DAVID REDDING AND ETHAN ALLEN.


In the journals of the Legislature held at Bennington, June 6, 1778, may be found the following: Voted, that the petition presented to this House by David Redding, be taken into consideration; and that a committee of five be appointed to prepare a bill, in consequence of said petition. &c. Committee chosen, Mr. Webb, Mr. Alverd, Capt. John Fassett, Ensign Harris and Major Olin.


Redding had been convicted of enemical conduct towards Vermont which was considered, at that time, unpardonable by the multitude, and sentenced to be executed on the 4th day of June. The curiosity which has ever been manifested on such occasions, was greatly heightened on this, as it was the first public execution ever witnessed in Vermont. To this curiosity was added a strong feeling of indignation which such a crime was calculated to excite in those days. A vast multitude collected to witness the execution. In the meantime, Redding's Council had discovered a very important defect in the proceedings. Redding had been tried by a jury of six only, which was not in accordance with the common law of England, which required twelve. On application to the Gov- ernor and Council, the following reprieve was granted just as the people were assembling to view the execution :


" IN COUNCIL, June 4th, 1778 ..


To Benjamin Fay, Esq., Sheriff of the County of Bennington .- This Council have taken into consideration, this day, the petition of David Redding, now a prisoner, under sentence of death, and do hereby, in Convention, reprieve him, the said David Redding, until Thursday next, the 11th instant, June, precisely at the hour of 2 o'clock, in the afternoon of said day. You are, therefore, hereby ordered to suspend his execution until that time.


By order of Council, THOMAS CRITTENDEN."

On the reading of the reprieve a clap of thunder would not produced half of the excitement man- ifested. Reasoning was out of the question. The mass had pronounced him guilty, and were not in a condition to understand how the verdict of the whole could, so easily, be set aside by the Gov- ernor and Council. While they were agitating what to do, and greatly excited with indignation. ETHAN ALLEN. suddenly pressing through the crowd, ascended a stump, and waving his hat, ex- claimed, " ATTENTION THE WHOLE "-proceeded to announce the reason which produced the re- prieve-advised the multitude to depart peaceably to their homes, and return on the day fixed for the execution, in the act of the Governor and Council ;- adding with an oath-You shall see some- body hung at all events, for if Redding is not then hung, I will be hung myself." Upon this assu- rance, the people became quiet and soon dispersed. Redding was again tried on the 9th and exe- cuted on the 11th, so that Allen was spared toshow an act of humanity two years afterwards.
