The license shall be in a form prescribed by the director, upon a blank to be furnished, **** by the county in which the town is lo- cated, and shall be subject to the condition expressed therein that the dog which is the subject of the license shall be controlled and restrained from killing, chasing or harassing livestock or fowls. **** The owner or keeper of a licensed dog shall cause it to wear around its neck or body a collar or harness of leather or other suitable material, to which shall be securely attached a tag in a form pre- scribed by the director, and upon which shall appear the license number, the name of the town issuing such license and the year of issue. Such tags shall be furnished in the same manner as the license blanks, and if any such tag shall be lost the owner or keeper of such dog shall forthwith secure a substitute tag from the town clerk ****

SEC. 139. FEES FOR LICENSES. The fee for every license shall, except as otherwise provided, be $2.00 for a male dog and $5.00 for a female dog, unless a certificate of a registered veterinarian who performed the operation that said female dog has been spayed and has thereby been deprived of the power of propagation has been filed with the town clerk, in which case the fee shall be $2.00. A certified copy of such certificate on file in the office of any town clerk within the Commonwealth may be accepted as evidence that the said operation has been performed. ***

(Summary and purpose of the law to be acted upon as determined b the Town Counsel). The purpose of "equal pay law" relating to school teachers' salaries is to secure general equality between men and wome teachers in matter of pay. It provides that women teachers employed in same grades and doing same type of work with same preparation and training as men teachers shall be paid at same rate as men teachers.

Law does not prevent differentiation in the rate of pay among teachers if based upon classifications which School Committee can reasonably and lawfully make and which are not discriminatory between sexes. Salaries of men teachers cannot be reduced in order to effect such equal pay.


We hereby certify that the above is a true canvass of the Votes Cast at the Annual Town Election held March 6, 1961.

ANNUAL TOWN MEETING - MARCH 11, 1961


At a legal meeting of the inhabitants of the Town of Westford, qualified by law to vote in Town affairs, held at Westford Academy on Saturday, March 11, 1961 at 1:00 P.M., the following business was transacted :


A 4-H Group presented a fine large photograph of the late Mr. William R. Taylor to the Town and it was accepted, on behalf of the Town, with appropriate reminiscent remarks by Charles L. Hildreth, Town Clerk.


Ben W. Drew, Town Moderator, called the meeting to order.


Carl 0. Benson, Robert V. Cassidy, Dorothy I. Mann and Ruth A. Sundberg, Election Officers using Voting Lists, acted as Tellers at the doors. The attendance was 367.


Rev. Virgil E. Murdock gave the invocation.


The canvass of the votes cast at the Annual Town Election on March 6, 1961 was read by the Town Clerk.


Voted to dispense with the reading of the Warrant in its entirety.


ARTICLE 1. Norman E. Day stated that the Report of the House Numbering Committee will be given when Article 39 is taken up.


Edward F. McLenna gave a Report of the Building Code Committee.


Voted that said Committee be continued and to report further at the next Annual Town Meeting, or, in the discretion of said Committee, at any Special Town Meeting held prior thereto.


E. Kennard Fletcher stated that the Secondary School Building Committee would give a full Report and its findings in June.


Roger H. Hildreth, of the Committee on, the Advisability of Dis- continuing the Town Infirmary, stated that/is the opinion of the Com- mittee that the Infirmary should be discontinued and that a Report will be given when Article 2 Item 36 is taken up.


Joseph B. Taylor gave a final Report of the Elementary School Building Committee.


Denis Maguire, Esq., said that a printed Report of the Planning Board is being mailed to the voters.

ARTICLE 26. Voted that the sum of $4,000.00 be raised and appro- priated for the purpose of defraying the expenses of procuring all necessary and professional consultations, services, opinions, cost- estimates, specifications and/or all other necessary or incidental data or information required by the Secondary School Building Commit- tee appointed under Article 33 of the Warrant for the 1960 Annual Town Meeting, said sum to be in addition to the amount appropriated under Article 6 of the Warrant for the Special Town Meeting held on Septem- ber 1, 1960.

