5.(c) All operating costs of the District, commencing with the budget for the calendar year 1965 and for every calendar year thereafter, shall be apportioned annually in December for the ensuing year as follows: Each member town's share for each calendar year shall be determined by computing the ratio which that town's

pupil enrollment in the regional district schools on October 1 of the year next preceding the year for which the apportionment is determined bears to the total pupil enrollment from all the member towns in the regional district schools on the same date. In the event that enrollment in the regional district schools has not been accomplished by October 1 of any year, all operating costs of the District shall be apportioned on the basis of enrollment in grades seven through twelve of pupils residing in each member town and receiving education at such town's expense on October 1 of that year.


The Pentucket Regional School Budget operational costs for 1963 shall be apportioned as follows: Each town's share of the costs as determined by the orginal Agree- ment plus thirty-three (33) percent, or less thirty-three (33) percent, whichever applies, of the difference be- tween the 1963 share of operational cost based on the original Agreement and the proportional per pupil cost as of October 1, 1962.

at 8:00 o'clock in the evening to act on the following articles, namely :


Article 1. To see if the Town will vote to fix the salary and compensation of all elective officers of the Town as provided by Section 108 of Chapter 41, General Laws as amended: Moderator, Town Clerk, three Select- men, three Assessors, Treasurer, Tax Collector, Tree Warden, three Commissioners of Municipal Light, three Water Commissioners, and raise and appropriate sums of money therefore, and to determine sums of money be raised to defray the necessary and usual charges and expenses of the Town for the year 1963 and make appro- priations for same said sums of money so raised and appropriated to be expended for specific purposes to be voted.

Article 2. To see if the Town will vote to authorize the Town Treasurer with the approval of the Selectmen to borrow money from time to time in anticipation of the Revenue of the Financial year beginning January 1, 1964 and to issue a note or notes therefore, payable within one year, and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws.


Article 3. To see if the Town will vote to authorize the Town Treasurer with the approval of the Selectmen to sell at public auction, after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the Town, fourteen days at least, before the sale, property heretofore taken or which may be taken by the Town under Tax Title Procedure, provided that the Town Treasurer, with the approval of the Selectmen or their authorized agent may at the time of such public auction reject any bid which they may deem inadequate, or may after such auction has been held sell such property provided that in their estimation an adequate offer may be made.


Article 4. To see if the Town will vote to authorize the Assessors to use a sum of money from "FREE CASH" in the Treasury toward the reduction of the 1963 Tax Rate.


Article 5. To see if the Town will vote to raise and appropriate or transfer from unappropriated available funds in the Treasury, a sum of money for the mainten- ance of Road Machinery to keep Road Machinery in operation.


Article 6. To see if the Town will vote to raise and appropriate a sum of money to be expended on highway work on thickly settled streets, or take any action relative thereto.

Article 7. To see if the Town will vote to raise and appropriate or transfer from unappropriated available funds in the Treasury, a sum of money for Chapter 81 Highway construction and maintenance, or take any action relative thereto.


Article 8. To see if the Town will vote to raise and appropriate or transfer from available funds in the Treasury, a sum of money for Chapter 90 Highway con- struction, or take any action relative thereto.


Article 9. To see if the Town will vote to raise and appropriate or transfer from unappropriated available funds in the Treasury, a sum of money for Chapter 90 Maintenance, or take any action relative thereto.


Article 10. To see if the Town will vote to accept Chapter 782, Acts of 1962 Section 4, (State funds used for construction of roads), Merrimac's share to be Five Thousand Five Hundred Fourteen Dollars and Eighty Cents, ($5,514.80). Said money to be used to reconstruct River Road from the corner of Broad Street to Merrimac East, a distance of approximately 800 feet, or take any action relative thereto.


Article 11. To see if the Town will vote to appro- priate the sum of Two Hundred Seventy Five Dollars, ($275.00) from the sale of Cemetery Lots, such sum or part thereof, to be expended under the direction of the Cemetery Trustees for the "Care, Improvement and Embellishment" of said cemeteries, according to Section 14 and Section 25 of Chapter 114, General Laws.


