8. Voted: To accept the report of the Selectmen relocating widening and straightening Summer Street from West to southerly end of the lay-out of 1881 and that the Board of Selectmen be. authorized to acquire by gift or purchase or take by right of

eminent domain an easement for all purposes of a public street and highway in and over said street as so relocated and that the Selectmen be further authorized to acquire by gift of purchase any parcels of land lying between Summer Street as heretofore exist- ing and Summer Street as so relocated and to deed the same to any adjoining abutter in complete or partial settlement of his claim for damages, and that the sum of $5,000 be raised and appropriated for the working of said street including the acquisition of the foregoing easements and land.

Article 12. Voted : That no action be taken under this article.


Article 13. Voted: To raise and appropriate the sum of $200 for the rebuilding and relocation of the drain from Vine Street to Lincoln Square.


Article 14. Voted to take up article 15 in conjunction with article 14. The appropriation Committee recommended no action be taken under articles 14 and 15.


Alfred C. Sheehy moved as a substitute motion: That a committee of five be appointed by the Moderator to study the subject matter of these articles and report at the next meeting.


Frederick Humphrey moved as an amendment that Irving E. Johnson be one of this committee. The amendment was so voted.


The substitute motion as offered by Mr. Sheehy as amended was so voted.


The Moderator appointed the following committee, Irving E. Johnson, chairman, Marion F. French, Frederick Humphrey, Robert W. Sheehan and F. Wayland Preston.


Article 16. The appropriation Committee moved as follows: To raise and appropriate the sum of $1,000 for payment of the claim .of Mary Egan under the provisions of Chapter 299 of the Acts of 1928, provided, however, that no part of this sum shall be paid unless the said Mary Egan shall execute a release in such form as the Town Counsel may approve releasing both the Town and the Commonwealth from all claim under Chapter 299 or otherwise łby reason of the widening of Bridge Street.


Samuel F. Upton moved to amend Article 16 by striking out $1,000 and inserting in place thereof the sum $2,500.


Frederick G. Bauer asked unanimous consent of the meeting that the privilege of the floor be granted to Judge Joseph A.

Sheehan, Counsel of Mrs. Egan, who spoke of the great damage the widening of Bridge Street had done to the property of Mrs. Egan.


The question on the amendment of Mr. Upton was put before the meeting and it was declared not a vote.


Cornelius J. Lynch moved as an amendment that the sum be $2,500.


This amendment was declared not a vote.


David J. Toomey moved as an amendment that the sum be $1,750.

The motion as offered by the Appropriation Committee was put before the meeting and it was so voted.


Voted: To take up article 4.


George E. Cunniff moved as an amendment to the motion as offered by the Appropriation Committee: That the Board of Park Commissioners be and hereby are authorized to acquire by pur- chase or take by right of eminent domain a certain tract of land between Lake Street and Whitman's Pond bounded and described as follows:


Northerly by Lake Street 150 feet; easterly by lot 31 on the plan hereinafter described 121 feet; Southerly by Whitman's Pond 157.92 feet; Westerly by lot 24 on the plan hereinafter described 78 feet containing 14,261 square feet of land, more or less, and being lots 25 to 30 inclusive on a plan entitled "Lakeside, Plan of sub- division of land in (East) Weymouth, Mass. Alan Wingate, Trustee, Russell H. Whiting. Civil Engineer, dated May 15, 1928 and that the sum of $1,500 be raised and appropriated for the acquisition of the above mentioned land.


Prince H. Tirrell moved to amend by striking out all reference to taking by right of eminent domain.


By unanimous consent of the meeting he withdrew his amendment.


John F. Dwyer moved that the subject matter of the article be laid on the table. Not a vote.


J. Edward Mulligan moved the previous question. So voted.


Prince H. Tirrell moved: That any taking of this land by right of eminent domain shall be for an agreed price not exceeding $1,500.


The amendment offered by George E. Cunniff was then put before the meeting and the tellers reported 131 voting in the a" rma'ive and none in the negative, a unanimous vote.


Voted to adjourn until Wednesday evening April 10, 1929, at 7.30 o'clock.

ADJOURNED SPECIAL TOWN MEETING


Weymouth, April 10, 1929. The adjourned special town meeting was held at the hall of the Weymouth High School, this evening, the meeting was called to order at 7.45 o'clock by George L. Barnes, Annual Moderator 144 Town Meeting Members names being checked by police stationed at the entrance of the hall.


Article 17. Voted: That no action be taken under this


article.


