City Solicitor's Report For The Year 1956
Dear Sirs:
In compliance with Section 4, Chapter 14 of the revised ordinances of the City of Newburyport, I am submitting nerewith my report as City Solicitor for the year 1956.
During the year 1956 there were several actions brought against the City of Newouryport and actions brought by the City of Newburyport. Among those actions is a case involving the Police Cruiser for the City of Newburyport. In this case, William belong, Et al is suing Patrolmen Joseph Gallagher and Peter Genna for property damage and personal injuries as a result of an accident occurring in Salisbury, Massachusetts during the year 1955. This action involves the sun of Ten Thousand ($10,000.00) Dollars, Ad Damnum.
Also there is an action of Nicnolas Costa Vs. Lieutenant John F. Cutter, Jr., of the Newburyport Fire Department, and also a companion case of the City of Newburyport Vs. Nicholas Costa. T .. ese actions result from collision of a car owned by Nicholas Costa and the Fire Department Ambulance on the Newburyport Turnpike. The Ad Damnum in this writ is Five Thousand (+5,000.00) Dollars. The City of Newburyport's action against ar. Costa is in the sum of Two Thousand ($2,000.00) Dollars.
There is also pending a case of the City of Newburyport Vs. Willian beaman. This is an action of Contract in which the City is suing the defendant for money owed on the Clam Account.
The following land damage cases are all pending against the City as a result of land taking for the construction of the North End Elementary School.

The following land damage cases are pending against the County of Essex and/or the City of Newburyport as a result of land taking on Low Street for widening and reconstruction of road on Low Street. Simon Zani, John F. Leary, Leonard Woodman Elizabeth Woodman.
The following case is pending against the City of Newburyport as a result of land taking for the Inn Street, bartlett Street, Off Street Parking Lot.

The right of action in which Rt. Rev. Hugh L. Doyle, Et Ali and William F. O'Brien, et ux., had against the City resulting from the establishment of this Off Street Parking Lot have been settled.
Considerable work has been done by the City Solicitor in relation to the aforementioned land takings. This work involved not only conferences and work in my office but also numerous hours spent visiting and talking with people whose land was being affected by the land taking.
In addition to the aforementioned cases there are other cases concerning tax abatements and Workmen's Compensation which the City Solicitor was required to handle for the City.
During the year 1956 I gave numerous opinions to the City Council, School Committee and the various department heads.
