At the adjourned meeting of the inhabitants of the Town of West- ford, qualified by law to vote in Town affairs, held at Westford Academy on Monday, June 25, 1962 at 8:00 P.M., the following business was transacted:

ARTICLE 1. After a long discussion on this Article, pertaining to borrowing $1,611,000 for an Intermediate School Building, it was voted by secret paper ballots checked with the Voting Lists by the above eight Tellers, YES 542, NO 378 and Blanks 3, this not being the necessary two-thirds vote to pass the Article.

SPECIAL TOWN MEETING - OCTOBER 25, 1962


At a legal meeting of the inhabitants of the Town of Westford, qualified by law to vote in Town affairs, held at the Town Hall on Thursday, October 25, 1962 at 8:00 P.M., the following business was transacted:


Ben W. Drew, Town Moderator, called the meeting to order and de- clared a recess of ten minutes pending the presence of the necessary quorum of 68. The meeting was again called to order as the Moderator declared the presence of the quorum meeting the requirements of the Town By-Laws. The attendance being 76.


Carl O. Benson, Sonja A. Loney, Dorothy I. Mann and James Wilkins, Election Officers using Voting Lists, acted as Tellers at the doors.


ARTICLE 1. Voted unanimously (a) that the Town accept a gift made to it during the year 1962 by the Murray Printing Company; and that the Town Clerk be authorized and directed to extend to said Corporation the appreciation of the Town for said gift.


(b) That the Town accept a gift made to it during the year 1962 by the Isabel F. Hyams Fund, Inc., formerly known as the Solomon Hyams Fund, Inc., and that the Town Clerk be authorized and directed to extend to said Corporation the appreciation of the Town for said gift.


Finance Committee approved.


ARTICLE 2. Voted that the sum of Seven Hundred Fifty (750) Dollars be appropriated from Unappropriated Available Funds in the Treasury for the purpose of defraying part of the legal expenses of the Planning Board in the defense of two actions now pending against it in the Superior Court.

ARTICLE 3. Voted unanimously that the Town amend its Protec- tive By-Law and Protective By-Law Map by rezoning to an Industrial B District the following described parcels of land, belonging to Alexandra Polesayka, a portion of which is presently zoned for Busi-

ness District Uses (that portion bounded by Littleton Road and a line distant 200 feet Southerly of and parallel to Littleton Road) and the balance of which is presently located in a Residence A District:

Do you approve of the adoption of an amendment to the constitu- tion summarized below which was approved by the General Court in a joint session of the two branches held May 13, 1959, received 143 votes in the affirmative and 118 in the negative, and in a joint ses- sion of the two branches held March 29, 1961, received 144 votes in the affirmative and 121 in the negative?


SUMMARY


The proposed amendment imposes no new taxes but gives the Gener- al Court the power to pass an income tax at graduated or proportioned rates and is a change in the constitutional limitations now in effect on the power of the General Court to pass tax measures. The proposed amendment would add a new Article to the Constitution of the Common- wealth by which full power and authority is granted to the General Court, in the alternative to the power and authority to tax incomes in the manner provided in Article XLIV of the Amendments to the Con- stitution, to impose a tax on incomes at rates which are proportioned or graduated according to the amount of income received, irrespective of the source from which it may be derived, and to grant reasonable exemptions, deductions and abatements. It further provides that any property the income of which is taxed under the provisions of the proposed Article may be exempted from the imposition and levying of proportional and reasonable assessments, rates and taxes as at pres- ent authorized by the Constitution, and that the Article shall not be construed to limit the power of the General Court to impose and levy reasonable duties and excises.

ARTICLE 1. Voted unanimously that the Selectmen be and they hereby are authorized and directed to appoint a School Building Com- mittee of three members to be known as the Nabnasset School Extension Committee and to authorize and empower said Committee, in the name and behalf of the Town, to enter into and execute all contracts, agreements, negotiations, duties and functions necessary, incidental, or convenient to, and in connection with the construction, equipping and furnishing of a proposed new addition to the Nabnasset Elementary School, said addition to consist of six classrooms and accessory space, including in the above authorization, but not limited to, the preparation and procurement of plans, both preliminary and final, specifications, professional services, technical advice, bid plans and other data and information relative to or in connection with such proposed construction, equipping and furnishing, hereby authorizing and empowering said Committee to invite all necessary bids for such proposed construction, equipping and furnishing, and to determine the lowest responsible and eligible bidder from the bids submitted, to execute all legal documents, contracts and agreements, approve all expenditures and vouchers for services rendered and for materials supplied in connection with such construction, equipping and furnish- ing; and said Committee is hereby directed to work in cooperation with the School Planning Committee appointed under Article 27 of the Warrant for the Annual Meeting of the current year and to report its progress, further findings, data and recommendations to the Town at a Special Meeting to be held for that purpose.