Article 18. Voted: That the town authorize its Electric Light Committee to contract with the Weymouth Light and Power Company for furnishing lights to the Town for a period not to exceed one year, contract to be subject to the approval of the Town Counsel before its execution.


Article 19. Voted: That the subject matter of this article be referred to the Electric Light Committee.


Article 20. Voted: To raise and appropriate the sum of $10,000 for the purpose of completing the work of the Committee 01 Sewerage, the same to be expended under the direction of the present Committee.


Article 21. Voted: That articles 22 and 23 be taken up with this article.


Articles 21-22-23. Voted: That the Board of Selectmen be authorized to advertise for bids and to award a contract for the removal of Garbage in the Town. One of the conditions of said contract to be that all such garbage shall be disposed of outside the limits of said Town, and that the sum of $15,000 be raised and appropriated for the foregoing purpose.


Article 24. Voted: That no action be taken under this


article.


Article 25. The Appropriation Committee moved as follows: That the Board of Selectmen be authorized to lease under the conditions and in the manner provided in Section 9 of Chapter 40 of the General Laws as amended a suitable part of a building for the purpose of providing headquarters for Weymouth Post 1399, Veterans of Foreign Wars of the United States; and that the sum of $300 be raised and appropriated for the foregoing purpose.

William A. Connell moved as a substitute motion: That the Town raise and appropriate the sum of $600 to provide suitable quarters for Wessagussett Post No. 1399, Veterans of Foreign Wars of the United States, this is in compliance with Chapter 30. General Laws, Section 9.


The question of the substitute motion was put before the meeting and it was so voted.


Article 26. Voted: To raise and appropriate the sum of $2.000 for the expense of revising the Town Map of 1915 and Me paring lithograph or other copies thereof, the same to be disbursed under the direction of the Board of Selectmen.


Article 27. The Appropriation Committee recommended no accion be taken under this article.


Alfred Shechy moved as a substitute motion: That the sum of $3,510 be raised and appropriated to be used to increase the salaries of the permanent members of the Fire Department.


The question of the substitute motion was put before the meeting and it was so voted.


Article 28. Voted: That the parcel of land on Church Street known as "Weymouth Heights Mall" be placed under the juris- diction of the Park Commissioners.


Article 29. Voted: To accept the report of the Selectmen laying out as a Town Way a certain strip of land lying between Front and Main Streets recently conveyed to the Town by the Stepson Shoe Company, Inc.


Proposed Street from Front Street to Main Street Description


Beginning at a point on the easterly side line of Front Street distant 68.66 feet southerly from a stone bound marking an angle point in said side line of Front Street; thence running in a general southeasterly direction by a tangent curve to the left with a radius of 15 feet a distance of 22.88 feet to a point of curvature; thence running in a general northeasterly direction by a tangent curve to the left with a radius of 15 feet a distance of 23.59 feet to a point on the westerly side of Main Street distant 259.53 feet southerly from a Massachusetts highway bound in said side line of Main Street, all by land of Stetson Shoe Company, Incorporated: thence turning and running in a general north- westerly direction by a tangent curve to the left with a radius of 15 feet a distance of 23.23 feet; thence running westerly by a tangent line a distance of 120.12 feet to the point of curvature; theres running in a general southwesterly direction by a tangent curve to the left with a radius of 15 feet a distance of 24.25 feet to said side line of Front Street, the last three courses being by said other land of Stetson Shoe Company, Incorporated; thence turting and running northerly by said side line of Front Street

a distance of 80.08 feet to the point of beginning. All of the land enclosed by the above described lines is hereby laid out as a Town Way and recommended to the Town for acceptance. For a further identification of this description and location, reference is hereby made to a "Plan of a proposed street, South Weymouth, Mass." made by Russell H. Whiting, Civil Engineer, dated Sept. 20, 1929, approved by us, verified by our signatures and adopted as a part of this record.


The aforesaid plan together with the certificate of the action of the Selectmen in laying out this proposed street have been duly filed with the Town Clerk.


No land, grade or other damage is awarded.


The proprietors of land hereby taken are given until the first day of September, 1929, in which to remove their trees, fences or other property.


Which laying out is hereby reported to the Town under the law provided for the assessments of Betterments, and when recorded and constructed is forever to be known as a Town Way and we recommend that the street he called: Charmada Street.


Done under our hands at Weymouth this 25th day of March, nineteen hundred and twenty-nine.

