To see if the town will vote to authorize and instruct the Board of Selectmen to purchase or take by right of eminent domain under Chapter 79 of the General Laws, for school purposes, a certain parcel of land in the town, bounded and described as follows:


Easterly by Montrose Ave. by a curved line, four hundred (400) feet, more or less; Northeasterly by land now or formerly of Victor and Mary Kuklinsky, three hundred and fifty-nine (359) feet; Westerly by land now or formerly of Anna Kuklinska, eight hundred and thirty-nine (839) feet. Southerly by land now or formerly of Kerr Building Trust, four hundred and twenty-seven (427) feet; Southeasterly by land now or formerly of Jennie H. Perkins' Heirs, one hundred and forty-seven (147) feet.


Being Lot 12 on Plat 39B of the Assessors' Plans and containing 5.34 acres according to said plans. Said parcel is supposed to be owned by David N. Perkins. And, to raise and appropriate a sufficient sum of money to carry out the purposes of this article .- Elementary School Planning Committee. .

ARTICLE 18


To see if the town will vote to dedicate to, and use for, park purposes only, the town-owned land in the area bounded by North Avenue, William H. Hall Park, Lake Quannapowitt and Lakeside Avenue,, shown on the Assessors' Plans as Lot 9 on Plat 11 .- Wakefield Planning Board.


On motion by Finance Committee:


Voted: To dedicate to, and use for park purposes only, the town owned land in the area bounded by North Avenue, William H. Hall Park, Lake Quannapowitt, and Lakeside Avenue, as shown on the Assessors' Plans as Lot 9 on Plat 11.


ARTICLE 19


To see if the town will vote to authorize the Board of Selectmen to convey the following described parcel of land in Wakefield, owned by the Town, and no longer required for public purposes, for the minimum amount of $500.00, and upon such further terms and conditions as it may deter- mine, said parcel being bounded and described as follows:


NORTHERLY by Lakeside Ave., about three hundred fifty-five (355) feet;


EASTERLY by other land of Town of Wakefield, one hundred twenty- five (125) feet;


SOUTHERLY by a line parallel to and one hundred twenty-five (125) feet distant from the first mentioned line of Lakeside Ave., about three hundred fifty (350) feet;


WESTERLY by North Ave., one hundred twenty-five (125) feet.


Containing about one (1) acre of land, and being a portion of Lot 9 of Plat 11 as shown on the 1957 Assessors' Plans of the Town of Wakefield. -George H. Adams and others.


The Moderator announced that any action under Article 19 would be illegal, owing to the vote of the meeting under Article 18.

Voted: That the subject matter of Article 19 be indefinitely postponed.


ARTICLE 20


To see if the town will vote to amend its Zoning By-Laws and Zoning Map by changing from a Single-Residence district to a Business district a tract of land southerly of Route 128, on the southwesterly side of North Avenue, and about opposite the intersection of North Avenue and Quanna- powitt Parkway (so-called), bounded and described as follows:


Beginning at a point in the southwesterly side of North Avenue 500 feet southeasterly from the junction of the southeasterly side line of the State Highway Layout known as Route 128 and the southwesterly side line of North Avenue, thence southeasterly 250 feet along the southwesterly side line of North Avenue to a point, thence turning at a right angle and running southwesterly 200 feet to a point, thence northwesterly 250 feet

Chairman Kenneth W. Thomson of the Town Planning Board read the report of the Planning Board which stated that a hearing, duly ad- vertised, was held on February 18, 1958, and all legal requirements duly com- plied with.


Mr. Thomson reported that the report also included the Committee's report on Articles 21 and 22, on hearings held the same evening.


On motion by the Planning Board:


Voted: That action on the subject matter of Article 20 be indefinitely postponed.


ARTICLE 21


To see if the town will vote to amend its Zoning By-Laws and Zoning Map by changing from an industrial district to a general residence district a tract of land one hundred and fifty (150) feet wide situated on the northerly side of Hart Street and bounded westerly by Melvin Street and easterly by Valley Street .- Americo Petrucci and others.


Motion by Planning Board:


That the Town amend the Zoning By-Laws and Zoning Map by changing the area described in Article 21 from an industrial to a general residence zone.


The vote on the motion was in the negative, and the Moderator de- clared the motion not carried.


