thousand dollars ($4,000.00) from said Article No. 64 to Highway Repairs to be added to the amount appropriated under Article No. 3 Annual Town Meeting 1959.


Article 5. Voted to rescind the vote in Article No. 3 under the Veterans' Benefits section at the Annual Town Meeting of 1959 whereby a segregated budget was voted in a total amount of Twenty-two thousand seven hundred sixty-six dollars and forty-six cents ($22,766.46) and to vote to raise and appropriate the above amount as one sum for Veterans' Benefits.


Article 6. A motion to pass this article over was voted in the negative and then it was:


Voted to authorize the Selectmen to convey, for a consideration of Three hundred fifty dollars ($350.00), all right, title and interest of the Town in the land known as Factory Avenue which is situated on the southerly side of East Water Street and is bounded; Northerly by East Water Street, 67 feet more or less; Easterly by land now or formerly of Lapointe, 205 feet more or less; Southerly by land now or formerly of Rice and Hutchins Shoe Com- pany, 67 feet more or less; and Westerly by land now or formerly of Rice and Hutchins Shoe Company 205 feet more or less.


Article 7. A motion to pass this article over was voted in the negative and then it was :


Voted to direct the Town Treasurer to publish in the Town Report for 1959, and each year thereafter, the total amount of monies paid to each employee of the Town for the year, said report to list the name of the employee, the department which employed the individual and the total amount of money paid to each employee as reported on the Federal withholding statements.


Article 8. Voted that the Moderator appoint a com- mitee of five to investigate the advisability of appointing a Town Accountant, said committee to make its report in

the town report for 1959 and that this same article with the added words "or take any other action relative there- to" be inserted in the Warrant for the 1960 Annual Town Meeting.

Article 9. A motion to amend the proposed by-law, as published in the Warrant, by inserting after the words "the estimated cost", where they first appear in said pro- posed by-law, the additional words "of any one item" was voted in the negative by a majority vote of the show of hands.


A motion to delete the words "or by letter of invi- tation to at least two (2) responsible persons, or by both means" from the proposed by-law was voted in the af- firmative by a majority vote of the show of hands.

Section 6. Except in cases of extreme emergency publicly declared by the Selectmen, no contract for work, or other services other than professional, to be performed for the Town, or the purchase of mate- rials, supplies or equipment, the estimated cost of which is estimated to cost one thousand dollars (1,000.00) or more shall be awarded by any officer, board, department, or committee unless written pro- posals therefor have first been solicited in two (2) of the newspapers circulating in the Town stating the time and place where plans and specifications of pro- posed works, services, materials, equipment or sup- plies may be had and the time and place for opening the proposals in answer to requests or advertisements.

The Town shall reserve the right to reject any or all such proposals. No purchases and work or services other than professional, for which a contract is pro- posed shall be split or divided for the purpose of evading the provisions of this section. All Statements of Emergency, Letters, Proposals and Contracts re- ferred to herein shall be kept on file by the officer, board of committee concerned for a period of two years and shall be open to public inspection at reason- able times, - and is adopted it is directed that the provisions of this By-Law shall become effective as of 30 June, 1959.

Voted to appropriate from available funds the sum of Fifty dollars ($50.00) for the care and maintenance of the Korean War Honor Roll at the Me- morial Library and it was further voted that the Veterans Agent be instructed to investigate the feasibility of moving said honor roll to a permanent roll on the Memorial Stadium.

Voted to appropriate from available funds the sum of One hundred fifty dollars ($150.00) for the removal of three (3) stumps in the sidewalk area on westerly side of Concord Street, southerly from Douglas Print Shop and added to amount raised and appropriated under Article No. 29 of Annual Town Meeting of 1958.


Article 16. A motion to pass over was voted in the negative and then it was: Voted to appropriate from available funds the sum of Three hundred dollars ($300.00) to be added to the sum voted under Article No. 30 of the Annual Town Meeting of 1958 for completion of sidewalk and concrete curbing, for a distance of approxi- mately 325 feet, on the westerly side of Lavina Avenue.


Article 17. Voted to raise and appropriate the sum of Two thousand six hundred dollars ($2,600.00) to re- move sidewalk and curb on private property and to install new curb, sidewalk, catch basin, leaching fields, 200' of 12" drain pipe and to penetrate approximately 1275 square yards of area at the end of Pine Haven Circle pro- viding that an easement can be obtained from James Millar.

A motion to raise and appropriate the sum of $3,700.00 for the purpose of this article was voted in the negative and then it was: Voted to raise and ap- propriate the sum of One thousand dollars ($1,000.00) for the purpose of installing necessary drainage in Lewis Park prior to re-surfacing as appropriated under Article No. 39 of the Annual Town Meeting of 1958.


Article 19. A motion to pass this article over was voted in the negative and then it was:


Voted to raise and appropriate the sum of One thou- sand three hundred and fifty dollars ($1,350.00) for the purpose of installing the necessary drainage and the pene- tration and sealing of Johnson Terrace and Nevens Circle from No. 83 Johnson Terrace to No. 70 Nevens Circle.


Article 20. A motion to pass over was voted in the negative and then it was:


Voted to raise and appropriate the sum of Two thou- sand nine hundred and ninety dollars ($2,990.00) for the purpose of installing the necessary drainage on Warren Avenue to complete Article No. 48 voted at the Annual Town Meeting of 1958 appropriating for resurfacing and drainage, providing the necessary easements are obtained.


