Arlington, Mass., March 22, 1926.


To the Moderator and Town Meeting Members :


The Committee to consider the condition of Spy Pond and the report thereon by the State Department of Public Health as provided for under Article 9 of the Warrant calling the Special Town Meeting of January 14, 1926, submit the following report:


The investigation as carried by the State Depart- ment of Public Health shows that in addition to excessive growths of water weeds in the shallow parts of the Pond, that its waters are also affected by the presence of mi- croscopic organisms, known as blue-green algae, which, unlike the weeds, affect the whole pond.


As a result of the investigation the Department of Public Health is of the opinion that in order to prevent

the excessive growth of water weeds and maintain the pond in satisfactory condition it will be necessary to deepen the shallow parts of the pond sufficiently to make the conditions unfavorable to their growth. The Depart- ment is further of the opinion that the blue-green algae can be controlled by the proper use of small quantities of copper sulphate at the times when the growth appears.


The State Department of Public Health's estimate for the necessary work to obtain a minimum depth of eight feet is as follows :


Surface of the Pond maintained at Grade 7 $219,000.00 Surface of the Pond maintained at Grade 9 131,000.00 Surface of the Pond maintained at Grade 11 85,000.00


These estimates include dredging, construction of control works at the Spy Pond end of the 36" iron pipe laid by the City of Cambridge in 1876, and the extension of the surface drains into the pond.


Your Committee realizing that any such expenditure is out of the question cast about for another solution of the question.


Mr. Hammond of the State Board of Health, the engineer handling the problem for the State, met with your Committee and went over the situation very care- fully. As a result of this conference, and other investi- gations carried on by the Committee, we submit the following recommendations :


1st. That the Town acquire all the rights in and to the 36" iron pipe laid by the City of Cambridge in 1876, and which today constitutes the only outlet to Spy Pond.


2nd. That a control works be constructed at the Spy Pond end of this pipe, and that said works be con- structed in such a manner as to permit the raising or lowering the surface of the Pond.

3rd. That a further study be made of the water growths, and other conditions in and about the Pond with a view of permanently improving and purifying the waters of the Pond.


4th. That the sum of $6000.00 be appropriated for the purposes as outlined in these recommendations.

SPECIAL MEETING


Arlington, March 26, 1926.


At 8:15 o'clock P. M. the Special Meeting called for this date was called to order by the Moderator, John G. Brackett.


Article 2 before the meeting. (Police Station)


On substitute motion of Frederick W. Hill :


Voted: (Unanimously) That there be and hereby is appropriated the sum of one hundred fifteen thousand ($115,000) dollars for the purpose of constructing a build- ing to be used for a police station house, lockup and police purposes connected therewith, upon the land of the Town situated on Central Street, including the cost of original equipment and furnishings; that for this pur- pose the sum of fifteen thousand ($15,000) dollars be transferred from available balances and receipts now in

the Treasury, the sum of thirty thousand ($30,000) dol- lars be raised by general tax and for the balance seventy thousand ($70,000)' dollars the Treasurer, with the ap- proval of the Selectmen, be and hereby is authorized to borrow the said sum of seventy thousand ($70,000) dol- lars and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with the provisions of Section 19 of Chapter 44 of the General Laws and all Acts in addition thereto or amendment thereof, so that the whole loan shall be paid in not more than twenty (20) years from the date of issue of the first bond or note or at such earlier date as the Treas- urer and Selectmen may determine; and that said appro- priation be expended under the direction of a committee of five.to be appointed by the Moderator, said committee to have the power to fill vacancies, substantially as fol- lows: For the construction of such building one hundred thousand ($100,000) dollars and for the original equip- ment and furnishing of such building fifteen thousand ($15,000) dollars.


On motion of Frederick W. Hill :


Voted: That the committee appointed at the meeting of March 26, 1925, to bring in plans and esti- mates for the construction for the building for police purposes be discharged.


The Moderator appointed the following committee under Article 2: Charles B. Devereaux, Alfred W. Lom- bard, Elliott R. Barker, Thomas J. Donnelly, Sr., and Hollis M. Gott.


Article 3 taken up. (Building on Central Street Land)


Voted: (Unanimously) That the Board of Selectmen be and hereby is authorized and empowered, in the name and on behalf. of the Town, to sell at public auction or

private sale the building on the land of the Town on Cen- tral Street acquired for the purpose of constructing thereon a building for police purposes under vote passed March 26, 1925, and to execute, acknowledge and deliver any proper documents, all for the minimum amount of. one ($1) dollar and upon such other terms as the Select- men shall consider proper.


