ANNUAL TOWN MEETING WARRANT


FEBRUARY 2. 1948 THE COMMONWEALTH OF MASSACHUSETTS

To either of the Constables of the Town of Harwich, in said County, Greetings :---


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of said town qualified to vote in elections and town affairs, to meet in Exchange Hall in said town on Monday, Febru- ary 2, 1948 at 7 A. M., then and there to act on the following articles :-


Polls will be open at 7 A. M. and may close at 2 P. M.


Article 1. To choose on one ballot the following Town Officers and Committees : Town Clerk, Town Treasurer, Col- lector of Taxes, for one year; one Selectman, Overseer of Public Welfare and Board of Health, for three years; one Assessor for three years; three Herring Committee for one year; one School Committee for three years; three Con- stables for one year; one Trustee of Brooks Library for three years; one Park Commissioner for three years; Mod- erator for one year; one Water Commissioner for three years; Surveyor of Highways for one year; one Cemetery Commissioner for three years.


Article 2. To choose all other Town Officers and Com- mittees.


Article 3. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the

revenue of the financial year beginning January 1, 1948, and to issue a note or notes therefor payable within one year and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


Article 4. To hear the report of all Town Officers and Committees for the year 1947.


Article 5. To see if the Town will vote to raise and appropriate such sums of money as may be necessary to de- fray Town expenses for the ensuing year, and act fully thereon.


Article 6. To see if the Town will vote to fix the sal- aries of the elected Town Officers for the year 1948.


Article 7. To see if the Town will vote to instruct its Selectmen to control, regulate and prohibit the taking of eels and any or all kinds of shellfish and sea worms within the Town limits, as provided in Chapter 130, Section 52 of Chapter 130 of the General Laws and to make any regula- tions in regard to such fisheries as may be expedient.


Article 8. To see if the Town will vote to transfer from surplus revenue or available funds a sum not in excess of


for the purpose of reducing the 1948 tax rate and act fully thereon.


Article 9. To see if the Town will vote to raise and appropriate a sufficient sum of money for unpaid bills of 1947, as provided for in Chapter 179 of the Acts of 1941.


Article 10. To see if the Town will vote to raise and appropriate or transfer from unappropriated available funds in the Treasury, a sum of money for Chapter 90 Highway Maintenance, or take any action in relation thereon.


Article 11. To see if the Town will vote to raise and appropriate a sum of money to be used with whatever State and County funds are available under Chapter 90 Road Con- struction and act fully thereon.


Article 12. To see if the Town will vote to raise and appropriate the sum of $500.00 for recreation and entertain- ment in the form of baseball, by local players.


Article 13. To see what action the Town will take in

regards to the Herring Fisheries for the year 1948 and act fully thereon.


Article 14. To see if the Town will vote to raise and appropriate the sum of $225.00 for band concerts to be held in Brooks Park in 1948.


Article 15. To see if the Town will vote to raise and appropriate the additional amount of eighteen hundred ($1800.00) for the purpose of purchasing Mckinney Beach property, so-called, on the westerly side of Pleasant Street, West Harwich ; the property to be used as a Town Bathing Beach. Said appropriation to be added to the appropriation of $3000.00 previously voted under Article 94 of the Warrant for the Annual Town Meeting held on Feb. 5, 1946.


Article 16. To see if the Town will vote to accept as a By-Law the building code or building restrictions as recom- mended by the Building Committee appointed by the Board of Selectmen and act fully thereon.


Article 17. To see if the Town will vote to raise and appropriate a sufficient sum of money to employ an Inspect- or of Buildings for the year 1948 and act fully thereon.


Article 18. To see if the Town will vote to raise and appropriate the sum of $11,500.00 to purchase and equip the Fire Department with a Ford Combination Fire Apparatus and to act fully thereon.


Article 19. To see if the Town will vote to authorize the appointment of an inhabitant of West Harwich, as Police Officer, for the Post Office Section of West Harwich only, from June 12, 1948 to Sept. 18, 1948; and to raise and ap- propriate the sum of $600.00 therefor, and act fully thereon.


