Of Rutland, is the next on 6:15 the list and was Sheriff of the conuty 16 years, and has long occupied a small piece of land 1052 in the burying ground a little 947 North of Rutland village. 612
JOSEPH SCOTT,
1223 Of Craftsbury, comes in for a 1137 1751 short notice, by having held the im-office of Sheriff of Orleans Co, 371 659(for a longer lerm than any oth. 1031er, 14 years. He was seven years 637)a member of the Legislature, 4+;)one year a member of the Coun- 4-cil of Censors and two years a 45% member of Constitutional Con- 502 ventions, and Judge of Probate six years. He died about 1841. His son Joseph, was elected Town Clerk in 1829, in room of 1305 Governor Crafts, who had held 2835 that office since 1792, and is the 3016 present Town Clerk The town Thave had but two clerks, both Gib of which are now living, 1751. 1477 Joseph Jr., was two years a 1536 member of the Legislature and 902 has held many important town 70R offices of various kinds. Har- 400 vey Sco't, which I presume is a 5015-on of the Sheriff, took the of- 876fice of Sheriff' one year after his 153 46father's time expired, and hell 30g)it eleven years. So it seems that office is hereditary in the 1813
family.

A few years since I was at Rudand on business, and spent 71. 1:380 164 the Sabbath there, and, as is my 12H Msnal custom took a walk to the 113 |burying ground. I soon came 16 kgto the arrive stone of Ex.Gov. 127! Israel Smith, who had filled a 830 page of his country's history 1.42 with honor to himself. He grad- 23 |dated at Yale College in 1781, 32 stuched law, and removed to Ru- 1:25 c2) pert in 1783,and commenced his profession. In 1785, 83, 89 112 172: ind 90 he represented the town fof Rupert in the Legislature, 13%: 13; Hand in 1791 removed to Rut- Fox| land, and in 1797 was chosen a representative in the General 725 Assembly. He was in high re- pute as a lawyer, and such was the estimation of his talents that 178 1 in 1783 he was chosen, together 1617 1311 with such roted men as Isaac 1770 2001 Tichenor, Stephen R. Bradley. 2150 Nathaniel Chipman, Elijah Paine, Ira Allen and Stephen 1619| Jacob, Commissioners,to adjust the controversy between Ver- 122.8 15 1 mont and New York. In 1791 171| he was a member of the Con- 1493| 18.500 1210 vention that assented to, and a. dopted the United States Con- 2762 stitution, preparatory to its be- 1327 ing admitted into the Union as 1851 951 a State, which was accomplished 1002 the same year. Vermont being 192- entitled to two representatives 3041 in Congress, Gov. Smith was 3.521 chosen for the western district

in 1791, and twice afterwards. During his third term in Congress, in 1796, he became identified with the rising republican party, by voting against the appropriation of funds to carry into effect Jay's Treaty. This being uns .tisfactory to a majority of his constituents, Mathew Lyon was chos- en a member in room of Gov. Smith. In 1797, the Legislature, of which he was a member, elect- ed him Chief Judge of the Supreme Court. He was a noble looking man, and got the name of "the handsome Judge."" At the Vergennes Slaughter in 1798, Gov. Smith was not re elected. In 1800 he was again chosen a member of Congress which he held one term. and at the end of which he took his seat in the United States Senate in March, 1803, which office he resigned on being chosen Governor of the State in October, 1807. While Governor he called the attention of the Legislature to the mode of punishment then existing, and to his influence was the present penitentiary system adopted. He held the office but one year, during which his health was much impaired His grave stone was worded so different from most others, that I took a copy of it, and is as follows:
"The Honorable Israel Smith, born at Suffield. Connecticut, April 4th, 1759, and died at Rutland, Vermont, Dec. 2d, 1510.
No lengthened scroll, no praise encumbered stone,
My epitaph shall be my name alone : If that with honor fail to crown my clay.
Oh ! may no other fame my deeds repav. 'That, only that, shall single ont the spot, By that remembered, or with that forgot."