Article 30. Voted: That the Town accept the report of the Selectmen laying out as a Town Way a certain parcel of land on the northerly side of Commercial Street in Washington Square. which taking was authorized by vote of the special Town Meeting held February 7, 1929, and that so far as any easements may exist the Selectmen be authorized to acquire by gift or purchase or take by right or eminent domain as easement for all purposes of a public street or highway in and over said parcel and that the sum of $1.00 be raised and appropriated for the acquisition of said easements.


The tellers reported 113 voting in the affirmative and none in the negative, a unanimous vote.

Beginning at a point of compound curvature situate in the northeasterly side line of Commercial Street as shown on "Plan showing the relocation and widening of Commercial Street in the

towns of Braintree and Weymouth between Quincy Avenue, B.aintree and Washington Square, Weymouth as made by the Norfolk County Commissioners" from surveys made by Russell H. Whiting, Civil Engineer, dated April, 1926, Hartley L. White, County Engineer; thence running north 51° 28' 39". W, a distance of 31.53 fcet; thence turning and running north 42° 31' 29"E, a distance of 3.84 feet to a point on the division line between land of Clarence M. Price and land of Harry Maltzman and Isaac Rovner the last two courses being by said side line of Commercial Street as relocated and widened by the Norfolk County Com- missioners; thence turning and running in a general southeasterly direction by said land of Harry Maltzman and Isaac Rovner by a curve to the left with a radius of 129.81 feet a distance of 31.58 feet to the point of beginning, containing 40 square feet more or less.


All of the land enclosed by the above described lines is hereby laid out as a Town Way and recommended to the Town for acceptance.


For a further identification and location reference is hereby made to a "Plan of a relocation of a part of Commercial Street, Weymouth, Mass." made by Russell H. Whiting, Civil Engineer, dated Jan. 25, 1929, and adopted as a part of this record.


The aforesaid plan together with the certificate of the action of the Selectmen in laying out this proposed way have been duly filed with the Town Clerk.

Article 31. Voted: That the Board of Water Commissioners be authorized to continue to acquire by gift, purchase or taking by eminent domain for the purpose of preserving the purity of the Town's water supply, under provisions of Chapter 79 and of Section of Chapter 40 of the General Laws of the Common- wealth, all the land lying within the watershed of Great Pond

and referred to by the vote passed by the Town under Article 57 of the warrant for the Annual Town Meeting held March 7, 1927, and that the sum of $13,500 appropriated for said purpose under item 40 of Article 1 of the warrant for the Annual Town Meeting held March 4, 1929, is hereby appropriated and made available for the takings referred to herein.


Article 32. The Appropriation Committee moved: That section 804 of the by-laws is hereby amended by strking out the words "above a light blue panel outlined in gold and bearing the words Weymouth, Massachusetts", so that said section shall read as follows:


Section 804. The Flag of the Town shall be of navy blue having in its center . the Seal of the Town, and in the four corners in gold the dates, "1623"-"1675"-"1676"- "1775".


The question was put before the meeting and was declared not a vote.


Article 34. Voted: That a committee of five be appointed by the Moderator to investigate and report at or before the next Annual Town Meeting on the expediency of petitioning the Legislature for legislation providing for a Town Manager, to- gether with a draft of any proposed legislation recommended by the committee, and that the sum of $50 be raised and appropriated for the expenses of the committee.


The Moderator appointed Fred L. Alden, chairman. Albert E. Gladwin, Josepk Kelley. John W. Heffernan and Josiah B. Reed.


Fred L. Alden resigned as chairman of this committee and the Moderator appointed Joseph Kelley in his place thereof.


Article 35. Voted: That the additional sum of $200 be raised and appropriated for the employment of district and other nurses under the provisions of Clause 21 of Section 5 of Chapter 40 of the General Laws, the money to be expended under the direction of the Board of Selectmen or by the Board of Health if so authorized by the Selectmen.


Voted: To adjourn at 9:06 P. M.

In the name of the Commonwealth of Massachusetts you are hereby required to notify and warn the inhabitants of Weymouth aforesaid qualified to vote in Town affairs to meet in the Hall of the Weymouth High School Monday, September 16th, 1929 at seven o'clock and forty-five minutes in the evening, then and there to act upon the following articles, namely:


Article 1. To receive and act upon the report of any Com- mittee heretofore appointed, and to appoint any Committee the Town may think proper.


Article 2. To see if the Town will vote to accept Chapter 132 of the Acts of 1929, relating to the refining of oil in the Town, or take any other action in reference thereto.


Article 3. To see if the Town will vote to accept Section 6 of Chapter 148 of the General Laws relating to the removal of combustible materials in the Town, or take any other action in reference thereto.