Article 12. To see if the Town will vote to appro- priate a sum of money from Electric Light Operating balance, said money to be used by the Assessors with the estimated receipts to fix the Tax Rate for the year 1963.

Article 13. To see if the Town will vote to raise and appropriate the sum of One Hundred and Fifty Dollars, ($150.00) for wages and expenses of the Gas Inspector, or take any action relative thereto.


Article 14. To see if the Town will vote to raise and appropriate the sum of One Thousand Seven Hundred Forty Two Dollars and Ninety Three Cents, ($1,742.93) to pay over-draft on Rocks Bridge assessment, or take any action relative thereto.


Article 15. To see if the Town will vote to raise and appropriate the sum of One Thousand Five Hundred Dollars, ($1,500.00) for new copper gutters, repointing and water proofing wall on north side of Town Hall, or take any action relative thereto.


Article 16. To see if the Town will vote to raise and appropriate the sum of Three Thousand Dollars ($3,000.00) to purchase a Fire Truck, to be housed at the Port Station, replacing the present 1928 Reo Truck and also authorize the Selectmen with the Fire Engineers to dispose of the 1928 Reo Truck, or take any action relative thereto.


Article 17. To see if the Town will vote to approve an amendment to the Agreement as amended, for the establishment of the Pentucket Regional School District as proposed by the Regional District School Committee of said District on January 2, 1963 and filed with the Board of Selectmen in each of the member towns.


THE AGREEMENT, as amended, for the establish- ment of the Pentucket Regional School District compris- ing the towns of Groveland, West Newbury and Merrimac is hereby further amended as follows:


By inserting at the end of Section 5 (d) the following new paragraph :

Notwithstanding the provisions of the preceding paragraph, all amortization costs incurred after January 1, 1963, whether or not incurred in connection with the construction of an addition to or the reconstruction, replacement or remodeling of or the making of extra- ordinary repairs to the initial school building, shall be apportioned as follows: Each member town's share for each calendar year shall be determined by computing the ratio which that town's pupil enrollment in the regional district school on October 1 of the year next preceding the year for which the apportionment is determined bears to the total pupil enrollment from all the member towns in the regional district schools on the same date. In the event that enrollment in the regional district schools has not been accomplished by October 1 of any year, amortization costs shall be apportioned on the basis of enrollment in grades seven through twelve of the pupils residing in each member town and receiving education at such town's expense on October 1 of that year. For the purpose of this paragraph, amortization costs shall in- clude all expenses in the nature of capital outlay such as the cost of acquiring land, the cost of constructing, re- constructing, and adding to buildings, and the cost of remodeling or making extraordinary repairs to a school building or buildings, including without limitation the cost of the original equipment and furnishings for such build- ings or additions, plans, architects' and consultants' fees, grading and other costs incidental to placing school build- ings or additions and related premises in operating condition; and such amortization costs shall also include payment of principal and interest on bonds, notes or other obligations issued by the District to finance amortization costs. A withdrawing town's share of any future install- ment of principal and interest on obligations incurred after January 1, 1963, and which are outstanding on the effective date of its withdrawal shall be fixed at the per-

centage prevailing for such town in the annual apportion- ment for the year at the beginning of which or within which the withdrawal takes effect. The remainder of any such installment shall be apportioned to the remain- ing member towns in accordance with this paragraph.


By striking out Section 2 and inserting in place thereof the following section :


Section 2. The initial regional district school shall be located in the town of West Newbury and any ad- ditional schools shall be located at or near the site of the initial school even though such additional schools may extend over the boundary line of the town of Groveland.


Article 18. To see if the Town will vote to author- ize the issuance of $68,500.00 bonds or notes of the dis- trict for the purpose of acquiring a site and preparing plans for additional School facilities under the provisions of General Laws, Chapter 71, Section 16 (d).


Article 19. To see if the Town will vote to raise and appropriate the sum of Two Thousand Seven Hun- dred Dollars, ($2,700.00) to increase the size of water main on South Pleasant Street from 114 inch to 6 inch from High Street, westerly to a point of 460 feet, then northerly to a point beyond residence of Robert Jolivet, a distance of 400 feet - - total of 860 feet, or take any action relative thereto.


