PARKS AND PLAYGROUNDS


ARTICLE 23. (On petition of the Park Commissioners and others). To see if the Town will accept by gift, purchase or take by right of eminent domain for park purposes a certain parcel of land situated at the corner of East and North Streets, Weymouth Heights, now owned by Joseph O. Thompson or take any other action in relation thereto.


ARTICLE 24. (On Petition of the Park Commissioners). To see if the Town will accept the gift of a certain parcel of land by James F. Cul- linane for park purposes, on the southerly side of Stella Tirrell Park, or take any other action in relation thereto.


ARTICLE 25. (On Petition of the Weymouth Lions Club). To see what sum of money the Town will raise and appropriate for the construction of ice skating facilities on Bicknell School Grounds, Legion Field, Weston Park, Stella Tirrell Playground and Bradford Hawes Park; and to request the School Committee and the Park Commission to sponsor and construct said project in 1939 or take any other action in relation thereto.

WATER DEPARTMENT


ARTICLE 26. (On Petition of the Water Commissioners). To see if the Town will rescind the action taken under Article 36 of the Annual Town Warrant of 1928 in so far as it applies to bonds or notes not already issued under the authority thereby given, or take any other action in relation thereto.


ARTICLE 27. (On Petition of the Water Commissioners). To see if the Town. will vote to reaffirm the action taken under Article 35 of the Annual Town Warrant of 1928, authorizing the Board of Water Commis- sioners to acquire by gift or purchase or take by right of eminent domain for the purpose of protecting the Town's water supply, certain land lying within' the water-shed of Weymouth Great Pond and not already owned by the Town, and will authorize the appropriation of an amount not to exceed $15,000. from the General Fund of the Water Department for said purpose, or take any other action in relation thereto.


MISCELLANEOUS


ARTICLE 28. (By Derection of the Selectmen). To see what sum of money the Town will vote to raise and appropriate for the repair of leaky masonry in the Town Hall.


ARTICLE 29. (By Direction of the Selectmen). To see what sum of money the Town will vote to raise and appropriate for the purpose of repairing the heating system in the Town Hall.


ARTICLE 30. (By Direction of the Selectmen). To see what sum of money the Town will vote to raise and appropriate for the repair and main- tenance of properties owned by the Town through foreclosure of tax liens.


ARTICLE 31. (On Petition of Ronald L. White and others). To see if the Town will appoint a suitable committee to study into the advisability of establishing a Municipal Airport in the Town of Weymouth.


ARTICLE 32. (By Direction of the Selectmen). To see if the Town will vote to raise and appropriate the sum of $400.00 for the purchase and planting of eight trees at Sea and Athens Streets to replace nine trees re- moved because of gas poisoning, or take any other action in relation thereto.


ARTICLE 33. (On Petition of Everett E. Callahan and others). To see if the Town will vote to construct a hospital under the terms of the will of Laban Pratt, or take any other action in relation thereto.


ARTICLE 34. (On Petition of the Veterans of Foreign Wars). To see if the Town will vote to instruct its Board of Selectmen to contact with Wessagusset Post No. 1399 of the Veterans of Foreign Wars of the United States for the care and maintenance of certain cemeteries in the Town; namely, Old Cemetery off Park Avenue; Old Cemetery opposite Fairmount Cemetery on Pleasant Street; Old Cemetery on Pleasant Street at Pine Street, and one located off Randolph Street, and that the sum of $400 be raised and appropriated to be paid to Wessagusset Post, V. F. W. No. 1399 for said care of these cemeteries, or take any other action in relation thereto.


ARTICLE 35. To see if the Town will accept the addition to its by-laws of the Zoning Committee's report, said addition to be known as the "Zoning Act", or take any other action in relation thereto.


ARTICLE 36. To see if the Town will vote to raise and appropriate the sum of $600.00 for the purpose of maintaining, during the ensuing year, the mosquito control works as estimated and certified to by the State Recla- mation Board in accordance with the provisions of Chapter 112, Acts of 1931.

ARTICLE 37. (By Direction of the Selectmen). To see if the Town will accept the gift of a certain parcel of land, lying on the northeasterly side line of Middle Street, by Wallace D. Cowing, for sidewalk purposes, or take any other action in relation thereto.

ANNUAL TOWN MEETING March 6, 1939


Pursuant to a warrant duly issued the annual meeting of the inhabitants of the Town of Weymouth represented by its duly elected and qualified town meeting members was held at the hall of the Weymouth High School, East Weymouth, on Monday, March 6, 1939. 243 town meeting members names being checked by police stationed at the doors for that purpose.


