Annual Town Meeting Warrant


THE COMMONWEALTH OF MASSACHUSETTS


Barnstable, ss.


To Harvey T. Moore, Constable of the Town of Eastham, in the County of Barnstable:


In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of said Town qualified to vote in elections and Town affairs to meet at the Town Hall on Monday, the Twentieth (20) day of February next at 7:00 o'clock in the evening, then and there to act on the following articles in this Warrant and to meet in the Town Hall at 10:00 o'clock in the morn- ing on Tuesday, the Twenty-First (21) day of February next, there and there to elect all necessary officers.


POLLS TO OPEN AT 10:00 A.M. and MAY CLOSE AT 6:00 P.M.


~ Article 1. To see if the Town will vote to have a black- board at the front of the Hall, showing the effect on the tax rate of the various articles in the Warrant, or take any action relative thereto.

Article 2. To see if the Town will vote to elect a Town Director for the Cape Cod Extension Service.


No recommendation required.


Article 3. To see in what manner the Town will vote to dispose of its refunded dog tax.


Recommended that the Town place the refunded dog tax at the disposal of the Public Library.


Article 4. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to bor- row money from time to time in anticipation of the revenue of the financial year beginning January 1, 1956, and issue

a note or notes therefor, payable in one year and renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, Gen- eral Laws.


Recommended.


Article 5. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to bor- row money from time to time in anticipation of reimburse- ment for the financial year beginning January 1, 1956, and to issue a note or notes therefor, payable in one year and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chap- ter 44, General Laws.


Recommended.


- Article 6. To see if the Town will vote to raise and ap- propriate a sum of money not to exceed $1,000.00 for the establishment and maintenance of a free bed in the Cape Cod Hospital, Hyannis, Mass., for the care and treatment of persons certified by the Selectmen to be residents of the Town and unable to pay for such care and treatment, in accordance with Chapter 111, Section 74, General Laws, or take any action relative thereto.


Recommended $500.00.


Article 7. To see if the Town will vote to raise and appropriate a sum of money to install and maintain a fire alarm system, to include North Eastham, the Elementary School and the present system, or take any action relative thereto. (By request.)


Recommended $1,100.00.


~ Article 8. To see if the Town will vote to authorize the Selectmen to sell property taken under Tax Title procedure by the Town, and raise and appropriate the sum of $500.00 for this purpose, or take any action relative thereto.

- Article 9. To see if the Town will vote to pay a bounty of fifty cents (50c) each for woodchucks killed within its boundaries during the ensuing year and raise and appro-

priate the sum of $30.00 for this purpose, or take any action relative thereto.

Article 10. To see if the Town will vote to raise and appropriate or transfer from unappropriated available funds in the Treasury, a sum of money for Chapter 81 Highways, or take any action relative thereto.

Article 11. To see if the Town will vote to raise and appropriate the sum of $1,200.00 for the purpose of having a road layout made of Nauset Road from the corner at Walter MacPherson's to Route 6 in North Eastham.

Article 28. To see if the Town will vote to amend the Zoning By-Law by adding after Paragraph 13, Section III, the following paragraph to be known as "Paragraph 14";

"Accessory use on the same lot with and customarily incident to any of the above permitted uses and not detri- mental to a residential neighborhood. The term "accessory use" in this section shall not include


a. Garage space of more than two automobiles, except as authorized by the Selectmen.


b. Signs, except those pertaining to the lease, sale or use of a lot or building, and such sign or signs shall not be more than two in number, each sign to contain not more than twelve square feet."

Article 29. To see if the Town will vote to amend the Zoning By-Law by deleting from Paragraph 1, Section VI, the words in Districts A and B no dwelling or business building shall be built on a lot with a frontage on an ac- cepted way of less than 135 feet, nor with an area of less than 20,000 sq. ft., and inserting therefor, "In Districts A and B only one dwelling or structure shall be built on a lot, and no lot shall have a frontage of less than 135 feet on any way nor contain less than 20,000 square feet."


