Warrant for Special Town Meeting, March 22, 1939 COMMONWEALTH OF MASSACHUSETTS

To either constable of the Town of Milford :
Greeting :
In the name of the Commonwealth aforesaid, you are hereby required to notify and warn the inhabitants of the Town of Milford qualified by law to vote in Town Affairs, to meet in the Town Hall in said Town on Wednesday, the twenty-second day of March A.D. 1939, at eight o'clock in the evening, then and there to act upon the following arti- cles, namely :---
Article 1. To see if the Town will vote to authorize the Selectmen to acquire by purchase, or take by eminent domain, a certain parcel of land situated in said Milford, being the southeasterly corner of the lot of land, the sup- posed owner of which is Consolidated Trading Company, located on the easterly side of the New York, New Haven and Hartford Railroad, for the purpose of improving, re- claiming and draining of the Cedar Swamp Pond area, owned by the Town as part of the P.W.A. project No. Mass. 1446-F, an appropriation for which having been made here- tofore, being described as follows :- "Commencing at the southeasterly corner of said lot; thence northerly along the easterly line of said lot and on the westerly line of premises owned by the Town of Milford, one hundred thirty (130) feet; thence turning southwesterly to a point seventy feet northerly of the southerly line of said lot on the easterly side of a right of way now owned by said Town, one hundred sixty (160) feet; thence southerly along the easterly line of said right of way, seventy (70) feet to the southerly line of said lot; thence turning easterly along the southerly line of said lot and on the northerly line of land now owned by said Town, formerly owned by Milford

Article 2. To see if the Town will vote to authorize the Selectmen to acquire by purchase or take by eminent do- main, a certain triangular lot of land situated in said Mil- ford, being the southwesterly corner of a lot of land located off Meade Street on the easterly side of Cedar Swamp Pond, the supposed owners of which are Antonio Diotalevi and Luisa Diotalevi, for the purpose of improving, reclaiming and draining of the Cedar Swamp area owned by the Town as part of the P.W.A. project No. Mass. 1446-F, an appro- priation for which having been heretofore made, the des- cription of which parcel is as follows: Commencing at the southeasterly corner of the parcel to be acquired or taken and thence running in a northwesterly direction one hun- dred (100) feet, being bounded southwesterly by land of the said Town, as flowed by Cedar Swamp Pond, to a stake on the westerly line of the remaining land of said Diotalevi; thence turning at an interior angle 42º 15' and running in an easterly direction by remaining land of said Diotalevi, fifty-eight and 5-10ths (58.5) feet to a stake; thence turn- ing at an interior angle of 103º 15' and running in a south-

easterly direction by said Diotalevi remaining land, seventy (70) feet to the point of beginning; together with an ease- ment in, through, over and under a certain right of way fifteen feet wide over the remaining land of said Diotalevi as laid out on a plan hereinafter mentioned, which passage- way extends from the westerly line of land of one Cassasanta in a westerly direction to the northeasterly boundary line of the triangular parcel of land hereto described; with the right to use said passageway for the purpose of passing and repassing on foot, or with teams, vehicles, automobiles or other conveyances, for the benefit of and appurtenant to all land owned by the Town of Milford located westerly of land owned by the said Diotalevi, said passageway however to be used in common by the said Diotalevi and all others having similar rights therein; or take any action in relation to the same. Said lot and said passageway are shown on a plan of land entitled "Taken at the Southwest Corner of the Premises of Antonio Diotalevi and Luisa Diotalevi, Mil- ford, Mass., March 4, 1939, Joseph A. Visconti, C. E."
Article 3. To see if the Town will vote to authorize the Selectmen to acquire by purchase or take by eminent do- main for the purpose of improving, reclaiming and draining of the Cedar Swamp area owned by the Town, as part of the P.W.A. project No. Mass. 1446-F, an appropriation for which having been heretofore made, an easement in, through and over a certain right of way, the supposed owner of which is one Giovanni Cassasanta, leading westerly from Meade Street, between Lots 3 and 4 as laid out on a plan of land of S. W. Hayward Estate, G. C. Eastman, C. E., dated June 1904, recorded with Worcester District Deeds Plan Book 9, Plan 6, extending from the westerly line of said Meade Street; and continuing therefrom along the southerly line of land of the Town of Milford, as flowed by Cedar Swamp Pond, in a westerly direction to the easterly line of one Diotalevi, said passageway to be used for the purpose of passing and repassing on foot or with teams, vehicles, automobiles or other conveyances, for the benefit of and appurtenant to all land owned by the Town of Mil- ford located westerly of land owned by the said Diotalevi, said passageway however to be used in common by the said

