Mr. Storm moved: That the sum of $400.00 be appropriated for the erection of a suitable Memorial to Commemmorate the Three Hun- dredth Anniversary of the Incorporation of the Town of Braintree and that a Committee be appointed by the Moderator, composed of the Con- servation Committee of the Philergian Club to co-operate with the Board of Selectmen in the erection of this memorial .- Carried 8:30.


ARTICLE 2.


Mr. Barrett moved: That the Moderator appoint a Committee of three to investigate the activities of the Tree Warden during the past two years and file a report with the District Attorney of Norfolk County-Not carried 8:37.


ARTICLE 72.


Mr. Frank Heaney submitted a report of progress made by the Zoning Committee.


Mr. Palmer moved: That the sum of $600.00 be raised and appropri- ated for the Expenses of the Zoning Committee .- Carried 8:41.


Mr. Foley submitted a report of the Committee on Tenure of Office for Certain Town Employees.


Voted: That this committee, or another committee ,be appointed to consider this bill to protect Town Employees .- Carried-8:45.


ARTICLE 73.


Voted: That the sum of $206.54 be raised and appropriated to meet the payment of certain bills contracted prior to January 1st, 1940.


ARTICLE 74.


Mr. Higgins moved: That the Town raise and appropriate the sum of $13,927.55 for the purchase or taking by eminent domain for general municipal purposes, of the French Estate, so-called, being Plot No. 6, Plan No. 1005 on file in the Assessors' Office.


Vote was counted by the tellers. There being 98 in the affirmative and 77 in the negative-the motion requiring a two thirds vote-was lost. 9:18.

Mr. Palmer moved: That there be raised and appropriated the sum of $36,000.00 for the purpose of constructing, furnishing and equip- ing a Fire Station to be located in East Braintree on a location to be designated by further vote under this Article; said Station to be con- structed under the direction of a Building Committee to be composed of the Chief of the Fire Department and four other members to be appointed by the Moderator.

Mr. Storm moved: That Mr. Palmer's motion be amended to read as follows: "That there be raised and appropriated the sum of $36,000.00 for the purpose of constructing, furnishing and equiping a Fire Station to be located in East Braintree on a location to be designated by further vote under this Article; said station to be constructed under the direction of a Building Committee to be composed of the Chief of the Fire De- partment and four other members to be appointed by the Moderator; and that to meet the said appropriation, the sum of $6,400.00 will be in- cluded in the tax levy of the current year, $1,600.00 will be appropriated from Sale of Real Estate Funds, and the Treasurer, with the approval of the Selectmen, be and he hereby is authorized to borrow the sum of $28,000.00 and to issue bonds and notes of the Town therefor, the said bonds or notes to be issued pursuant to General Laws, Chapter 44 and payable in accordance with the provisions of Section 19 thereof, so that the whole loan shall be paid in not more than four years from the date of issue of the first bond or note, or at such earlier date as the Treasurer, with the approval of the Selectmen, may determine."

Mr. Atherton N. Hunt moved: That this matter be referred to a committee of five to be appointed by the Moderator to examine this matter and report at the next Annual Town Meeting .- Not carried 10:58.

The adjourned Annual Town Meeting was called to order by the Moderator, Wm. F. Rogers, at 7:49 P.M .There were 137 Town Meeting Members present.


Voted: That the reading of the minutes of the last session be dispensed with.


ARTICLE 80.


Voted: To raise and appropriate the sum of $100.00 for the care and maintenance of property acquired by the Town under Tax Title Foreclosure Procedure .- Carried 7:50.


ARTICLE 81.


Mr. Palmer moved: To raise and appropriate the sum of $50.00 and authorize the Selectmen to expend the same as an annual payment on a lease from year to year of a parcel of land containing fifteen acres as shown on a plan prepared by the Town Engineer and being a portion of Plot 1 on Plan 1029 on file in the Assessors' Office, said parcel to be used as a Town Dump.


The Moderator appointed the following to serve as tellers: Messrs. Iliffe, Seaver, Wade, Erwin, White, Taylor, Gates and Young.


There being 56 in the affirmative and 72 in the negative the motion was lost. 8:24.

ARTICLE 82.

ARTICLE 27.

Mr. French moved: That the Selectmen be authorized to abandon the Town's right of way and easement for sewer purposes over and through land now or formerly of John E. Buckley et al from the north- erly side of Union Street to the southerly line of the highway at the new underpass, so-called, and that the town specify the minimum amount to be paid for such abandonment to be $1.00 .-

ARTICLE 2.


Voted: That the Moderator appoint a committee composed of thre members to act as Executive Committee for the Tercentenary Com- mittee, with authority to act for the Tercentenary Committee in all matters pertaining to appropriations made under Articles 12 and 13. Carried-8:44.


ARTICLE 83.


Voted: To authorize and direct the Assessors to use not more than $75,000.00 from Free Cash toward the reduction of the 1940 tax rate. Carried-8:44.


ARTICLE 59.


Mr. Anderson moved: That we take Article 59 from the table .---- Carried 8:45.


Mr. Anderson moved: That the report of. the Committee be ac- cepted and the Selectmen be instructed to issue a warrant for a Special Town Meeting to adopt the code of by-laws as presented by the report of the Committee, and that the committee be continued until the Town has voted on the adoption of its report.


The following recommendations were offered as amendments to the original report submitted by the By-laws Committee:


Article1- Section 7 .- Moved: The Chairman of the Finance Committee shall be a Town Meeting member at large. Voted- favorable action.


Article 1-Section 8. - Moved: The Town Clerk shall deliver, by mail or otherwise copy of these By-Laws to each Town Meeting Member within seven days after his or her election. He shall also deliver at the same time a copy of the Legislative Act (Chapter 56) establishing the Limited Form of Town Govern- ment. Voted-favorable action.


Artcile 3-Section 1 .- Moved: That this apply to the representa- tive to our State Legislature .- Not carried.

Voted: That there be raised and appropriated the sum of $377.00 for advertising in the warrant, publication, printing and binding the by- laws, there to be included in the same pamphlet a reprint of the Town Meeting Act .- Carried 10:02.


Voted: That the Moderator appoint a committee of five citizens to study, and, if found desirable, prepare a revision of that portion of the by-laws referred to as the "Building Code"; said committee to include the Town Counsel and at least three members who are actively con- nected with the building trades and report at the next Annual Town Meeting .- Carried 10:04.


Mr .Foley moved: That this Town Meeting congratulate the Mod- erator, William F. Rogers on his usual fairness in conducting the Town Meeting in its Tercentenary Year.

NORFOLK, ss. To either of the Constables of the Town of Braintree: GREETINGS:


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Braintree, qualified to vote as Town Meeting members, to meet at the Town Hall in said Braintree on Tuesday, the eighteenth day of June, 1940, at seven forty-five o'clock in the evening, then and there to act upon the following articles, namely :


Article 1. To hear and act upon the report of the several boards of Town Officers and Committees, and choose any committee the Town may think proper.


Article 2. To see if the Town will vote to amend its By-Laws by adopting the following proposed Code of Revised By-Laws.


ARTICLE I TOWN MEETING


SECTION 1. The annual meeting shall be held on the first Mon- day of March, on which day shall be held the annual election of town officers and the determination of such matters as by law are required to be determined by ballot.


SECT. 2. The polls shall be opened not later than six o'clock in the morning and shall close not earlier than seven o'clock in the eve- ning. This provision shall also apply to all elections and primaries, unless otherwise provided by law, except that in the case of primaries, the polls may be closed not earlier than two o'clock in the afternoon.


SECT. 3. All business, except the election of officers and the de- termination of such matters as by law are required to be determined by ballot, shall be considered at an adjournment thereof to the third Mon- day in March at 7:45 P.M.


SECT. 4. Notice of every Town Meeting shall be given by a Constable of the Town by posting attested copies of the warrant in one or more public places in each voting precinct ten days at least before the day fixed for the meeting, also by publication of a copy of the war- rant once each week for two successive weeks in one or more newspapers published in th Town, if there be any, the first publication to be at least eight days before said meeting.

SECT. 5. Notice of every adjourned meeting shall be posted by the Town Clerk at the Town Hall, and if the period of adjournment will permit, shall be advertised in one or more newspapers published in the Town, if there be any. In each case, the notice shall refer to th earticles in the warrant on which final action has not been taken.


SECT .. 6. Special elections for Town officers shall be by precinct voting, at the polling places in thie several precincts of the Town, polls to be opened and closed as prescribed in Section 2 of this Article.


SECT. 7. The Chairman of the Finance Committee shall be a Town Meeting member at large.


SECT. 8. The Town Clerk shall deliver, by mail or otherwise, a copy of these By-Laws to each Town Meeting Member within seven days after his or her election. He shall also deliver at the same time a copy of the Legislative Act (Chapter 568) establishing the Limited Form of Town Government.


ARTICLE II PROCEDURE AT TOWN MEETINGS


SECTION 1. The procedure at Town Meetings shall be gov- erend by the rules of practice contained in Cushing's Manual of Parli- amentary Practice, except as modified by law or by these by-laws.


SECT. 2. Until a question under debate is disposed of, no motion shall be received except motions to adjourn at a time certain, to adjourn the meeting, for the previous question, to lay on the table, to commit, to recommit, to amend, to refer, or to postpone indefinitely, which sev- eral motions shall have precedence in the order in which they are herein arranged, but a motion for extension of time under Section 6 may be presented at any time. On any motion to adjourn, to lay on the table, for the previous question, or for an extension of time, (1) no person shall speak more than once, and then for not more than two minutes, (2) not more than ten minutes in all shall be allowed for debate except with con- sent of the meeting voted at the time, and (3) no other motion shall be entertained until the pertinent motion is finally disposed of.


SECT. 3. All articles in the warrant shall be taken up in the order or their arrangement, unless otherwise voted by the meeting.


SECT. 4. A motion, if required by the Moderator, shall be re- duced to writing before being submitted to the meeting.


SECT. 5. Except as provided in Section 2 of this Article, all questions may be debated, but without consent of the meeting, no person except the Chairman of the Finance Committee shall speak more than twice on any one question, not to exceed ten minutes the first time and five minutes the second, and no person shall speak more than once until all who desire to speak for the first time have been heard.


SECT. 6. On proposed amendments involving sums of money, the largest amount shall be put to the question first, and on declaring an affirmative vote on said amendment, the Moderator shall, if the motion calls for an appropriation, take a vote on the appropriation of said larger amount, the action on which shall be final action on the article in question.


SECT. 7. No final vote shall be reconsidered, unless notice of the intention to move a reconsideration has been given to the Clerk witihin one hour after the vote has been declared, or in the event that the meeting adjourns to a day certain, within said hour, said notice in writing may be given within twenty-four hours after said adjournment. Said motion to reconsider shall be in order only at said meeting or the next adjournment thereof, and only one such motion shall be received and

acted upon. No reconsideration of any final vote shall be had unless ordered by a two-thirds vote of the voters present and voting thereon.


SECT. 8. All voting in a Town Meeting shall be in the form re- quired by the Moderator, unless otherwise required by law or by vote of tlie meeting, except that if the result is questioned immediately by seven voters, the Moderator shall appoint tellers to verity the vote.


SECT. 9. When a report of a committee is placed in the hands of the Moderator, it shall be deemed to be properly before the meeting for its action thereon, and a vote to accept shall discharge the committee, but shall not be equivalent to a vote to carry out its recommendations without a special vote to adopt it.


SECT. 10. No appropriation shall be made under the report of any committee of the Town, except under an article in the warrant pro- viding for such appropriation.


ARTICLE III FINANCE COMMITTEE


SECTION 1. The finance committee shall consist of fifteen voters appointed as provided in the following sections. No person who is an elected officer of the Town (excepting Town Meeting Members) or a member of any board of the town receiving pay therefrom, or an appoint- ive employee of the Town, shall be qualified to serve as a member of the finance committee.
