Dabney Hunter, Engineer and Superintendent of Public Works dated June 20, 1904, and recorded herewith; reserving, however, to the owner or owners of the different parcels of which said land forms a part, their heirs and assigns, the right to pass and repass on foot and with teams over the above described lands, and all other rights not inconsistant with the laying, making, maintaining and repair of any main or mains or pipes or other necessary appliance of said City of Melrose now or hereafter laid in said lands hereby taken.
On June 27, 1904, the Board of Aldermen passed Order No. 2473, taking rights in certain private lands belonging to Samuel Robinson, William L. Cheever, Est. Seth E. Benson, Mrs. Emily G. Cochrane, Isabel W. Thurber, Bessie Levine, Daniel J. Dowd, Rebecca Grossman and Eliza D. & Emily Clark, as follows:

Be it ordered: That acting under the provisions of law applicable thereto, a main drain either open or covered, shall be laid or constructed under the law authorizing the assessment of betterments in the following described right of way as hereinafter set forth, viz:
Beginning at a point on the easterly line of Green Street, said point being one hundred eighteen and sixty-six one hundredths (118.66) feet southerly from the stone bound marking an angle in said line opposite Holbrook Court, thence north 49° 21' 30" west forty and eight one hun- dredths (40.08) feet to the westerly line of Green Street; thence in same course three hundred fifty-five and thirty-one one hundredths (355.31) feet more or less to a point on the dividing line between land now or form- erly of J. Q. A. Holbrook and Emily G. Cochrane; thence along said divid- ing line between land now or formerly of J. Q. A. Holbrook and Emily G. Cochrane, north 0° 59' 30" east, twenty-eight and ninety-six one hundredths (28.96) feet; thence north 43º 10' 30" west one hundred sixty-two and sixty-two one hundredths (162.62) feet; thence north 84° 25' 30" west seventy-one and nine one hundredths (71.09) feet to the easterly line of Main Street; thence in same course forty-eight (48) feet across Main Street to the westerly line of said Main Street; thence north 78° 09' 30" west seventy-six and forty-one one hundredths (76.41) feet; thence north 87º 48' 30" west three hundred and forty-nine (349) feet more or less to a point of curve; thence by a curve to the left, radius forty (40) feet, sixty-nine (69) feet more or less to a point on the easterly side of a taking for drainage of Sucker Brook.
The above descrbed line from Green Street to the easterly line of Main Street is the center line of a taking fifteen (15) feet wide, and from Main Street to the taking for the drainage of Sucker Brook it is the southerly line of a taking varying in width as is shown on a plan drawn by W. Dabney Hunter, Engineer and Superintendent Public Works, dated June 20, 1904, filed herewith and made a part of this taking.
Due notice having been given and the parties heard, it is hereby ad- judged that the said drain is a necessity for the public convenience and health; that the City of Melrose acting under the authority of the Re- vised Laws, and also under all other provisions of law and every other power it hereto enabling, has taken and hereby does take for the purposes of constructing and maintaining a main drain in the private lands as hereinbefore specified for the sole use and benefit of the said City of Melrose the following lot and parcels of land situated in said Melrose, in said County of Middlesex, viz:
A certain lot of land situated on the westerly side of Green Street, sup- posed to be owned by Eliza D. and Emily M. Clark, bounded and described as follows: Beginning at a point on the center line of taking on the west- erly side of Green Street, thence the line runs northerly along the line of Green Street seven and five-tenths (7.5) feet more or less; thence north 49° 21' 30" west one hundred sixty-five (165) feet more or less to the dividing line between land of said Clark and Grossman; thence southerly on dividing line fifteen (15) feet more or less; thence south 49° 21' 30" east one hundred sixty-five (165) feet more or less to the west line of Green Street; thence northerly on Green Street seven and five tenths (7.5) feet more or less to the point of beginning, containing 2475 sq. feet. more or less.