Article 4. To see if the Town will vote to authorize the Selectmen to acquire by purchase, a certain parcel of land, the supposed owners of which are Henry Davoren and Catherine F. Davoren, for the purpose of improving, re- claiming and draining of the Cedar Swamp Pond area owned by the Town, as part of P.W.A. project, No. Mass. 1446-F, as amended, an appropriation for which having been heretofore made, the description of which parcel is as follows : " A certain parcel of land situated on the easterly side of the channel of the Charles River, commencing at the southwesterly corner thereof at the intersection of the centre of said channel with the northerly side of Main Street; thence N. 89º 59' E. five and 5-10th (5.5) feet to a drill hole at the southerly end of a stone wall at the north- erly side of said street; thence three and 5-10ths (3.5) feet to a stone bound on the northerly side of said street; thence N. 74° E., fifteen and 25-100ths (15.25) feet on the northerly side of East Main Street to a spike; thence N. 23° 28' E., eighty-four and 75-100ths (84.75) feet to an iron pin in the stone wall on the northwesterly side of said premises; thence S. 77º 28' W. eighteen and 5-10th (18.5) feet to a point about eighty-three (83) feet north of the drill hole first mentioned ; thence seven and 5-10ths (7.5) feet on the same course to the centre of said channel; thence southerly along the centre of said channel, eighty-one and 7-10ths (81.7) feet to the point of beginning. Article 5. To see if the Town will vote to authorize the Selectmen to acquire by purchase, or take by eminent do- main, an easement in, through, over and under certain land, the supposed owner of which is Archer Rubber Com-

pany, for the purpose of enlarging and improving the channel of the Charles River as part of the P.W.A. project No. Mass. 1446-F, as amended, drainage of the Cedar Swamp Pond area, an appropriation for which having been here- tofore made, the description of which land is as follows: "So much of the premises of said Archer Rubber Company as is located on the southerly side of Central Street in said Milford and which lies approximately in the channel of the Charles River in a southerly direction along the said chan- nel for a distance of 250 feet, being bounded and described as follows : Commencing at the northeasterly corner thereof at a point five (5) feet easterly of the easterly side of said channel on the southerly side of Central Street; thence westerly along the southerly side of Central Street and on the northerly line of said premises, thirty (30) feet to a point five feet westerly of the westerly side of said chan- nel; thence southerly along a line five feet westerly of said channel, two hundred fifty (250) feet to a point; thence turning at right angles in an easterly direction to a point five feet easterly of the easterly line of said channel; thence turning north along a line five feet east of the easterly side of said channel to the place of beginning"; or take any action in relation to the same.
And you are hereby directed to serve this warrant by publishing at least seven days before said meeting an at- tested copy of this warrant in the Milford Daily News, a newspaper published and having a general circulation in the Town of Milford, and by posting at least seven days before said meeting, attested copies of this Warrant in five or more public places located in said Milford.
Hereof Fail Not and make due return of this warrant with your doings thereon to the Clerk of said Town at the time of said meeting.

The following Recommendations of the Finance Com- mittee were presented :

Article 1. To see if the Town will vote to authorize the Selectmen to acquire by purchase or take by eminent domain a parcel of land the supposed owner of which is the Con- solidated Trading Company and also an easement over in through and under a right of way located southerly and easterly of the aforesaid lot for the purpose of improving, reclaiming and draining of the Cedar Swamp area.
On this article the Finance Committee take favorable action.
Article 2. To see if the Town will vote to authorize the Selectmen to acquire by purchase or take by eminent do- main a certain triangular lot of land situated in Milford, the supposed owners of which are Antonio Diotalevi and Louisa Diotalevi together with an easment in through, over and under a certain right of way fifteen (15) feet wide over the remaining land of said Diotalevi, and land of one Cassasanta for the purpose of improving, reclaiming and draining the Cedar Swamp area.

Article 4. To see if the Town will vote to authorize the Selectmen to acquire by purchase a certain parcel of land the supposed owners of which are Henry Davoren and Catherine F. Davoren for the purpose of improving, re- claiming and draining the Cedar Swamp area.