ARTICLE 22


To see if the town will vote to amend the Town Zoning By-Laws and Zoning Map by changing from a general residence to a business district a tract of land containing approximately 434 acres by extending the exist- ing business district on the southerly side of Water Street as follows:


Beginning at a point on the easterly side line of a Private Way known as Del Carmine Street at the southerly line of the existing business district on the southerly side of Water Street, thence the line extends southerly along the easterly side line of the Private Way known as Del Carmine Street to the center line of Mill River, thence turning at a right angle and running westerly approximately 300 feet to a point, thence turning at a right angle and running northerly by a line running parallel to it, a. distance of 300 feet from the easterly side line of the Private Way known as Del Carmine Street to the existing business district on the south- erly side of Water Street .- Arthur Muse and others.


On motion by Planning Board:


Voted: That action on the subject matter of Article 22 be laid on the table.

ARTICLE 23


To see if the town will vote to amend its Zoning By-Laws and Zoning Map by changing from a general residence to a business district all land not already zoned for business lying within a tract of land bounded by Main Street, Lowell Street, and Route 128, said land being bounded and described as follows:


Easterly by the westerly side line of Main Street; northerly by the southerly side line of the State Highway layout known as Route 128; west- erly and southerly by the existing business district located at the inter- section of Main and Lowell Streets .- Cornelius Thibault and others.


The report of the Town Planning Board was read by Chairman Ken- neth W. Thomson. The report stated that a hearing on Article 23, duly advertised, was held on February 18, 1958, and all requirements of the law duly complied with.


On motion by Planning Board:


Voted: To amend the Zoning By-Laws and Zoning Map by changing the area described in Article 23 from a General Residence to a Business Zone.


The vote in the affirmative, as counted by the tellers, was: Yes, 258 - No, 4, and, having received the necessary two-thirds vote, the Moderator declared the motion carried.


ARTICLE 24


To see if the town will vote to amend Section 2 of its Zoning By-Laws entitled "Single Residence Districts" by striking out the first paragraph and inserting in place thereof the following:


In a single residence district no building or premises shall be erected, altered, or used for any other purpose than 1, Single family detached dwelling; 2, Club, except a club the chief activity of which is a service customarily carried on as a business or a club with more than five sleep- ing rooms; 3, Church; 4, Educational use; 5, Crop or tree farm, garden, nursery, or greenhouse; 6, Municipal recreational use; 7, Railroad local passenger station; 8, Physicians' and doctors' offices; 9, Accessory use on the same lot with an customarily incident to any of the above permitted uses and not detrimental to a residential neighborhood. The term "access- ory use" in this and the next section shall not include garage space for more than two cars, nor the keeping of poultry, pigeons, dogs, swine, or other animals except for domestic use .- Richard A. Stacio and others.


The report of the Planning Board was read by Chairman Kenneth W. Thomson. The report stated that a hearing, duly advertised, was held on February 18, 1958, and that all requirements of law were complied with.


The report stated that favorable action on this article will amend the Zoning By-Laws so that any use of buildings in a residential area for the purpose of operating convalescent homes will be subject to the approval of the Board of Appeals after a public hearing.


On motion by Planning Board:


Voted: To amend Section 2 of the Town Zoning By-Laws entitled "Single Residence Districts" by striking out the first paragraph and in- serting in place thereof a new first paragraph as described in Article 24.

ARTICLE 25


To see if the town will vote to raise and appropriate a sum of money for the improvement of streets and/or roads under Chapter 90, and to authorize the Board of Public Works to take by right of eminent domain rights and easements necessary in connection therewith for construction and to slope land back from street lines, said money to be used in con- junction with any money which may be allotted by the state or county, or both, for this purpose, or take any other action in relation thereto. -Board of Public Works.

Voted: To raise and appropriate the sum of $9,250 to carry out the purposes of Article 25.


ARTICLE 26


To see if the town will vote to raise and appropriate a sum of money for the maintenance of various streets; built under Chapter 90, General Laws, Ter. Ed., said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose or take any other action in relation thereto .- Board of Public Works.


On motion by Finance Committee :


Voted: To raise and appropriate the sum of $1,500 to carry out the purposes of this article.


ARTICLE 27


To see if the town will vote to raise and appropriate a sufficient sum of money to construct sidewalks on various public streets in the town. -Board of Public Works.


On motion by Finance Committee:


Voted: To raise and appropriate the sum of $5,000 for the purpose of constructing a sidewalk on the North Side of Lowell Street from Mag- nolia Terrace to the existing sidewalk of the Dolbeare School, said work to be done under the provisions of the Betterment Act.