Article 4. To see if the Town will vote to accept from: Reynolds Post No .. 58, Grand Army of the Republic, a deed of a certain lot in Fairmount Cemetery, to be held by the Town upon certain trusts specified in said deed, or take any other action in reference thereto.


Article 5. To see if the Town will vote to sell to the Merchants Co-operative Bank of Boston a certain triangular piece .. of land shown as lot A on a "Plan of Land in (South) Weymouth, Mass." dated' August 20, 1929, Russell H. Whiting, Civil Engineer, and bounded and described as follows:


Commencing at the Easterly corner of the said premises, thence running in a Westerly direction by Lot 10 shown on said. plan, One Hundred Eighty-One and 31-100 (181.31) feet to a stone bound; thence running in a Southeasterly direction by land of the Town of Weymouth occupied by the Water Depart- ment of said Town, Twenty-one and 79-100 (21.79) feet; thence running in a Northeasterly direction by land of the Town of Weymouth occupied by the School Department of said Town, One- Hundred Eighty (180) feet to a point of beginning. Containing 1961 square feet of land, more or less.


Article 6. To see if the Town will vote that all money" appropriated for the construction of the new fire station in. Ward Three and for plans, estimates and preliminary work in connection with the same shall be accounted for and disbursed as one fund for the purposes expressed in the votes appropriating said moneys, or take any other action in reference thereto.


Article 7. To see what sum of money the Town will vote. to raise and appropriate for the purpose of having a plan made of the several cemeteries in the Town with the location of the graves of all veterans marked thereon, or take any other action in reference thereto.


Article S. To see if the Town will instruct its Selectmen to petition the Legislature for an act authorizing the Town to- raise and appropraite money for participation in the Massachu- setts Bay Tercentenary Celebration, or take any other action in reference thereto.


Article 9. To see what sum of money the Town will vote. to raise and appropriate or appropriate from the income of the- John B. Rhines Fund for the adornment of the walls of the Town Hall, or take any other action in reference thereto.


Article 10. To see if the Town will vote to ratify the action of the Board of Selectmeu in taking from John F. Dwyer. and Joseph Kelley leases of certain land adjoining their estates on Washington Street and now forming part of the sidewalk, or take any other action in reference thereto.

SCHOOL DEPARTMENT


Article 11. To see if the Town will vote to authorize the Board of Selectmen to acquire by purchase or take by right of eminent domain for School purposes the so-called Stetson-Hunt property at the corner of Front and Stetson Streets, and bounded Westerly by land now or late of Cora A. Sanborn, Northwesterly by the Hunt School lot belonging to the Town of Weymouth, Easterly by Stetson Street, and Southerly by Front Street and by a certain lot of land now or late owned by Elizabeth Peyton, containing about 96,200 square feet of land, and to see what sum of money the Town will vote to raise and appropriate for the acquisition of said land, or take any other action in reference to the same.


Article 12. To see if the Town will vote to authorize the Board of Selectmen to acquire by purchase or take by right of eminent domain for school purposes the parcel of land adjoining the High School bounded and described as follows:


"Beginning at the Northeasterly corner of the premises at the junction of said land with land of the Town of Weymouth on the Westerly side of Middle Street:


Thence Southerly, bounded Easterly by said Middle Street 83.16 feet;


Thence Westerly by a line parallel with and distant 100 feet Northerly from the Southerly boundary of property now or formerly of the New England Telephone and Telegraph Company;


Thence Westerly approximately 205 feet to a stake at land now or formerly of Owen Mitchell;


Thence Northerly on land of said Mitchell 144.24 feet to land of said Town of Weymouth;


Thence Easterly on said land of the Town of Weymouth ~ 336.78 feet to the point of beginning on said Middle Street.


Being the same premises described in a deed of Rose A. Homa or Holna to Belle S. Whitmarsh dated October 19, 1923 and recorded with Norfolk Deeds. Book 1579, Page 630, "and to see what sum of money the Town will vote to raise and appro- priate for the acquisition of the above described land, or take any other action in reference thereto."


Article 13. To see what sum of money the Town will vote to raise and appropriate for the permanent construction of roadways and parking spaces on the grounds adjoining the High School, including the installation of lights and the planting of trees and shrubs adjacent thereto, or take any other action in reference thereto.

Article 14. To see what additional sum of money the Town. will vote to raise and appropriate for the further drainage, surfacing and laying out of Legion Memorial Field or take any other action in reference thereto.
