Lothrop Fund
To the Voters and Taxpayers of the town of Pittsford:
I desire to address you regarding the so-called "Lothrop Fund," about which I understand there has been considerable talk and discussion by some of the inhabitants.
In and by the will of Mr. Lothrop he provided that after the death of his wife, the interest and income of a portion of his estate should be paid to me during my life- time, and the will then provided that, "If she (meaning myself) should die leaving no issue or descendants of such issue then the said principal shall be paid and de- livered to the said town of Pittsford for the support of a hgher grade of public schools for the whole town, but the school buildings shall be located and always remain within the present limits of School District Three in said town."
The funds of the trust created under that clause of the will are now under the control of a trustee, appointed by the Probate Court, who has given large bonds, and the funds are safely invested partly in mortgages and partly otherwise, and the fund is yielding to me after paying all expenses including a large amount for taxes paid to this town on the funds, an income considerably in excess of 4 per cent. per year, and I consider the fund absolutely safe.

I have been asked to allow the town to borrow this fund in such a manner that the fund would be freed from all taxes, and the proposition at first was to pay me 41/2 per cent free from taxes, but I learned that counsel for the town, as well as my own attorney, gave an opinion that this could not be done, because it is only bonds or notes of a town, issued for certain purposes and bearing not over 4 per cent interest that can be made tax free.
I am now asked to allow the town to borrow this fund at 4 per cent, tax free, so that the proceeds can be used in paying for the cost of the new school house.
By loaning the fund to the town at 4 per cent tax free, it would mean a large shrinkage in my income, and it would also mean that the town would lose the income from the taxes paid on the fund, and inasmuch as the town can borrow this amount from others at 4 per cent, issuing its bonds, it would seem better to me to borrow it from others and save the taxes paid on the fund. But it is claimed that by borrowing this fund the town would only have to provide for payment of interest to me during my lifetime, because after my death the town would receive the principal of the fund and so wipe out the indebtedness. I am informed by my attorney that this cannot be done in this manner, because the will provides that this fund must be used for the "support of a higher grade of public schools for the whole town" and that this fund must be kept as a fund to support the school, and cannot be used for paying a debt created for the building of a school house, and I am informed that the attorney consulted by the town, and other eminent lawyers coin- cide in this view. If this is so the town must provide otherwise for the payment of the school house debt, at my death, and must keep ths fund for the support of the school, but the income from this fund would of course lessen the amount of taxes to be raised for purposes of supporting schools.
If the town should attempt to use the fund, as has been proposed by some as I am informed, to pay the debt for building the school house, the Court would probably

enjoin such action and require the fund to be used by the town according to the will.
But without further going into this matter, which really does not concern me, because the question cannot come up until after my death, I am willing personally that the fund may be loaned to the town provided the net income to me shall be 4 per cent per annum, paid semi- annually, and such income shall be free from all taxes, charges for services of the trustee, probate fees, etc., and that such arrangement can be legally brought about, al- though it would materially reduce my income, and would also reduce the tax list of the town.
