ANNUAL TOWN MEETING, MARCH 14, 1945


Commonwealth of Massachusetts


Worcester, ss


Milford, March 14, 1945


At a legal meeting of the inhabitants of the Town of Milford qualified by law to vote in Town Affairs held in Town Hall on the fourteenth day of March A.D. 1945, the said inhabitants proceeded as follows:


The Moderator called the meeting to order at 8 P.M. and requested the Monitors who served last year to have the vacancies filled in their precincts. This request was followed out and then the Monitors for 1945 were ap- pointed by the Moderator: At Large, J. Frank Cahill, Pre- cinct 1-John F. Maher, Precinct 2-Joseph L. DeLuca, Precinct 3-William E. Moore, Precinct 4-Alfred E. Daigle, and Precinct' 5-Alfred P. Henderson. They were sworn in by the Moderator and the check was taken, 161 persons present, more than enough needed for a quorum, the Moderator opened the business meeting.


The Clerk read the Warrant and the officers return thereon.


Under Article 1 it was Voted: To hear and act upon all reports of Town Officers and Committees of said Town.


It was moved and seconded that the Town Report be accepted.

The following Resolutions were read at this time:


Resolved


The Town Meeting Members assembled have heard with deep regret of the passing of Judge Clifford A. Cook, presiding justice of the local District Court about 35 years.


Judge Cook served as Town Treasurer from 1889 until 1912 without opposition. He also served as Representa- tive from this district in the General Court from 1888-89.


He was honest, sincere and possessed a thorough knowledge of the law. He was prudent, interested in the common welfare and was a firm believer that work to be done should be done well.


RESOLVED: That as a further mark of respect, busi- ness of the meeting be suspended and the voters stand with bowed heads as a silent tribute to his memory.


RESOLVED: That the Clerk be directed to send a copy of these Resolutions to the relatives of the deceased.


Voted: : That the Resolutions be adopted.

The Moderator called for a report of the Committee appointed by the Selectmen to present a set of rules for use at the Town Meetings. The Committee did not func- tion and it was voted to dismiss this committee and have the Moderator appoint a committee.

Article 2. James E. Birmingham, Secretary of the Finance Committee presented the following report of the Finance Committee:


TO THE VOTERS OF MILFORD


The Finance Committee herewith submits their recommendation for the 1945 budget. Appropriations have been increased Forty-five thousand dollars due largely to the added expense of removing snow and a 100 per cent increase in Soldiers' Benefits. Inasmuch as we have not received the necessary figures from the State Tax Com- missioner's Office we hesitate to estimate a tax rate. But if the figures are the same as last year the forty-five thou- sand dollar increase in the appropriation will mean a Three dollar jump in the tax rate.


Salaries and Wages accounts add up to Three hundred and fifty-two thousand dollars and this includes a one hundred and fifty dollar bonus for all full time employees of the town.


Article 1. To hear and act upon the reports of all Town Officers and Committees.


Article 2. To raise and appropriate money for Town expenses for 1945.

Article 6. Asks that the sum of $1,660.96 returned from the County for 1944 Dog Taxes be appropriated for Town Library. Finance Commission recommends that $1,660.96 be appropriated to the Salary and Wages Ac- count of the Town Library.


Article 7. Asks the Town to choose a Director of County Aid to Agriculture. Finance Commission does not act on this article.


Article 8. Asks authority for the Selectmen for the year 1945 to sell any Real Estate acquired by Tax Title foreclosures. Finance Commission recommends that this authority be given.


Article 9. Asks authority to use available funds against the total of Town appropriations for 1945. To be used by the Assessors in setting the Tax Rate for 1945. Finance Commission recommends that a sum not to ex- ceed $50,000.00 be authorized for this purpose from the Excess and Deficiency Account.

Article 10. Asks that a sum of money be raised and appropriated for Chapter 90 Maintenance. Finance Com- mission recommends that $1,000.00 be provided for this purpose, and has included this amount under Article 2, provided that equal amounts are allotted by both State and County.


Article 11. Seeks to establish the Annual Salary of each Selectman at Five Hundred ($500.00) dollars. The Finance Commission recommends passing over this article.


Article 12. To see if the Town will vote to raise and appropriate the sum of Two hundred ($200.00) dollars for the purpose of stocking the waters with fish in the Town of Milford. The Finance Commission recommends that this article be passed over.


Article 13. To see if the Town will vote to accept and allow the report of the Selectmen on the laying out of a Public Way, a private way known as So. Cemetery Street from Depot Street and continuation of Charles Street. Finance Commission takes no action.


Article 14. To see if the Town will vote to rescind action taken under Article 7 of the Special Town Meet- ing wherein the Selectmen were authorized to sell the Braggville School Property. The Finance Commission takes favorable action.


Article 15. Asks for special compensation adjust- ments for the year 1945 for certain officers and employees of the Town, including School Teachers. The Finance Commission recommends favorable action on this article.