Article 20. To see if the Town will vote to raise and appropriate the sum of twelve hundred dollars ($1200.00) to continue the planting of shade trees along the Town roads as deemed proper by the Committee established at the 1946 Annual Town Meeting and act fully thereon.


Article 21. To see if the Town will vote to authorize the Selectmen to sell at a sum not to exceed one thousand ($1,000) dollars, the Town owned property in North Har- wich, known as the North Harwich Grade School, to be used as a Portuguese Community Center and act fully thereon.

Article 22. To see if the Town will vote to authorize the Selectmen to sell at public auction, the Town owned prop- erty in North Harwich, known as the North Harwich Grade School and act fully thereon.


Article 23. To see if the Town will vote to raise and appropriate the sum of six thousand dollars to be added to the sum of five thousand eight hundred fifty ($5,850.00), appropriated at last Town Meeting, to build and equip a building to be used for the purpose of housing the road equipment, to be located on the property now owned by the Town on Sisson Road, and to act fully thereon.


Article 24. To see if the Town will vote to raise and appropriate the sum of five thousand dollars to widen and re- surface Great Western Road, starting from Lothrop Ave. to the residence of Walter Wilson and act fully thereon.


Article 25. To see if the Town will vote to raise and appropriate the sum of $1000.00 to re-surface Kendrick Road, East Harwich, and act fully thereon.


Article 26. To see if the Town will vote to raise and appropriate a sufficient sum of money to harden with oil Doane Way in Harwichport, and also to construct two catch basins on said way and act fully thereon.


Article 27. To see if the Town will vote to harden with oil Earle Road from Lower County Road in a southerly di- rection approximately 1600 feet at a cost not to exceed $1000.00 and act fully thereon.


Article 28. To see if the Town will vote to raise and appropriate the sum of eight hundred dollars to extend the sidewalk from the Arthur Chase residence ou Sisson Road, to South Street and act fully thereon.


Article 29. To see if the Town will vote to raise and appropriate the sum of $595.20 for the purpose of operating the street lights in the Town of Harwich from sunset to sunrise all the year, and act fully thereon.


Article 30. To see if the Town will vote to raise and appropriate a sufficient sum of money to erect and maintain one street light on the corner of Doane Way and Lower County Road, Harwichport, and act fully thereon.

Article 31. To see if the Town will vote to accept Chap- ter 649 of the Acts of 1947 establishing a forty hour work week for Town employees and act fully thereon.


Article 32. To see if the Town will vote to grant the Harwich Police Department a ten per cent increase in wages for the personnel of its department and act fully thereon.


Article 33. To see what action the Town will take with reference to leasing Exchange Theatre, Monday through Saturday from the 28th of June to Labor Day, 1948, to Har- wich Players, and to act fully thereon.


Article 34. To see if the Town will vote to discontinue a Town way (name unknown) in Pleasant Lake leading from Pleasant Lake Avenue (north of Queen Ann Road) easterly to Oak Street about 1682 feet. Said way being 22 feet wide, and having been accepted November 11, 1850 by the Town and recorded in the Town Clerk's road book onl page 28.


Article 35. To see if the Town will vote to discontinue that part of the town way known as Oak Street leading from Queen Ann Road northerly to Pleasant Lake Avenue. Said way being 22 feet wide, and having been accepted Novem- ber 11, 1850 and recorded in the Town Clerk's Road Book on page 26.


Article 36 To see if the Town will vote to discontinue a town way (name unknown) leading from the Great West- ern Road northerly to the dwelling now or formerly belong- ing to the widow Hannah Kelley, said way being 30 feet wide and 280 feet long and having been accepted by the Town August 16, 1862 and recorded in the Town Clerk's Book on page 59.