ARTICLE 28


To see if the town will vote to raise and appropriate a sufficient sum of money for the construction of sewers for surface drainage in the town and/or authorize and instruct the treasurer, with the approval of the selectmen, to borrow and issue notes or bonds of the town therefor, and/or by transfer from other available funds .- Board of Public Works.

Voted: To raise and appropriate the sum of $3,500 to carry out the purposes of Article 28.

a. Stark Avenue running from Nahant Street southerly approximately 1400 feet to a turnaround.


b. Woodcrest Drive running from Vernon Street to Vernon Street a distance of approximately 1900 feet.


c. Paon Boulevard running from Fosters Lane to Paon Boulevard a distance of approximately 2140 feet.


d. Paon Circle running from Paon Boulevard easterly a distance of approximately 120 feet to a turnaround.


e. Karen Road running from Brook Street to Putnam Avenue a dis- tance of approximately 1075 feet.


f. Court Street running from Aborn Avenue to Cordis Street a dis- tance of approximately 950 feet; and to see if the town will vote to raise and appropriate a sufficient sum of money for the original construction

Voted: That the town accept and adopt, under the Betterment Act, the reports of the Board of Public Works on the acceptance and layout of the streets described in Article 31, paragraphs A, B, C, D and E, plans of said layouts being on file with the Town Clerk, and that the Town author- ize the taking of slope easements in land adjoining the locations of said proposed town ways in accordance with the provisions of Chapter 82, Section 32B of the General Laws; and further that for the original con- struction of Stark Avenue, Woodcrest Drive, Paon Boulevard, Paon Circle, and Karen Road, including land damages and cost of pavement and side- walks laid at the time of said construction or for the construction of stone, block, brick or other permanent pavement of similar lasting character under specifications approved by the Department of Public Works, the town raise and appropriate the sum of $107,860.09 and appropriate by transfer the sum of $4,130.33 from the following unexpended balances:

Meeting called to order at 7:36 P. M. by Moderator Roger H. Wingate.


ARTICLE 32


To see if the town will vote to authorize the Board of Public Works to construct sewers across private land and in or across highways herein- after named:


a. Oak Street from existing sewer at Atwood Street, to Nahant Street, including Oak Street trunk sewer from Oak Street to Mill River trunk sewer; Nahant Street from Oak Street to Farm Street pumping station, construction of Farm Street pumping station; force main from Farm Street pumping station to existing sewer in Nahant Street.


b. Greenwood Avenue from Hillis Avenue southerly approximately 57 feet to Maple Way and from Maple Way southwesterly approximately 245 feet toward Everett Avenue; and from Everett Avenue westerly approx- imately 185 feet to a point near Orchard Avenue; and easterly from Everett Avenue approximately 80 feet, and in Everett Avenue from Hillis Avenue southerly approximately 365 feet to Greenwood Avenue; and in Maple Way from Greenwood Avenue southerly approximately 240 feet to a dead end.


c. Quannapowitt Parkway; beginning at the existing sewer approxi- mately 2300 feet easterly from North Avenue and extending the existing sewer approximately 350 feet easterly to a dead end.


d. Green Street; beginning at the existing sewer northerly of Sher- man Road in Green Street and extending the existing sewer northerly approximately 800 feet to a dead end.


e. Parker Road; beginning at the existing trunk sewer on the south side of Route 128 and extending approximately 700 feet southerly to a dead end near Elm Street.


f. Preston Street; beginning at an existing manhole at the inter- section of Preston Street and Curtis Street and extending northerly ap- proximately 300 feet to a dead end.


g. Hopkins Street, Prospect Street; from the M.D.C. trunk sewer crossing in Hopkins Street southeasterly approximately 1100 feet to Pros- pect Street and easterly in Prospect Street approximately 1100 feet to a dead end.


h. Stark Avenue; from the existing sewer southeasterly approximately 325 feet to a dead end. and raise and appropriate a sufficient sum of money therefor and/or authorize the treasurer with the approval of the Board of Selectmen to borrow and issue notes or bonds of the town therefor and/or appropriate by transfer from available balances and authorize the Board of Public Works to purchase or take by right of eminent domain easements in and over private land necessary in the construction and maintenance of said sewers .- Board of Health.


On motion by Finance Committee:


Voted: To authorize and instruct the Board of Public Works to con- struct sewers as described in Article 32, paragraphs b, d, e, f, g and h and
