I, John Rivers, of Machlinburg County being of sound mind and memory blessed bo God, do make, this the twentieth day of May in the year of our Lord one thousand seven hundred and seventy nine. Make and publis: this my last Will and Testament in manner and as following that is t- say in primes, I lend to my loving wife all my household furniture ar: four head of horses and gears, two cows and calves and one negro woma named Betty and one nogro boy named George as long as she remains a widow and if my said wife should marry then only a child's part or her thied, and if said negro woman should have any more children my desir: is that I land them also to my loving wife and when ever she should ;... married or dies then the whole of my estate to be sold and the money laid out in land in Georgia to the best of advantage and that equally divided between my three children and if my wife should be with child from this date for that to have an equal part with the rest of my chi- Idren. Item I give and bequeath to my loving sister, Lucy Rivers, one gray horse named Spider. And I do constitute and ordain my loving wif: and my brother Jones Rivers and my friend Robert Thomson my executors of this my last Will and Testament. STATE OF GEORGIA WARREN COUNTY


In the name of God Amen. I, Thomas Rivers of said State and County 'being of advanced age and knowing that I must shortly depart this life deem it right and proper both as respects my family and myself that I should make a desposition of the property with which a kind providence has blest me. Do hereby make this my last will and testament hereby revoking all others heretofore made by me. Item 1. I desire and direct that my body be buried in a decent and Christian-like manner suitable to my circumstance and condition in life. My soul I trust shall re turn to rest with God who gave it and my body to the dust from whence it samc. Item 2. I desire and direct that all my just debts be paid without delay by my executors hereinafter appointed as I am unwilling my creditors should be delayed in their rights. Item 3. I give bequeath and devise to my beloved wife Mary Milligan with whom I have lived in quitness for a great while a certain portion of the plantation wheron I now live to wit: North and West of the Lane as it now runs including the house and all the housing furniture and plantation tools. Item 4. I give and bequeath unto my beloved wife for and during her natural life my Negro woman by the name of Sarah and a boy by the name of Isaiah and the choice horse that there may be on the plantation and four cows and calves and fifteen head of hogs such as she may choose all to remain hers during her natural life or widowhood (only) then to be disposed of in the same like manner as I dispose of the remainder part of the property which is as followeth. Item 5. I direct that the remainder part of my proporty be made in six equal shares to wit: one share to my son William, one share to my daughter Harriett McGahee; one share to my daughter, Susan Raborn; one share to my son Thomas J. River one share to my son John Floyd Rivers; one share to my son Francis Milligan Rivers. I do hereby constitute and appoint my sons John Floyd Rivers and Francis M. Rivers executors to this my last will and test- ament hereby revoking all other or any former will by me made. This thirteenth day of March 1847.

This decd of conveyance 1802 made the fourth day of September in the year of our Lord one Thousand eight hundred and two and in the twenty sixth year of Americans Independence between William Whittington planter of the one part and John Rivers planter of the other part re- siding in Richmond County of the Said State witnesseth that the said William Whittington for and in consideration of the sum of one hundred and fifty dollars to him in hand paid at.or before the unsealing ard delivery of these presents the receipt whereof is hereby acknowledged ho said Wm. Whittington hath granted bargained sold release conver to said John Rivers all that tract or parcel of land containing one hund- red and fifty acres be the same more or less lying and boing in the sajd state and county aforesaid on the waters of Big Briar Creek be- girning et a pine, in the branch thence up said branch to the head thence a strate course to the back line, thence along said line to a pine corner thence S. 35.50 to a pine Station from thence to Pine

