To the Constables of the Town of Weymouth in said County,


GREETING :


In the name of the Commonwealth of Massachusetts you are here- by required to notify and warn the inhabitants of Weymouth afore- said qualified to vote in Town affairs to meet in the hall of the Wey -- mouth High School on


THURSDAY, THE EIGHTEENTH DAY OF OCTOBER, 1934 at seven o'clock and forty-five minutes in the evening, then and there to act upon the following articles, namely :


Article 1. To see what additional sums of money the Town will vote to raise or borrow and appropriate for the expenses and opera- tion during the remainder of the current fiscal year of each of the fol- lowing Town Departments and activities, to wit:


1. Maintenance of Town Hall


2. Elections and registrations


3. Building Inspector


4. Streets and Highways


5. Unpaid bills


6. Water Department


and to determine in each case how and under whose direction the money shall be expended, to impose any conditions and restrictions upon the expenditure of any appropriation for any Town Departments now or heretofore made that the Town may think proper, and to fix the terms and conditions of any loan or loans authorized to procure any of such funds and to authorize the issue of bonds or notes for the same, and fix the term and rate of interest of any such bonds or notes, or take any other action in reference to any of the foregoing subjects.


Article 2. To see what sum of money the Town will vote to trans- fer from Public Welfare, to wit, from that item providing for relief given by the Town of Weymouth to persons having a legal settlement in said Town, to Old Age Assistance, under Chapter 118A of the Gen- eral Laws, or take any other action in relation thereto.

Article 3. To see what sum of money the Town will vote to trans- fer from Public Welfare, to wit, from that item providing for relief given by the Town of Weymouth to persons having a legal settlement in said Town, to Soldiers' Benefits, or take any other action in relation thereto.


Article 4. To see if the Town will vote to disperse and account for as one fund the unexpended balance voted by the Annual Town Meet- ing under Article 1 Section 27, Public Welfare, Items A, B and C, or take any other action in relation thereto.


Article 5. To see what sum of money the Town will vote to raise and appropriate for materials, supplies, equipment, supervision and investigation of E. R. A. projects, or take any other action in re- lation thereto.


Article 6. To see if the Town will vote to authorize the town mod- erator to appoint a committee of six members, consisting of two build- ers, one real estate dealer, the town engineer, the town counsel and the building inspector without power to vote, to act in conjunction with the planning board to revise the town's building laws so as to have zoning laws conform with and become a part of the building laws. This committee to report at the next Annual Town Meeting.


Article 7. ON PETITION: To see what sum of money the Town of Weymouth will vote to raise and appropriate for the purpose of providing heat and light for the Headquarters of Wessagusset Post, Veterans of Foreign Wars, No. 1399. Said sum of money to be in lieu of work performed by the Post in caring for abandoned cemeteries, and also as to what other action the Town may take in relation to this request.


Article 8. To see if the Town will vote to authorize its Board of Selectmen, in behalf of the Town, to accept certain personal property, to wit: two mahogany chests, offered the Town as a gift by Mary Fi- field King, or take any other action thereon.


Article 9. To take any action that the Town may think proper upon the reports of the several Town Boards and Committees and ap- point or change any committee that the Town may think proper.


Article 10. ON PETITION OF APPROPRIATION COMMITTEE: To see if the Town will vote to elect at its Annual Town Meeting in March, 1935, two selectmen for the term of three years, two for the term of two years and one for the term of one year, from said Annual Election, and at each Annual Town Meeting thereafter elect in place of those selectmen whose terms are about to expire, an equal number of selectmen each to serve for three years, and the selectmen elected at the Annual Town Meeting in March, 1935, and thereafter, shall serve without salary, remuneration or compensation of any kind, or to take any other action thereon.


Article 11. ON PETITION OF APPROPRIATION COMMITTEE: To see if the Town will vote to authorize the Moderator to appoint a committee of three, one of whom shall be the Town Counsel, to petit- ion the incoming legislature for authority to prohibit any selectman elected under the provision of the foregoing article to succeed himself after having served a three year term, or to take any other action in relation thereto.


