CITY OF NEWBURYPORT In City Council March 2,1965
Ordinance:
Be it Ordained by the City Council of the City of Newburyport that Chapter 29 Entitled "Superintendent of Streets and Sewers" of the Revised Ordinances of 1937, as amended, be further amended by striking out "Superintendent of Streets and Sewers" and inserting in place "Super- intendent of Public Works". Section 1 and Section 2 are deleted and in place are Section 1 and Section 2 as follows :
Section 1: The Mayor, subject to the approval of the City Council, shall appoint annually, in the month of January, a person qualified by train- ing and experience to be Superintendent of Public Works, to serve until his successor is appointed and qualified. He shall receive such compen- sation for his services as the Mayor and the City Council may determine.
Section 2: He shall have all the powers and perform the duties consist- ent with the laws of the Commonwealth in relation to road construction. He shall supervise and be responsible for the care and maintenance of all City Parks, Playgrounds, Tree Work and Cemeteries, within the City. All duties formerly held by Tree Warden and Superintendent of Cemeteries are now vested in this office.

An Ordinance Amending The Ordinance Entitled "City Council Committees"
Chapter 6 of the Revised Ordinances of the City of Newburyport is hereby amended by striking therefrom Sections 1 through 5 inclusive and substi- tuting therefore the following 5 Sections.
Section 1
There shall be four committees of the City Council, a Committee on Public Safety, a Committee on Public Service, a Committee on Licenses and Permits, each to consist of three members of the City Council, and a Committee on General Government to consist of the Mayor, President of the City Council and one Councillor.
Section 2
The Committee on Public Safety shall be concerned with all the activities in the Police and Fire Departments, with all public properties, excepting school properties and the City Hall, and with parking meters and City parking lots.
Section 3
The Committee on Public Service shall be concerned with all the activities in the Public Works Department, and the Sewage System and Plant, and also be the Committee on lighting and City Cemeteries.
Section 4
The Committee on Licenses and Permits shall view and make rec- ommendations on all applications for licenses and permits that come under the jurisdiction of the City Council. The Committee shall also investi- gate all persons applying for certificates of incorporation as provided for in Chapter 180 of the General Laws.
Section 5
The Committee on General Government shall be the Committee on City Finances, the Committee on Claims, and Municipal Departments. The Committee shall also have charge of and supervision over City Hall.

An Ordinance Entitled An Ordinance Relative to Muzzling of Dogs. Be it Ordained by the City Council of the City of Newburyport as follows :
Sec. 1 The Marshal of the Police Department, or the Dog Officer, may order that any dog who has bitten or wounded any person, shall not go at large without an adequate muzzle, and the owner or keeper of any such dog shall forfeit and pay the sum of ten ($10.00) dollars for each breach of such order, in accordance with General Laws, Chapter 140, Sec. 173 of the Commonwealth of Massachusetts.
Sec. 2 Restraint or muzzling of, by order of dog officer. If any per- son shall make a complaint in writing to the dog officer of the city, that any dog owned or harbored within his jurisdiction is a nuisance by reason of vicious disposition or excessive barking or other disturbance, the dog officer shall investigate such complaint, which may include an examination on oath of the complainant, and may order such dog to be restrained or muzzled.
Sec. 3 Restraint of by dog officer. The dog officer may restrain or order to be restrained or muzzled any dog for any of the following rea- sons :
(a) If found at large, as the case may be, while an order of the dog officer for the restraint or muzzling of such dog is in effect
(b) If found in a school, schoolyard, or public recreational area
(c) For having killed or maimed or otherwise damaged any other domesticated animal
(d) For chasing any vehicle upon any public way or way open to public travel in the city.

An Ordinance Entitled An Ordinance To Amend An Ordinance Relating To The Salary of the Mayor of Newburyport.
Section 1 of Chapter Four of the Revised Ordinance of the City of New-
buryport is hereby amended by striking out Section 1, of said Chapter Four, as amended July 6,1943, and inserting in place thereof the follow- ing:
Section 1. The salary of the Mayor of the City of Newburyport is hereby fixed at the sum of
$7,500.00 annually, to be paid in monthly installments.
Effective after organization of City Government in January 1966.

CITY OF NEWBURYPORT In City Council July 19,1965
Ordered: That a Public Hearing be held on Monday, August 9,1965, 7:30 P.M. at the Council Chamber, City Hall, Newburyport, Massachusetts, on the pro- posed change in the Zoning Ordinance submitted by the Planning Board to the City Council at their meeting of June 7,1965, by changing Section V-E paragraph 2 of the present Zoning Ordinance and substituting the follow- ing:
/2/ No dwelling shall be reconstructed, remodelled, or altered in such a manner as to reduce the living space per occupant to less than the following minimum regulations as to space and use :
a. Every dwelling unit shall contain at least two hundred (200) square feet of floor space for the first occupant, and at least a hundred (100) square feet of floor space for each additional occupant, the floor space to be calculated on the basis of hab- itable room area .*
b. In a dwelling unit, every room occupied for sleeping purposes by one occupant shall contain at least eighty (80) square feet of floor space, every room occupied for sleeping purposes by more than one occupant shall contain at least sixty (60) square feet of floor space for each occupant.

c. In a rooming unit, every room occupied for sleeping purposes for one occupant shall contain at least eighty (80) square feet of floor space; every room occupied for sleeping pur- poses by more than one occupant shall contain at least six- ty (60) square feet of floor space for each occupant.
d. No room shall be considered habitable if more than three- quarters (3/4) of its floor to ceiling height is less than seven (7) feet.
e. In computing total floor area for the purpose of determing maximum permissible occupancy, that part of the floor area where the ceiling height is less than five (5) feet shall not be considered.
f. No room or area in a dwelling may be used for sleeping pur- poses if more than half of its floor to ceiling height is below the average grade or the adjoining ground. Provided, that any such room may be used for sleeping if it has been damp-proofed in accordance with any method approved in writing by the Newburyport Board of Health.
*HABITABLE ROOM means every room or enclosed floor space used or intended to be used for living, sleeping, cooking, or eating purposes, excluding bathrooms, toilet compart- ments, laundries, pantries, foyers, communicating corridors, closets and storage spaces.
The above definition of Habitable Room to be included as a footnote, to the substitution and also under Section ID entitled "Definitions".

To the Honorable Mayor and Members of the City Council, City Hall,
Newburyport, Massachusetts.
Gentlemen : -
For the year 1965 I herewith submit my annual report as City Solicitor.
This department has processed many highway and sidewalk defect claims, and Workman's Compensation cases and injury claims wherein City Employees were involved.
Appellate Tax Board matters including the First National Stores, Inc., and the Koufman cases have had further attention and orders to dismiss were entered.
Board of Health department, - suit was instituted in one instance and settled; I have submitted opinions and letters on various matters.
Board of Public Welfare ,- I have had conferences with members of the department, attended to correspondence involved in many of the cases, and attended Court to prosecute matters. In other matters have conferred with attorney wherein settlements have been reached.
City deeds have been prepared and executed in several matters.
In the Water Commissioners' department I have given opinions on several questions and attended to settlement of Court cases.
An action by Hon. Andrew J. Gillis in the Essex Superior Court was successfully defended by the City.
An action brought by Mr. Raymond Mace was defended and discontinuance filed.
During the year suit was brought by Philip Goltz resulting from an accident involving a Fire Department vehicle.
Conferences were held with members of the Planning Board.
Letters of opinion were forwarded to the School Department , the Public Library and Housing Authority.
Since the year 1937 there has been no consolidation of the City Ordinances and, in the past thirty years, there have been a great many changes.
