Johnson, of said Dunkirk on eath depose and say that on or about February 1st. 1944 I purchased of the proprietors of the Lowell Cemetery, a Corporation located in Lowell, in the County of Middlesex, Common- wealth of Massachusetts, two certain lots numbered 890 and 891 on plan be- longing to said Corporation and located on the passage way or path in the Lowell Cemetery known as Washington Avenue. That I paid the sum of Five Dollars, [$5.00] for each of the said lots to said Corporation, and received therefor a certificate of deposit, but that no deeds of said lots were ever executed or deliverea to me by said Corporation. That I have lost or ris- laid said Certificates, and am unable to produce the same, That I have this day signed, sealed, executed, acknowledged and delivered to one Benj. Walker of said Lowell a quit claim deed, of all my right, title, and interest in and to said lots either at Law or in Equity, and further if said Corporation shall confirm said conveyance so made to said Walker, in consideration thereof I hereby release and discharge said Corporation from any and all claims and agree to hold said Corporation fully indemnified and harmless on account of said money so depositea, or said Certificates so issued to me.