Article 12. ON PETITION OF THE APPROPRIATION COM- MITTEE: To see if the Town will adopt the following By-Law; If a person is employed by the Town and receives as salary or compensa- tion for such employment a sum in excess of two thousand dollars ($2,000), he shall not receive any other compensation or salary from the Town, derived from any other office, position or employment by the Town.

Article 13. ON PETITION OF APPROPRIATION COMMITTEE: To see if the Town will vote to authorize the Moderator to appoint a committee of five to investigate and act upon suggestions embodied in report of the Appropriation Committee covering,


(a) Married woman working for the Town whose husband is em- ployed by the Town,


(b) Employees of the Town whose salary is $2,000 or more who are engaged in private businesses,


and report at the next Annual Town Meeting or to take any other ac- tion in relation thereto.


You are directed to serve this warrant by posting a copy thereof, attested by you in writing in each of two public places in each voting precinct in said Town, seven days at least before the time for holding said meeting.


Hereof fail not, make due return of this warrant with your doings to the Town Clerk of said Town on or before the tenth day of October, 1934.


Given under our hands at Weymouth this third day of October in the year of our Lord Nineteen Hundred and Thirty-four.

SPECIAL TOWN MEETING


October 18, 1934


Pursuant to the within warrant a special meeting of the inhabi- tants of the town of Weymouth, represented by its duly elected and qualified Town Meeting Members, was held at the Hall of the Wey- mouth High School on Middle Street, East Weymouth, Thursday eve- ning, October 18, 1934.


The meeting was called to order at 7:50 o'clock by George L. Barnes, Annual Moderator, who requested the Town Clerk to read the warrant for said meeting. After reading the call for said meeting, it was voted on motion of Melville F. Cate, that the reading of the arti- cles in the warrant be omitted. The Town Clerk then read the last three paragraphs of the warrant and the attestation of the constable who served the warrant.


The Moderator then requested Rev. James J. Walsh, assistant pastor of St. Francis Xavier Church of South Weymouth to invoke the Divine Blessing upon the deliberations of this meeting.


Before proceeding to the business of the evening the following were sworn as Town Meeting Members:

Article 1. VOTED. To provide for salaries, operations and ex- penses during the remainder of the current fiscal year of several de- partments and activities of the Town, for certain improvements and to meet several requirements of the law, the several sums hereinafter set forth are hereby transferred from sum already appropriated; or borrowed or appropriated as specified for the several purposes and sub- jected to the conditions hereinafter declared; all such sums to be raised by taxation in the levy in the current year unless some other source of revenue is expressed.


Item. 1. VOTED: For maintenance of Town Hall, the sum of Four hundred and twenty-three ($423) is transferred from the interest and Discount account Item 42 of Art. 1 of the Annual Town Meeting 1934, to be expended under the direction of the Selectmen.


Item 2. Motion offered by the Appropriation Committee: For elections and registrations of voters, the sum of Fourteen hundred and fifty-five dollars ($1,455) is transferred from the interest and Discount account-Item 42 of Art. 1 of the Annual Town Meeting 1934. Robert H. Buchan moved as an amendment: That the sum be increased $600. to provide for a filing system of enrolled voters of the town with their party designation. This amendment was declared lost.


The motion of the Appropriation Committee was so voted. .


Item 3. VOTED: That no action be taken under this article.


Item 4. Motion offered by the Appropriation Committee: For the highway department the sum of Twenty-two-thousand, three hun- dred and five dollars and forty cents ($22,305.40) provided that the sum of eight thousand six hundred and five dollars and forty cents ($8,605.40) shall be for the salaries or wages of the regular men of the department; Four thousand dollars ($4,000) shall be for materials; Three thousand six hundred dollars shall be for additional labor; Four thousand nine hundred and fifty dollars ($4,950) shall be for unpaid bills; and One thousand one hundred and fifty (1,150) shall be for re- pairs on tractors; providing further that the sum of $16,205.40 of the above amount shall be raised and appropriated and the balance of Six thousand one hundred dollars ($6,100) shall be transferred from the Interest and Discount account-Item 42 of Art. 1 of the Annual Town Meeting 1934.