The meeting was called to order at 7:45 o'clock in the evening by Daniel L. O'Donnell, annual moderator. In the absence, by illness, of Mr. Clayton Merchant, Town Clerk, the meeting elected Emerson R. Dizer, temporary clerk who was duly sworn.


The attested copy of the warrant for the meeting was read, after which Rev. Joseph R. Newton, minister of the East Weymouth Congregational Church was called upon to invoke the Blessing of the Ruler of the Universe upon the deliberations of the meeting.


Those town meeting members not previously sworn were at this time sworn by the Moderator.


The Moderator then called for consideration of the articles in the warrant.


BUDGET


ARTICLE 1. Mr. John Field, Secretary of the Appropriation Com- mittee moved that Article 1 be considered item by item. So voted.


Mr. Field moved: To provide for the salaries, operation and expenses for the fiscal year of the several Town's Departments and activities, for certain improvements, and to meet certain requirements of the law, the several sums hereinafter set forth are hereby appropriated for the several purposes and subject to the conditions hereinafter specified, all such sums to be raised by taxation in the levy of the current year unless some other source of revenue is specified.


Item 1. For all expenses of the Appropriation Committee $ 600.00 Of this sum $100. is reserved and is not to be used except in case of a Special Town Meeting. Mr. Callahan offered a substitute motion making the amount $300. instead of $600. Declared not a vote. Mr. Callahan moved for a roll call vote on the question. The Moderator appointed as Tellers: Mr. Edward A. Hunt, Mr. William A. Hodges and Mr. George E. Curtin. They were duly sworn and after taking a count of the Town Meeting Members present announced the number as 196. Those desiring a roll call were then counted and the tellers reported 29 so re- questing. Less than the required number (1/5) having expressed a desire for a roll call the moderator de- clared the request denied.


The motion of the Appropriation Committee was then tentatively adopted.


Item 2. Mr. Field moved: For salaries and expenses of the Selectmen's Department. Of this sum $3,463.70 shall be for the salaries and all expenses of the Selectmen, whose base pay for salary and all expenses is hereby established at the rate of $520. each per year together with $100. additional for

the Chairman and $480. for a clerk who may be a Selectman.


Mr. Callahan offered a substitute motion as follows: For salaries and all expenses of the Selectmen's De- partment $4,740.00. Of this sum $4,140. shall be for the salaries of the Selectmen to be divided as follows: $900. for the Chairman; $1,140. for the Clerk and $700 for each of the three remaining Selectmen; $300. shall be for miscellaneous expenses; $300. for printing and advertising.


Mr. Peterson moved that $2,000. be substituted for the sum of $2,224.40.


Mr. Callahan's motion lost.


Mr. Peterson's motion lost.


Motion of Appropriation Committee tentatively adopted.


Item 3. Mr. Field moved: For the salary and all expenses of the Town Accountant's Department.


$ 6,274.00


In this sum provision is made for increasing the salary of a clerk to a rate of pay not exceeding $1,144.00 per year.


This motion was tentatively adopted.


Mr. John W O'Donnell moved: That the Town Accountant, in preparing his statistics for the annual Town Report, be instructed to tabulate and have printed in said Report, - on a page or pages, apart from other departmental statistical matter, the names of all those holding elective and appointive offices in the Town government, together with the complete annual income derived by each from all sources, such as salaries, fees, commissions, etc. paid to them by the Town. Said annual incomes to be itemized so as to show from which department or departments the income is derived, - with a brief explanation of the services rendered.


So voted.


Item 4. Mr. Field moved: For the salary of the Town Treas- urer and all expenses of the Treasurer's Department Not exceeding $1,700. of this total appropriation shall be for clerical assistance and in this latter sum pro- vision is made for increasing the salary of a clerk to a rate of pay not exceeding $728. per year and whose total compensation for the fiscal year shall be $470. Mr. Anderson moved that the salary of the Treasurer be $1,000. Motion lost.

The motion of the Appropriation Committee was ten- tatively adopted.


Item 5. Mr. Field moved: For the compensation of the Tax Collector and all expenses of the Tax Collector's De- partment. $ 9,657.00 The compensation of the Tax Collector shall be five and one-half mills on each dollar of taxes collected the Selectmen shall be authorized and instructed to insure the Tax Collector in the sum of $15,000. for Robbery Insurance.


This motion tentatively adopted.

Mr. Field moved: For the salaries and all expenses of the Assessors' Department. Of this amount a sum not exceeding $2,570. shall be for clerical salaries and authority is granted the Asses- sors to equalize the wages of the clerical assistants at the maximum in effect during 1938. The salary of the Clerk of the Board of Assessors is hereby estab- lished at a rate of $2,250. per year. $1,300. shall be for equalization of property values of which sum not exceeding $800. shall be for compensation to the Assessors. This motion was tentatively adopted.