Article 30. To see if the Town will vote to amend the Zoning By-Law by adding after Paragraph 1, Section VI, the following paragraphs :


2. Front Yards


In Districts A, B, C, and D, there shall be provided in front of each and every structure a front yard of not less than thirty feet of clear width between the build- ing and the lines of the way or ways. Projecting eaves and uncovered steps shall not be considered as coming within the meaning of this section.


3. Back Yards


Behind every structure in Districts A and B there shall be provided a back yard, between the rear line of the structure and the rear lot of not less than twenty- five feet in depth. Provided, however, that the building lines of structures which are necessary to wood framed structures for human habitation shall not be nearer to

side or rear lot lines than twelve feet, or nearer to the nearest boundary of any public way than thirty feet. In Districts C and D behind each structure there shall be provided a back yard between the rear lot line of not less than twelve feet and in such buildings in the Districts C and D there shall be a fireproof rear wall. 4. Side Yards


At the side of each dwelling or structure in Dis- tricts A and B there shall be a side yard of not less than twenty-five feet in clear width, between the side of the structure and the side lot line. In Districts C and D at each side of the structure there shall be a side yard of not less than ten feet in clear width between the side of the structure and the side lot line; pro- viding, however, that if the abutting owners agree to put a fireproof party wall, then the building may be built upon such party wall.


5. If the Building Inspector finds that adjacent build- ings for a reasonable distance on either side of the property on which the applicant proposes to build, con- form to some substantially common front line, the Building Inspector may require the applicant also to conform thereto, regardless of the class of construction and use of the proposed structure.

Article 31. To see if the Town will vote to amend the Zoning By-Law by adding after Paragraph 5, Section VI, the following paragraph to be known as "Paragraph 6";


"In any district in this Zoning By-Law there shall not be allowed the neon type sign, so-called, or gas-filled illum- inated type sign nor shall such gas-filled tube or neon type be permitted to adorn the buiding, structure or premises".

Article 32. To see if the Town will vote to amend the Zoning By-Law by adding after Paragraph c, Section VIII, the following paragraph to be known as "Paragraph d";


"Any person aggrieved by reason of his inability to

obtain a permit from any administrative official hereunder or any person aggrieved by any order or decision of the en- forcing officers of this By-Law in violation of any pro- vision of Chapter 40A of the General Laws as amended, shall be entitled, within twenty days thereof, to file an ap- peal with the Board of Appeals."

On Eastham's ocean side, is Nauset Beach Light, situated about mid-distance north and south on the great outer beach of Cape Cod.


Three brick towers, The Three Sisters of Nauset, were originally built here in 1839, and were noted in the writings of Thoreau and Ralph Waldo Emerson.


The ocean steadily carved away the bank on which the first Three Sisters stood and three wooden towers were built to replace the brick ones, should they become victims of the ocean tides. It was but a short time after the wooden ones were built that the first three towers toppled into the ocean.


Some years later, in 1911, a new single beacon replaced the three towers, and in 1923 when the twin lights at Chatham were split up, one was sent to Nauset for solitary duty.


The "lighthouse keepers" were housed in a home beside the light, the house being owned by the U. S. Government. What a wonderful recollection, that of being allowed to climb the winding stairs in the lighthouse with the keeper, and watch him light the old kerosene lamp which stood as a bea- con for the mariners.


When the modern electric light replaced the old kero- sene lamp, it was no longer necessary for a lighthouse keeper to maintain the vigil, and the operation of the light was as- sumed by the United States Coast Guard.


The home was sold by the government four years ago by auction, and is now privately owned.


The light, long a favorite subject of artists, can be seen 17 miles at sea and is a group flashing light. Summer visitors and residents as well make "the Light" a favorite stopping place on a summer's evening.

NOTICE OF TOWN OFFICE HOURS


The Town Clerk, Treasurer and Tax Collector's Office hours are 9 to 12 A.M. and 1 to 5 P.M. daily, Saturdays excepted.


The Selectmen, Assessors and Boards of Welfare and Health are in the office at the Town Hall on Mondays and Saturdays from 9 to 12 A.M. and on the second and fourth Wednesday evenings from 7 to 9 P.M.
