A The removal of soil, loam, sand or gravel from any parcel of land not in public use in the City of Newburyport, except as hereinafter provided, shall be allowed only after a written permit therefor is obtained from the City Council after a public hearing of which due notice is given.
B No permit shall be required for the continuous operation on any parcel of a sand or gravel pit in operation at the time this by-law is adopted, provided such operation is not thereafter discontinued for more than one year; and no permit shall be required for the removal of soil, loam, sand, or gravel from any parcel of land when incidental to and in connection with the construction of a building on the parcel. No permit shall be re- quired by a home owner or farmer for the transfer of loan, sand, or gravel from one part of his own premises to another part thereof for the improve- ment of his own premises, nor shall any permit be required for removal of loam, sand, or gravel in connection with the improvement or construction of any road over his premises provided such loam, sand, or gravel so remov- ed is used on said premises to improve the same and is not contrary to the regulations of this by-law as adopted.
C In issuing a permit under this by-law, the City Council may impose such conditions not specifically provided for therein as it may deom nec- essary for the adequate protection of the neighborhood and the city, and conditions imposed by the City Council shall be attached to and made a part of the permit. The City Council may, in its discretion, require a bond, certified check, or other security for compliance with such condi- tions or as evidence of good faith as to the completion of any proposed construction. The City Council may, after a public hearing on proof of violation of any condition, revoke any permits so issued. No permit shall be issued under the provisions of this by-law for a period of more than three years.
D Sand and gravel may be removed from any parcel of land, except within 300 feet of a street or way, and the City Council shall issue a permit therefor provided however, that the City Council shall impose such reason- able conditions as to the disposition of top soil and the reestablishment of ground levels and grades as it may deem necessary.
E £ Soil or loam may be removed and sold from any parcel of land within such parcel determined by the City Council, to be unsuited to agricultural use, and the City Council may issue a permit for such romoval; provided, however, that the City Council shall in making such decision, obtain the recommendations of the appropriate soil district supervisor and the County Extension Director or Agent, or their successors, and their recommendations shall be made a part of the records of the City Council. In issuing a permit, the City Council may impose reasonable conditions as to the re- establishment of ground levels and grades.
F Notwithstanding the provisions of the above, the City Council may issue a permit for the removal of soil or loam from any parcel of land in the city where such removal is necessarily incidental to and in connection with the construction of a road or other facility involving a permanent change in the use of the land. The City Council shall issue no such per- mit unless it is reasonably satisfied that the construction will be com- pleted and evidence thereof shall be made part of the records of the City Council.

G Sand or gravel may be removed from any parcel of land within such par- cel lying within 300 feet of any street or way, provided a permit therefor has been issued by the City Council after satisfactory evidence that such removal will not be seriously detrimental or injurious to the neighbor- hood; provided further that the City Council shall impose reasonable con- ditions as to the method of removal, the re-establishment of ground levels and grades and the planting of the area to suitable cover, as it may deem necessary.
H The penalty for violation of the provisions of this by-law shall be as follows : For the first offense fifty dollars ($50.00); for the second offense one hundred dollars ($100.00); and for each subsequent offense two hundred dollars ($200.00); or action relative thereto.

An Ordinance Establishing The Office of Assistant City Messenger. Be it ordained by the City Council of the City of Newburyport as follows:
Section 1. Every three years in the month of October the City Council shall elect a suitable person to styled an assistant City Messenger.
Section 2. It shall be the duty of the said assistant City Messenger to assist the City Messenger in duties as outlined in the Revised Ordinances of 1937, Newburyport, Mass., entitled City Messenger An Ordinance Establishing The Office Of City Mess- enger. He shall receive for his services such compensation as the City Council shall annually or from time to time alow.