Article 37. To see if the Town will vote to discontinue a town way (name unknown) in West Harwich leading from Herring River (Johnson's Dam) southerly over "Ball Hill" to Depot Road (north of Aaron Baker's house), said way being 20 feet wide and accepted on February 9, 1839 and recorded in the Town Clerk's Book on page 159.


Article 38. To see if the Town will vote to discontinue a town way (name unknown) in West Harwich leading from Depot Road (opposite Cemetery Road) easterly to School Street, said way being thirty-five feet wide and about three

hundred fifty-five feet long and having been accepted in February, 1890 by the Town and record in the Town Clerk's Road Book on Page 128.


Article 39. To see if the Town will vote to discontinue a town way known as Factory Road leading from Depot Road (North Harwich) easterly to Chatham Road (Harwich Cen- tre), said road being thirty-three feet wide and having been accepted May 22nd, 1865, and recorded in the Town Clerk's Road Book on Page 69.


Article 40. To see if the Town will vote to authorize the Selectmen to purchase in behalf of the Town for a Town Bathing Beach, the land in the Village of South Harwich at the foot of Deep Hole Road and being lots N & M & L & J and K as shown on Land Court Plan 10688A and raise and appropriate a sufficient sum of money to be used by the Selectmen for this purpose.


Article 41. To see if the Town will vote to authorize the Park Commissioners to purchase or take by eminent domain in behalf of the town, for park purposes the land in the Village of East Harwich, at the east end of Long Pond, bounded and described as follows: on the north by Eldredge Pond, on the east by a road 333.22 feet, on the south by a Town way 147.00 feet, and on the west by Long Pond, being a part of the land owned by James E. Riley et ux, as shown on Land Court Plan 18389A and to raise and appropriate a sufficient sum of money to be used by the Park Commission- ers for this purpose.


Article 42. To see if the Town will vote to authorize the Selectmen to purchase from A. E. Sebbens, two forty- eight foot lots of land at the foot of Pine Ave., Harwichport, with title to high water mark and rights to low water mark for a Town Bathing Beach and parking lot and to raise and appropriate or take from available funds the sum of $7000.00 to be used for this purpose.


Article 43. To see if the Town will vote either to trans- fer from surplus funds or to raise and appropriate the sum of $25,000.00 to be set aside to start a fund for the purpose of building a new elementary school at some future date . this fund to be added to at future Town Meetings until a sufficient sum is available to build a new school.


Article 44. To see if the Town will vote to raise and

appropriate a sufficient sum of money to build and equip a new elementary school and act fully thereon.


Article 45. To see if the Town will vote to raise and appropriate a sufficient sum of money to construct a tide- gate on the river below Coy Brook to the north of the bridge on Horse Jockey Road and act fully thereon.


Article 46. To see if the Town will vote to raise and appropriate the sum of one hundred and twenty dollars to satisfy a judgement in the case of Antone Raneo vs inhabit- ants of Town of Harwich, and act fully thereon.


Article 47. To see if the Town will assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws for all damages that may be incurred by work to be performed by the Department of Public Works of Massachusetts for the improvement, development, mainten- ance and protection of rivers, harbors, tide waters and fore- shores, in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Selectmen to execute and deliver a bond of indemnity therefor to the Commonwealth, and act fully thereon.


Article 48. To see what action the Town will take to remove and fill with sand the cistern or fire reservoir, north of the Brett Block so-called, on land belonging to Pilgrim Lodge A.F. & A.M. and to raise and appropriate a sufficient suni of money therefor, and act fully thereon.


Article 49. To see if the Town will vote to raise and appropriate a sufficient sum of money to be used by the Board of Water Commissioners to purchase a new truck for the Water Department, and to authorize the Board of Water Commissioners to sell or trade a truck now in use and to apply the money received against the purchase price of the new truck.


Article 50. To see if the Town will vote to raise and appropriate the sum of $3000.00 to be used by the Board of Water Commissioners for extending water mains where re- quested, providing that the estimated income from such ex- tensions is at least 6% of the cost of installing.


