1. The following is an authentic copy of this Indian Deed. It is still preserved, and to be seen in the town house of old Braintree; on the back of it is the following: "In the 17th reign of Charles II, Branty Indian Deede, given 1665, August 10th. Take great care of it."

"To all Indian people to whom these presents shall come :- Wampa- tuck, alias, Josiah Sagamore, of Massachusetts, in Newengland, the son of Chickatabut, deceased, sendeth greeting: Know yoo that the said Wampatuck, being of full age and power, according to the order and custom of the natives, hath with the consent of his wise men, viz .: Squamog, his brother Daniel, and old Hahatun, and William Mananio- mott, Job Nassott, Manuntago, William Nahanton. The abovesaid Wampa- tuck Sagamore, for divers good and valuable reasons thereunto, and in special for, and in consideration of twenty-one pounds, ten shillings in hand, payed by 'Samuel Basse, Thomas Faxon, Francis Elliot, William Needham, and William Savill, Henry Neale, Richard Thayer, Christo- pher Webb, all of Braintrey, in the County of Suffolk, in New-England, in behalf of the inhabitants of the Town of Braintrey, above said within themselves; whereof and wherewith the said Wampatuck doth acknowledge himself fully satisfied, contented and payd; thereof and of every part thereof doth exonerate, acquit and discharge the abovesaid Samuel Basse, Thomas Foxon, &c., with all the inhabitants of the Town of Braintrey, them, their heirs, executors, administrators, and assignes, and every of them. And by these presents have given, granted, bargained, sold, en- feoffed and confirmed, and by these presents do give, grant, bargain, sell, enfeoff, and confirm unto the said Samuel Basse, Thomas Faxon, &c., and with themselves, in the behalf of all the inhabitants of the Town of Braintree, them, their heirs and assignes, forever, all the East of lands within the bounde of Braintrey, above-said, be there more or lesse, being bounded on the sea side with the North East, and with Dorchester line on the North West, and by Waymouth line by the South East, and by Dorchester line on the South West. Excepting Mr. Wilson's farme, Mr. Coddington's farme, Mr. Hough's Neck of land, Mr. Quinsey's farme, which lands were purchased by the abovesaid men of his predecessors, which the said Wampatuck doth hereby confirm, being all the lands within the bounde of Braintrey, abovesaid, with all the trees, timber, wood, underwood, standing, lynig, growing thereon, together with all the meadow lands, swamps, ponds, rivers, and brooks, lying between the bounde of Dorchester and Waymouth, together with all privileges and appurtenances belonging or anyways appertaining to the same, to the said Samuel Basse, Thomas Faxon, &c., in the behalf and for the use of all the inhabitants of Braintrey, to them, their heirs and assignes, forever. To have and to hold the said bargained premises, as before buttelled and bounded, together with all deeds, evidences, writings and monuments, that concern the same, in particular, fair and uncancelled unto the said

Samuel Basse, Thomas Faxon, &c., to the only and proper use of the inhabitants of the Town of Braintree, to them and to their heirs, and assignes, forever. And the said Wampatuck for himself, and for his heirs, and executors, administrators, and assignes, doth covenant and grant with the full consent of his wise men, abovesaid, and with Samuel Basse, Thomas Faxon, &c., and with them, in the behalf of the inhabitants of the Town of Braintrey, aforesaid, to them, their heirs, and assignes, by these presents, that the said Wampatuck is the right owner of the said bargained premises, and to every part thereof, unto the day of the date thereof, and hath himself full power and lawfull authority to bargain, sell, convey, and assure the same, in manner and form abovesaid. And that the said Samuel Basse, Thomas Faxon, &c., with the inhabitants of the Town of Braintrey, shall forever, hereafter, peaceably and quietly enjoy, have and hold the said bargained, with the appurtenances thereof, as abovesaid, free and clear, and clearly acquitted from all former bargains, sales, gifts and grants, joynture's tytles, dowrys, tytles of dowers, estates, mortgages, forfeitures, judgements, executions, and any other incumbrances, whatever; as, also, from all tytles of any person or per- sons, claiming any right of tytle, interest or propriety to the same, or any part of the same, in from, or under him, the said Wampatuck, or any of his predecessors. Excepting some lands abovesaid; whereby the said inhabitants of the Town of Braintrey, their heirs or assignes, shall, or may be, hereafter, molested by either English or Indian person, or per- sons, or unlawfully hunted out of the possession, by, from or under him. And that the said Samuel Basse, Thomas Faxon, &c., or any other in the behalf of the inhabitants of Braintrey aforesaid, shall have free liberty to record and enroll the said bargained premises, or cause it to be en- rolled according to the usual custom of recording tytles in such a case. Also the said Wampatuck reserveth liberty to hunt and fish, provided he do the English no harm. In the fifth day of August, one thousand, six hundred and sixty-five, and in the seventeenth year of the reign of our Lord and Sovereign, King Charles the second, by the grace of God, King, of England, Scotland, France, and Ireland, defender of the faith, &c.

