CONSTRUCTION.
On June 27, 1905, the Board of Aldermen passed Order No. 2794, ordering sewers constructed in Sewall Woods Road, from the northerly terminus of the present sewer northerly 700 feet, in Pleasant Street from Goodvear Avenue southerly to Brazil Street, and in private way known as Goodyear Avenue from Metropolitan Sewer near track of Boston & Maine Railroad westerly to Pleasant Street.
The sewer in Goodyear Avenue proved more difficult and ex- pensive to construct than was anticipated; the excavation was in extremely fine sand which made the crossing under the tracks of the Boston & Maine Railroad quite difficult, especially as the conditions were aggravated by the close proximity of Ell and Spot Pond Brook. This work was in progress at the time of the heavy fall of rain the first of September, when between five and six inches fell in about 36 hours, the brook overflowed its banks, broke into the trench, and necessitated doing a considerable quantity of work the second time. This rain so thoroughly saturated the ground that even after the railroad tracks and the brook were crossed, it materially effected the cost of the re- mainder of the work. After the passage of the order and the work of construction began, it was found that the connection of the Boston Rubber Shoe Co. factory with the sewer in Pleasant Street could and would have to be made at a point near the junction of Washington Street instead, as first contemplated, at point near Brazil Street; consequently the work was suspended, the Board of Aldermen notified, and later they passed an order No. 2794 B, rescinding so much of the former order as referred to constructing that part of the sewer in Washington Street from Pleasant Street to Brazil Street.
The owners of the only two houses on a private way leading off of Clifton Park, George A. P. Codwise and Charles A. Wag- gett, applied to be connected with the sewer, and as the house of Mr. Waggett could have been connected with the public sewer in Clifton Park, it was ruled by the department that this sewer was a private sewer and should be paid for by the owners of the property. Mr. Waggett and Mr. Codwise entered into an agree-

ment, gave a release of the premises to the City of Melrose, and deposited the amount of the estimated cost of performing the work. This agreement and release provided that if at any time Mr. Waggett and Mr. Codwise, each or both of them, should re- quest of the city the removal of the sewer, that the city should in turn release back to them the rights given. It further provides that, if at any time in the future, this sewer should become a public sewer, the city of Melrose would refund to them the cost of constructing the same as paid by them.
On the opposite side of this private way are several vacant lots which at some future time may be built upon; these lots are quite low, and in order to construct this sewer so as to be of any benefit to them, it was necessary to lay it much deeper than was needed to serve the purpose of Mr. Codwise or Mr. Waggett, therefore the additional expense, amounting to $126.04, was charged to sewer construction, as will appear upon the state- ment of expenditures.
