COMMISSIONS AND CHARGES


REAL ESTATE.


Minimum scale of commissions and charges is adopted as obligatory:


For making sales of real estate:


On sales of $3,000 or under, 5 per cent.


On sales over $3,000, 5 per cent on the first $3,000, 21/2 per cent for the excess above $3,000. No charge to be less than ... On sale of farms and lands sold at $100 per acre or less .. 5 per cent.

For exchange of property the same rate as in above rules, but no agent who represents both parties in the exchange shall charge more than one commission, which shall be paid one-half by each party to the transaction.


It is customary for abstracts to be furnished by the party selling, and to pay all taxes due upon property. Exclusive listings are recommended.


LOANS.


Minimum scale of commissions and charges for making of loans adopted as obligatory.


On loans of $3,000 or less, 2% for 3 years, 3% for five years; the minimum charge for any loan being $15.00.


On loans over $3,000 and not exceeding $10,000, 2% for three years, 21/2% for five years. On loans in excess of $10,000 and not exceeding $50,000, 2% for a term of not exceeding five years.


On all loans over $50,000 and not exceeding $100,000, 11/2% with no limit as to term of loan. On building loans 1/2 of 1% shall be added to the foregoing rates.


In addition to the above charges the borrower shall pay the expenses of the loan, viz .: The attorney's fees for examination of abstract, the recording of the necessary papers and shall furnish or pay for an abstract of title continued to date, showing the record of the mortgage deed. Borrower pays mortgage tax of 1/2 of 1 per cent.


The rates of commission as above set forth shall be charged upon all renewals.


RENTINGS


Commissions and charges adopted as advisory.


For negotiating and making leases when rents are not collected by agents.


1. Stores and business property, lease not exceeding two years, charge on amount of average annual rental (3) per cent.


2. When term exceeds two years, add 1 per cent of the total rental for the additional years.


3. Residence property, on total rent for terms of lease, two (2) per cent. When lease on residence property shall be less than one (1) year a charge of twenty-five (25) per cent of one month's rent shall be made, but in no case shall the charge be less than five ($5.00) dollars. 4. Ground lease, term less than 15 years, on total rent covered by lease, two (2) per cent. When property is subject to reappraisal during life of lease, the charge is to be computed for the full term, on the basis of the first five years' rental.


5. Ground leases exceeding 15 years, on the appraised value of property at date of making lease, two (2) per cent.


If more than one appraisal is mentioned in the lease, then the percentage is to be figured on an average of the appraised value specified.


6. Should there be a clause in the lease giving the lessee an option to purchase the prop- erty, and should he avail himself of said option, the owner is to pay the agent commission in full, less amount for making lease.


7. When a tenant has privilege of "renewal" expressed in lease it is to be understood that the owner of property shall pay a commission for said renewal at the same rate as though the lease, when first written, had covered the whole term. This commission is to be paid at the time of the renewal.


Charges for procuring tenants are to be made at the foregoing rates, unless there shall have been a previous agreement with the agent that he shall collect the rent.