Report of Selectmen
FOR THE YEAR 1940
The Town of Braintree has completed three hundred years of its existence as a municipal corporation. During the past year we have commemorated that anniversary through a celebration well planned and executed by an able committee, whose report appears in the following pages. Attention is again called to that extended period of our history through the memorial cover of this volume and the insertion of a copy of the historic deed from Josiah Wampatuck in these pages.
So far as current management of town affairs is concerned, the Board, composed of the same members as last year, has continued the policies which were inaugurated in 1939 and reported in that year. The traffic and parking regulations which were in the formative stages last year have been completed and are now in effect. The most conspicuous effect of these regulations has been the improved movement of traffic through our business centers, due to the changes in parking regulations. The limitation of parking space, however, occasioned in part by the require- ment of parallel parking makes more urgent the necessity for the town to consider the provision of parking areas off of the highways.
While the Board claims no credit for the work of the committees that proposed new codes of by-laws and a new zoning ordinance, it should be noted that we are now operating under such by-laws, designed and better fitted to our new form of government, and we are going through the first phases of enforcement of our new zoning ordinance. In that connection, the Board has appointed, and there is now functioning, a Board of Appeals for the purpose of dealing with the exceptional cases arising under the zoning ordinance. We feel that the Board of Appeals is an outstanding group of men, capable of and now performing a work which is of great value to the future development of the town.
In the normal course of events, the Board has exercised supervision over the departments coming under its control, and feels that the con- fidence which they placed in the men appointed to manage those de- partments has been fully justifid by their work, which is reported in detail in other pages of this volume.
The Board will continue to consider problems before it from the standpoint of the citizens of the Town of Braintree, seeking always to act for the greatest good for the greatest number, and will welcome any constructive suggestions from the citizens as to the management of their affairs to that end.

Tercentenary Committee Report
BRAINTREE, MASSACHUSETTS December 30th, 1940
To the Citizens of Braintree, Massachusetts. Greeting:

I have the honor to submit the following financial report covering the activities of the Braintree Tercentenary Committee, to date. The committee was organized under the leadership of your Chairman in December 1939, and during the period preceding the annual meeting in March, was financed by a private loan without interest which was ad- vanced by one of our public spirited citizens who prefers to remain anonymous.
Under Articles 12 and 13 of the Warrant for the Town Meeting held in March of this year, the sum of $8114.97 was appropriated for the use of the committee. Since that time returns in checks which were drawn but not cashed. has increased the funds available to $8169.97. The Com- missioner of Taxation of the Commonwealth of Massachusetts had per- mitted the Assessors of Braintree, "to use as an item of estimated re- ceipts, the amount of $3000 to be received from the activities of said committee." Weather conditions during the Tercentenary celebration greatly curtailed the anticipated revenues of the committee; but because of this circumstance we have been able to effect savings on certain items carried in our budget.
All known bills of account chargeable to the committee have been paid or vouchers drawn authorizing payment.
The summary given below gives the present financial status of the committee.

In accordance with the vote of the Town and at a special Town Meeting on June 18, 1940 it was voted to give a commemorative medal to each pupil graduating this year from the grammar schools and a historical booklet to each pupil graduating from the High School. These gifts were distributed as directed by the Town.
We have on hand at the present time approximately 1,200 historical booklets, which have been placed in the custody of the Selectmen in the Town Hall.

Warrant for Annual Town Meeting
NORFOLK, ss. To either of the Constables of the Town of Braintree. Greetings:
In the name of the Commonwealth of Massachusetts, you are hereby directed to notify . and warn the inhabitants of the Town of Braintree, qualified to vote in elections therein, to meet at the polling place's in their respective Precincts, to wit:
Polling Place in Precinct 1, Noah Torrey School.
Polling Place in Precinct 2, Town Hall.
Polling Place in Precinct 3, Legion Building.
Polling Place in Precinct 4, Penniman School.
Polling Place in Precinct 5, Hose House, Allen Street.
Polling Place in Precinct 6, Thomas Watson School.
On Monday, the fourth day of March, 1940, at five forty-five o'clock in the forenoon, then and there to bring in to the Wardens of their re- spective Precincts their votes on the official ballot for a Moderator; Town Clerk; a Town Treasurer; one Selectman for a term of three years; one member of the Board of Public Welfare for a term of three years; one member of the Board of Assessors for a term of three years; one Water Commissioner and Commissioner of Sinking Fund for a term of three years; two members of the School Committee for a term of three years; one member of the Municipal Lighting Board for a term of three years; one member of the Board of Health for a term of three years; one Sewer Commissioner for a term of three years; one Park Commis- sioner for a term of three years; a Tax Collector; a Tree Warden; two members of the Planning Board for a term of three years; one member of Thayer Public Library for a term of two years; and eighty-four Town of the Planning Board for a term of two years to fill vacancy; two Trustees meeting members as follows: Thirteen Town Meeting members in Pre- cinct 1 for a term of three years; fourteen Town Meeting members in Precinct 2 for a term of three years; fourteen Town Meeting members in Precinct 3 for a term of three years; fourteen Town Meeting members in Precinct 4 for a term of three years; one Town Meeting member in Precinct 4 for a term of two years to fill vacancy; one Town Meeting member in Precinct 4 for a term of one year to fill vacancy; thirteen Town Meeting members in Precinct 5 for a term of three years; one Town Meeting member in Precinct 5 for a term of one year to fill vacancy;

twelve Town Meeting members in Precinct 6 for a term of three years; one Town Meeting member in Precinct 6 for a term of one year to fill vacancy.
The polls will be opened at five forty-five o'clock in the forenoon and will be closed at eight o'clock in the evening.
You are further directed to notify and warn the said inhabitants qualified to vote as Town Meeting members, to meet at the Town Hall in said Braintree on Monday, the eighteenth day of March, 1940, at seven forty-five o'clock in the evening, then and there to act upon the follow- ing articles, namely :
Article 1. To choose all Town Officers, except those elected by ballot.
Article 2. To hear and act upon the report of the several boards of Town Officers, and committees, and choose any committee the Town may think proper.
Article 3. To see if the Town wil vote to authorize the Town Treas- urer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1940, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws.
