VERMONT CONSTITUTION.


The 8th section of part second is as follows " The House of Representatives of the freemen of this state, shall consist of persons most noted for wisdom and virtue, to BE CHOSEN by ballot by the freemen of every town in this state, respectively, ON THE FIRST Tuesday of September, annually, forever."


From this alone, it appears plainly that when an act must be done on a certain day, by the Constitution, no other day will answer to do that duty on, nor can it be made so by any statute law whatever, unless that law is in accordance with the Constitution ofthe state. The law re- hej upon to hold the election for weeks and months, is the 14th section of chapter 1 of the Re- vised Statutes which says that the voting sha I be continued "until an electiou is ma.le." Here the Con-t tution and the law clash, and as the Legislature have not the power to make the Coo- stitution accord with the law, it is their duty to alter the law so as not to conflict with the Con- stitution.


According to the precedents by the Legislature, no freeman's meeting can be dissolved till . Representative is chosen, if one person, deunk of sober, objects to dissolving the meeting, but the same must be continued 12 months. Such a state of things ought not to exist, as more evil than good grows out of it. Bet if nothing better can be done, make a law so that the majori- ty of the freemen prevent can dissolve the meeting after midnight, and go home and test satisfied that the town will not be misrepresented by a vote of the minority, before they awake.

If you wish to keep roads free from mud, keep the water from them, which is easily done, by leaving no hol ows thereon. to holl the water, and if hollows do occur, draw the water from them soon after a rain, and then fill the same up with grave ..


If you wish to prevent the water from running into your wooden houses, you can do it by making the clapboards the lo vest on the outside, so that the water will not follow down to the holes'made by the nails to hold up the claphoard while clapboarding, but will drop so near the bot- tom of the . ne below, and no water will run down in those nail boles. In 1845, I tried the expor- iment to goud effect, and have stated it to many joiners, who have all approved of the theory, but do not practice accordingly. Just try it, and I'll be bound you will opprove of it.

WHITINGHAM GORE .- This Gure is not mentioned in the Appendix. It was chartered by Vermoi.t, Oct. 20, 1.96. It is 29 + chains east and west, and 174 chaina. 50 links north and south, with 506 1 acies and over ; and is now the south-west corner of_Whiting- ham,-bounded south on Mussar husetts, east ou Cul Whiting's patent, north on Cot Fitch's pa tent, and west ou Readeboro'. How it besamue Whitinghamn, I have yet to learn.


Having examined the Catalogue of Virmont Officers and the Appendix annexed, by Leonord Deming, of Middlebury, we must cheerfuly recommend it to every man in Vermont, as a val wall : work for reference, as to any statement therein made. The Catalogue contalua, as wo have reason to believe, an accurate list of all the Ex cutive, Leg,-lative aud Judiciary officers from 1778 to 1852, -- the Council of Censors, "'unstitutional Conventions, with the popul : tion of the State by towns, at each census. 'The Appendix gives the true date aud origin of the char- ter of each town,-the first settl i ment, organization and officers of each town, aud much other useful information. It will be found a useful work for every citizen ol Vermout.