WILLIAM ASHLEY and AGNES ASHLEY. Pension Number W. 9708 Continental (Maryland Service) William Ashley appeared before Hon. Waddy Thompson, esquire, one of the Judges of the court of Equity for the State of South Carolina, states he is a citizen of ABBEVILLE, SOUTH CAROLINA, that he served 16 months as a Corporal upon the Continental establishment during the war of the Royelution, that he enlisted in Maryland about the middle of May 1778 in Capt Scagong's? company, in the squadron of Cavalry commanded by Col Cowate'h' attached to the body of troops called Pulaski's Corps, that he afterwards commanded by Capt. Brown, until middle of September 1779 whe: he was discharged at Beufort, S. C. Sworn to Aug. 11, 1818. .. Affidavit of Thos Dove 1818, Abbeville, S. C. who states he has been acquainted with the said soldier since 1779, shortly after he left the army, that He has frequently heard Ashley's discharge read, and believes that he did serve in the Revolution. Affidavit made by Joshua Ashley in Abbevill Dist. S.C. Aug. 6, 1818, statos he is a brother of the said Willian Ashley, that he resided in Maryland with his brother at the time he en- listed and was frequently acquainted with the fact that his said brothe: was absent several years, and that he was discharged at Beaufort, South Carolina, and that several soldiers who served with his brother and on their return to the state of liaryland, informed this deponent that they had left his brother vet in the service. William Ashley states that his family consists of three persons viz; himself, his wife Ann and an old negro man, that he himself is now age 73 and that his wife is age 69. H. Gave a schedule of his property, among which 229 acres of poor land worth $100. One negro man age 42 worth $250 etc. He signed this in 1830. A copy of deed is filed of Wm Ashley Senior of Abbeville District to Martin Fralia of said district-consideration $380 dated 1828 ... his wif. Anne Ashley signed 1828 Sept 30. It was recorded 1830. See record book 13 page 450 at Abbeville Dist. S.C. .. affidavit of C. Stark 1829 who states that said Wm Ashley owes him for a negro man on a note bearing date 11-25-1826 the sum of $421. The widow Agness Ashley made applicatic 1838 as the widow of William Ashley, and states she was married to said Wm Ashley 1781 and that her said husband died 3-3rd-1839 that her third child now living is age 60. The widow stated that in 1845, that from bodily infirmity she cannot attend court, but can spin cotton upon a little wheel at home, that her residence was 12 miles away. 2 neighbors to her were Em and James Wire. These 2 witnesses state they have known soldier and present widow since 1792, and have been their neighbors al: this long period until 1845 Sept 4th, and know they had 2 or 3 children when they first became acquainted with them, the widow states she was christened by the name of Agness, but her husband always called her "An: for shortness, and her neighbors always called her "Ann" that some of h. relatives named their children Ann, thro friendly regards to her, that whenever her husband sold land, she always signed her name Agness to her relinquishment of dower, affidavit of Sophia Smith 1845 at Abbeville Dis

S. states "I am the daughter of Agress Achlay and her third child that according to the register of my birth and marriage in my family bible, I was born 3-3-1785, and I was married 1308 to David (illegit it might be Daniel?) Smith. States this handwriting of the register : in the handwriting of her husband who is absent, and who has been absent for three vears, and his affidavit cannot be secured .. affida; by Thos P Spierin, Abbeville, S.C. who states that the following are truly copied from the family bible of Mrs. Sophia Smith viz: "Daniel Smith was born 7-2-1789 married to Sophia Ashley 1808." Sophiah Ashle was born 1785 March 3rd. This affidavit was signed 12-26-1845 by Thes P. Spierin. The said family bible was sent in for proof but the reque: of its return was made, so it is not in this file note. The 2 persons James and Wm Wire state they were brothers, and that they with our father and mother took shipping at LARN IN IRELAND in the month of November 1789 and arrived in Charleston, in the month of February 179. and came to Abbeville District where they resided at a Mr. Hodges unt .. October 1790 and in the same month of October and the year removed to the neighborhood and within half a mile of said William Ashley and Ag. his wife, the claimant and have been personally their neighbors from the month of October 1790 to the present time. That I have a sister w: was born on the ocean on our passage to this country and that she is age: 56 since Jany last, that my brother William Wire who deposes with myself in this matter heretofore died in the month of October last, an. that he with myself deposed, generally without deeming it requisite to state particular facts as appears to be required by the Commissione: of pensions. I further state the said Agness Ashley is the widow of William Ashley, who was a pensioner of the U.S. and that his widow gou by the name of Ann than Agness, signed by James Wire 1846 March 6th. The bible was returned by the pension commissioner 1877 October 2nd to Mrs. Sarah Ashley, Anterville Post Office, Abbeville Co. S.C. The following is a copy of the bible records.