Be it ordained by the City Council of the City of Newburyport as follows : Chapter 31 of the Revised Ordinances of the City of Newburyport is hereby amended by striking out Article 10 thereof as amended and inserting in place thereof the following Article :- Article 10,
"off-Street Parking Lots"
1. The herein after mentioned areas are hereby designated as Municipal Off-Street Parking Lots. Any person park- ing a vehicle in any of the following designated Off- Street Parking Lots shall be subject to the following rules and regulations governing said Lots.
2.
a. Person-The word "person" shall mean and in- clude any firm, individual, co-partnership, or corporation.
b. Off-Street Parking Lots-The words "Off-Street Parking Lots" shall include any Municipal own- ed or operated parking area which is used or established by the City of Newburyport as an

Off-Street Parking Lot or as may hereinafter be fixed by ordinance, but it shall not in- clude any parking on any street or way with- in the city.
3. Off-Street Parking Lots- Kent Street, Municipal Parking Lot, being that area bounded by Washington, Kent, Congress and Buck Streets, excepting therefrom that area set off for use as the Davenport School grounds. Inn Street Municipal Parking Lot, being that area bounded by Inn and Bartlett Streets.
4. Whenever any motor vehicle shall be parked in an Off- Street Parking Lot, owner or operator of said motor vehicle shall park within a space designated by the marking lines. No person shall park a motor vehicle in said parking lots for a period greater than herein- after set forth.
5. Fee and time limit -- a Kent Street Municipal Parking Lot Parking regulations shall be effective and apply seven days per week.
(1) Any person before using and entering the aforesaid parking lot shall obtain from the City Treasurer, or such other person as may be designated by him, a sticker. A sticker shall entitle a person to park his motor vehicle in said parking lot for a period of eight hours each day for one
week. The week shall begin on Monday and terminate on Sunday. Each day shall be divided into three eight hour periods. Period one shall be between twelve mid- night to eight A.M., period two from eight A.M. to four P.M .; period three from four P.M. to twelve midnight. The sticker issued as aforesaid shall indi- cate which period a purchaser thereof may park his car or vehicle together with the date or week for which it was issued. Be- foro any person shall be entitled to park a motor vehicle in said lot the sticker must be displayed or placed on the rear window of said motor vehicle or some other suitable place so that the same can be in- spected from the outside of the motor ve- hicle.
(2) The fee for such sticker shall be fifty ($.50) cents per week.

b. Inn Street Municipal Parking Lot
No person shall park a motor vehicle in said Inn Street Parking Lot for a period of time longer than two hours, between the hours of nine A.M. and six P.M., or in any Off-Street Parking Lot that may be hereafter established and fixed by ordinance, except that on Fridays and on days immediately prior to legal holidays, the limited parking time shall apply between the hours of nine A.M. and nine P.M. This parking restriction or regu- lation shall not apply on Sundays or le- gal holidays or on a Monday whenever a legal holiday falls on Sunday and the same is celebrated on Monday.
(1) The fee for use of said Inn Street Park- ing Lot shall be give (5cts) cents per hour. Whenever any motor vehicle enters said parking lot, the owner or operator of said motor vehicle shall immediately deposit the fee in the parking meter assigned to the parking space which his motor vehicle has entered. The coin in- serted in the parking meter shall be a United States coin and in accordance with the directions on the meter.
6. All monies obtained through Off-Street Parking Lots as set forth in this ordinance shall be received by the City Treasurer and shall be credited to the account by law.
7. Any person who violates any provision of this Ordi- nance shall be subject to the following penalties.
First violation during the calendar year- Warning Second violation during the calendar year- fine $1.00 Third violation during the calendar year- fine $2.00 For each violation thereafter during the calendar year-$5.00 per violation.

An Ordinance Entitled An Ordinance To Amend An Ordinance Entitled "Board of Assessors" Be it ordained that an Ordinance entitled "Board of Assess- ors" be amended by the addition of the following new Section 5:
Section 5: The Board of Assessors shall publish, annually in the City Report, a list of all changes made in the assessed valuation on all real properties in the city for the current year and shall also publish in said City Report, all assessed valuations placed on new construction or remodelled properties during said year.