By inserting, after the words "the side lot lines," in sub- section (a) of paragraph 1 of Section 3 of said By-Law, the following: --- , provided, however, that a permit must first be obtained from the Selectmen for such storage, --- so that said paragraph 1, as amended, will read as follows: 1. Detached one family dwelling: Such term shall not be construed to include trailer, mobile or immobile except (a) When such trailer not occupied or used for dwelling purposes is stored on the rear portion of any lot and is 30 feet at least from the rear lot line and 15 feet at least from the side lot lines, provided, however, that a permit must first be obtained from the Selectmen for such storage. (b) When such trailer is used for temporary dwelling purposes during the construction, reconstruction, alteration or repair of a permanent dwelling (not including trailer) for a period not to exceed six months or additional period or periods in hardship cases, but no such period of use of such trailer shall be commenced, contin- ued or extended without the approval of the Board of Appeals after public hearing nor without the approval of the Board of Health.

ARTICLE 5. Voted unanimously that the Town further amend its Protective By-Law,


1. By inserting, after paragraph 3 of Section 9 of said By-Law, the following paragraph: - 4. No appeal or petition under Paragraph 3 of Section 15 of Chapter 40A of General Laws for a variance from the terms of the Zoning By-Law with respect to a particular parcel of land or the building thereon, and no application under Paragraph 2 of Sec- tion 15 of Chapter 40A of the General Laws for a special exception to the terms of such By-Law which has been unfavorably acted upon by the Board of Appeals shall be considered on its merits by said Boards

within two years after the date of such unfavorable action, except with the consent of all of the members of the Planning Board. Approved by the Planning Board.


2. By renumbering the present paragraph 4 of Section 9 of said By-Law, designated "Validity", paragraph 5.

ARTICLE 6. Voted unanimously that the Town further amend its Protective By-Law,


1. By inserting, after the word "erected", in the first sentence of paragraph 1 of Section 7 of said By-Law the words "or maintained", -- so that said sentence, as amended, will read as follows: --- 1. Lot size and frontage: In residence districts no building except a one-story building of accessory use shall be erected or maintained upon a lot having less than the following area and frontage:

By inserting, after the word "placed" in the first sentence of paragraph 2 of Section 7 of said By-Law the words "or maintained", and by inserting, after the word "erected" in the second sentence of paragraph 2 of said Section 7 of said By-Law the words "or maintained", so that said paragraph 2, as amended, will read as follows: --- 2. Front Yards: In a Residence A or B District, no building or roadside stand shall be erected or placed or maintained within twenty-five feet of a street line. In a Business or Industrial District A no building shall be erected or maintained within thirty-five feet of the line of a street. In any district there shall be in front of every dwelling on a lot not abutting on a street, a yard not less than thirty feet deep.


3. By inserting, after the word "built" in each instance said word appears in the first sentence of paragraph 3 of Section 7 of said By-Law the words "or maintained", and by inserting, after the word "erected", in the second sentence of said paragraph 3 of Section 7 of said By-Law the words "or maintained", --- so that said paragraph 3, as amended, will read as follows: --- 3. Side and Rear Yards : In a Residence A or B District, no building except a one-story accessory building shall be built or maintained within fifteen feet of a side lot line or within thirty feet of a rear lot line, or within twenty feet of another building on the same lot; and no one-story accessory building shall be built or maintained within ten feet of a lot line in any case, provided that in a Residence B District a building accessory or otherwise may be built or maintained up to ten feet from any side lot line on any parcel of land individually owned which is shown on a plan recorded in the Middlesex North District Registry of Deeds, on or before March 12, 1955 and which contains no more than 10,000 square feet in area and less than one hundred feet frontage.


In a Business District or Industrial District A, no building shall be erected or maintained within 15 feet of a side lot line or within 30 feet of a rear lot line or within 20 feet of another build- ing.

ARTICLE 7. Voted unanimously that the Town further amend its

Protective By-Law, by adding at the end of paragraph 1 of Section 9 of said By-Law, the following three sentences: --- The Selectmen shall issue no permit for the construction and/or alteration of any building which creates a new dwelling unit unless written approval from the Board of Health for the sanitary disposal system or systems has first been procured. If the Board of Health neither approves nor disapproves a written application for approval of such sanitary system within ten days of the receipt thereof by the Board of Health, it shall be pre- sumed that such approval has been procured, and the Selectmen may then issue a permit for such construction or alteration. For the purposes of this paragraph a dwelling unit shall be construed to mean one or more rooms arranged for the use of one or more individuals living to- gether as a single housekeeping unit with cooking, living, sanitary and sleeping facilities.


