ANNUAL TOWN MEETING
Memorial High School Auditorium March 16, 1959
The meeting was called to order by the Moderator, Kenneth C. Latham at 8:00 P. M.
Msgr. William F. Reilly delivered an invocation.
The Town Meeting Members were requested to stand and be sworn in by the Moderator.
The warrant was partially read by the Town Clerk, Boyd H. Stewart, when on motion of Lawrence Drew it was voted to dispense with the further reading of the warrant, except the Constable's Return, which was then read by the Town Clerk.
ARTICLE 2. It was moved by William H. Dolben, Chairman of the Finance Committee, that its report under Article 4, Public Works De- partment, Page 9, be amended by striking out the amounts for Snow and Ice Removal, as follows:
Snow and Ice Removal Salaries $ 22,000.00 Snow and Ice Removal Expense 23,000.00
and striking out the total recommended for Public Works 886,807.84 and inserting in place thereof the following:
Snow and Ice Removal Salaries $ 25,000.00
Snow and Ice Removal Expense 27,000.00
so that the total recommended now reads 893,807.84

Progress Report of the Building Code Study Committee
The Building Code Study Committee has held seventeen meetings during the past year, and has made substantial progress in drafting recommended changes to the Town Building Code.
The Committee proposes to continue its work.

ARTICLE 2. The following report was read by Domenick Zanni, Jr.
Board of Public Works Report on Water Development Program
Work on the program of water development is progressing steadily. More than normal rainfall in 1958 eased the water consumption pro- blem so that the Board of Public Works was able to take more deliber- ative action on several of the matters.
The work accomplished has followed in detail the report of the Consulting Engineers, dated July 1958.
A booster station at Lothrop Road has been constructed and will be in operation as soon as tests are completed.
A gravel walled well has been constructed in Revay Meadow and a second one with pump and pipe connections is under construction.
A pumping station is under construction in Revay Meadow and will be completed shortly.
A contract has been signed for the so-called "loop main" and work will commence as soon as weather conditions permit.
Depending on the Town Meeting action on Article 35 the work under this contract can be expanded.
It is proposed under Article 36 to obtain funds for engineering to remodel, enlarge and change the type of the present filter plant. If this request is approved it is proposed to request funds for the filter plant project in 1960.
All in all progress has been steady and the entire program is well under way.
On motion of Lawrence Drew it was voted that Report be accepted as Report of Progress.
The following report was read by Edward W. Batten. Planning Board Report of Public Hearing
On Monday, February 16, 1959 the Planning Board, under authority of Section 6 of Chapter 40A of the General Laws held a hearing on the following proposed amendment to the Zoning By-Laws and Zoning Map by changing the following described area from Residence A3 to Residence A2 district;

Beginning at a point on the center line of Haverhill Street two hundred and fifty (250) feet north of the center-line of Franklin Street and running:
Northerly by Haverhill Street three hundred sixteen and 77/100 (316.77) feet; thence
Easterly to a point two hundred fifty (250) feet from the center-line of said Haverhill Street; thence
Southerly to the presently existing Residence A-2 boundary, three hundred (300) feet; thence
Westerly along the presently existing Residence A-2 boundary to the center-line of Haverhill Street, two hundred fifty (250) feet, the point of beginning.
This hearing was well attended by residents of the immediate area, 7 of whom have gone on record as favoring the foregoing change, 1 opposed to the change and 2 were non-committal.
Evidence submitted at the hearing and further investigation by the Board has established the fact that approximately 75% of the lots that front on Haverhill Street are presently in the Residence A2 Dis- trict, requiring only 120 foot frontage. The remaining 25% of the lots for the most part were subdivided into 80 foot lots prior to their designation as a Residence A3 District. These 80 foot lots adjacent to the area in question have been built upon.
One of the constitutional requirements of the exercise of the police power in which the zoning laws fall is that regulations must be gen- eral in nature and apply to all property similarly situated. If there is to be classification there must be some reasonable ground for support- ing it.
To require the petitioner to divide his 402.2 feet frontage into only two lots of 200 feet frontage would not take into consideration that zoning must have due regard for the character of the district.
The Planning Board recommends that this proposed amendment be acted upon favorably as the subdivision of this Haverhill Street frontage would be into three lots having approximately 134 feet each or 14 feet each more frontage than required of 75% of the lots along the entire length of the street from the Wakefield town line to North Reading.

ARTICLE 22. On motion of William F. Murphy it was voted that Schedule A, Job Classifications, or Article XVIII-A of the General Laws of the Town relating to the Wage and Hour Classification Plan, be and the same hereby is amended in the following manner:
Delete the following Classification:
Supervisory Employees, Mechanic and Shovel Operator
Skilled workman who for at least two thirds of his time supervises small groups of employees while performing similar work, or skilled workman who makes repairs on all types of motorized equipment in- cluding primary and heavy duty equipment or skilled workman who operates power shovel.
Delete from the Salary and Wage Schedule the Classification of Supervisory Employees, Mechanic and Shovel Operator under Section 2, Supervisory Employees.
Add the following new classification:
Supervisory Employees, Mechanic and Equipment Operator.
Skilled workman who for at least two thirds of his time supervises small groups of employees while performing similar work, or skilled workman who makes repairs on all types of motorized equipment in- cluding primary and heavy duty equipment or skilled workman who operates power shovel, power backhoe, road grader, bulldozer, power road roller and main pipe tapping machine.
Amend Section 2, Supervisory Employees, of the Salary and Wage Schedule by establishing the hourly and weekly minimum and maxi- mum rates for the new Job Classification of Supervisory Employees, Mechanics and Equipment Operator, as follows:
