and also land located on King's Beach ter- race, shown on Assessors' Plan No. 1 as Lots numbered 175 and 176 as petitioned for by John J. Foley.


Article 10. To see if the town will vote to rezone a certain lot of land on the southerly side of Paradise road about opposite Franklin avenue which is described as Lot 3 on Plate 15 of the

Town Plan, so-called, and which contains about 15,000 square feet, so that it may be used for business purposes as petitioned for by Fred L. Mower.


Article 11. To see if the town will vote to amend or annul Section 8, Chapter 7, of the Town By-Laws, so that the same shall not apply to any construction of a public street, laying of mains, or the doing of other public work on Foster road so-called.


Article 12. To see if the town will appropriate the sum of $12,000 to be used for the purpose of constructing a roadway over Foster road, as laid out by the Board of Selectmen, and shown on a plan dated February, 1934, drawn by W. W. Pratt, Town Engineer, on file in the office of the Town Clerk, said roadway to be construct- ed from Burpee road to the junction of Elwin and Foster roads; said appropriation shall be authorized and used only under the jur- isdiction of the Board of Selectmen when the Board of Selectmen have received sufficient and proper releases and conveyances from all owners of land abutting on Foster road releasing all rights in any land which may be included in the lay out, and waiving all dam- ages incident to the construction of the roadway.


Article 13. To see if the town will appropriate the sum of $8,000 for the laying of water pipes in Foster road from Burpee road to the junction of Elwin and Foster roads; as laid out by the Board of Selectmen, and as shown on a plan dated February, 1934, drawn by W. W. Pratt, Town Engineer, on file in the office of the Town Clerk; said appropriation shall be authorized and used only under the jurisdiction of the Board of Selectmen when the Board of Selectmen have received sufficient and proper releases and convey- ances from all owners of land abutting on Foster road releasing all rights in any land which may be included in the lay out, and waiving all damages incident to the work of laying said water pipes.


Article 14. To see if the town will vote to add to or amend the Building By-laws so that no permit shall issue to erect a building in a location where water mains or sewers are not available, without the approval of the Building Inspector and the Board of Health.


Article 15. To see if the town will vote to accept and incor- porate the following by-laws to govern the office of Wire Inspector:


Section 1. There shall be appointed annually by the Board of Selectmen an Inspector of Wires. Such appointment shall be made in March of each year and he shall hold office from the first day of April following for the term of one year and until another is ap- pointed in his place. His salary shall be fixed by vote of the town. The Selectmen may at any time remove him. He shall keep a record of the business of his department and submit to the Selectmen in time for publication in the annual town report a yearly report of such business.


Section 2. He shall require all persons and corporations owning or operating wires to conform to all the laws of the Commonwealth of Massachusetts and to all rules and regulations contained in the National Underwriters Code.


Section 3. Any person or corporation operating electric or other wires within the town shall, upon request of the Inspector, furnish him with such information as may be necessary to the faith- ful and effectual discharge of his duties under this by-law.


Section 4. The Inspector shall have access at all reasonable times, to all wires, appliances, and apparatus in the interior of a public building or on private premises, which are intended for carry- ing an electric light or power current, and no person shall arrange, affix or change any such wires or apparatus without giving the Inspector reasonable opportunity to inspect such wires and their

arrangement and fixtures before the same are covered or enclosed; and no person shall place such wires in any building in process of construction until all gas, steam, water and furnace pipes have been placed in proper position. No person shall connect such wires in the interior of a building and on private premises with an outside circuit which crosses or runs along, over or under any street or way of the town without written permission therefor having been first obtained from the Inspector.


Section 5. No person or corporation shall attach any wire or line for the transmission of electricity for any purpose to any post, except on his own premises or upon other lands with the consent of the owner thereof, nor insert the same into any underground con- duit, except with the consent of the owner and by the order of the Board of Selectmen.


Article 16. To see if the town will fix a salary of $500.00 for the office of Wire Inspector established at the adjourned town meet- ing of March 23, 1926, under Article No. 49 and appropriate $100.00 for printing, secretarial and clerical work.


Article 17. To see if the town will vote to appropriate $1,100.00 for the Public Library; $635.00 to be appropriated to restore the ten per cent. salary reduction effective in 1933 and $465.00 for the purchase of books. Said restoration of wages to become effective as of January 1st, 1934 and to cover the year 1934, as recommended by the Board of Library Trustees.


Article 18. To see if the town will vote to construct a surface water drain about 600 feet long to drain the low area between Bur- rill street, Elmwood road and Paradise road and appropriate money for same as petitioned for by Joseph G. Clancy.