Item 7. Mr. Field moved: For the salaries and all expenses of the Legal Department. $ 3,000.00 Of this sum $100. shall be paid to the Town Counsel for preparing the Annual Town Warrant. This motion was tentatively adopted.


Item 8. Mr. Field moved: for the payment of Damages. $ 4,000.00 This motion was tentatively adopted.


Item 9. Mr. Field moved: For the salary of the Town Clerk and all expenses of the Town Clerks Department. $ 4,252.89


A sum not exceeding $1,230. of this total appropriation shall be for clerical assistance and in this latter sum provision is made for increasing the salary of a clerk to a rate of pay not exceeding $1,300. per year. The salary of the Town Clerk is hereby established at a rate of pay of $800. per year. This motion was tentatively adopted.


Item 10. Mr. Field moved: For Elections and Registrations of Voters.


$ 3,208.00


Of this amount $100. additional compensation is voted the Clerk of the Board of Registrars of Voters for the year 1939 only, and a sum not exceeding $288. shall be for clerical assistance at a rate not exceeding $936. per year.


This motion was tentatively adopted.


Item 11. Mr. Field moved: For all expenses of the Engineering Department. $ 5,500.00


This sum includes payment for the Town Survey and placing of bound stones on existing Town Ways, the making of street surveys, and such engineering work as may be authorized by the Selectmen. This motion was tentatively adopted.


Item 12. Mr. Field moved: For all expenses of the Planning Board. Mr. Callahan moved to substitute $100. for $300. Not a vote. The motion of Mr. Field was tentatively adopted.

Item 13. Mr. Field moved: For the maintenance and upkeep of the Town Hall and War Memorials at the Civic Center including the grounds, to be expended under the direction of the Selectmen. $ 7,250.00


Provided that all toll calls of the Water Department and for the Works Progress Administration or its suc-

cessors shall be paid out of their respective appropria- tions; of this total sum $1,560. shall be for the services of a janitor and $65.40 shall be for the purchase of a desk for the Tax Collector's office.


Mr. Peterson moved to reduce the appropriation by $420. Motion lost. The motion of Mr. Field was tentatively adopted.


Item 14. Mr. Field moved: For the maintenance of the Civil War Soldiers' monument and the King Philip War Memorial including the grounds; to be expended under the direction of the Selectmen. $ 100.00 This motion was tentatively adopted.


Item 15. Mr. Field moved: For the salaries and all other ยท expenses of the Police Department. From this sum provision is made for the disposition of one automobile and the purchase of another by the Chief of Police. Authority is granted the Chief of Police to equalize the wages of all regular patrolmen at the maximum in effect during 1938. This motion was tentatively adopted.

Item 16. Mr. Field moved: For the salaries and all other expenses of the Fire Department. The wages of the Deputy Chief are hereby established at a rate of pay not exceeding $2,185.72 per year. Pro- vision is made herein for the services of three addition- al permanent firemen. $300. shall be for the rental of church bells as heretofore and $550. for the renewal of old fire-alarm boxes. In this aggregate amount a sum not exceeding $2,000. is provided for the disposi- tion of a truck and its replacement in the fire alarm division and the purchase of a car for the use of the Deputy Chief. Mr. Peterson moved the sum of $61,300 for salaries instead of $66,008.20. Motion lost. The motion of Mr. Field was tentatively adopted.

Item 17. Mr. Field moved: For the salary and all other ex- penses of the Building Inspector's Department. $ 1,610.00 Of this sum $60. shall be for the Board of Appeals. This motion was tentatively adopted.


Item 18. Mr. Field moved: For the salary of the Sealer of Weights and Measures and all other expenses of the Department. $ 1,250.00


This motion was tentatively adopted.


Item 19. Mr. Field moved: For Gypsy Moth and all other insect pest extermination to be expended under the direction of the Gypsy Moth Superintendent $ 4,500.00


Of this sum $1,500. shall be used for work on private property for which the Town shall be reimbursed. Mr. Hebert moved to substitute $1,000. for $1,500. So voted. The motion of Mr. Field as so amended was tentatively adopted.


Item 20. Mr. Field moved: For the salary of the Tree Warden and the care of shade trees. $ 2,150.00 Of this sum $250. is allocated for special emergency

Item 21. Mr. Field moved: For Street Lighting. $ 36,135.69 The Electric Lighting Committee is hereby instructed to contract with the Weymouth Light and Power This motion was tentatively adopted. Company for street lighting.


Item 22. Mr. Field moved: For the salary and all other expenses of the Harbor Master. ($ 800.00) Mr. Paul A. Newsome moved to increase the amount $ 1,200.00


to $2,000. later changing it to $1,200.