ARTICLE 8. Voted that the Planning Board be and it hereby is authorized, in the name and behalf of the Town, to acquire such options as it, in its discretion, shall deem to be in the best interests of the Town for the purchase of land for municipal use including, without limiting the generality of the foregoing, parks, municipal buildings and wild life refuges and for the purpose of acquiring such options and for defraying all incidental expenses incurred in connection with said project, that the sum of $1,000.00 be raised and appropriated, said sum to be under the supervision and to be expended by said Plan- ning Board.

ARTICLE 9. Voted that the sum of $10,250.00 be raised and appropriated to meet the Town's share of the cost of Chapter 81 High- ways and that, in addition, the sum of $22,500.00 be transferred from Unappropriated Available Funds in the Treasury to meet the State's share of the cost of the work, the reimbursements from the State to be restored, upon their receipt, to Unappropriated Available Funds in the Treasury .

ARTICLE 10. Voted that the sum of $1,500.00 be raised and appro- priated for maintenance of Chapter 90 Roads on condition that like amounts be contributed by either or both the State and County respec- tively, to be used in conjunction therewith and that, in addition, the sum of $3,000.00 be transferred from Unappropriated Available Funds in the Treasury to meet the State's and County's shares of the cost of the work, the reimbursements from the State and County to be restored, upon their receipt, to Unappropriated Available Funds in the Treasury. Finance Committee approved.


ARTICLE 11. Voted that the sum of Three Hundred Eight (308) Dol- lars be raised and appropriated for the Highway Equipment Account and, in addition, that the sum of Seventy Six Hundred Ninety Two (7,692) Dollars be transferred from the Highway Machinery Fund to said Equip- ment Account.

ARTICLE 12. Voted that the sum of Eight Thousand Six Hundred (8,600) Dollars be raised and appropriated to meet the Town's share of

the cost of Chapter 90 Highway Construction on Hildreth Street and Groton Road and for continuing Chapter 90 Highway Construction on Concord Road and Carlisle Road, contingent upon either or both the State and County contributing towards the cost thereof and to meet said appropriation, the sum of Twenty Five Thousand Eight Hundred (25,800) Dollars be transferred from Unappropriated Available Funds in the Treasury to meet the State's and County's shares of the cost of said construction, the reimbursements from the State and County to be restored, upon their receipt, to Unappropriated Available Funds in the Treasury.

ARTICLE 13. Voted that the sum of Sixty One Hundred (6100) Dol - lars be raised and appropriated for the purchase of a new Truck for the Highway Department, said purchase to be made under the supervision of the Board of Selectmen and that said Board be and they hereby are authorized, in the name and behalf of the Town, to transfer by a good and sufficient Bill of Sale title to one of the trucks now being used by said Department and apply the sum received therefrom against the purchase price of the new truck.

ARTICLE 14. Voted that the sum of $900.00 be raised and appro- priated for the purpose of purchasing one new Snow Plow for the High- way Department, said purchase to be made under the supervision of the Board of Selectmen.

ARTICLE 15. Voted that the sum of $2,200.00 be raised and appro- priated for the purchase of a new Sander for the Highway Department, said purchase to be made under the supervision of the Board of Select- men.

The ad journment of the Annual Town Meeting of March 11 was held at Westford Academy on Saturday, March 18, 1961 at 1:30 P.M.


Ben W. Drew, Town Moderator, called the meeting to order, a quorum being present.


Carl O. Benson, Robert V. Cassidy, Dorothy I. Mann and Ruth A. Sundberg, Election Officers, acted as Tellers at the door. The at- tendance was 234.


ARTICLE 16. By a standing vote counted by said Tellers of YES 87, NO 103, it was voted not to install a drainage system in and along a portion of Plain Road.

ARTICLE 17. By a standing vote counted by said Tellers of YES 113, NO 51, it was voted to dismiss this Article relative to con- structing a sidewalk along a portion of Plain Road.


ARTICLE 18. Voted unanimously that the sum of $5,200.00 be raised and appropriated for the purpose of defraying the cost of con- structing and equipping two new Town Offices and a Ladies' Rest Room in the Town Hall, including all preliminary plans, cost estimates, fees and expenses necessarily incidental thereto, said sum to be ex- pended by and said project to be under the supervision of the Board of Selectmen.