Article 19. To see if the town will vote to lay a drain to care for surface water in Nason road according to a plan drawn by the Town Engineer and appropriate money therefor as petitioned for by Thomas F. Winston.


Article 20. To see if the town will vote to accept Section 13A of Chapter 147 of the General Laws of Massachusetts (Ter. Ed.) relative to the establishment of a reserve police force, and will vote to establish a reserve police force in accordance with the provisions of Section 13A of Chapter 147 of the General Laws of Massachusetts (Ter. Ed.) consisting of the present permanent intermittent police officers of the department and such others as may be lawfully ap- pointed as petitioned for by Frank Parker, Jr.


Article 21. To see if the town will authorize the Board of As- sessors, the Park Commission, the Board of Public Welfare and the Planning Board to employ one of its own members to act as secre- tary thereof, and to receive pay therefor as provided by Chapter 41, Section 4A of the General Laws, Tercentenary Edition, and to fix the salaries of said secretaries as in such case required by said law.


Article 22. To see if the town will authorize the Board of Pub- lic Welfare to appoint one of its own members as clerk and fix the salary of such appointee at the rate of $1,000.00 per year as provid- ed by Chapter 41, Section 4A of the General Laws, Tercentenary Edition, and authorize the transfer from the appropriation for Pub- lic Welfare designated as "Others" the sum of $900.00 to "Salaries and Wages" so that the clerk may receive such compensation.


Article 23. To see if the town will vote to establish an office of Secretary of the Planning Board. The same to be a member of the board and establish a salary of $100.00 per year and appropriate money therefor as submitted by the Planning Board.

Article 24. To see if the town will vote to build a garage for the Police department, and appropriate the sum of $1,800.00 for the same.


Article 25. To see if the town will vote that no person holding the office of Town Accountant shall be eligible to hold any other elective or appointive town office, or keep books or accounts for any town department.


Article 26. To see if the town will vote that no person holding the office of Town Counsel shall be eligible to hold any other ap- pointive or elective town office.


Article 27. To see if the town will vote that no person holding the office of Town Moderator shall be eligible to hold any other elec- tive or appointive town office.


Article 28. To see if the town will authorize the Surveyor of Highways to use a part of the present budget for the purpose of re- imbursing the employees of the Highway department with the amount of money due them caused by the deduction of 10 per cent. from their wages from January 1st, 1934, to March 8th, 1934.


Article 29. To see if the town will authorize the Board of Park Commissioners to fill, grade and cover the dump now in Phillips Park, for use as a football gridiron, and erect a suitable chain link fence, and appropriate $10,000.00 therefor, as recommended by the School Committee and the Park Commissioners.


Article 30. To see if the town will vote to appropriate the sum of $5,000.00 to the Snow and Ice account in addition to the $10,000.00 appropriated at the annual town meeting.


Article 31. To see if the town will vote to transfer from the Cemetery Lots Fund and Income the sum of three thousand six hun- dred and thirty dollars, ($3,630.00) to the account of Cemetery Improvement.


Article 32. To appropriate and raise by borrowing, under any general or special law which authorizes the town to borrow money, or otherwise, such sum or sums of money as may be necessary for any or all of the purposes mentioned in the foregoing articles.


And you are directed to serve this warrant by posting attested copies thereof at the Town Hall, Post Offices and in at least one pub- lic and conspicuous place in each precinct of the town and at or in the immediate vicinity of each railroad station in the town seven days before the day appointed for said meeting.


Hereof fail not, and make due return of this warrant, with your doings thereon, to the Town Clerk at the time and place of meeting aforesaid.

SPECIAL TOWN MEETING Wednesday, April 4, 1934


In accordance with the foregoing warrant the town meeting members assembled at the auditorium of the Hadley school, and were called to order by John R. Hurlburt, Moderator, at 7.45 P.M., the necessary quorum being present (115).


The warrant with the return thereon was read by the Town Clerk.


Under Article 1 the report of the committee to consider the question of fire protection for the town was read by Joseph Atwood, chairman.


Motion to lay Article 1 on the table until Article 2 had been acted upon was lost.


Voted, Article 1. That action on this article be indefinitely post- poned.


Motion that town meeting adjourn to one week from this date, to allow the Finance Committee report be printed, was lost. For 51; No 73.


Under Article 2 the following resolution from the Trustees of the Public Library was accepted and adopted. (Unanimous.)


Whereas, Professor Elihu Thomson gave to the Town of Swamp- scott, the lot on which the Public Library now stands, and


Whereas, Professor Thomson was a member of the Board of Trustees of the Swampscott Public Library from October 7, 1921 to February 19, 1934, and


Whereas, he has shown so much interest in and rendered such valuable service to the Public Library, be it therefore