Article 4 taken up. (School House on Irving Street)


Voted: (Unanimously) That there be and hereby is appropriated the sum of one hundred twenty-two thousand ($122,000) dollars for the purpose of construct- ing a school building on land of the Town on Irving Street, including the cost of the original equipment and furnishing; that for this purpose twelve thousand six hundred and fifty-four and seventy-seven hundredths ($12,654.77) dollars be transferred from available bal- ances and receipts now in the Treasury, the sum of thirty-four thousand three hundred forty-five and twenty-three hundredths ($34,345.23) dollars be raised by general tax and for the balance seventy-five thousand ($75,000) dollars the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow said sum of seventy-five thousand ($75,000) dollars and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with the provisions of Section 19 of Chapter 44 of the General Laws and all acts in addi- tion thereto or amendment thereof, so that the whole loan shall be paid in not more than twenty (20) years from the date of issue of the first bond or note or at such earlier date as the Treasurer and Selectmen may deter- mine; and that said appropriation be expended under the direction of the committee appointed under vote passed January 14, 1926, to procure plans and estimates for such building, substantially as follows: For the con- struction of such building one hundred thirteen thousand five hundred ($113,500) dollars and for the original

equipment and furnishing of such building the sum of eighty-five hundred ($8500) dollars.


The following motion was made by William A. Muller :


It is the sense of this meeting that hereafter com- mittees appointed for the construction of municipal buildings give preference to local architects.


The motion being put before the meeting was lost.


Article 5 taken up. (Land for School Purposes)


The following substitute motion was made by Pro- fessor Alexander H. Rice :


That the Selectmen be and hereby are authorized and empowered, on behalf of the Town, to purchase or take in fee by eminent domain or otherwise acquire, for the purpose of constructing thereon a school building, the land situated in said Arlington and bounded and de- scribed as follows: Beginning at the point of intersec- tion of the westerly side line of Broadway and the south- erly side line of Tufts Street; thence south 34°, 32', 20" west on said westerly side line of Tufts Street, a distance of 420' to other land of the Boston Elevated Street Rail- way Co .; thence south 34°, 32', 20" east across said other land of the Boston Elevated Street Railway Co., a dis- tance of 377', more or less, to land now or formerly of Edith L. Hill; thence north 54°, 56', 20" east by said land now or formerly of Edith L. Hill and land now or formerly of owners unknown, a distance of 523', more or less, to the westerly side line of Broadway; thence north 45°, 13' west on said westerly side line of Broadway, a distance of 6.22' to a county bound at an angle point in said westerly side line of Broadway; thence north 49°, 04', 10" east on said westerly side line of Broadway, a distance of 382' to the point of beginning, containing about four acres, being a portion of the land formerly

of Ethel E. Tappan and another and now or formerly of the said Railway Company; that the sum of thirty-six thousand dollars be and hereby is appropriated therefor ; and that for this purpose sixteen thousand dollars be raised by general tax, and for the balance twenty thou- sand dollars the Treasurer, with the approval of the Se- lectmen, be and hereby is authorized to borrow said sum of twenty thousand dollars and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with the provisions of Section 19 of Chap- ter 44 of the General Laws and ali acts in addition there- to or amendment thereof, so that the whole loan shall be paid in not more than twenty (20) years from the date of issue of the first bond or note or at such earlier date as the Treasurer and Selectmen may determine.


On rising vote, 71 voting in favor and 120 in oppo- sition, the motion to place the substitute motion before the meeting was lost, Messrs. Russell, Elliett and Ahern acting as tellers.


On the original motion as recommended by the Finance Committee, it was


Voted: That the Town make no appropriation for the acquisition by purchase or otherwise, for school pur- poses, of a parcel or parcels of land within the area de- scribed in Article 5 of the Warrant.


Article 6 taken up. (Tenement House Act)


On the substitute motion of J. William Fellows, it was


Voted: (Unanimously) That the Town do revoke its acceptance of Chapter 635 of the Acts of Nineteen Hundred and Twelve, being an act relative to tene ment houses in towns.

of Fire Department for Injuries Received During Per- formance Duty and Pensioning Call Members)


Voted : (Unanimously) That the vote passed by the Town, March 25, 1918, under Article 36 of the War- rant for the annual meeting of 1918, to wit: "That the Town accept the provisions of Chapter 79 of the Special Acts of the year 1918 relating to the compensation of call members of the Fire Department for injuries re- ceived during the actual performance of duty as such call men," be and hereby is ratified, and that Chapter 79 of the Special Acts of the year 1918 being "An Act rela- tive to pensioning call members of the Fire Department of the Town of Arlington," be and hereby is accepted.


Article 8 taken up. (Police Department)


Voted: (Unanimously) That Section 97 of Chapter 41 of the General Laws relating to police departments be and hereby is accepted.


