REPORT OF THE FIRE DEPARTMENT.


To the Board of Selectmen :-


Gentlemen-This year we have had quite a few fires for a town of this size, and for a new department I feel good work has been done.


My frequent inspections have found the houses well taken care of at all times; apparatus well cared for and in working condition, showing an interest by the members.


A suggestion from me has always been taken with the right sort of spirit, and I must say I am highly pleased with existing conditions for so new an organization.


The additions to the fire houses are much appreciated by the members, and with the new appliances added during the year, we are very well fitted for a small town.


The members of both companies have furnished and deco- rated their respective halls at quite an outlay of money and it is well worth the time spent for one to inspect them.


To save property in times of fire all unnecessary delay must be avoided.


Having this fact in mind and also the fact that we have some seven and one-half miles north and south, and five miles east and west to cover, it seems to me the town ought to take soine step in the direction of permanent horses for the depart- ment.


The horses could be used in the street department both summer and winter, and considering the amount of money we expend each year on our streets and for removing snow, the extra net expense ought not to be heavy.

I recommend that the town sink a well near the Wilming- ton Post Office, at least 20 feet deep and six feet in diameter; also that the town well, corner of Main and Lowell Streets, be enlarged to these dimensions.


My estimate for the year is $500.00.

AUDITOR'S REPORT.


The Assessors' and Collector's books for the year 1904 were verified and compared, and the Collector's accounts were examined on different occasions during the year, and their reports shown in this book are correct.


All bills were examined each month before being paid, and at the end of the year were checked with the Selectmens' and Treasurer's accounts.


The report of the Trustees of the Trust Funds was also examined.

CONTRACT RELATING TO THE ESTATE OF SABRA CARTER.

Whereas, at a sitting of the Supreme Judicial Court, holden at Cambridge within and for the County of Middlesex in the Commonwealth of Massachusetts, upon a hearing had on the twenty-sixth day of April, A. D. 1904, in a case in equity brought by Chester W. Clark, administrator with the will annexed of the estate of Sabra Carter, late of Wilmington, in said County of Middlesex, complainant, against the Attorney- General of the Commonwealth, and others, heirs-at-law of the said Sabra Carter, respondents, and upon consideration thereof by the Court, it was ordered, adjudged and decreed that all the property belonging to the estate of the said Sabra Carter, the testatrix, remaining undisposed of, be converted into money by the said administrator, as soon as practicable, and the net amount remaining in his hands after paying certain expenses and charges, be paid over to the Northfield Seminary, a corpo- ration organized under the laws of said Commonwealth, as trustee, upon the terms and conditions expressed in said decree and which are hereinafter fully set forth:


And whereas, in pursuance of said decree, the said Chester IV. Clark, administrator as aforesaid, has converted into money all the property of said estate that in his opinion is of any sub- stantial value or that can be realized upon, and has paid there-

from said expenses and charges, leaving the net sum of five thousand dollars, as appears by the fourth account of said administrator, to be by him filed in the Probate Court, which sum the said administrator has paid over to the said corpora- tion simultaneously with the execution and delivery of these presents :


Now, therefore, these articles of agreement, made and entered into this twenty-third day of July, in the year one thousand nine hundred and four, by and between the Northfield Seminary, a corporation as aforesaid, party of the first part, and Chester W. Clark, administrator with the will annexed of the estate of said Sabra Carter, party of the second part, witness the following:


The said party of the first part does hereby acknowledge the receipt from the said party of the second part of said sum of five thousand dollars, upon the trust expressed in the terms of said decree and incorporated herein.


The said party of the first part, in consideration of the premises and the payment to it by the said party of the second part of said sum of five thousand dollars, in trust as aforesaid, and the payment hereafter to be made to it of the net amount of any other property of said estate of said Sabra Carter, if any- thing in the future should be realized from property now con- sidered of doubtful value, and in consideration of the entire income, of whatsoever amount it may be, to be derived from all said trust property, does hereby promise, undertake and agree to and with the said party of the second part, and his successors in office, as follows:


1. That the said party of the first part shall and will, at all times hereafter, keep separate and apart from the other funds of said corporation said sum of five thousand dollars and all other money (if any) that may hereafter be realized from said estate of said Sabra Carter and paid over to the said party of the first part, and invest the same with reasonable care and

prudence, and pay the same, in accordance with the order of said court, upon the failure of said corporation or the termina- tion of its charter or final cessation of its business for any cause.


II. That the said party of the first part shall and will so long as it may have possession of and receive the income of said trust fund, furnish board and tuition for, and educate in its seminary, one female student upon the following plan :- A stu- dent shall be selected by the trustees of said seminary from among applicants living in the Town of Wilmington, who shall remain in said seminary until she has pursued the full course of study and has graduated, unless she elects to remain a shorter time; and upon her graduation or sooner voluntary termination of her connection with the school, another student shall be selected in like manner from applicants living in said Town of Wilmington, who shall, for a similar period of time, be admitted to and educated in said seminary; and such selec- tion shall be made as often as there is a vacancy; so that at all times the said corporation shall be furnishing board and tuition for and educating one student in said seminary under the pro- visions of this agreement. Provided, that if, when a vacancy occurs, there should be no applicant resident in said Wilming- ton, then the trustees of said seminary shall select a student from some other town or city in this Commonwealth. Pro- vided, that every student entering said seminary in accordance with the terms hereof shall observe the reasonable rules and requirements of the seminary. The term "board" as used here- in shall include ordinary washing, proportional expense of employing a trained nurse, and all incidental charges.