Article 16. Asks the Town to raise and appropriate a sum of money for the purpose of constructing additional surface drainage on Central Street from Charles River westerly towards Depot Street. The Finance Commis- sion recommends favorable action on this article.


Article 17. To see if the Town will vote to transfer from available funds a sum of money to be used for the purpose of purchasing new equipment for the Highway Department, money to be expended under the supervision of the Finance Commission and the Highway Surveyor. The Finance Commission recommends favorable action.

Article 18. To seek authority for the Selectmen to sell a certain piece of land located on Green Street, or take any action in relation thereto. The Finance Commission takes favorable action.


Article 19. Asks that a sum of money be raised and appropriated for the purpose of meeting the cost of paint- ing and repairing the exterior of the Town Hall Building. The Finance Commission recommends favorable action.


Article 20. To see if the Town will vote to raise and appropriate a sum of money for the purpose of construct- ing a drainage project on John Street. The Finance Com- mission recommends passing over this article.


Article 21. To see if the Town will vote to raise and appropriate a sum of money for the purpose of meeting the cost of construction of a drainage project on High- land Street. The Finance Commission recommends pass- ing over this article.


Article 22. Asks if the Town will vote to raise and appropriate the sum of One hundred ($100.00) dollars for the use of the Zoning Board to be appointed by the Select- men. The Finance Commission takes favorable action on this article.


Article 23. To see if the Town will vote to raise and appropriate the sum of One hundred fifty ($150.00) dollars for the purpose of constructing cement retaining walls at or near the entrances to the foot bridge over Cedar Swamp Pond. The Finance Commission recommends favorable action.


Article 24. Seeks to establish the annual salary of the Superintendent of Sewers at the rate of Two thousand Twenty-four ($2,024.00) dollars, said salary to be appro- priated from the Sewer appropriation for Salaries and Wages for the year in which said office is created. The Finance Commission recommends favorable action.

Article 25. To see if the Town will vote to raise and appropriate a sum of money for the improvements of Fisk Mill Road Bridge, said money to be used in conjunction with any money which may be allotted by the Town of Upton, the County of Worcester or Commonwealth of Massachusetts, the same to be expended under the super- vision of the Selectmen and Highway Surveyor. The Finance Commission recommends favorable action.


Article 26. Asks the Town to raise and appropriate the sum of Thirty-seven Hundred and Seventy-five ($3,775.00) Dollars for the purpose of installing a sewer on Florence Street. The Finance Commission recommends favorable action on this article.


Article 27. To see if the Town will vote to raise and appropriate the sum of Six hundred ($600.00) dollars to install emergency lighting in the Town Hall as required by the State Building Inspection Department. The Finance Commission recommends favorable action.


Article 28. Asks the Town to accept and allow the report of the Selectmen on the layout of a Public Way, a private way known as Finley Court. The Finance Com- mission takes no action on this article.


Article 29. To see if the Town will vote to accept the report of the Committee appointed at the Annual Town Meeting of 1944 to investigate the advisability of the Town establishing a Town Forest. The Finance Commis- sion recommends favorable action.


Article 30. To see if the Town will vote to establish a Town Forest on land located on the easterly side of Purchase Street and on the northerly side of Dilla Street, title to which was acquired by Land Court Decree dated June 3, 1937, from the Southerly New England Ice Co. The Finance Commission takes no action on this article.


Article 31. To see if the Town will vote to accept Ch. 48 (Ter. Ed.) Sec. 58A whereby the hours of duty of permanent members of the uniformed fire fighting force in the Fire Department shall not exceed seventy average weekly hours of duty in any year. The Finance Commis- sion recommends that this article be passed over.

Article 32. Seeks authority to transfer from the Civilian Defense Account the sum of Five Hundred ($500.00) Dollars to be used for the benefit of a Teen Age Canteen under the Supervision of the Selectmn. The Finance Commission recommends that this article be passed over.


Article 33. To see if the Town will accept an addi- tional fee to the annual fee for a license to carry on the business of slaughtering. The Finance Commission recom- mends favorable action


Article 34. Relative to placing School Janitors under Civil Service. The Finance Commission recommends that this article be passed over.


Article 35. To see if the Town will vote that with the Annual Election in 1946, the Tax Collector shall be elected for a term of three years instead of one year. The Finance Commission takes favorable action on this article:


Article 36. Extend to the Office of the Town Treas- urer the same adjusted compensation recommended for other departments. The Finance Commission recom- mends favorable action.


Article 37. Seeks to raise and appropriate money for the reconstruction of Camp Street. The Finance Com- mission recommends that the article be passed over.

Voted: That in taking action under Arti- cle 2 of the Warrant, that the Rule passed in 1941 be fol- lowed namely: that there be reading of each one of the budget items, together with the amount requested and the recommendation of the Finance Commission; that as each item is read, any voter who desires to object to the amount recommended by the Finance Committee shall state that he objects thereto: After all the items have been read, a motion be made incorporating all these items to which no objection has been made. After such vote has been taken, the items to which objection has been made shall be taken up separately for action thereon.