Mr. Albert Thibault moved as an amendment: That the sum of $8.000. be for additional labor instead of $3,600. as recommended by the Appropriation Committee.


The amendment was declared lost. More than seven members having doubted the vote a recount was ordered. The Moderator ap- pointed Albert Silvester, Daniel L. O'Donnell and George Reed as tell-

ers and they were sworn as such. The tellers reported 68 voting in the affirmative and 87 in the negative.


The Motion of the Appropriation Committee was then put and was so voted.


Item 5. VOTED: For unpaid bills of the Board of Public Welfare the sum of Five hundred and forty dollars ($540.) is transferred from that part of the appropriation of Public Welfare made at the Annual Town Meeting 1934, referring to the relief of persons not having a legal settlement in the Town.


Item 6. For the operation and all other expenses of the Water De- partment as itemized below, all of which sum shall be paid from the revenue of said department.


a. Maintenance $1,500.00


b. Replacements 2,100.00


c. Minor construction 2,500.00


d. Debt retirement 1,000.00


e. Interest 421.46 $7,521.46


Article 2. VOTED: That the sum of Seven thousand dollars (7,000.) be transferred from that part of the Appropriation for Public Welfare made at the Annual Town Meeting, 1934, referring to the relief of per- sons not having a legal settlement in the Town, to the appropriation made at the Annual' Town Meeting, 1934, for the Old Age Assistance under Chapter 118 of the General Laws.


Article 3. VOTED. That the sum of Five thousand dollars ($5,000.) be transferred from that part of the appropriation for Pub- lic Welfare made at the Annual Town Meeting, 1934 having to do with the relief of persons having a legal settlement in the Town; to the ap- propriation made at the Annual Town Meeting, 1934, for Soldiers Bene- fits: including State and Military Soldiers relief and the burying of in- digent soldiers and sailors.


Mr. Ralph Haskins moved and it was so voted that Article 5 be taken up.


Article 5. The Appropriation Committee moved: That the sum of Twenty five thousand nine hundred and forty-nine dollars and thirty- nine cents ($25,949.39) be transferred from that part of the Appropri- ation for Public Welfare-Art. 1, Item 27-made at the Annual Town Meeting, 1934, providing for the relief of persons having a legal settle- ment in the Town, to be expended under the joint direction of the Planning Board and the Board of Selectmen for the following pur- poses :


a. $21,700. shall be for the purchase of materials for Emergency Relief Administration projects, to be used through the Park, School and Street Department.


b. $1,500 for repairs to the Town Hall.


c. $1,000 for two Emergency Relief Administration investigators to be appointed by the Social Service Supervisor of the Relief Adminis- tration with the recommendation that preference be granted to citi -. zens of Weymouth, for these positions.


d. $1,749.39 for the unpaid bills of the Street Department incur- red on Emergency Relief Administration projects.


Under this article John H. Moran, Assistant to the Administrator and Accountant of the E. R. A. projects gave an interesting talk of the doings of the C. W. A .- and E. R. A. as applying to the Town of Weymouth.


In his remarks he stated that C. W. A. projects started Dec. 1933 and ended March 1934 when it was taken over by the E. R. A. The amount of wages paid to Weymouth persons since the start of the C. W. A. to the present date, October 10, 1934 under the E. R. A. was $285,548.80; amount paid for materials by the Town $48,626.54. Amount

paid for materials by the U. S. Government $7,830.50 making a total amount paid to Weymouth of $341,995.96.

Under the by-laws Mr. Moran's time having expired he was gran- ted further time in which to finish his remarks.


Mr. Robert H. Buchan moved to amend the motion of the Appro- priation Committee by striking out the words in sub-division c "prefer- ence be granted to" and insert the words "they must be" this amend- ment was so voted.


Mr. Thomas L. Kelly moved as an amendment by inserting the words in sub-division A after the word "for" as the word first appears "supervision and."