Article 51. To see what action the Town will take to establish a construction account for the Water Department for the purpose of extending water mains and appurten-

ances in such streets and ways, public or private, as the Board of Water Commissioners shall determine.


Article 52. To see if the Town will vote to extend the water main on Miles Street.


Article 53. To see if the Town will vote to extend the water mains to Hoyt Road.


Article 54. To see if the Town will vote to extend the water main on Hiawatha Road.


Article 55. To see if the Town will vote to extend the water mains to Wah-Wah-Taysee Road.


Article 56. To see if the Town will vote to raise and appropriate the sum of twenty-five hundred dollars to ex- tend the water mains from Bank Street connection down Long Road as far as money will permit, and to act fully thereon.


Article 57. To see if the Town will vote to extend the water mains to North Road.


Article 58. To see if the Town will vote to extend the . water mains to Smith Street.


Article 59. To see if the Town will vote to extend the water mains to School Street.


Article 60. To see if the Town will vote to extend the water mains on Gorham Road.


Article 61. To see if the Town will vote to extend the water mains to Saquatucket Bluffs.


Article 62. To see if the Town will vote to raise and appropriate a sufficient sum of money to extend the water mains from Lower County Road on Strandway, Pine Lane. Mill Point Road and Riverway in West Harwich and to act fully thereon.


Article 63. To see if the Town will vote to extend the water main on Grey Neck Road.


Article 64. To see if the Town will vote to extend the water main on Woodlawn Avenue.


Article 65. To see if the Town will vote to extend the water main on Brooks Road.

To see if the Town will vote to raise and appropriate a sum of money for the purpose of improving. the water system by constructiong a standpipe on land owned by the Town known as "Brooks Park Grove" and additional water mains not less than 6-inches but less than 16-inches in diameter-in Sisson Road, South Street, Allen Street, Great Western Road, Kelly Road, Depot Street, (East Dennis Road), Oak Street, Park Street, Pleasant Lake Road, Queen Anne Road, connecting ways and in publicly and privately owned land, substantially as shown on Sheets 1 to 18, inclusive, of drawing on file in the office of the Board" of Water Commissioners, entitled "Proposed Water System Extensions, Harwich, Mass., Whitman & Howard, Engineers, 89 Broad St., Boston, Mass., November, 1947", and provide how the appropriation shall be raised, by borrowing, trans- fer from available funds or otherwise, or take any action relative thereto.


Article 72. To see if the Town will vote to raise and appropriate a sum of money for the purpose of improving the water system by constructing additional mains not less than 6-inches but less than 16-inches in diameter, in Old County Road, Queen Anne Road, Orleans-Harwich Road, Pleasant Bay Road, and in connecting ways substantially as shown on Sheets 19 to 26, inclusive, of drawings on file in the office of the Board of Water Commissioners, entitled "Pro- posed Water System Extensions, Harwich, Mass., Whitman & Howard, Engineers, 89 Broad St., Boston, Mass., Novem-

ber, 1947", and provide how the appropriation shall be raised, by borrowing, transfer of available funds or other- wise, or take any action relative thereto.


Article 73. To see if the Town will vote to expend the refunded dog tax for the support of Brooks Free Library, and to act fully thereon.


Article 74. To see if the Town will vote to raise and appropriate the sum of fifteen hundred dollars ($1500.00) to paint and repair the exterior of Brooks Block, and act fully thereon.


Article 75. To see if the Town will vote to raise and appropriate the sum of $250.00 for band concerts to be given by the Chatham Band at Brooks Park during the summer.


Article 76. To see if the Town will vote to raise and appropriate the sum of $600.00 to resurface with oil, the Town parking lots at the foot of Bank Street and the School-House lot in Harwichport and act fully thereon.


Article 77. To see if the Town will vote to raise and appropriate the sum of $5000.00 for the purpose of reloca- tion, alteration, laying out of Town ways, engineering and surveying of Town property, and act fully thereon.