The motion of Mr. Newsome was carried. The motion of Mr. Field, as amended, was tentatively adopted.


Item 23. Mr. Field moved: For the salaries and all other ex- penses of the Board of Health. $ 16,000.00 Of this sum the following specific appropriations are made :


$1,000.00 shall be for the supplies and services of dentists ;


450.00 shall be for the salaries of the elected mem- bers of the Board;


5,000.00 shall be for payments as required to the Norfolk County Tuberculosis Hospital;


1,040.00 and not exceeding this sum, shall be for the services of a dental hygienist and $200. for her expenses;


1,800.00 shall be for the maintenance of the Town dumps including the services of an attend- ant whose wages shall not exceed 621/2c per hour ;


1,800.00 shall be for plumbing inspections but the services and all expenses of the plumbing inspector shall not exceed an amount equal to that collected for all plumbing permits plus $250 .;


250.00 shall be for all expenses of conducting the diptheria clinic;


50.00 shall be for all expenses for the protection of the public from rabies;


on and after December 15th any unexpended bal- ances in the above account may be treated as one fund. This motion was tentatively adopted.


Item 24. Mr. Field moved: For the employment of Nurses. $ 2,500.00 The Board of Selectmen are hereby authorized to contract with the Weymouth Visiting Nurse Associa- tion to furnish the services of one or more nurses in case such services are a proper charge against the Town.


This motion was tentatively adopted.


Item 25. Mr. Field moved: For the maintenance of the Nor- folk County Tuberculosis Hospital. $ 16,544.68 This motion was tentatively adopted.

Item 26. Mr. Field moved: For Garbage Disposal. $ 4,500.00


The Selectmen are authorized to contract for the disposal of garbage from April 1, 1939 to April 1, 1940; of this total amount $3,900. shall be raised by taxes in the current year and in addition to this sum the Selectmen may use whatever unexpended balance re- mains in the existing appropriation from prior years for the same purposes.


Mr. Callahan moved to amend by changing the word Selectmen to Board of Health in both instances where the word Selectmen appears. So voted. The motion as amended was tentatively adopted.


Item 27. Mr. Field moved: For Public Welfare.


$173,206.00


Provided that $2,000 of this sum and $1,000 of the appropriation under Item 28 aggregating and not ex- ceeding $3,000. shall be for the salary and all expenses of the Welfare Agent appointed under the provisions of Chapter 7, of the Acts of 1938. Of this sum $47,212. shall be for Aid to Dependent Children pro- vided not more than $1712. shall be used for ad- ministrative expenses. Of the balance of this appro- priation not more than $6024. shall be used for admin- istrative expenses in the Welfare Department. Provision is made in the administration fund for increasing a clerk to a rate of pay not exceeding $780. per year, and for the replacement of 2 typewriters in an amount not exceeding $100. which is available specifically for that purpose. $5,970. shall be for all expenses of the Town Infirmary. $4,000. shall be for compensation to doctors and other medical services rendered. $10,000. shall be for the reimbursement to other cities and towns for relief provided by them to persons having a legal settlement in this Town. The balance of this ap- propriation shall be for relief of persons having a legal settlement in the Town or the relief of persons not having a legal settlement in the Town. Provided that any portion of the total appropriation for Public Welfare under this Item may be expended for mis- cellaneous Welfare Items after the Appropriation Committee has approved such expenditures. Mr. Dowd submitted the report of the Committee on the Study of Relief and moved as follows:


1. That the Board of Public Welfare be instructed to grant permission to, and cooperate with, the committee on the Study of Relief to complete the supervision and installation of an accounting system as recommended in the report of the Certi- fied Public Accounting Investigators, the funds for which being available under the appropriation now in force.


2. That the committee on the Study of Relief be made a permanent committee, subject to modifica- tion by the Moderator after each annual Town Meeting; that this Committee and its successors be empowered to continue its studies of Relief with access to Records and Procedure of the De- partments of Public Welfare and Relief and who shall go before the Board of Public Welfare when

necessary to make recommendations and ask for corrections in the conduct or administration of relief. Such committee shall report to each Annual Town Meeting and may be terminated at such time by a majority vote of the members then present. The above motions were tentatively adopted.


Item 28. Mr. Field moved: For Old Age Assistance under General Laws, (Ter. Ed.) Chapter 118A as amended Of this sum an amount not exceeding $3394.00 shall be for administrative expenses - this amount includes the sum of $1000. to be expended under Item 27 for the salary and expenses of the Welfare Agent - and provision is also made in this sum for a clerk's wages at a rate of pay not exceeding $728. per year.