Mr. Prince H. Tirrell moved as an amendment by adding the words "hiring of equipment and trucking" to be inserted after the word "Pur- chase" as it first appears in the motion.


Mr. Benjamin M. Cowan moved as an amendment under sub- division "c" That the $1,000 be for two engineers to procure plans in- stead of two Emergency Relief Administrators investigators.


Mr. Ronald A. MacDonald moved to amend the motion by making the amount under sub-division "A" $22,000. instead of $21,700.


The amendment of Mr. Kelly was voted.


Mr. Emil J. Melee moved as an amendment by adding the words "for the purchase of a compressor". Not a vote.


The amendment of Mr. Tirrell was so voted.


The amendment of Mr. MacDonald was not a vote.


The amendment of Mr. Cowan was not a vote.


The motion of the Appropriation Committee as amended by Mr. Kelley and Tirrell's amendments was so voted.


The sub-division of "a" reads as follows:


$21,700 shall be for supervision and for the purchase of materials and for the purchase or hiring of equipment and trucking for Emergency Relief Administration projects, to be used through the Park, School, and Street departments.


Article 4. VOTED: That the Unexpended balance of that part of the appropriation for Public Welfare-Art. 1, Item 27-made at the Annual Town Meeting 1934, referring to the relief of persons having a legal settlement in the Town; and for reimbursement to other cities and towns for relief provided by them to persons having a legal settle- ment in this Town; be disbursed and accounted for as one fund.


Motion made to reconsider Article 1. After a long discussion on this question Mr. Melville F. Cate moved the previous question, after 10 minutes further debate the question was put and was declared lost. More than seven members having doubted the vote a recount was ordered. The tellers reported 57 voting in the affirmative and 81 voting in the negative.


Article 6. VOTED: That the Moderator be authorized to appoint a Committee of five to study and revise the Building Laws of the Town and to incorporate zoning laws in conformity with the Building laws and report its recommendations to the next Annual Town Meeting.


Article 7. The Appropriation Committee moved: That no action be taken under this article.

Mr. Francis N. Drown moved: That the Town vote to raise and appropriate the sum of $296.50 (Two hundred and ninety-six dollars and fifty cents) same to be paid to Wessagusset Post, Veterans of Foreign Wars of Weymouth for services rendered to the Town in connection with caring for abandoned cemeteries. The Moderator de- clared it was not a vote. More than seven members having doubted the vote a recount was thus ordered. The Tellers reported 84 voting in the affirmative and 50 in the negative, the motion of Mr. Drown was so voted.


Article 9. This article was passed.


Article 10. Motion made by the Appropriation Committee: That at the Annual Town Meeting in March 1935, the Town shall elect by official ballot five Selectmen who shall hold office, two for the term of three years, two for the term of two years and one for the term of one year, from said Annual Election and at each Annual Town Meeting, thereafter, it shall elect in place of those Selectmen whose terms about to expire, an equal number of Selectmen, each to serve three years, and in each instance the Selectmen shall serve until their respective successors are qualified, and all such selectmen so elected shall serve without salary or compensation of any kind.


Mr. John W. Knox moved: That the subject matter of this article be referred to the next Annual Town Meeting. So voted.


Article 11. Voted: That no action be taken under this article.


Article 12. Voted: That the Town adopt a by-law as follows: "If a person is employed by the Town and receives a salary or compen- sation for such employment, a sum in excess of two thousand dollars ($2,000) he shall not receive any other compensation or salary from the Town derived from any other office position, or employment by the Town.


Article 13. Motion offered by the Appropriation Committee: That the Moderator be authorized to appoint a committee of five members to investigate, study and report to the next Annual Town Meeting its recommendations concerning the employment by the Town of married women whose husbands are employed by the Town; and concerning such Town employees whose salary is Two thousand dollars ($2,000.) or more, and who are engaged in private business.


Mr. Robert H. Buchan moved as an amendment that the Commit- tee be appointed from the floor. Not a vote. The motion of the Appro- priation Committee was so voted.


Voted to 10:10 P.M. to adjourn without date.