Article 21. Voted to appropriate from available funds the sum of One thousand four hundred and fifty dol- lars ($1,450.00) for the purpose of completing the Web- ster Street drain to avoid cave-in of retaining wall adja- cent to Lannin Brothers property.


At 10:23 P. M., William J. Cantelmo questioned the presence of a quorum and a count by the Tellers disclosed 208 registered voters then in the Auditorium. The Mod- erator declared a quorum present.


Article 22. Voted to pass over the appropriating of $425.00 to complete the curbing and black top gutter on the westerly side of Union Street to Payson Avenue as vot- ed under Article No. 65 of the Annual Town Meeting of 1959.

Article 23. A motion to pass this article over was voted in the negative and then it was :


Voted to raise and appropriate the sum of Two thou- sand three hundred dollars ($2,300.00) for the purpose of completing the necessary drainage and paving (type I) as voted under Article No. 41 of the Annual Town Meeting of 1959 for Durbeck Road.


At 10:45 P. M., William J. Cantelmo questioned the presence of a quorum and a count by the Tellers disclosed 181 registered voters then in the Auditorium. The Mod- erator declared a quorum was not present.


At 10:50 P. M. Voted to recess until next Monday evening May 25th, the meeting to reconvene in the same Auditorium at 8:00 P. M.

Meeting reconvened in the Rockland High School Auditorium, Monday evening May 25th, 1959 at 8:00 P. M.


Moderator James H. Kenney, Jr., presiding.


A total of 145 names of registered voters were check- ed on the voting lists.


The Moderator declared it was evident that a quorum was not present and he advised the meeting of the course of action it could take, namely :


Take up Article No. 32 which did not require a quo- rum, Recess until a later time this evening to see if a quorum appears at the meeting, Recess to a stated time on another date, or vote to pass over the remaining articles in the Warrant and adjourn, sine-die.


At 8:10 P. M. Voted to recess for twenty (20) min- utes.

At 8:30 P. M., the meeting reconvened and the Mod- erator ordered a count, by the Tellers, of the number of registered voters who had been checked into the Audi- torium and were then present. The count was 143 regis- tered voters present. Not a quorum.


At 8:35 P. M. Voted that all remaining articles in the Warrant - Articles No. 24 thru No. 32 inclusive - be passed over and that the meeting be adjourned, sine-die.

SPECIAL TOWN MEETING October 20, 1959


Pursuant to the foregoing Warrant a meeting was held in the Rockland Junior High School on Tuesday, October 20th, 1959 beginning at 8:00 P. M.


The meeting was called to order by the Moderator, James H. Kenney, Jr.


The Call for the meeting with the Constable's return of service thereof was read by the Town Clerk.


The following persons were appointed tellers for the meeting, by the Moderator, and they were sworn to the faithful performance of their duties by the Town Clerk. Warren B. Woodward, Jr. and Charles E. Orr.


At 8:05 P. M., a count, by the tellers, of the number of registered voters who had been checked into the Audi- torium disclosed 120 present. Declared not a quorum by the Moderator.


Voted to recess for fifteen (15) minutes.

At 8:20 P. M. a count, by the tellers, of the number of registered voters who had by then been checked into the Auditorium disclosed 156 present. Declared not a quorum by the Moderator.


Voted to recess until 8:45 P. M.


At 8 :45 P. M. a count by the tellers of the number of registered voters then present who had been checked into the Auditorium disclosed 160 present. Declared not a quorum by the Moderator.


Voted to take up Article No. 12 of the warrant for the meeting as a quorum was not needed to take action on this article.


Mr. Charles Damon, chairman of the Finance Com- mittee, reported that the committee had approved said Article No. 12 and then the following action was taken by the meeting.


Article 12. Voted to direct all departments to con- duct an inventory of all office type equipment, construc- tion and repair equipment, and tools or machine equip- ment valued at $20.00 or more, and to publish said inven- tory in their report to the town in the Annual Town Report for the year 1959; and to further instruct all departments to suitably mark said items, by stenciling or other mark- ing devices as follows :

SPECIAL TOWN MEETING November 23, 1959


Pursuant to the foregoing Warrant a meeting was held in the Memorial Park School Auditorium on Monday evening, November 23rd, 1959 and the following votes were passed and action taken.


The meeting was called to order at 8:10 P. M., by the Moderator James H. Kenney, Jr.


The Moderator appointed Lawrence Lelyveld and William Kane as Tellers for the meeting and they were sworn to the faithful performance of their duties by the Town Clerk.


A count, by the Tellers, of the registered voters who had at that time been checked into the Auditorium dis- closed 226 registered voters present. The Moderator de- clared a quorum present.


The Call for the meeting with the Constable's return of service thereof was read by the Town Clerk.


A total of 256 names of registered voters were check- ed on the Voting Lists as being in attendance at the meet- ing.


Mr. Charles W. Damon, Chairman of the Finance Committee, reported in writing to the Moderator and Clerk the action taken by the Finance Committee on the articles in the warrant and their recommendations were as follows: Article 1. Approved, and money to be trans- ferred from Overlay Surplus ; Article 2. Approved, money to be transferred from Free Cash; Article 3. Approved, and amounts as follows be transferred from Free Cash, $2,650.00 for wages 9 men for rest of year, $2,691.00 for Unpaid Bills for 1959, and $3,219.00 for Materials and Maintenance, a total of $8,560.00; Article 4. Approved, the sum of $950.00 to be transferred from Overlay Sur- plus; Article 5. Recommends article be passed over; Arti- cle 6. Approved, the sum of $350.00 to be transferred
