CHAPTER XXXIII.
ORDINANCE ON THE HEADS OF DEPARTMENTS.
Section 1. Every officer in charge of a department shall within thirty days after the close of the financial year trans- mit to the Mayor a report containing a statement of the acts and doings, and receipts and expenditures, of the department for such financial year, together with such other matters as may be required by law, or as the Mayor or officer may deem to be of public interest.

CHAPTER XXXIV.
ORDINANCE FOR THE WEIGHING OF COAL AND OTHER COMMODITIES.
Section 1. A sworn weigher not engaged in the business of buying or selling coal or other public commodities shall attend on every day, Sunday and legal holidays excepted, at the Engineering Department of the office of the Superintendent of Public Works of the City of Melrose during office hours of said Department, for the purpose of weighing coal or other public commodities. He shall deliver to the driver of every load of coal or other public commodity weighed by him a certificate specifying the name and address of the seller, the purchaser, and the driver, the number of the load and the weight and tare thereof, the date when the certificate is given, and the amount of fees received.
He shall also keep in a book furnished by the City Clerk a duplicate of said certificate, and said book shall always be open to public inspection and when filled shall be deposited with the City Clerk.
Section 2. The fee for weighing on said scales for residents of Melrose shall be ten cents per load, and for non-residents shall be fifteen cents per load, but no fee shall be taken for weighing done on account of the City or for weighing the cart or vehicle containing the article to be weighed or for any other tare. The weigher shall pay over to the City Treasurer weekly all fees collected.
Section 3. All coal or other commodities furnished to the City or any department thereof shall be weighed on the City scales by a sworn public weigher who shall keep a record as above set forth and deliver a certificate of weight to the driver to deliver to the janitor or person in charge of the building where the coal is to be delivered.
Section 4. Whoever in the City of Melrose sells coke or coal by weight shall without cost to the purchaser cause the goods to be weighed by a sworn weigher of the City of Melrose, and shall cause a certificate stating the name and place of business of the seller, the name of the person taking charge of the goods after the weighing, as given to the weigher on his request, and

the quantity of goods, to be signed by the weigher. Such certificate shall be given to said person and shall by him be given only to the owner of the goods or his agent when he unloads the same; and every such person, owner or agent shall, on request and without charge therefor, permit any sealer of weights and measures of the City of Melrose to examine the certificate and to make a copy thereof. Such goods shall on the request of the purchaser be taken by the seller to the City scales and weighed by a sworn weigher not engaged in the busi- ness of buying or selling such goods, without expense to the purchaser, except that the purchaser shall pay for the charges of the City for weighing the same.
Section 5. Any dealer failing to comply with the provisions, or any of them, of Section Four (4) shall be liable to a fine not to exceed Ten (10) dollars.

CHAPTER XXXV.
RULES AND REGULATIONS OF THE PUBLIC WORKS DEPARTMENT OF THE CITY OF MELROSE, RELATIVE TO THE USE OF DRAINS.
Under the authority prescribed by Chapter 49, of the Revised Laws, Section 13, the following rules and regulations are made for the construction and use of private drains.
Section 1. For the purpose of conforming to the Public Statutes the words ''private drain" and ''main drain" used in these rules and regulations shall be considered to mean the same as "'particular sewer" and ''common sewer."
Section 2. No person shall enter or connect any private drain into any main drain without first making application to the Engineer and Superintendent of Public Works. Whenever such applicant or owner has paid an assessment for betterment, no fee shall be paid for entering said drain except as provided in Section 6. When no betterment has been paid, then the fee for entry shall be fixed by the Board of Aldermen.
Section 3. All applications for the construction of private drains and their entrance into main drains shall be made upon blank forms, furnished by the Engineer and Superintendent of Public Works, and must be signed by the owner or by the ac- credited agent of the premises to be drained.
Section 4. The applicant must deposit the entrance fee and the estimated cost of his private drain, as determined by the Engineer and Superintendent of Public Works, at his office before the work is commenced. Said estimated cost shall be a credit on the cost of the drain applied for.