All business in the Warrant cailing this meeting having been disposed of, the meeting adjourned at 9:50 o'clock P. M.

ARLINGTON TOWN REPORT


Arlington, April 5, 1926.


Pursuant to the vote of adjournment on March 26, 1926, the Town Meeting Members met in the Town Hall on Monday evening, April 5, 1926, notices having been sent by mail by the Town Clerk seven days before the meeting. A notice was placed in the local paper and notices were posted in five places in each precinct of the Town.


Lists of the duly qualified Town Meeting Members were used at the entrances of the meeting place and were in charge of Philip T. Robinson and Albert Peirce.


The Check Lists filed with the Town Clerk at the close of the meeting showed that one hundred and ninety-two members attended the meeting.


The meeting was called to order at 8 o'clock P. M. by the Moderator, John G. Brackett.


On motion of Frederick W. Hill:


Voted: That if this meeting adjourns, it adjourn to meet on Thursday evening, April 15, 1926, at 8 o'clock.


The Town Meeting Members who had not already been sworn were sworn by the Moderator.

Voted : (Unanimously) That the sum of $69,000 be and hereby is appropriated for the extension of the Sewerage System and for this purpose $7,945.82 be trans- ferred from the Sewer Assessments Receipts Account now in the Treasury; $1,600 available for said purpose, be taken from the proceeds of the sales of houses and land now in the Treasury; $34,454.18 be raised by gen- eral tax and for the balance $25,000 the Treasurer, with the approval of the Selectmen, be and hereby is author- ized to borrow the said sum of $25,000 and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with Section 19 of Chapter 44 of the General Laws, and ail acts in addition thereto or amendment thereof, so that the whole loan shall be paid in not more than five years from the date of issue of the first bond or note or at such earlier date as the Treasurer and the Selectmen may determine, said appropriation to be expended under the direction of the Board of Public Works.

(Extension of Water Mains) Voted: (Unanimously) That the sum of $59,500 be and hereby is appropriated for laying and relaying street water mains of six inches or more in diameter, and for this purpose $15,500 be raised by general tax, and for the balance $44,000 the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow the said sum of $44,000 and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with Section 19 of Chapter 44 of the General Laws and all acts in addition thereto or amendments thereof, so that the whole loan shall be paid in not more than fifteen years from the date of issue of the first bond or note or at such earlier date as the Treasurer and Selectmen may determine, said appropriation to be ex- pended under the direction of the Board of Public Works.

Voted : That the sum of $3,100 be and hereby is appropriated for the planting of trees, removal of dead and dangerous trees, and for the trimming and general care of existing trees during the year 1926, the same to be expended under the direction of the Tree Warden, as follows: Salary of Warden, $600; Wages and Expenses, $2,500.

On substitute motion of Paul M. White:


Voted: That the sum of $3,500 be and hereby is appropriated for the maintenance and improvement of the Public Parks of the Town, the same to be expended under the direction of the Board of Park Commissioners.

Voted: That the sum of $4,750.20 be and hereby is appropriated for the payment of pensions, during the year 1926, under the provisions of law accepted by the Town.


Article 22 taken up. (Authority of Town Treasurer to Borrow)


Voted : (Unanimously) That the Town Treas- urer, with the approval of the Selectmen, be and hereby is authorized to borrow money, from time to time in an- ticipation of the revenue of the financial year beginning January 1, 1926, and to issue a note or notes therefor, payable within one year; any debt or debts so incurred to be paid from the revenue of said financial year.

Voted : That a committee of five be appointed by the Moderator to investigate and consider the securing of land adjacent to the present reservoir of the Town at Arlington Heights; said committee to have the power to fill vacancies, and to report to the Town not later than the Annual Meeting of 1927.

Voted: That the additional sum of $1,700 be and hereby is appropriated for the grading of and the con- struction of walks upon the grounds of the new school building on Lake Street, Brooks Avenue, so-called, and Chandler Street, so-called; said sum to be raised by general tax and to be expended under the direction of the committee appointed to construct said new school building under vote passed February 13, 1925.

Voted: That the Town do not appoint a committee of five to procure plans and estimates for the construc- tion of a Junior High School building on land of the Town situated on Tufts Street.


Article 34 taken up. (Committee on Additional School Accommodations)


Earl A. Ryder presented a substitute motion but the Moderator's declaring the same was not in order, no ac- tion was taken.


Voted: That a special committee of five citizens be appointed by the Moderator to investigate and consider the matter of additional school accommodations, such committee to have the power to fill vacancies and to re- port to the Town not later than the annual meeting of 1927; and that the sum of $400 be and hereby is appro- priated for the use of said committee.