Article 20. To see if the Town will vote to raise and appropriate the sum of Eight Hundred Dollars, ($800.00) to increase the size of water main on Prospect Hill from 11/4 inch to 6 inch, from the residence of Kenneth Gibbs northerly to the residence of James Hurley, a distance of 300 feet, or take any action relative thereto.

Article 21. To see if the Town will vote to raise and appropriate the sum of Two Thousand Five Hundred Dollars, ($2,500.00) to paint exterior and repair roof of standpipe, or take any action relative thereto.


Article 22. On petition of James Parry to see if the Town will vote to raise and appropriate the sum of Five Hundred and Seventy Seven Dollars and Thirty Cents, ($577.30) to install a six inch Water Main on Merrimac Street from the residence of Joseph Donaghue westerly to a point beyond the property of said James Parry, a distance of 230 feet, or take any action relative thereto.


Article 23. To see if the Town will vote to pur- chase and install water meters on the premises of the individual water users in the Town of Merrimac and to appropriate therefor the sum of Thirty Thousand Dollars, ($30,000.00), said appropriation to be met by issuing bonds or notes of the Town therefor in accordance with the provisions of Chapter 44 of the General Laws (Ter. Ed.) so that each bond or note issued shall be payable in not more than ten years from this date, or take any action relative thereto.


Article 24. To see if the Town will vote to author- ize the Board of Water Commissioners to determine the dates upon which charges for the use of water shall be due, and in addition to other remedies provided by law, to determine when to shut off the supply of water because the charges therefor have not been paid, as well as to establish a reasonable charge for shutting off and turn- ing on the water supply, and to make such other rules and regulations pertaining to the water supply as are not inconsistent with law.

Article 25. To see if the Town will vote to amend the Zoning By-Laws of the Town of Merrimac by adding to Section XI (Uses permissable on Appeal) by paragraph ten (10) thereto as follows:

"To permit the use of land, in Agricultural-Residen- tial District, for Camp Grounds open to the public, using Tents and Adirondack Shelters, for temporary occupancy during the months of June through October 15, subject to the approval of the Planning Board, rules and regulations of the Board of Health and the Board of Appeals." or take any action relative thereto.


Article 26. To see if the Town will vote to amend the Zoning By-Laws of the Town of Merrimac by adding to Section XI (Uses permissable on Appeal) Paragraph eleven (11) thereto as follows:

"To permit the use of Camping Trailers on Camp Grounds in Agricultural-Residential District, for tempor- ary occupancy during the months of June through Septem- ber, subject to the approval of the Planning Board, rules and regulations of the Board of Health and the Board of Appeals.", or take any action relative thereto.


Article 27. To see if the Town will vote to name the park located on the site of the former Merrimacport School, the Merrimacport Memorial Park, or take any action relative thereto.

SCHOOL REPORT


REPORT OF THE MERRIMAC SCHOOL COMMITTEE 1962


To the Citizens of Merrimac:


Your School Committee submits the following report for the year 1962. As you know, your Committee super- vises the elementary grades within the town and three of its members serve on the Pentucket Regional School Committee. At the present time there are 466 pupils in grades 1-6 and 331 in grades 7-12 with 11 students at the Vocational Trade School in Haverhill and one in a Haver- hill Special Education class.


PUPIL HOUSING


During the past two years the Pentucket Regional School Committee has been wrestling with the problem of additional housing. The need for more pupil space is well established. The school, originally erected to house 800 pupils, now has 944 pupils. It is now expected that be- tween 1040 and 1100 pupils will be in attendance in the fall of 1963. Present planning calls for some type of platooning this fall. The shortcomings of platooning are well-known and will not be reviewed here.


The efforts of the Pentucket Committee to secure additional pupil housing have been slowed by the problem of cost distribution. The favorable vote of the three towns, in December, to put operational costs on a per pupil basis by 1965 has augured well for future planning.

TOWN OF MERRIMAC


On the elementary level in Merrimac we are now using all the available classrooms. Although present conditions do not indicate any need for classrooms this year, any shifting of grade distributions could create classroom shortages. It would be well for the community to begin a study of additional facilities before the need is pressing or platooning be made compulsory.