Section 5. No private drain (unless by special consent of the Engineer and Superintendent of Public Works) larger than eight inches in diameter or which is constructed of material other than vitrified or iron pipe of an approved weight, will be al- lowed to connect with any drain; all drains shall be laid accur- ately to straight lines, and grades, and when angles are unavoid- able the changes in direction shall be made by Y branches and bends and the opening in the Y in the direct line of the pipe shall be sealed and left unused for the purpose of flushing or cleaning.
Section 6. The material required in the construction of private drains and appurtenances thereof, shall be provided and the labor thereon shall be performed by the city or its duly authorized agents, and no other person or persons; excepting

the applicant may make all of the excavation and back fill out- side the street lines, excepting so much as will affect the proper bedding and securing of the pipe or other structure. All ma- terials furnished and all the labor performed by the city shall be charged at the actual cost to the city, an exhibit of which will be furnished each applicant upon the completion of the work. The difference between the estimated cost and that actually found shall be made good by the party debtor. The use of any private drain will not be allowed until any deficiency in the amount of cost, as estimated shall be made good by the applicant in the case.
Section 7. No person shall be allowed to make any altera- tion in or make any connection with, any private drain, further than that intended in the original permit, without making an- other application and obtaining permission to do so from the Engineer and Superintendent of Public Works.
Section 8. The Engineer and Superintendent of Public Works may at any time require such catch basin and traps to be introduced along the line of any private drain, or on the dis- charge of any fixture connecting therewith, as he may deem necessary for the proper maintenance of the said private drain or of the main drain.
Section 9. Present private drains which connect with " blind drains" or with drains whose joints are not cemented or which have any inlet from the surface through an open grate, shall have located, at some convenient place, a catch basin, not less than three feet in diameter and extending at least three feet below the grade of the private drain, constructed of brick or other material and to prevent any deposit entering the main drain must be trapped in a manner satisfactory to the Engineer . and Superintendent of Public Works.
Section 10. The joints of all private drains, between the catch basin or trap and the main drain, must be securely and permanently cemented with Portland cement and mortar.
Section 11. Private drains for draining house cellars shall be laid to and through the cellar wall, and shall be trapped and provided with a clean-out in the direct line of the drain, and all pipe through or under the wall of any building, and for a dis- tance of five feet outside of said wall or building, shall be of cast iron of an approved weight.
Section 12. No exhaust from steam engines, and no blow- off from steam boilers shall be connected with a main drain through any private drain or otherwise, unless the steam be properly condensed and the water properly cooled.

Section 13. No excessive quantity of manufacturing or other waste which shall be at a high temperature or otherwise calculated to unduly interfere with the proper maintenance of the main drain shall be allowed to enter therein.
Section 14. All private drains shall be under the control of, and be maintained and kept clean by the city. The expense of cleaning and repairing any private drain shall be paid by the owner of the premises connected by the said private drain, provided, however, that any labor on private drains occasioned by defects or obstructions in the main drain shall be paid for by the city.
Section 15. All the pipes and fixtures outside of the build- ing shall be considered a part of the private drain or drain con- nection, and shall be under the control of the Public Works Department. All pipes and fixtures within any building shall be considered a part of the plumbing, and shall be under the control of the Board of Health.
Section 16. Any person who shall violate any of the pro- visions of these rules and regulations shall be liable to a pen- alty not exceeding Twenty (20) dollars for each violation.

CHAPTER XXXVI.
ORDINANCE ON SETTLEMENT OF CLAIMS.
All claims against the city for damages, and such other claims as may be referred to them, shall be examined by the Com- inittee on Claims, and the Committee may recommend such steps as it deems expedient for the defence of the city in suits at law, and may recommend settlement of any such claim to an amount not exceeding Two hundred (200) dollars. Claims not exceeding said amount, so recommended, if approved by His Honor the Mayor, shall be paid from the appropriation of the department in which the applicant was injured at time of service.

CHAPTER XXXVII.
ORDINANCE ON BASE BALL PARK ON COMMON.
Be it ordained, that any ball team desiring to secure the ex- clusive use of the ball field on the Melrose Common on any par- ticular day, shall file an application with the Engineer and Superintendent of Public Works, stating the time for which such use is desired; and the Engineer and Superintendent of Public Works may issue a permit for such exclusive use accord- ing to his discretion.

ORDINANCE ON BROWN TAIL AND GYPSY MOTHS.
Be it ordained, that no person, firm or corporation shall under- take the business of suppressing or exterminating, for hire, the nests, pupæ or caterpillars of the brown tail or gypsy moth without first registering with the officer or Board having charge of this work and obtaining from him or them a license.