ARTICLE 2. Voted unanimously that the sum of Fifteen Hundred (1500) Dollars be appropriated from Unappropriated Available Funds in the Treasury for paying the retainer of the architect for preliminary drawings of the proposed addition to the Nabnasset Elementary School described in the preceding Article, and for defraying all expenses of the Committee appointed under said Article.

ARTICLE 3. Voted unanimously that the Board of Fire Engineers be and they hereby are authorized, in the name and behalf of the Town, to transfer to the 4-H Club by a good and sufficient Bill of Sale title to the Ambulance now being used by the Town, said transfer to be made for such sum and upon such conditions as said Board shall determine.

REPORT OF THE BOARD OF SELECTMEN


The Board of Selectmen met and organized on March 28, 1962; present were John J. Kavanagh, Arthur L. Healy and Horace F. Wyman. Arthur L. Healy was elected Chairman and Horace F. Wyman, Secretary.


Reports submitted by departments, committees and individuals, under the jurisdiction of the Selectmen, appear elsewhere in the Town Report.


Joint meetings of certain departments, boards and committees of the Town have been held regularly and continue to be of value in planning for the future needs of the Town. The proposed Industrial Complex, LaCroix 495, in the Howard Road area, is progressing through the planning stages and there is reason to believe that, in the not too distant future, certain marked changes will be made in that area.


R. Ernest Leffel, of the Firm of Camp, Dresser & McKee, has dis- cussed with the Selectmen and other Town officials the studies now being made under the supervision of the Merrimack River Pollution Commission, with particular reference to future sewage disposal prob- lems which may arise in the Town. These studies are continuing and it is expected that recommendations will be made in February 1963 as to available Federal or State Funds for a comprehensive study and, if necessary, construction grants. Lucien J. Menard, a member of the Board of Health, has represented the Town in the work of the Commis- sion.


The Selectmen accepted with regret, the resignation of John F. Sullivan as Chief of Police, effective May 12, 1962. As the result of competitive examinations Officer Joseph R. Connell was appointed Permanent Sergeant, Keith C. Kiberd as Permanent Patrolman. Other appointments were: Sergeant Joseph R. Connell as Acting Chief of Police, Officer John F. Sullivan, Jr., as Acting Sergeant. The Selectmen, upon the recommendation of the Acting Chief of Police and the School Committee, have appointed several Policewomen to serve as Traffic Officers in Forge Village and Nabnasset. On August 24, 1962, Regular Police Officers of the Town took a Civil Service Promotional Examination for Chief of Police. The Selectmen have not been in- formed of the results of said examination.


The Selectmen, after consulting with Fred C. Church & Co., the Town's broker of record, have adopted a new Insurance Plan for the protection of Town buildings, such Plan providing more extended and increased coverage at reduced unit rates.


The books of the Town were audited by State Auditors as of April 4, 1962 and were found to be in order.


To compel compliance with the Town's Earth Removal By-Law, the Selectmen, acting for the Town, sought injunctive relief in the Supe- rior Court against one Chester M. Whitney and Campanella & Cardi, to prevent unlicensed gravel removal from a site off Lillian Road, Nab- nasset. After testimony and argument, but before decision, the par- ties entered into a stipulation providing for the grading and fencing

of the excavated area to the general satisfaction of the residents in the neighborhood .


The inhabitants of the Town are reminded that the Gas and Plumb- ing Installation Codes are in force and that permits are required in accordance with the provisions of said Codes. The Gas Inspector is George D. Carpenter, Nutting Road and the Plumbing Inspector is Paul L. McDonald, Main Street, Westford Center. The proposed Building Code is still under Committee study.


Additional 7,000 Lumen Street Lights have been installed at var- ious locations in the Villages. All residents are requested to re- port improperly functioning or dead street lights to the Clerk of the Board or to any Police Officer.


During the year 1962 the Selectmen issued 169 Building Permits, charging as fees therefor $2.00 or $3.00, depending upon type and size of construction. The total amount of fees received was $456.00. Said permits were classified as follows: Houses - 116; Additions - 31; Sheds - 5; Carports - 2; Garages - 6; Dormers - 3; Accessory Buildings - 3; Covered Patio - 1; Business Building - 1; Cottage - 1.
